JUDICIAL AFFIDAVIT OF MARICEL PESIGAN

I, MARICEL PESIGAN, 40 years old, married, residing at Tacloban City, after

having been sworn to in accordance with the law do hereby depose and state:

That Atty. Merry Dee is the counsel who conducted and supervised my
examination as a witness at her office at 203, Maria Cristina, Tacloban, Philippines;

That I am answering the questions herein fully conscious that I do so under oath
and that I may be criminally liable for false testimony or perjury;

PURPOSE: This affidavit / testimony of witness, MARICEL PESIGAN, is being offered

to prove that the said TCT in the name of Spouses Haulo is valid.

Q1: Do you swear to tell the truth and nothing but the truth?
A1: Yes Ma’am.

Q2: Please state your name and other personal circumstances for the record.
A2: I am Maricel Pesigan, 40 years of age, married and resides in Tacloban City. I am
one of the helpers of Sps. Haulo for 20 years that they supported to finish my
studies.

Q3: Do you personally know the plaintiff?

A3: No Ma’am, but I personally know the wife of Benjie.

Q4: What is your relation to the Benjie’s wife?

A4: Wala po. Pero andun po ako when she handed the deed.

Q5: What is your knowledge about the defendant acquiring a property from Sps. Paras?
A5: On January 10, 2002, Jackie, Benjie’s wife came to Sps. Haulo’s residence to settle
the sale of said property. I remember that it was just Jackie. She transacted for Sps.
Paraz.
 Q6: Where were you exactly when their conversation took place?
A6: I was seated beside Mrs. Haulo, assisting her with the food preparation.

Q7: What do you remember of the conversation?

A7: At first, Mr. Haulo asked why the property owners were not around, and how they
are not able to show up during the signing. She said that the Sps. Paraz were busy
with other matters that is why they could not come that day.

Q8: How did Mr. Haulo agree to this?

A8: Mr. Haulo took it as a trust risk if the signatures were real as they did not sign in
the presence of witnesses and the other party.

Q9: What happened after this?

A9: Jackie bid goodbye and received the payment for the property.
