Bills aim to take away control on city issues

AUSTIN — Texas Republicans have
a new political enemy, and he looks like
Mike Rawlings. And Sylvester Turner.
And Ron Nirenberg. And Steve Adler.
GOP leaders have made the Demo-
cratic mayors of Texas’ largest cities
(Dallas, Houston, San Antonio and
Austin, respectively), along with other
local elected officials, the poster boys for
an all-out legislative assault on local
control. Republican lawmakers have
filed legislation that would prevent local
governments from making decisions
that have long been left to the elected

officials closest to the voters.
That legislation would determine
whether local leaders can decide which
immigrants to turn over to federal au-
thorities, how much local taxes should
increase, if people can cut down trees
and who can use a public restroom.
Republicans like Gov. Greg Abbott
and Lt. Gov. Dan Patrick say their aim is
to protect the individual liberty and
property rights of Texans that are being
“trampled” by policies of progressive
mayors, county judges and sheriffs.
Democrats see a calculated attempt
by the Texas Republican Party to under-
mine their success in urban local elec-
tions and ensure the GOP’s continued
stronghold on political power state-
wide.
Republican proposals have met with
patchy success this year, and many of
Abbott’s top priorities for the current
special session are at risk of failure. But
Democrats say they expect the GOP to
continue its assault on local authority.
“It absolutely is an effort to counter
the gains we’ve been making in local
and county governments,” said Manny
Garcia, deputy executive director of the
Texas Democratic Party. “This is about
Democrats passing progressive eco-
nomic reforms and progressive agendas
at the local level, and them doing every-
thing they possibly can to block it.”
As the two parties fight, local offi-
cials worry injecting partisanship into
their business will make their govern-
ments just as divided as those in Austin
and Washington. And government ex-
perts say the biggest losers could be city
and county residents and their right to
govern themselves.
“At the local level, they have a better
idea of the pulse of their communities,”
said Abraham Benavides, a professor of
public administration at the University
of North Texas.
All politics is local
Democrats, who haven’t won a state-
wide election since 1994, have in recent
years made a concerted effort to sup-
port candidates in Texas’ urban centers.
Their goal is to groom people with cam-
paign experience and name recognition
to take on Republicans statewide.
No one tracks the partisan affilia-
tion of local officials, but Democrats
have won mayoral elections in Dallas,

Shoppers took to Denton County stores
to take advantage of special sales this past
weekend — without having to pay about 8
percent of qualifying sales to state and local
governments for the Lone Star State’s an-
nual tax-free weekend.
Golden Triangle Mall in Denton was
buzzing on Sunday, the last day of the
state’s sales tax holiday on most purchases
of clothing, shoes and school supplies.
Many patrons were looking to get some
last-minute shopping done before school
starts, and lots of people were hoping to
find some good deals and skip out on pay-
ing the government for a few things.
Around the mall there were buy-one,
get-one deals, 40- and 50-percent dis-
counts and more on clothes, backpacks,
school supplies, shoes and other items. Not
everything was free from the clutches of
government sales taxes, but a lot of it was.
While children played on a stage in the
mall and parents sat to gather their compo-
sure from extended periods of sifting
through hangers of clothes, one man sat
among many, lifting the spirits of several.

Lindsay plays the mall’s piano for several
hours most weekends and says the mall
was noticeably busier than normal for tax-
free weekend.
So, did that mean more tips than nor-
mal for him?
“I wish,” he said.

dangerous fringe groups” and said they
“have no place in American public life
and in the American debate.”
Trump, meanwhile, remained out of

