1032 DEPUTATION
Board have advised that the instructions on the subject of 142/2012 -
extension of deputation period of non-gazetted staff issued
from time to time should be followed scrupulously to avoid
overstayal of employees while on deputation and the
deputationists being assigned higher grade pay above that
of the grade pay of his/her parent Railway.
1033 DISCIPLINE AND APPEAL RULES
Action on inquiry report – communicating tentative 36/2012 36/2012
reasons for disagreement with the findings of the
Inquiry Officer etc.:[1] The provisions of rule 10[2] of
Railway Servants [Discipline & Appeal] Rules, 1968 have
been reiterated. [2] It should be ensured that the
communication forwarding the Inquiry Officer’s report
should not contain phrases such as ‘Article of charge is fully
proved’ or ‘Article of charge is fully substantiated’, which
could be construed to mean that the Disciplinary Authority
is biased even before considering the representation of the
Charged Official.
Board have reiterated the extant procedure for submission 117/2012 -
of representations by Railway servants. Henceforth, only
those representations from Railway officers that are
received through the proper channel would be dealt with in
the Board’s office.
1034 EDUCATIONAL ASSISTANCE &
REIMBURSEMENT OF TUITION FEES
Board have issued further clarifications on reimbursement 45/2012 45/2012
of Children Education Allowance admissible to Railway
employees.
Board have clarified that the fee paid to the school for the 94/2012 93/2012
use of any aid or appliances by the child is reimbursable.
It has been decided with effect from the current academic
year that:- [1] Hostel Subsidy would mean expenses
incurred by the Government servant if he/she keeps his/her
children in a hostel of a residential school/institution
located beyond a distance of 50 kilometres from his/her
residence. Hostel Subsidy is not related to transfer
liability of the Government servant. [3] reimbursement of
CEA/Hostel Subsidy may be allowed for the initial two
years of a diploma/certificate course from Polytechnic /
ITI / Engineering College, if the child pursues the course
after passing 10th standard and has not been granted
CEA/ Hostel subsidy for studies in 11th and 12th standards.
1036 FIXATION OF PAY
Board have clarified that a Railway servant has the option 100/2012 105/2012
to have his pay fixed from the date of his second promotion,
if he has been granted two promotions/upgradations
between 01.01.2006 and 29.8.2008. In such cases arrears
on account of 6th CPC will be drawn only from the date of
option exercised on second promotion.
1040 HONORARIUM
Board have circulated updated/revised and consolidated 04/2012 157/10
list of one hundred thirty three recognized
Institutions/Societies [both National and International] for
the purpose of availing reimbursement of 90% of
membership fee.
The rates of honorarium payable to various functionaries 124/2012 125/2012
engaged by RRBs for conducting examinations have been
enhanced with effect from 02.11.2012.
1042 GROUP INSURANCE
Central Government Employees Group Insurance 55 /2012 58/2012
Scheme,1980 – Tables of benefits for the Savings Fund for
the period from 1.1.12 to 31.12.12, circulated.
1044 INCREMENTS
Consequent to implementation of VI CPC scales, two 32/2012 33/2012
additional non-absorbable increments may be allowed @
3% of the basic pay to a Nurse holding BSc. Degree as an
additional qualification, in a particular scale where
possession of BSc. Degree is not required as per
Recruitment Rules, subject to certain conditions.
Railway employees who were due to get their annual 33 /2012 40/2012
increment between February and June during 2006 may be
granted one increment on 1.1.2006 in the pre-revised pay
scale as a one time measure and thereafter they will get the
next increment in the revised pay structure on 1.7.2006 as
per Rule 10 of RS(RP) Rules, 2008.
Board have clarified that the additional increment granted 83/2012 83/2012
as a one time measure to railway employees who were due
to get their annual increment between February and June
2006 [SC No. 33/2012] is admissible to all those employees
who were stagnating at the maximum of their pay scale for
more than one year as on 01.01.2006 including those who
were in receipt of stagnation increment[s]. The period of
one year should be reckoned from the date of drawal of pay
at the maximum of scale and not the date of drawal of
stagnation increment.
1046 LEAVE RULES
Board have decided to permit encashment of leave to all 59/2012 61/2012
the running staff including Drivers, Assistant Drivers,
Motormen, Shunters, Guards etc. and Station Masters
/Assistant Station Masters for encashment of Leave on
Average Pay [LAP] while availing Railway Passes/PTOs in
cases where leave is refused but Pass/PTO is availed.
