 STATEMENT OF PROBABLE CAUSE
 
The Complainant states that the following facts establish probable cause:
 
Your complainant is a licensed peace officer in the State of Minnesota and is employed by the Minnesota
State Patrol. In that capacity and after review of the reports, your complainant states the following to
establish probable cause: 

On February 10, 2018 at approximately 9:35 p.m. Trooper Mielke was on routine patrol when he was
dispatched to an erratic driver complaint on eastbound I-494 near Highway 61. Trooper Mielke was
provided with a description of the vehicle and was advised the complainant was following the suspect in
her vehicle and would have her flashers activated. Trooper Mielke located the suspect vehicle and
complainant's vehicle near on I-494 near Valley Creek Road, in Washington County. Trooper Mielke
followed the suspect vehicle and observed the vehicle cross over the lanes of travel multiple time and the
suspect vehicle almost hit another vehicle. Trooper Mielke activated his emergency lights in an attempt to
stop the vehicle. The vehicle continued to travel and Trooper Mielke activated his sirens. The vehicle exited
onto 10th Street and came to a stop on the exit ramp. 

Upon approaching the vehicle Trooper Mielke observed it was occupied by a sole female, later identified
as KIMBERLEE MARIE WILSON, dob 06/28/1967, the defendant herein. Trooper Mielke observed a
strong odor of alcohol coming from the vehicle. WILSON exited the vehicle and almost fell upon exiting.
Trooper Mielke also observed that WILSON's eyes were bloodshot and watery. Trooper Mielke performed
the HGT test on WILSON and noted lack of smooth pursuit, distinct and sustained nystagmus at maximum
deviation and the onset of nystagmus prior to 45 degrees in both eyes. WILSON admitted to consuming
alcohol and later would admit that she "may have" used cocaine prior to driving. 

WILSON was placed under arrest and transported to the Washington County Jail. During transport to jail
WILSON stated that she "might" have cocaine in her purse. Upon arrival at the jail, WILSON's purse was
searched. Located in her purse was a plastic bag with a white powdery substance inside. The substance
was later sent to the BCA for testing and was identified as cocaine, weighing .313 grams. 

At the jail WILSON submitted to a breath test, after being read the Minnesota Implied Consent Advisory.
The result of the test was .06.

 FINDING OF PROBABLE CAUSE
From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).

X SUMMONS
THEREFORE YOU, THE DEFENDANT, ARE SUMMONED to appear on July 5, 2018 at 9:00 AM before the
above-named court at 14949 62nd Street N PO Box 3802, Stillwater, MN 55082-3802 to answer this complaint.

IF YOU FAIL TO APPEAR in response to this SUMMONS, a WARRANT FOR YOUR ARREST shall be issued.

WARRANT
To the Sheriff of the above-named county; or other person authorized to execute this warrant: I order, in the name of the State
of Minnesota, that the Defendant be apprehended and arrested without delay and brought promptly before the court (if in
session), and if not, before a Judge or Judicial Officer of such court without unnecessary delay, and in any event not later than
36 hours after the arrest or as soon as such Judge or Judicial Officer is available to be dealt with according to law.