Electricity market riddled with deceivers
H
ow much trouble can one
Texas electricity company get
into?
If you’re super-huge Direct Ener-
gy, the answer is a jolt.
Every few years, the mammoth
British-owned company pays a steep
fine to Texas regulators.
Yeah, Direct Energy, The Watch-
dog keeps track of your sorry record.
You and your companies are about to
earn your 11th fine since the market
was deregulated.
These violation fines are handed
down by the (Public) Utility Com-
mission. Parentheses around “Pub-
lic” because I gave up on the idea
that the PUC actually cares about
us, the public. It’s the Utilities
Commission.
So many marketplace manip-
ulators sell electricity in Texas. Yet
state enforcement against these de-
ceptive trade practices could be much
stronger. Getting fined is a chore.
Companies must engage in unethical
conduct so widespread and obvious
that wrongdoing can’t be ignored.
That’s what makes Direct Energy
special.
Direct Energy and three other
companies it owns — First Choice
Power, CPL Energy and Bounce
Energy — have been party to 11 dif-
ferent settlements in the last 13 years
for a total of $1.8 million in penalties.
How does this stack up against
other companies? The UC doesn’t
keep a public list of top violators.
Direct Energy, commission spokes-
man Terry Hadley says, is one of the
largest companies with more cus-
tomers, thus more likely to be subject
to many complaints.
Direct Energy fines
Just a sampling:
Direct Energy paid a $200,000
fine in 2009 because it was unable to
bill customers for months at a time.
Two years before, Direct Energy
paid a $695,000 penalty for improp-
er renewal of commercial customers.
The company paid a $220,000
penalty in 2015 for improperly shut-
ting off service to 250 families.
Now the company faces it latest
trouble: a $70,000 fine for multiple
violations committed by shady door-
to-door sales people. Never buy

The Utilities Commission is
charging $2,400 per violation based
on 29 complaints. Direct Energy’s
sales staffers didn’t properly identify
themselves, enrolled customers with-
out permission and did not provide
required information.
Direct Energy spokeswoman Jessi-
ca Mahaffey says the company has
“worked constructively with commis-
sion staff to resolve issues.” A final vote
on the fine by the UC is scheduled for
Thursday. Approval is expected.
“If we make a mistake,” she says,
“we do everything we can to make
things right for the customer.”
She adds, “We believe the Texas
competitive electricity market is work-
ing well, and consumers are benefiting
with many competitive options along
with robust protections.”
Marketplace manipulators
Direct Energy wrote the UC last
year asking them to shut down the
state-sponsored shopping site man-
aged by the UC, PowerToChoose.org.
“The market no longer requires
this tool to support the transition
from regulations to competition,” the
company wrote regulators.
That’s a disgraceful request, but
consider the source.
The site was not shut down, but
Texans are clamoring for its im-
provement. Shopping for electricity
is too complicated, and many Texans
pay more than they should.
It’s lonely complaining about
electricity. The UC and state law-
makers act like deregulated retail
electricity in Texas works almost
perfectly because prices are lower.

A group of legal scholars is urg-
ing President Donald Trump to
keep a program protecting hun-
dreds of thousands of young im-
migrants from deportation and
is outlining a legal argument to
maintain it.
Around 100 law professors
and immigration attorneys are
scheduled Monday to send
Trump an open letter arguing
the president has the legal au-
thority to preserve the Obama
administration program known
as Deferred Action for Child-
hood Arrivals, or DACA.
Michael Olivas, a law profes-
sor at the University of Houston
Law Center and Santa Fe, New
Mexico, resident, told The Asso-
ciated Press the letter details
why the program, which has
helped around 750,000 immi-
grants, is legal.
“It’s a very successful pro-
gram, and we layout the legality,”
said Olivas, one of the authors of
the letter. “It is not unconstitu-
tional as some have suggested.”
Federal courts have ruled the
president can use “prosecutorial
discretion” to give certain immi-
grants, like these young mi-
grants, temporary protective
status, the scholars said.
The Trump administration
has said it still has not decided
the program’s fate.
A group of Republican attor-
neys general has called on the
Trump administration to phase
out the program. Texas Attorney
General Ken Paxton and others
have threated to amend a dis-
trict court case to challenge the
DACA program unless the
Trump administration acts to
phase it out.
Meanwhile, 20 Democratic
attorneys general led by Xavier
Becerra of California are asking
Trump to keep the program.
Last month, then-Homeland
Security Secretary John Kelly told
Hispanic lawmakers that the pro-
gram is likely illegal, though he
personally supports it.

spond to a request for comment.
But the frequency and variety of
the legal challenges — from
cases involving the energy effi-
ciency of ceiling fans to gender
reassignment surgeries at the
Department of Veterans Affairs
— have sparked criticism that
Democrats may be playing poli-
tics with their states’ legal re-
sources.

office is involved with roughly
50 legal actions against the
Trump administration. Aware
that Trump won Pennsylvania in
last fall’s election, he casts his ag-
gressive steps in apolitical terms.
“I would hope that I would
never have to file another legal
action against the federal gov-
ernment, the Trump adminis-
tration,” Shapiro said. “But that
would require the Trump ad-
ministration to follow the rule of
the law.”
McMaster said, adding that the
Trump administration is pre-
pared to deal militarily with
North Korea if necessary.
But he stressed that the U.S.
is pursuing “a very determined
diplomatic effort” led by Secre-
tary of State Rex Tillerson that’s
coupled with new financial
sanctions to dissuade North Ko-
rean leader Kim Jong Un from
further provocations.
“The U.S. military is locked
and loaded every day,” McMas-
ter said, repeating Trump’s
threat.

