Statement of PW2
I am a resident of said address and earned my living through farming.
At around 6:30 AM on 17th June 2016, I want for morning walk near
Lavakera bus stand barrier.
At around that time, some policeman from Tapkara police station came
there and took me and one Kesar Singh to the Lavakera main road
barrier.
They told us that an informer has informed them a white indigo car with
registration no. OD 15A 4847 with three people in it is coming toward
Tapkara Lavkera.
They have huge amount of contraband substance Ganja with them.
After waiting for some time, a white indigo car with registration no. OD
15A 4847 was spotted coming toward us at very high speed which was
intercepted by the policeman with our help.
On asking the name of driver, he revealed his name was Mohmmad
Guddu, resident of UP.
The persons seating on the back seat revealed their name as, Anupam
Baranwal, and a lady, Pappi Baranwal, also resident of UP.
The lady has 6-7-month-old baby with her.
During the search of vehicle, twenty packets of Ganja were recovered
under the seat next to the driver seat.
Mohmad Guddu accepted it as his. An additional forty packets of ganja
were recovered from the trunk of the car.
The petitioner and his wife accepted it as their.
The Policeman then summoned Gauri Shanker with his weighing scale
after serving him with the notice.
The total weight of contraband substance was ascertained to be 60 Kg.
After that contraband substance were sealed.
The statement of PW2 on 16th March 2017
Policeman did not take any action in my presence nor any proceeding
was undertaking in front of me.
They took my signature on number of blank paper and reason for the
same was not disclosed to me.
Police did not inform me about anything before taking my statement. The
Police did not take Kesar Singh with me to Lavakera bus stand barrier.
The Police did not inform me about any white indigo car with registration
no. OD 15A 4847 carrying three people and heavy amount of
contraband substance ganja coming towards Tapkara Lavakera main
road.
It is totally false to say that a white indigo car came towards Tapkara
Lavakera from Orissa Bali Shankra Road.
It is totally false that police asked driver name in front of me or of the
person seating on the back seat of the car.
It is entirely false that the lady had 6-7-month-old baby with her.
It is also false that the persons were given the notice under NDPS act.
It is also untrue that twenty packets of ganja were recovered from the
under the seat next to the driver seat and forty packets from the trunk of
the car.
Gauri Shankar was not summoned with his weighing scale in my
presence. It is totally false that the total weight of ganja was 60 Kg.
