The state of Nevada is in the ninth circuit court of appeals for the United States. In the

Nevada State Constitution, there are nineteen articles. Article 11, the Education article, has ten

sections which pertain to the laws of education in Nevada.

Section 1 mentions the legislature and the superintendent, stating that the legislature shall

provide for a superintendent of public instruction. This section includes the power of the

legislature to prescribe manner of appointment, term of office, and duties as superintendent. It

also states that the legislature will encourage the promotion of improvements, including that of

literary, moral, intellectual, and more.

Section 2 includes information about common schools. It states that a common school

shall be in school at least six months out of the year as part of the uniformity of common schools.

Also, any teachings of sectarian characters may deprive the school of public funding. During

neglect or infraction, the legislature may pass laws to secure attendance in public schools.

The next section, Section 3, states that all land taken to be used by the government for

educational purposes must be compensated for. All proceeds derived from the land can be used

for educational purposes only and not be transferred for other uses. Any amount unused by the

end of the year must be added to the principal sum for educational purposes.

A Board of Regents, whose duties shall be described by law, is stated in Section 4 to be

in control of Mining, Agriculture, and Mechanic Arts. These will be embraced by a State

University, established by the legislature.

In Section 5, it is stated that the legislature is able to create schools and universities. In

these schools and universities, all teachers and professors are required to adhere to the laws

written in this Article 14 of the Nevada State Constitution. Failure to follow the laws written out

in this Education article may subject said schools or universities to lose their public funding.

The legislature is required to provide a budget for public schools, according to Section 6.

The budget is based on a biennium, or two year budget, and the funds are based on what the

legislature deems sufficient. Upon the presentation of budgets in a manner required by law, the

legislature is required to provide maintenance to the common schools. Any appropriation of

money enacted violating this section is void.

According to Section 7, a Board of Regents, constituting of the superintendent, Secretary

of State, and Governor, is put together for the first four years and until their successors are

qualified. This Board of Regents is in charge of controlling and managing the affairs of the

university, as well as the money. After the expiration of the term of office for said Board of

Regents, the legislature shall provide election for a new Board of Regents and define their duties.

Section 8 states that the State of Nevada must set apart public lands for the purpose of

instruction on Mining. Agriculture and the Mechanic Arts.

As stated in Section 9, the last section of Article 14 on Education, no sectarian instruction

is tolerated in any school or university, as established by this constitution. Sectarian instruction

refers to instruction of religious form. Section 9 holds the ideal of “separation of church and

state” in play in the state education system.
