Dear Madam:

I write in behalf of my client, XAVIER McCOY DASIG, your

husband relative to his concern about the custody of your child, One
Miguel Dominique, 6 years old.

According to my client, you left the conjugal abode together with

your child last 4 July 2014 and has not returned since then. After you
left, you initially allowed my client to have custody of your child fifteen
(15) days for every month on December, 2014. Prior to this, custody of
your child was being given to my client in accordance with your wishes.
However, beginning January, 2015, you only gave him (8) days a month
custody of the child but on 11 June 2015 you texted my client informing
him that custody of your child with him is exclusively yours and since
then you have deprived my client of his parental authority over your
child.

You must remember that the law vests on the father and mother
joint parental authority over the persons of their common children. The
provision under the law that no mother shall be separated from a child
under five (5) years of age, is not an absolute rule since in all cases
involving the custody, care, education and property of children, the
latter’s welfare is paramount.

This is being the case, I humbly opine that my client who is the
father of One Miguel Dominique, your common child has every right
under our laws to exercise parental authority over him and he must be
given also the opportunity to exercise the same.

You are hereby demanded to recognize my client’s right to exercise

parental authority over your common child and if you still insist
depriving my client of this right then we shall undertake appropriate
legal measures.
