Constitution and By-Laws

PREAMBLE

We, the undersigned officers and members of Municipal Federation of Senior Citizens
Association (MUFESCA) of the Municipality of Marihatag, Province of Surigao del Sur,
cognizant of the need of organizing ourselves into an association that shall embody our
ideals, aspirations and objectives for the moral well-being in order to enjoy the blessing
of liberty, equality, and democracy and secure unto ourselves at all times an efficient,
honest and responsible association subscribing and upholding the Constitution of the
Republic of the Philippines, all its laws and the duly constituted authorities and imploring
the Aid of the Almighty God, do hereby ordain and promulgate this Constitution and By-
laws.

ARTICLE 1
Name and Domicile

SECTION 1. Name – The name of the Association shall be the Municipal Federation of
Senior Citizens Association, Marihatag, Surigao del Sur (MUFESCA).

SECTION 2. Domicile – The MUFESCA office shall be at the Senior Citizens Office
located at the back of the Municipal Gym, Barangay Poblacion, Municipality of
Marihatag, Surigao del Sur.

ARTICLE II
Guiding Principles

SECTION 1. Preliminary – To give full meaning to the word brotherhood and sisterhood
for the socio-economic development of the needy older persons/senior citizens of
Marihatag, Surigao del Sur.
SECTION 2. Ethics – The ethics of MUFESCA is to be found in its humanitarian
inclination and orientation towards the mutual and reciprocal efforts in the preservation
and rejuvenation of its aging physical, mental and professional capacities, so as to
prolong its usefulness to family, community, for as long as possible.

SECTION 3. Principles – The MUFESCA shall foster and maintain the dignity of human
being through honest labor, justice, fairness and decency in its dealing with loving
service as a rule of life.

ARTICLE III
Aims, Purposes and Objectives

SECTION 1. The MUFESCA, in the attainment of its objectives for which this federation
is organized, proclaims the following essential aims and purpose, to wit:
1. To serve as a focal pint of all provincial, city and municipal chapters of the Senior
Citizens Association from the 12 barangays and be affiliated with the Provincial,
Regional and National Federation of Senior Citizens Association of the
Philippines (NFSCAP);
2. To promote unity, harmony, brotherhood and sisterhood, and goodwill amongst
the members of the federations;
3. To provide mortuary assistance to beneficiaries of deserving members as funds
are available;
4. To motivate and encourage the senior citizens to contribute to nation-building
pursuant to Republic Act No.

ARTICLE IV
Membership
SECTION 1
All duly accredited and bonafide members of the component associations shall be
considered automatically as members of MUFESCA.
SECTION 2
Members shall be categorized as follows:
1. Regular members – bona fide and active paying members
2. Associate members – bona fide, but not actively-paying members, and that these
members cannot vote and cannot be voted upon.
ARTICLE V
Officers
SECTION 1
The officers of the MUFESCA of Marihatag, Surigao del Sur shall be the following:
1. President
 2. Vice-President
3. Secretary
4. Treasurer
5. Auditor
6. Public Relations Officer (PRO)
7. Board of Directors
SECTION 2.
The Board of Directors shall be composed of 12 members, consisting of one (1)
representative from each component association.
ARTICLE VI
Duties of Officers
SECTION 1
1. President –
a. Preside in all meetings of the Board of Directors, Officers and the General
Assembly;
b. Authorize payments of official/legal obligations of the federation;
c. Sign affiliations for membership and related papers and/or documents;
d. Render performance report annually; and
e. Performs such other duties, as the Board shall authorize.
2. Vice-President –
a. Assist the President in the discharge of his ministerial powers and duties;
b. Takes over the position of the President in case of absence, death or
resignation, removal or incapacity of the former to perform his/her duties.
3. Secretary –
a. Records and keeps the proceedings of all meetings of the Board and of the
General Assembly;
b. Keeps and updates roster of members together with pertinent data, such as
address, dates of admission, birthplace and others;
c. Responsible in sending communication of an official business of the
federation thru the MSWD Field Office;
d. He/She shall be appointed by the President.
4. Treasurer –
a. Receive and is custodian of all funds and accounts of the Federation,
including properties and records pertaining thereto;
b. Pays all legal expenses, duly authorized by the President;
c. Keeps books of accounts of the federation which shall be open for scrutiny by
any members;
d. Keeps deposits in the name of the federation all sums of money of the
federation in the bank designated by the officers of the federation;
 e. Keeps a periodic inventory of all assets and liabilities of the federation and
shall be held liable and accountable for all funds/properties of the federation
with the obligation to render/submit reports during the General Assembly; and
f. He/She shall be appointed by the President.
5. Auditor –
a. He/She shall examine and audit the books of accounts of the federation from
time to time and may pass in audit all legal disbursements made by the
Treasurer; and
b. Submit an annual of semi-annual audit reports as the need arises to the
Board of Directors.

