A civil case for insurance claim can proceed simultaneously with an


administrative case before the Insurance Commission.

Respondent Lin demanded payment of her insurance claim before the


RTC because of Malayan’s denial of the same despite the finding of the
Bureau of Fire Protection that the fire was accidental. She also filed an
administrative case before the Insurance Commission to determine
whether Malayan should be liable for unfair claim settlement.

Did respondent Lin commit forum-shopping when she filed the


civil and administrative cases?

No, she did not. A civil case before the trial court involving recovery of
payment of the insured’s insurance claim plus damages, can proceed
simultaneously with an administrative case before the Insurance
Commission: the issues to be resolved, the quantum of evidence and
the procedure to be followed, and the reliefs to be adjudged by these
two bodies are different.