Protests, vigils around U.S. decry rally

pelled to counteract the white
supremacist rally that spiraled
into deadly violence in Virgin-
ia.
The gatherings spanned
from a march to President Don-
ald Trump’s home in New York
to candlelight vigils in several

ert E. Lee was vilified during the
Civil War only to become a heroic
symbol of the South’s “Lost Cause”
— and eventually a racist icon.
His transformation, at the
center of the recent violence in
Charlottesville, Virginia, reflects
the changing moods in the Unit-
ed States around race, mytholo-
gy and national reconciliation,
historians say.
Lee monuments, memorials
and schools in his name erected at
the turn of the 20th century are
now facing scrutiny amid a demo-
graphically changing nation.
But who was Robert E. Lee
beyond the myth? Why are there
memorials in his honor in the
first place?
The soldier
A son of American Revolu-
tionary War hero Henry “Light-
Horse Harry” Lee, Robert E. Lee
graduated second in his class at
West Point and distinguished
himself in various battles during
the U.S.-Mexico War.
Lee accepted a leadership
role in the Confederate forces al-
though he had little experience
leading troops. He struggled but
eventually became a general in

A career army officer, Lee
didn’t have much wealth, but he
inherited a few slaves from his
mother. Still, Lee married into
one of the wealthiest slave-hold-
ing families in Virginia — the
Custis family of Arlington and
descendants of Martha Wash-
ington. When Lee’s father-in-
law died, he took leave from the
U.S. Army to run the struggling
estate and met resistance from
slaves expecting to be freed.
Documents show Lee was a
cruel figure with his slaves and
encouraged his overseers to se-
verely beat slaves captured after
trying to escape. One slave said
Lee was one of the meanest men
she had ever met.

pretty well stocked with every-
thing,” Belton said, dashing be-

The busiest day was Satur-
day, he said, and the most pop-
ular items at his store seemed to
be shoes and backpacks. He said
he noticed lots of shoppers paid
with $100 bills over the week-

On one of the other ends of
the mall, at a popular entrance
with lots of foot traffic, store
manager Kathleen Schaefer was
at the helm of the Barnes & No-
ble bookstore, steadily maneu-
vering from customer to cus-
tomer, solving problems and
making sales.
“We get business that’s
school-related kind of all sum-
mer,” she said. “Kids operate in a
pattern. It’s kind of funny.”
Schaefer said she’s been
working at the Denton Barnes &
Noble location for six years, and
worked for the company for 25
years total. With plenty tax-free
weekends behind her, she’s
learned some tricks of the trade
and recurring patterns for back-

velop a plan for endorsing local

what the Democrats had already
done,” said Texas GOP Chair-
man James Dickey.

weekend. He said he’s support-
ive of tax-free weekends like this
one.
“I think it’s a great initiative
by the state. It gives families the
opportunities to pick up things
that are going to be needed,”
Begnoche said.
“Stores seem to do a good job
of packaging a lot of sales in con-
junction [with each other],” he
said, “which really helps out
families.”

Traditionally, local races have
been insulated from the divisive
partisan politics that dominate
state and national campaigns,
said Emily Farris, a professor of
political science at Texas Chris-
tian University.
But she said amping up the
focus on local politicians could
have a beneficial unintended
consequence. It might drive up
the dismal turnout of voters in
local elections.
“If it gets them out and gets
them engaged,” she said, “that’s
the only bright side to this.”

leash “fire and fury” on North
Korea has been met with silence
from the top levels of South Ko-
rea’s government — and worry,
sometimes anger, from the
country’s citizens.

just hours after her mother Da-
na, rescued from a defunct zoo
in war-torn Syria, was released
into a wildlife reserve in Jordan.
Dana and 12 other animals,
including four other lions, two
bears and two tigers, had barely
survived under harsh conditions
in the Syrian city of Aleppo, until
a few months ago a major battle-
ground in the country’s civil war.
They were transported from
Syria to Turkey and then to Jor-
dan by the international animal
charity Four Paws, stuck in cages
during the three-week journey.
They arrived at the al-Ma’wa re-
serve in northern Jordan on Fri-
day.
Dr. Amir Khalil, a vet who ac-
companied the animals, said
Sunday that he had been worried
during the transport that Dana
would give birth while in a cage.
In such a case, it’s unlikely the
cub would have survived, he said.
Khalil said he believes the li-
oness waited for a safe space to
give birth.
“She is a mom, she had the
instinct,” he said. “It’s a miracle.”

