NOTICE OF ADVERSE CLAIM

I, ADELA FAYO UY, of legal age, Filipino and a resident of Sta, Cruz, Dumalag, Capiz,
after having been duly sworn to in accordance with law, depose and state:

1. That I have an adverse claim on that certain registered real property, more particularly
described as follows:

KATIBAYAN NG ORIHINAL NA TITULO BLG. P- 14909

“A PARCEL OF LAND (Lot No. 1516, Psc- 30, Dumalag Cadastre), situated in
Brgy. Sta. Cruz, Municipality of Dumalag, Province of Capiz. Bounded on the S., along
lines 1-2-3 by Lot No. 1517; on the W., along lines 3-4-5-6-7-8 by Lot No. 1520; on the
N., along line 8-9 by Lot No. 1603; on the N., along lines 9-10-11-12 by Lot No. 1515; on
the NE., along lines 12-13-14 by Lot No. 1514; and on the E., along line 14-1 by the Nat’l
Road, all of Psc-30. Containing an area of SEVEN THOUSAND FIFTY NINE (7,059)
square meters, more or less.”

as the registered owner;

2. That said parcel of land has been issued a new Transfer Certificate of Title No. 089-
2016000426 in the name of Ma. Ruby F. Obapial which fact of registration in her name is
highly questionable when said Title was previously declared as lost through a Police
Blotter Report dated May 2, 2012 filed at Brgy. Sta, Cruz, Dumalag, Capiz and issued a
Certification by the Philippine National Police Dumalag Police Station certified by Police
Inspector Nino Leonard Amar;

3. That my adverse claim consists of a right of ownership over a TWO THOUSAND

(2,000) SQUARE METERS portion in the property above described through a DEED
OF DONATION executed by CLARO FAYO on March 17, 2011 in my favor,(copy of
which is hereby attached), but said deed could not be registered due to the loss of said
TCT;

4. That I am in possession of the subject property and I am a resident of Sta, Cruz, Dumalag,
Capiz to which all notices maybe served upon me.

WHEREFORE, I hereby request the Register of Deeds of the Province of Capiz to Register
this claim in the manner provided by law.