SECTION 6.

6. Press Relations Officer (PRO)

a. Project the image, objectives and activities of the federation to government
agencies and to the general public through press releases, speaking
engagements and other channels with the end in view of attracting support for
the federation’s objectives.

ARTICLE VII
Term of Office
SECTION 1.
All elected officers of MUFESCA shall hold office for one (1) term of three (3) years on
the same position or office without re-election, however, any of the said officers may ran
for other position, or office, other than the position/office he/she has served.
SECTION 2
In case of death or permanent disability or resignation, the remaining terms shall be
served by the new elected or appointed officer, as the case may be, which has
undergone the selection process.
ARTICLE VIII
Meeting
SECTION 1
The ANNUAL MEETING of MUFESCA shall be held on
__________________________________.
SECTION 2
1. The regular meeting of the Board of Directors of MUFESCA shall be held
QUARTERLY on every ________ day of the LAST MONTH OF THE QUARTER
(MARCH, JUNE, SEPTEMBER and DECEMBER).
2. Special Meeting shall be called by the President or by at least three (3) members
of the Board of Directors, in coordination with the MSWD Office specifying the
 need and urgency of the meeting, the important agenda to be taken up, the date,
time and venue of said meeting fifteen (15) days before/prior to the date of
special meeting.

SECTION 3.
Expenses of the members of the Board of Directors in attendance to regular or
special meetings shall be borne by the local chapter with the possible support from
the MSWD Office or LGU concerned.
ARTICLE IX
Quorum Rules and Procedures
SECTION 1
The procedure and Order of Business shall be governed b the Robert’s Rules of
Order which means, majority wins. All members present during a regular or special
meeting shall observe decorum at all times.
ARTICLE X
Election
SECTION 1
The President shall call an election in accordance with Section 1 of ARTICLE VII of
these Bu-Laws.
SECTION 2
Election Procedures shall be governed by Memorandum Circular No. 1-99 which
shall be strictly followed.
SECTION 3
Nomination shall be made on the floor, provided however, that the nominees are for
the positions of officers or directors who must be qualified in accordance with the
above-mentioned circular.
SECTION 4
Qualifications for the officers of MUFESCA are the following:
1. Must be a bona fide member of the accredited senior citizen’s
association/organization, with a track record of at least three (3) years;
2. Must be a registered voter of the concerned municipality;
3. Must be a High School graduate; and
4. Must be physically and mentally fit.
SECTION 5
1. The election of officers shall be supervised by an ELECTION COMMITTEE
composed of five (5) members from the MSWD Office Staff.
2. The ELECTION COMMITTEE shall perform the following tasks:
a. Elect among themselves a Chairman;
b. Prepare election paraphernalia and ensure clean and honest election;
 c. Rule on any question as to qualification or protest regarding the conduct of
election; and
d. Proclaim the duly elected officers.
3. Conduct of Election:
a. Nomination of Candidates shall be either by self-nomination or from any
members; and
b. Voting shall be by secret ballot.

ARTICLE XI
Funds/Financial Obligation
SECTION 1
This federation shall be affiliated to the Regional Federation of Senior Citizens
Association of CARAGA, and shall be required to pay FIVE HUNDRED (P500.00)
PESOS only, as its annual membership fee, payable within three (3) months after
adoption or ratification of these By-Laws.
SECTION 2
The federation is authorized to raise funds through solicitation, fund-raising, donations
and other fund-raising activities, pursuant to Republic Act No. 7432, as amended and its
Implementing Rules and Regulations.
ARTICLE XII
Logo/Seal
SECTION 1
The MUFESA shall adopt the official LOGO/SEAL of the National Federation of Senior
Citizens Associations of the Philippines (NFSCAP). It may, however, adopt its own seal
incorporating some aspects of the NFSCAP LOGO/SEAL.
ARTICLE XIII
Amendments and/or Charter Change
Amendments or charter change to this Constitution and By-Laws may be proposed at
the General Assembly of MUFESCA, provided however, that:
1. The proposal or proposals shall be submitted in writing within thirty (30) days
before every meeting of the General Assembly; and
2. Two-thirds (2/3) of the members present constituting a quorum approve the
amendment or charter change, as the case may be.
ARTICLE XIV
Adoption
The foregoing Constitution and By-Laws are hereby adopted and approved by the
majority of the members of the Municipal Federation of Senior Citizens Association
(MUFESCA) of Marihatag, Surigao del sur.