Board have clarified that NPA shall be taken into account 66/2012 67/2012
for calculating the cash equivalent for encashment of LAP
upto 10 days while availing Privilege Passes /PTO.
Instructions regarding grant of study leave for Jawaharlal 97/2012 98/2012
Nehru Memorial Fellowship and other Fellowships offered
by reputed Institutes, are circulated.
1047 LEAVE RESERVE
Temporary exemption from the provisions of Railways Act, 122/2012 121/2012
1989, for introducing three weeks’ roster at a stretch
followed by continuous rest of one week at the
headquarters in respect of staff operating Track Machines
valid upto 08.09.2012, has been extended for a further
period of three years w.e.f 09.09.2012 till September, 2015
with the stipulation that the three weeks work at a stretch
will include the journey period utilized by the workman in
respect of journey conducted by him from the duty point to
his headquarters followed by one week rest.
1049 MEDICAL FACILITIES
Retired Employees Liberalised Health Scheme-97 has 64/2012 -
been re-opened, as under :
For Pre-March-2009 retirees: RELHS-97 will remain open-
ended with a lock-in-period of six months for referral
outside Railway Hospital with a rider that this lock-in-period
can be relaxed under certain conditions by a specially
constituted Medical Board.
For March 2009 and onwards retirees: RELHS-97 will
remain open for a period of another one year from the date
of issue of Board’s letter i.e. 31.05.2012, with similar lock-
in-period of six months relaxable under certain conditions
as in the case of Pre-March 2009 retirees.
Henceforth joining RELHS-97 has been made mandatory
for all retiring Railway personnel without any exit clause
whatsoever.
All other terms and conditions of RELHS-97 mentioned in
Board’s letter dated 16.03.2009 [SC No.43/09] will remain
unaltered.
1051-1 APPRENTICES
Board have circulated the list of the name of establishments 85/2012 85/2012
and the number of slots for training of trade apprentices
under the Apprentices Act 1961 for compliance.
Engagement of Course Completed Act Apprentices as 118/2012 113/2012
substitutes in Group ‘D’ on Indian Railways:Board have
issued clarifications regarding the procedure/ methodology
to be adopted for engaging the Degree/Diploma holder Act
Apprentices as substitutes in Group ‘D’ posts within the
General Managers’ powers in administrative exigencies.
1051-13 PAY SCALES & DESIGNATION
Board have circulated revised pay structure for Official 103/2012 101/2012
Language staff of Indian Railways.
1051-17 UNIFORMS
Board have decided that the breakdown staff may be 07/2012 10/2012
provided with an extra set of uniform in addition to their
eligibility as laid down in the Dress Regulations.
Board have issued instructions regarding supply of 108/2012 106/2012
protective helmets, quality uniforms/jerseys, retro-reflective
clothing, shoes etc. to Trackmen, effective from
20.09.2012.
Board have issued the specification of the luminescent 123/2012 123/2012
vests [safety jacket] to be supplied to Keymen, Mates,
Patrolmen, Gatemen and Trolleymen.
1051-25 PL BONUS
PLB equivalent to 78 [Seventy Eight] days wages 8975/- 114/2012 118/2012
without any ceiling on wages for eligibility sanctioned for
the Financial year 2011-12 to all eligible non-gaz Rly.
employees(excluding all RPF/RPSF personnel).
1053 NIGHT DUTY ALLOWANCE
Board have revised the rates of Night Duty Allowance w.e.f. 58/2012 63/2012

Board have revised the rates of night duty allowance with 126/2012 129/2012
effect from 01.07.2012.
1056 PASS RULES
Issue of Special Passes to retired Railway Officers 12/2012 13/2012
empanelled as Inquiry Officers - ACS No. 72 to RS[Pass]
Rules,1986 Item No. 41 of Schedule VII on Special Passes
amended: Retired Railway Inquiry Officers may be issued
Railway passes for self and spouse of the Class as
admissible at the time of their retirement, alongwith
provision of an attendant in the Second /Sleeper Class, to
undertake journeys in connection with D&AR inquiries.
Advance Correction No. 73 to RS [Pass] Rules: Item 3[iv], 34 /2012 41/2012
[v] and [xiv] of Schedule II under heading ‘General Rules’,
item No. [i] under Column 4 of Schedule IV and item
Nos.11 &12 under Annexure ‘C’ have been revised. The
validity of such Passes /PTOs shall be Five months instead
of Four months, at present. However, if advance
reservation is reduced in future, the validity of Pass/PTO
will not be less than four months period.
