This DEED is entered into and executed by FELIX FORTUITO PABAYOS, Heir of
Eufrocina Pabayos married and resident of Calabnugan, Sibulan, Negros Oriental; CELEDONIA
PABAYOS CASAYSAY, married and a resident of Pototan, Iloilo; NAZARIA PABAYOS
CALENTIG, married; CORANACION FORTUITO PABAYOS, single; and VENERANDA
PABAYOS DALES, married, the last three names are all residents of barangay San Antonio,
Sibulan, Negros Oriental; they all of legal age, Filipinos, and the last four names are hereinafter
called the HEIR-VENDORS in favor of,
Spouses REYNALDO MENDOZA and DOROTHY C. MENDOZA, both of legal age,
Filipino, and residents of barangay San Antonio, Sibulan, Negros Oriental, hereinafter referred to
as the VENDEES;
That invoking the provisions of Section 1, rule 74 of the Rules of Court of the Philippines,
the heirs of Eufrocina F. Pabayos have settled and adjudicated unto themselves One-fifth (1/5)
shares each of the aforementioned parcel of land which is in accordance with their rights, interests
and participations, consisting of THREE HUNDRED EIGHT (308) Square Meters, each;
That FELIX F. PABAYOS have already segregated his share consisting of Three Hundred
Eight (308) of the said parcel of land and occupied the same since the last Twenty Five (25) years;
That for and in consideration of the sum of ONE HUNDRED EIGHTY FIVE
THOUSAND FOUR HUNDRED PESOS (Php 185,400), Philippine Currency, in hand paid by the
herein Vendees, and receipt in full is hereby acknowledged by Heir-Vendors to their entire
satisfactions and that by virtue of these presents, the herein Heir-Vendors do hereby SELL,
TRANSFER, and CONVEY unto the vendees, their heirs and assigns, all the vendor’ rights,
interests, and participations consisting of Four fifths (4/5) over the aforementioned parcel of land;
containing of ONE THOUSAND TWO HUNDRED THIRTY SIX (1,23) square meters, more or
less, including all the improvements found therein, free from all liens and encumbrances;
That the vendor herein declares that the said land is not tenanted nor worked upon by an
agricultural lessee because the vendor is the one occupying and in possession of this land and that
due notice has been given to all persons affected by this transaction in compliance with the
provisions of the New Civil Code of the Philippines, pertaining to the rights of the redemptioner and
preemptioner, but nobody opted to exercise the said rights and the said parcel land belongs to the
retention limits of the vendor, further, the vendor warrants his title and ownership the said parcel of
land and will defend the rights of the vendee against any adverse claim whatsoever.
IN WITNESS WHEREOF, I have hereunto affixed my signature this ___day of May 2015 at
Tayasan, Negros Oriental.
