APPLICATION FOR PROBATION

COMES NOW, the accused, by himself, unto this Honorable Court, most respectfully
applies for probation under the provisions of Presidential Decree No. 968, as amended, and
hereby declares that:

1. On December 5, 2016, the Court handed down its Decision in this case
wherein it found the accused guilty beyond reasonable doubt of the crime of
violation of PD 1602, as amended by RA 9287, Sec 3(a) as “bettor” and
hereby sentences him to suffer the penalty of thirty (30) days imprisonment.

2. The crime for which the accused was convicted is not an offense against the
security of the state or against public order.

3. The accused has not been previously convicted by final judgment of any
offense punishable by an imprisonment of not more than six (6) months and
one (1) day and/or a fine of not more than ONE THOUSAND (Php1000.00)
PESOS.

4. The accused has not previously applied for or on probation under the provisions
of Presidential Decree No. 968, as amended.

AFFIDAVIT OF UNDERTAKING

I, xxx, of legal age, with residence address at xxx, after having been
duly sworn to in accordance with law, deposes and states that:

1. I am a Barangay Kagawad of Barangay Tonsuya, Malabon City;

2. I accept the custody of xxx, who was convicted for the crime of of
violation of PD 1602, as amended by RA 9287, Sec 3(a) as
“bettor” and is an applicant for probation;

3. I guarantee the appearance of xxx whenever the Court and/or the

probation office requires his presence;

4. I am executing this affidavit to attest the veracity of the foregoing

statements of fact for whatever legal, and other intents this
affidavit may duly serve.