Board have communicated equivalent grade pay after 37/2012 47/2012
reckoning running allowance to running staff for the
purpose of entitlement of Passes/PTOs. The ultimate pass
entitlement will, however, be as per Board’s letter dated
06.01.2011 [SC No. 01/2011].
Validity of Duty Passes for travel in Duronto Express 43/2012 37/2012
Trains: Board have decided to allow railway officials to
travel in Duronto Trains while traveling ON DUTY only
subject to conditions given therein.
Board have decided that the Civilian recipients of Chakra 79/2012 79/2012
awards shall also be provided 1st Class /2nd AC
Complimentary Card passes on the same lines as
admissible to Defence awardees, the procedure and other
conditions for issue of such Card passes to Civilian Chakra
awardees remaining the same.
Board have decided that the facility of Complimentary 86/2012 84/2012
Card passes issued to sports-persons who are Arjuna
Awardees including the entitlement of facility of
companion allowed at the age of 65 years shall be valid for
travel in 2nd AC/3rd AC in Rajdhani trains and Chair Car
[CC] in Shatabdi trains besides being valid for travel in 1 st
Class/2nd AC in other Mail/Express trains [except Duronto
trains].
Board have clarified that the employees retiring from posts 90/2012 -
carrying GP 1800 in PB-1 which is now classified as Group
‘C’ posts, they would automatically be entitled for post
retirement complimentary passes/widow passes as per
Group ‘C’ entitlement.
The instructions that a dependent relative in relation to a 116/2012 117/2012
railway servant as defined in Para-2[C] of the Railway
Servants [Pass] Rules, 1986 [Second Edition, 1993] shall
be considered eligible for entitlement of Privilege
Passes/PTOs if his/her income does not exceed minimum
pension/family pension i.e. 3500/- and Dearness Relief
thereon or 15% of the basic pay of the Railway servant,
whichever is more, are reiterated for strict implementation.
Board have decided that Post Retirement Complimentary 129/2012 132/2012
passes/Widow passes issued to employees of Konkan
Railway Corporation Limited has been made valid to travel
over Indian Railways.
Board have clarified that railway employees having less 130/2012 -
than 5 years of service and drawing G.P. 1800/- and
above but below 2800/- are entitled for one II class ‘A’
pass in a year even if they are eligible for only one set of
privilege pass owing to the length of their service.
Board have now decided that the 1st Class/2nd AC 136/2012 141/2012
Complimentary Card passes issued to freedom
fighters/their widows shall also be valid for travel in 2 nd
AC/3rd AC in Duronto trains along with one companion in
same Class, besides the facility of rail travel already
admissible.
1058 PENSION RULES
Board have decided that in case any pre1996 09/2012 01/12
pensioner/family pensioner submits application for revision
of pension/family pension in terms of Board’s letter
dt.10.01.2007 [SC No. 20/2007], the same may be
considered and pension/family pension revised w.e.f.
01.01.1996, without insisting on any deadline for this
purpose.
Board have clarified that family pension admissible to a 10/2012 05/12
beneficiary in respect of one deceased
employee/pensioner is not to be counted as income for the
purpose of determination of eligibility for another family
pension, which is admissible in connection with another
deceased employee/pensioner. However, any other
income/earning of the beneficiary under consideration will
be counted towards income for deciding eligibility for family
pension.
Board have communicated revised rates of Dearness 15/2012 15/2012
Relief @ 127% with effect from 01.07.2011 to the Railway
pensioners who are in receipt of provisional pension and
pension in the pre-revised scale of 5th CPC and to the
surviving CPF beneficiaries who retired from service
between 18.11.60 and 31.12.85 and are in receipt of ex-
gratia.
[2] DR @ 119% w.e.f. 01.07.2011 is payable to CPF
beneficiaries who retired before 8.11.60 and
widows/dependent children of CPF beneficiary who
retired/died before 1.1.86 and who are in receipt of ex-
gratia payment .
Grant of Secondary Family Pension: The list of documents
for grant of secondary family pension, including 23/2012 22/2012
certificate of income etc, required to be submitted by a
claimant member of family ( other than spouse) along
with application form ( Form 10 of RS [Pension]
Rules,1993), PPO and death certificate after the death of
a pensioner /family pensioner is circulated.
Instructions on grant of family pension to next eligible 38/2012 24/2012
member in the family in the case of missing family
pensioners and the prescribed Indemnity Bond, are
circulated.
Board have reiterated their instructions on the steps to be 71/2012 72/2012
taken to ensure timely payment of pension and retirement
dues for strict compliance.
