Mayor Roser Garcia CITY OF LONG BEACH February 3, 2016 Mr. Rich Dines nl as An independent investigation by the City Attorney was conducted concerning allegations of inappropriate statements and conduct by you as Harbor Commissioner towards various employees of the City of Long Beach (“City”) Harbor Department. a. Discussed personnel matters relating (o I'S ond SII during the ‘September 14, 2015 public Board meeting. b. Engaged in rude conduct toward Harbor Department employees. ©. _ Engaged in unprofessional conduct toward Harbor Department employees. d. Used profanity toward and in the presence of Harbor Department employees. fe. Made employees of the Harbor Department feel intimidated by your behavior and demeanor. 1. Had a list [mental or otherwise] of individuals whose employment you thought should be terminated. 9g. Have requested information directly from Harbor Department employees and have given direction directly to Harbor Department employees bypassing those employees’ supervisors. This conduct violates Harbor Commission Bylaws, Section X! regarding personal and professional conduct (See Section XI (i) (i), (ii), (iv), and (v)). This is not optional but is a condition of your continued service as a Harbor Commissioner for the City of Long Beach. Completion of ethies training, Please work with the City Attorney for assistance in completing these requirements. For the protection of Harbor Department employees, the following performance criteria must be adhered to: All communications and requests for information by you shall be directed through the Chief Executive Officer Jon Slangerup. Direct contact with Harbor personnel shall be limited to the CEO's office or preapproved by the CEO. Outside of Board meetings or public events, the CEO's office needs to be notified in advance if you plan to attend other meetings inside the port headquarters. Requests for promotional items, tickets, etc. shall be made through the CEO's office and shall be consistent with the Commission's written policy. Further, you must conduct yourself in a professional manner and fully comply with the Harbor Commission Bylaws, Section XI regarding your personal and professional conduct while performing your duties as Harbor Commissioner. Please be advised, failure to improve your performance or to adhere to the training or performance criteria set forth above, will result in the initiation of a removal proceeding in accordance with Charter Section 510, Long Beach City Charter Section 510 Removal of Commission Members states in part that the Mayor may remove any member of a Charter-mandated Commission at any time with the concurrence of two-thirds of the members of the City Council. This action to remove would occur at a City Council meeting in open session. It is important to note the Charter was amended in 2007 to remove the “for cause” requirement.