Ezekiel Elliott and the Cowboys
had their world rocked by a
six-game suspension they didn’t see
coming, the volume on outrage and
bluster was turned down.
No more recriminations were
hurled at the NFL office. Vows of
fighting the commissioner’s decision,
of taking this to the mattresses, were
absent. Elliott himself casually stood
on the sidelines in his Cowboys uni-
form wearing a blue visor Saturday
evening, watching his teammates face
the Los Angeles Rams.
Owner Jerry Jones was silent.
It’s too early to know if this is the
calm before the storm. But now that
everyone has gotten over the shock
and raw emotion of Friday, it’s time for
a more strategic conversation.
Elliott and his representatives will
file an appeal before the end of busi-
ness day Wednesday. The league’s
leading rusher then has two ways to

MANHATTAN, Kan. — Bill
Snyder likes to spin a well-worn
story about an old man from
western Kansas, who had driven
through the night many years ago
to visit Kansas State’s coach after
a victory in the Copper Bowl.
Snyder was in the early stages
of turning around one of the
worst programs in college foot-
ball, what became known as the
“Miracle in Manhattan.” And the
man was so appreciative of Sny-
der that he patiently sat in his car
outside the coach’s office await-
ing his early morning arrival.
They chatted about family
and life. Hopes and dreams.
Then, the man said the Wildcats’
bowl victory was “the greatest ex-
perience of my life,” words that
stick with Snyder to this day.
“That,” Snyder said, “made me
understand what this all means.”
Just imagine how thankful
that man would be these days,
after nearly 25 years interrupted
by a brief retirement. The Wild-
cats have been a perennial Big 12
title contender and bowl partici-
pant, and a program that was
once a national laughingstock
has triggered a university-wide
renaissance, marked by a cam-
pus building boom, enrollment
increases and alumni pride.
The 77-year-old Snyder’s
name now adorns the football
stadium, where about $200
million in recent renovations
have turned it into a jewel of the
Flint Hills. The Hall of Famer’s
life-size statue stands sentinel at

the front gates, and a short drive
away is a highway bearing his
name.
Snyder will begin his 26th
season on Sept. 2 with a team ex-
pected to once again contend for
a title.
“The guy to me is the picture
of class. Everyone in our confer-
ence respects him,” Kansas
coach David Beaty said.
That respect has only grown
this year, while Snyder was be-
ing treated for throat cancer.
The diagnosis came about
the time the Wildcats were pre-
paring for the Texas Bowl last
winter, and chemotherapy be-
gan in January. Yet the normally
debilitating rounds of treatment
never slowed him.
The biggest change? His
ubiquitous cup of coffee has dis-
appeared.
“I drink water all day. Be-
tween water and food, it’s driv-
ing me crazy,” Snyder said.
Snyder has treated his cancer
scare with self-deprecating hu-
mor, but the gravity of the situa-
tion caught even those closest to
him by surprise.
“It was wearing him down,”
said Sean Snyder, his eldest son
and associate head coach. “But
when we got started and got
close to going for fall camp, his
energy was up and he was close
to where he was always at be-
fore, and it’s really surprising at
where he’s at compared to where
he should be at.”

making everybody stay.
The world championships
came to a melancholy close Sun-
day with an on-track tribute to
the man who made the sport fun
again. There were 11gold medals
at stake on a frenetic final day in
London, and yet it was the sight
of the hobbled champion walk-
ing slowly around the track —
stopping to kneel at the starting
lines for the 100- and 200-meter
races he dominated for a decade
— that made for the evening’s
best theatre.
“I think I almost cried,” Bolt
said. “I was just saying goodbye.
That was it. Saying goodbye to
my events. Saying goodbye to
everything.”
The United States says good-
bye to London in possession of
30 medals, the most it has ever
taken from the worlds. Of those,
10 were gold, including the cap-
per in the women’s 4x400 relay
final, where Allyson Felix won
her 16th medal to finish as the
most-decorated athlete of all-
time at the worlds.
Felix also won gold in the
4x100 relay, but the bronze she
took in her only individual
event, the 400, makes this a less-
than-perfect trip for her.
In that way, she’s got some-
thing in common with Bolt.