AMENDMENT TO RS[PENSION] RULES, 1993: Board 78/2012 -
have amended Rules 15[3], 16[4] & 16[6] and Rule 98 of
RS[Pension] Rules, 1993, on the provisions regarding
recovery of licence fee and damages for occupation of
Railway/Government accommodation beyond the
permissible period after the date of retirement of the allottee
and on withholding of gratuity.
Board have issued clarification regarding fixation of 84/2012 78/2012
enhanced family pension consequent on implementation of
the recommendation of VI CPC scales in respect of pre-
2006 family pensioners.
Board have issued clarifications on payment of family 119/2012 120/2012
pension to physically handicapped/mentally disabled
children.
Board have circulated instructions regarding the list of 127/2012 128/2012
documents to be submitted by a claimant member of
family (other than spouse) along with Form 14 [Form 10
of RS{Pension} Rules], PPO and death certificate in
respect of the deceased pensioner / family pensioner.
1058 NEW PENSION SYSTEM
Board have issued instructions regarding applicability of 70/2012 53/2012
new pension scheme to the employees of the Autonomous
Bodies/PSUs under various Central Ministries/
Departments.
1060 PROMOTION RULES
Board have decided that in cases where the persons are
medically de-categorized and appointed to some other 22/2012 20/2012
posts in lower pay scale/Grade Pay for which they are
suitable in terms of medical conditions, past service may be
counted towards MACP Scheme. Even where a person had
earned one promotion/financial upgradation prior to medical
de-categorization and is appointed to a lower post, since
the transfer is not on own volition, there is no objection to
counting of the past service including for the period he held
a higher service on promotion, for deciding three financial
upgradations under MACP Scheme.
Board have clarified that the instructions under ACP/MACP
Scheme regarding refusal of promotion is applicable in 25/2012 -
case of regular promotions only and the employees who
have refused ad hoc promotions are entitled to be
considered for grant of financial upgradation under MACPS
subject to fulfillment of other terms and conditions.
Selection for Intermediate Apprentices from amongst 49/2012 50/2012
Skilled Artisans for absorption as JE in G.P. 4200,
PB 9300-34800 – Board have decided to allow one more
but as a final chance to the employees who qualified in the
previous selection on the cut-off date, i.e. 12.08.2002 with
pre-revised qualification but could not be promoted due to
non-availability of vacancies – to appear in the selection for
the post of JE in GP 4200 against the Intermediate
Apprentices Quota.
Board have restored Para 2.3 of their letter dated 61/2012 65/2012
03.09.2009 [SC No. 143/09] prescribing percentages for
filling up of direct recruitment and promotee quota
vacancies in GP 4200 and 4600, arising upto
31.12.2012.The promotional vacancies as may arise upto
31.12.2012 may be filled up in terms of para 2.3 of letter
dated 03.09.2009 [SC 143/09], if not assessed otherwise.
Board have decided to reduce the lower age limit for 87/2012 86/2012
induction of Trackmen for transfer to Workshops, Traffic
and Commercial department against 10% quota with 50%
seniority and against 40% quota on bottom seniority, from
45 years to 40 years, other terms and conditions remaining
the same, for a period of six months.
Restructuring / Reorganisation of Staffing pattern of 89/2012 91/2012
Trackmen on Indian Railways: Board have decided that
the existing categories of Trackmen/Gatemen/ Trolleymen/
Watchmen/Keymen in PB-1 GP 1800 and Mates [P.Way] in
PB-1 GP1900 in the P.Way side of Civil Engg. Department
will henceforth be operated as a unified cadre of Track
Maintainer, effective from 17.08.2012 i.e. date of issue of
Board’s orders. The revised percentage and pay structure
of the unified cadre of Trackmen, is circulated.
Board have issued clarification regarding grant of MACPS 99/2012 100/2012
in respect of employees selected under LDCE/GDCE
Scheme.
Board have issued guidelines on the status of promotions 107/2012 107/2012
made between 01.01.2006 and 04.09.2008 [date of
implementation of 6th CPC on Railways] and seniority of
staff holding post in grades which have been merged in
pursuance to the recommendations of 6th CPC.
Board have clarified that where the feeder post in a cadre 137/2012 142/2012
and the promotional post is in the same grade pay,
financial upgradations under ACP/MACP scheme cannot
be to a higher grade pay than what can be allowed to an
employee on his normal promotion. In such cases
financial upgradations under MACPS would be granted to
the same Grade Pay.
