Waiver Policy, Byahe Ni Juan Travel Services requires its participants to understand and sign upon registration a

waiver that states the following:

1. I am fully informed and otherwise aware of and acknowledge that activities like trekking/hiking/caving/surfing/island
hopping/snorkeling/diving/swimming/top load riding/sandboarding/4x4 Sand Dunes extreme ride entails known and
unanticipated risks which could result to accidents and injuries that can be caused by weather conditions,
unpredictable terrain, force of nature and other unforeseen elements that we cannot prepare for. ALL water and
extreme activities during the tour is not covered in your Insurance (Review sample Insurance Policy for the
coverage). Client accept full responsibility for arranging and paying for own medical treatment in case of medical
emergency and accident incurred in said activities.

2. I certify that I am physically capable and fit to participate in this activity and I have no medical conditions or needs.

3. Agreement to assume voluntary participation in spite of risks on activities and will not hold Byahe Ni Juan Travel
Services from any and all claims, demands, or causes of action which are in any way connected with your voluntary
participation.

4. Byahe Ni Juan Travel Services shall not be liable for any vehicular accident that will happen to the participant
throughout the travel. (This is for those clients who did not avail Travel Insurance)
For those participants who availed Travel Insurance, kindly review sample Insurance policy for the coverage of your
insurance. (Insurance Company’s Liabilities to its clients)

5. Byahe Ni Juan Travel Services shall not be liable for any minor who joins the trip. They need to be supervised by
an adult or be given parent’s consent.

6. Byahe Ni Juan Travel Services shall not be liable for any pregnant, disabled or elders who join the trip. They need
to be assisted by their own trusted company.

7. Byahe Ni Juan Travel Services shall not be liable for any lost or damage of baggage and personal belongings. All
participants shall be responsible for their own belongings unless stated otherwise.

8. Byahe Ni Juan Travel Services reserves the right to refuse service to anyone under the following circumstances,
which they will be asked to leave without refund.
a. A participant becomes disruptive to the program and creates discomfort to other guests.
b. A participant that disregards safety and becomes abusive [Verbally and Physically] to co-participants, driver, guide
and tour coordinators.

9. Participants have the right to discontinue or leave the trip if they need to do so without refund, participants that
decide to do so and has signed the terms and condition are/is still amenable with the arrangements and Terms and
condition prepared by Byahe Ni Juan Travel Services.

(For those participants/clients/guests who did not avail the travel insurance:
I assume and understand that there is a risk involved with my travel. I acknowledge that I was informed by Byahe Ni
Juan Travel Services about my options before I confirmed my booking but I declined to purchase the travel
insurance. By declining this protection, I acknowledge and accept the full responsibility for arranging and paying for
my own medical treatment in case of medical emergency and accident while travelling.)

I, the undersigned, agree to this release of all claims, waiver liability and assumptions of risk (“Waiver and Release’). I
waive any and all claims I may have now and in the future, and release from all liability and agree not to sue Byahe
Ni Juan Travel Services, its owner, operators, coordinators, guides, agents and representatives from any and all
liability for any personal injury, death, property damage or loss I may suffer as a result of my participation in their trip,
for any cause whatsoever.
