STUDENT SAFETY - CONTAGIOUS ILLNESS

The following administrative procedure shall be used with any student infected with an

HIV infection:

Upon notification by the local health director the superintendent will appoint an

inter-disciplinary committee made up of the appropriate school personnel, a

medical expert, and the child's parent or guardian. The purpose of the

committee is to assist in the investigation and determination of risk. The

committee must be appointed within three days of notification by the public health

director.

The public health director will meet with the committee. If the director

determines that a significant risk of transmission exists, the public health director

will proceed according to North Carolina General Statute and will among other

things notify the committee and assist the committee in determining whether an

adjustment can be made to the student's school program to eliminate sufficient

risks of transmission; determine if an alternative educational setting is necessary

to protect the public health; instruct the superintendent concerning appropriate

protective measures to be implemented in the alternative educational setting

developed by appropriate school personnel; and consult with the superintendent

to determine which school personnel directly involved with the child need to be

notified of the HIV infection in order to prevent transmission and ensure that

these persons are instructed regarding the necessity for protecting confidentiality.

The following administrative procedure shall be Used with any student infected with any

other contagious illness, regardless of whether or not actual symptoms are present:

Decisions regarding the type of educational setting for any student affected with

a contagious illness (other than HIV infection) will be made on a case by case

basis taking into account the student's behavior, neurological development, and

physical conditions. These decisions are to be made using the team approach

including the student's physician, the student's parent or guardian, and personnel

from the local education agency and local health department, and should be

reviewed and approved by the superintendent. Evaluation to assess the

continued appropriate placement should be performed regularly. Persons

involved in the evaluation of students infected with a contagious illness should

respect the student's right to privacy including maintaining confidential records.

The number of personnel who are aware of the student's condition should be

kept to an absolute minimum.

All school personnel are to strictly adhere to File, JGFH-E which delineates guidelines

for handling body fluids.