1061 PROVIDENT FUND
The accumulations at the credit of the subscribers to State 53/2012 55/2012
Railway Provident Fund for the financial year 2011-12 carry
interest at the rate of 8% (Eight per cent) for the period
from 01.04.2011 to 30.11.2011 and 8.6% [eight point six
percent] with effect from 01.12.2011.
The accumulations at the credit of the subscribers to State 67/2012 68/2012
Railway Provident Fund for the financial year 2012-13 carry
interest at the rate of 8.8% (Eight point eight per cent) per
annum during the financial year 2012-13.
1062 QUARTERS
Board have issued instructions on relaxation in retention of 39/2012 21/2012
Railway quarters by the compassionate ground appointees
in case of missing Railway servants, in addition to the
existing retention period of a maximum period of two years
[01+01].
Utilisation of Railway Quarters lying surplus due to 47/2012 43/2012
shift/closure of establishments : General Managers are
delegated the powers to allot the surplus quarters to
employees posted at other stations.
Board have extended the period of retention of Railway 65/2012 66/2012
accommodation at the previous place of posting in favour of
officers/staff posted to ECR and NWR till 31.03.2013. The
retention of 08 months (02 months on normal rent & 06
months on special license fee) granted in cases of normal
transfer, is also applicable beyond the date up to which the
special relaxation is granted.
Board have granted permission for retention of Railway 128/2012 136/2012
accommodation at the previous place of post in favour of
officers/ staff posted to RWP/Bela for a period of five [05]
years on payment of normal rent.
Board have decided to allow retention of Railway 132/2012 138/2012
accommodation by the Railway officers/staff at their
previous place of posting upto 30.06.2014, on their
deputation to CONCOR, CRIS, IRCON, IRCTC, IRFC,
KRCL, MRVC, RVNL, RCIL, RITES, DFCCIL and RLDA.
Employees on deputation to IRCON/RIRES will, however,
continue to be governed by the instructions contained in
Board’s letter dated 20.11.2006 [SC No.206/06] .
Board have decided that the officers and staff posted at 140/2012
Jammu-Udhampur-Srinagar-Baramulla Project may be
permitted to retain Railway accommodation at their
previous place of posting on normal rent upto March, 2018
or completion of the project, whichever is earlier.
1063 RECRUITMENT RULES
Board have decided that Metro Railway, Kolkata can also 05/2012 07/12
recruit the sportspersons against the sports quota, in the
category of Skilled Artisans against direct recruitment
quota.
Board have clarified that sportspersons having the sports 06/2012 09/12
norms for higher Grade Pay and applied against the
vacancies for the lower Grade Pay, can be considered for
recruitment against sports quota both through Open
Advertisement and Talent Scouting, subject to certain
conditions.
Board have clarified that in the case of request for release 08/2012 12/12
of berth from RSPB’s Talent Scouting or for granting
relaxation [if any, as per extant rules] by Railway Board for
recruitment of a sportsperson through Talent Scouting; the
one month validity period of Trials may be counted from
the date of Trials of the candidate to the date of obtaining
approval of the competent authority, within Railway/Unit,
for sending proposal to Board’s office.
Recognition of Certificate /Qualification of ITI upgraded as 16/2012 16/12
Centre of Excellence [COE] and its acceptance for the
purpose of employment in Railways:- Board have decided
that certificates of Broad Based Basic Training [BBBT] and
Advance Modules obtained from ITIs upgraded as Centre
of Excellence in the notified trades, may be accepted for
posts wherever ITI has been prescribed as direct
recruitment qualification. Cases of recruitment already
finalized need not be reopened.
Incentive increments for outstanding sports 26/2012 26/2012
achievements: Board clarified that Railway Administration
can grant incentive increments, only for the sports
achievements in the Championships/ Events concluded on
or after the date of issue Board’s policy letter dated
31.12.2010 [SC No. 0/2011]. All other cases of incentive
increments should be dealt with as per policy in vogue at
the time of such sports achievements.
Instructions on constitution of Committee for 29/2012 29/2012
interview/viva-voce in connection with recruitment to
Group ‘C’ posts and posts in Pay Band-1 of 5200-20200
[Grade Pay 1800] including screening of Substitutes on
Indian Railways are circulated.
Recruitment to posts in Pay Band -1 of 5200-20200 ( 31/2012 31/2012
Grade Pay: 1800) on Indian Railways: Para 7.2 of
Annexure-I to Board’s letter dated 18.7.2005 [SC No.
126/05] has been modified :
1] the question paper for written test should be based on
10th standard
2] the question paper should be printed in Urdu in addition
to Hindi, English, and regional language[s].
