I. POLITICAL AND INTERNATIONAL LAW

The teachers claim that their right to peaceably assemble and petition the government for redress
of grievances has been curtailed. Are they correct? Why? (2%)

II. LABOR LAW AND SOCIAL LEGISLATION

Differentiate labor standards law from labor relations law. Are the two mutually exclusive?

III. CIVIL LAW

Lina married Sixto in a civil ceremony. Lina however, did not know at the time she married Sixto
that the latter was already married. Upon learning that Sixto was already married Lina immediately
left Sixto and since then had not seen nor heard from him. Lina, however, did not take any step to
have her marriage with Sixto annuled before she married Hugo.

Could Hugo successfully sue for a declaration of nullity of his marriage with Lina? Explain.

IV. LAW OF TAXATION

Article VII, Section 28 (3) of the 1987 Philippine Constitution provides that charitable institutions,
churches and personages or covenants appurtenant thereto, mosques, non-profit cemeteries and
all lands, buildings and improvements actually, directly and exclusively used for religious,
charitable or educational purposes shall be exempt from taxation.

To what kind of tax does this exemption apply? (2%)

VI. CRIMINAL LAW

Rodolfo is an informer who told the police authorities that Aldo is a drug pusher. Policeman Taba
then posed as a buyer and persuaded Aldo to sell marijuana worth P10.00 to the former. Aldo
agreed. He delivered the goods and so was apprehended with the marked money. He is now
prosecuted for violation of the Dangerous Drugs Act.

Aldo’s defense is that he1 was the victim of an instigation of the police who persuaded him to sell
the goods to him. Decide the case with reasons.

VII. REMEDIAL LAW

“A” leased his commercial land and building in Malate, Manila, to “B”, a resident, of Malolos,
Bulacan. The Contract of Lease provided that in the event “A" violates the Contract, “B” may file
suit in Manila. “AY’ residence, and if “B” violates the Contract, “A” may sue “B” in Malolos. “B”
violated the Contract, entitling “A” to sue for ejectment.

If you were the lawyer of “A”, where and which court can you lawfully file the action for
ejectment? Explain.

VIII. LEGAL ETHICS

Atty. Aguirre as counsel de officio for boy Batong Bakal, was able to win an acquittal for Boy who
was charged with robbery in band. A year later, Atty. Aguirre discovered that Boy in fact had a lot
of money which he had been bragging as part of the loot in the crime which he is acquitted.
Knowing that Boy can no longer be prosecuted on the grounds of double jeopardy, Atty. Aguirre
sent him a bill for his services as counsel de officio.

Please give your reasoned comments on the ethical CONSIDERATIONS if any is involved in the
above case.
