Dear Ms. Ioanes:

This letter is in response to your email dated February 19, 2018 appealing the determination
of the Records Access Officer made on February 1, 2018 regarding records requested from the
New York City Police Department. Your request, pursuant to the Freedom of Information Law,
was originally received by the FOIL unit on January 25, 2018 and subsequently denied pursuant
to Public Officers Law Section 87(2)(b).

The FOIL request as it pertains to “handgun license application[s] for the following
individuals: Donald John Trump, Donald John Trump, Jr., Eric Frederick Trump” is denied
because disclosure of the record would constitute an unwarranted invasion of personal privacy
[§87(2)(b)]. Additionally, disclosure of the application would endanger the life or safety of the
applicant [§87(2)(f)]. Finally, disclosure of the record is specifically exempted by state or federal
statute [§87(2)(a)]; specifically, New York Penal Law §400.00(5), which states that the application
itself is not subject to disclosure; rather, only that, “the name and address of any person to whom
an application for any license has been granted shall be a public record.”

You may seek judicial review of this determination by commencing an Article 78


proceeding within four months of the date of this decision.