Recruitment of sportspersons against Sports Quota [ 40/2012 38/2012
through Talent Scouting] :In case of delay in submission of
Trial Reports by the Trial Committee to the President of
Divisional/HQrs Sports Association within the prescribed
time limit of three days, accountability is to be fixed and
action taken should be reported to Board along with
proposal for relaxation of the time limit.
Recruitment of sportspersons against Sports Quota: Board 41/2012 42/2012
have decided to delete Judo & Karate form the list of
recognized games mentioned in para 2.7 of their letter
dated 31.12.2010 [SC No. 09/2011] for the purpose of
recruitment of sportspersons against sports quota from the
year 2012-13 onwards. The players already recruited in
these disciplines will, however, continue to get the
incentives & facilities as per extant rules.
Recruitment of sports persons on Zonal Railways 51/2012 52/2012
/Production Units against sports quota: Board have
circulated the amended / new norms for recruitment of
sportspersons recruited against sports quota.
The relaxation of 03 (three) years above the prescribed 52/2012 57/2012
upper age limit for direct recruitment to all Group ‘C’ posts
and posts in Pay Band-1 [Grade Pay 1800] including
engagement of Substitutes, current upto 3.2.2012, is
extended further for a period of three years from 04.2.2012
to 03-02-2015.
Board’s guidelines for providing various concessions/ 54/2012 -
facilities including scribes to persons with disabilities while
conducting examination for their recruitment from open
market against 3% quota, has been modified.
The jurisdiction of RRB/Gorakhpur is revised /modified to 62/2012 64/2012
include Rail Coach Factory, Rae Bareli.
Board have accorded recognition to the Ball Badminton 63/2012 62/2012
Federation of India and Cycling Federation of India as
National Sports Federations for promotion of Ball
Badminton and Cycling sports respectively, in the country.
The relaxation of upper age limit [five years] in favour of the 68/2012 70/2012
residents of the State of Jammu & Kashmir for appointment to
Central Civil Services and posts, recruitment to which are made
through UPSC or SSC or otherwise by the Central Government
has been extended for a further period of two years beyond 31-
12-2011 i.e. upto 31-12-2013.
Board have reiterated that submission of certificate of 69/2012 71/2012
actual participation of sportspersons in the field of play in
team games in the event under consideration, is mandatory
towards eligibility for being considered for recruitment
against sports quota on Indian Railways.
Board have decided that the instructions contained in their 73/2012 75/2012
letter dated 18.04.2012 [SC No. 51/2012] should be given
effect to from 01.10.2012 and if any notification has been
issued based on the revised instructions of 18.04.2012, the
same should be kept pending and re-notified on or after
1.10.2012.
The notification for open market recruitment to vacant posts 74/2012 76/2012
in Pay Band-1 of 5200-20200 [Grade Pay 1800] to be
issued in the month of July 2012 should indicate that
vacancies notified will be subject to revision and the
number of vacancies published in this notification should
exclude ex-servicemen quota.
Instructions regarding Recognition /acceptance of Section 82/2012 82/2012
‘A’ and ‘B’ examination conducted by the Institution of
Engineers [India], 8 Gokhale Road, Kolkata for
employment purpose on the Railways, are circulated.
Board have decided that private candidates are to be 91/2012 -
treated at par with the regular candidates, once they pass
the requisite All India Trade Test of Craftsman Training
Scheme [CTS]. National Trade Certificates are issued only
to passed out candidates, irrespective of whether they are
regular or private candidates.
Revised statement identifying equivalency between various 93/2012 92/2012
streams of Trades Group under Restructured Pattern of
Craftsmen Training Scheme with Conventional Pattern of
Craftsmen Training Scheme and indicating rebate in
Training period under Apprenticeship Training Scheme, is
circulated.
The recognition granted to PRATHAMA examination 95/2012 94/2012
awarded by Hindi Sahitya Sammelan, Allahabad for the
purpose of employment under Central Govt., for the post for
which desired qualification was Matriculation, current upto
26.10.2005, has not been further extended.
Board have issued clarifications on recruitment of 96/2012 95/2012
sportspersons on Indian Railways against Sports Quota.
Recognition of Courses conducted by Institution of Civil 104/2012 103/2012
Engineers [India], Ludhiana [Pb.] for the purpose of
employment on the railways:-
Board have clarified that the candidates who obtained
qualification from the Institution of Civil Engineers [India],
Ludhiana [Pb.] during the year 2007-08 only shall be
considered for employment .