the 100 and the hamstring pull
and tumble to the track that
ended his anchor leg of the
4x100 relay — and still made
him wince when he had to ne-
gotiate big steps around the
stadium — the championships

“Someone tried to blame me,
and said I started it,” Bolt said of
a 10-day run filled with upsets
and surprises. “It was just one of
those things. It was one of those
championships where every-
thing does not go your way.”
Winners on the final day in-
cluded:
■ Caster Semenya of South
Africa, who added the 800-me-
ter gold to her 1,500-meter
bronze from earlier in the meet.
■ Elijah Manangoi, who led
a 1-2 Kenyan finish in the 1,500
meters.
■ Hellen Obiri of Kenya,
who pulled away from favorite
Almaz Ayana with 250 meters
to go to win the 5,000-meter
race.
■ Sandra Perkovic of Cro-
atia, who added this latest discus
title to her two Olympic golds.
■ Mutaz Essa Barshim of
Qatar, who won the high jump
by clearing 2.35 meters without
a miss.
■ The men’s 4x400 relay
team of Trinidad and Tobago,
whose anchor, Lalonde Gordon,
beat American sprinter Fred
Kerley to the line.
■ Yang Jiayu of China, Yo-
hann Diniz of France, Eider Are-
valo of Colombia and Ines Hen-
riques of Portugal in race walk-
ing. Henriques set a world re-
cord in winning the first
women’s 50-kilometer walk at
the worlds in 4 hours, 5 minutes,
56 seconds.
There’s not a household name
in the bunch, and though all the
performances were remarkable
in their own way, this sport’s lack
of star power with Bolt out of the
mix is hard to gloss over.
“What we’re going to miss
about Usain Bolt isn’t the three
back-to-back Olympic Games or
the clutch of world records and
medals,” said Sebastian Coe, the
leader of track’s governing body,
the IAAF. “It’s because he has an
opinion. He has a view. He fills a
room.”

news conference was scheduled
for 15 minutes but went about 35.

He said over the long term,
he could see himself coaching
track and occasionally stepping
into the TV booth for the sport’s
biggest events. His immediate
plans? “I need to go out and have
a drink,” he said.
Asked one more time about
doping, he said he thinks track is
on an upward trajectory after
two dispiriting years involving a
doping scandal in Russia and
problems across Africa and in
his own country, Jamaica.
“I’ve proven to the world that
you can do it, that you can be
great without doping,” he said.
“Hopefully young athletes can
look at me.”
He has no regrets about run-
ning in this meet, or concerns
that the results will tarnish his
legacy. In a way, he said, the jaw-
dropping losses were similar to
the breathtaking wins: They
showed that when he’s on the
track, anything really is possible.
“For me, it was brilliant,” he
said of the week that was. “I’m
just really sad I have to walk
away now.”

We’ve been together 27 years, so I know him
well. He recently stopped smoking after 30
years of nicotine addiction. He did it cold tur-
key, and he’s been smoke-free for three
months now. I’m proud of him and tell him so.
The problem is, when he drinks he gets
drunk — which I’m used to — but then he
starts saying (sometimes belligerently) that
he wants a cigarette badly. I don’t know how to
respond to this.
I continue praising him for quitting and
point out the health benefits that are already
obvious — his breathing, returned senses, etc.
— but it’s getting old.
Should I continue to say helpful things or
just ignore him when he’s drunk?

Dear Dumbfounded: Try this. Tell him
calmly that his craving for a cigarette is nor-
mal, particularly if he used to smoke while con-
suming alcohol.
Reassure him that with time the craving
will lessen, and continue to reinforce that he
did himself a huge favor by mustering up the
willpower to quit. Tell him you know it wasn’t

tion created for friends and family members

sumption. It isn’t difficult to find a meeting.

you must. Give him credit for having been hon-
est with you, but if after a year and a half he
wasn’t able to summon up any romantic feel-
ings for you, you must accept that it isn’t going
to happen.