Board have decided that henceforth the prescribed 113/2012 111/2012
qualification for direct recruitment of Electrical Signal
Maintainer, Gr.II will be ‘ a pass in 1st year of BSc. [Physics]
or [b] a pass in 10+2 stage in Higher Secondary in Science
i.e. Maths or Physics.
Board have amended the criteria for Physical Efficiency 121/2012 126/2012
Test prescribed for recruitment of staff in PB-1 5200-20200
[GP 1800] on Indian Railways. The revised norms will be
applicable in the recruitment process initiated vide
notifications issued in July/August 2012 and all future
recruitments from open market.
Participation and medal winning performance in the events 133/2012 132/2012
organized by the Indian Body Builders Federation may be
considered for recruitment in Railways, incentives and all
other establishment related issues.

Retired railway employees who were not covered under 110/2012 109/2012
Safety Related Retirement Scheme, upto a maximum age
limit of 62 years, may be engaged upto 14.09.2013, on
daily remuneration basis subject to certain conditions.
1065 RESERVATION RULES
Board have decided to carve out a sub-quota of 4.5% for 02/2012 02/2012
minorities as defined under Section 2 it is of the National
Commission for Minorities Act. 1992, from within the 27%
reservation for OBCs, for employment in Civil posts and
Services under the Government of India with effect from
01.01.2012.
1067 RETIREMENT RULES
Board have decided [i] to include Trolleyman of all 01/2012 04/2012
Departments in the scheme of LARSGESS [ii] to
dispense with the requirement of PET for recruitment in the
relevant categories under LARSGESS [iii] relax the
prescribed minimum educational qualifications for
recruitment under LARSGESS by placing them in
minimum of the -1S pay band without any grade pay to
non-matriculates and non-it is.
Recruitment under Liberalised Active Retirement 60/2012 -
Scheme for Guaranteed Employment for Safety Staff
[LARSGESS] for the retirement /recruitment cycle of
July-December 2011: Board have issued clarifications on
the procedure to be followed in cases where PET had been
completed, or was under process for the
retirement/recruitment cycle of July – December 2011.
1068 RUNNING ALLOWANCE
Board have decided that subject to other terms and 75/2012 77/2012
conditions for admissibility of Kilometreage Allowance and
ALK, remaining the same, the rates of Kilometreage
Allowance [per 100 Kms] and the rates of ALK [per 160
Kms] laid down vide their letter dated 26.12.08 [SC
No.202/08] may be increased by 25% with effect from
01.01.2011.
1074 SPECIAL CASUAL LEAVE
Board have circulated the policy regarding participation of 88/2012 -
Indian Railways Personnel in Meditation/Yoga/Spiritual and
other related training programmes.
Board have clarified that the Special Casual Leave of upto 120/2012 -
a maximum of five days allowed once a year for
participation of Indian Railways Personnel in spiritual
programmes, Meditation/ Yoga and other related training
programmes, is inclusive of travel time also.
1077 TRAINING FACILITIES
Board have decided to include one day course on “Threat
Perception & Emergency Response” in the contents of 21/2012 11/2012
training module prescribed for railway staff involved in train
operation [crew/Guard/SM/Controller/Gangmen/TTE/AC
staff] under Disaster Management Training with the period
of training remaining unchanged.
Revision of Training Modules of Supervisors : Board have 30/2012 27/2012
decided that, in a situation where the previous batch of
trainees undergoing 18 months training completing their
training after new batch undergoing training for 12 months,
the training of the previous batch may be reduced to the
date before the completion of training of new batch
undergoing the revised training of 12 months without
affecting the course content, and allowed to join first after
successful completion of training, as a one time exception.
Board have issued instructions regarding ensuring of 72/2012 74/2012
qualitative improvement in the training imparted to staff
especially LPs/ALPs and SM/ASMs.

Board have decided that the detailed information pertaining 77/2012 73/2012
to the training centres under the jurisdiction of the Zonal
Railway/PU should be displayed on their website and have

Imparting Moral Education to directly recruited 92/2012 90/2012
Staff/Supervisors- Board have decided that two sessions
mainly on Values in Administration; Ethics in Government
and provisions of Conduct Rules as envisaged in
RS[Conduct] Rules, 1966 should be taught to the staff and
supervisors during their initial/induction training courses
without increasing the duration of the training course.
Board have circulated the revised the training modules of 131/2012 133/2012
Office Superintendent and Chief Staff & Welfare Inspector
through 20% LDCE Quota and revised the training period
for both categories as 21 working days. The revised norms
of training are applicable to future batches from the date of
issue of Board’s letter.
Board have clarified that the term ‘TA’ as used in the 134/2012 139/2012
general guidelines regarding messing facilities in the
Centralised Training Institutes on the Railways, may be
read as ‘DA’.
Board have reiterated their instructions regarding training of 139/2012 144/2012
front line staff in rendering first aid for strict implementation
at the time of their deployment at stations & trains.

Board have issued consolidated instructions on periodical 14/2012 17/2012
transfer of non-gazetted Railway employees holding
sensitive posts.
Board have decided that henceforth the cases of own 27/2012 30/2012
request transfer of sportspersons recruited against sports
quota, from one Railway/Unit to another Railway /Unit shall
be decided exclusively by the General Managers of
concerned Railways/Units; subject to fulfilling both the
eligibility conditions viz., the sportsperson should be a
regular employee with at least five years service on
Railways. The general conditions governing request
transfers, like, educational qualifications prescribed for
recruitment to the category/post to which transfer has been
sought for, assignment of bottom seniority etc. will also
apply.

The issue of inclusion of some categories, dispensation of Physical Efficiency Test

2. The Government of India had set up the National Commission for Religious and
Linguistic Minorities to suggest criteria for the identification of the socially and economically
backward sections amongst Religious and Linguistic Minorities and to recommend measures
for their welfare, including reservation in Government employment. The Commission
submitted its report to the Government on 10th May. 2007, wherein it had, inter-alia,
recommended creation of a sub-quota for minorities from within the reservation of 27%
available to OBCs, in Government employment.
3. The Government have carefully considered the above recommendation and it has
been decided to carve out a sub-quota of 4.5% for minorities, as defined under Section 2 (c)
of the National Commission for Minorities Act. 1992, from within the 27% reservation for
OBCs as notified by the aforesaid O.M. The castes / communities of the said minorities
which are included in the Central list of OBCs, notified state-wise from time to time by the
Ministry of Social Justice and Empowerment, shall be covered by the said sub-quota.
5. These orders will have effect from 1st January, 2012 and the O.M. No. 36012/22/93-
Estt. (SCT), dated 8th September, 1993 stands modified to the above extent.

Railway Board from time to time recognizes Institutions/Societies [both National and
International] for the purpose of allowing Railway personnel to take membership and avail of
re-imbursement to the tune of 90% of the membership fee. Till date a total number of 131
institutions/societies [both National and International] on various subject areas have been
recognized and notified for the purpose. The Ministry of Railways have further decided to
include two more institutions namely, [1] Institution of Valuers, and [2] Quality Council of
India in the list of recognized institutions/societies for the purpose of membership and
reimbursement of membership fees.
2. The name of the institute namely, the ‘Chartered Institute of Transport [India]’ that
had been originally recognized vide S.No.50 in the Annexure-‘A’ to Board’s letter No. E[G]
83 FE1/4 dated 29.4.1988 has since been changed. The new name of the institute may be
read as the ‘The Chartered Institute of Logistics and Transport – India [CILT-India]’ [refer
S.No.13 in the new list].
3. The updated/revised and consolidated lists of one hundred thirty three [133] such
recognized institutions/societies [ including the latest two] are attached as Annexure- ‘A’ &
‘B’. Wide publicity may be given at all the relevant levels to encourage Railway personnel to
take membership. The competent authority may process for reimbursement of membership

LIST OF PROFESSIONAL INSTITUTIONS/SOCIETIES (INTERNATIONAL)
As per extant instructions officers of the rank of JA grade and above are permitted to
take up membership of a maximum of five professional Institutions/Societies of which not
more than two can be International institutions. Officers below the level of JA grade upto Sr.
Supervisors in the grade of Rs.2375-3500 (RPS) and Rs.2000-3500 (RPS) have been
allowed to take up membership of two professional Institutions/Societies of which not more
than one can be international. They can claim 90% re-imbursement in respect thereof.
General Managers have been delegated powers to make 90% re-imbursement in favour of
the officers only in respect of one Institution and for any re-imbursement for the second
Institution onwards prior approval of Railway Board is necessary for which Railways are
required to send proposals to Railway Board.
Railway Board have further reviewed the scheme and it has been decided that General
Managers may make 90% re-imbursement of membership fee to Officers of JA grade and
above in respect of membership of professional Institutions/Societies (recognized by Railway
Board for the purpose of 90% re-imbursement of membership fee) upto a maximum of three
Institutions/Societies, of which one can be international.
Similarly in respect of officers below the level of JA grade upto Sr. Supervisors, in grade of
Rs.7450-11500 (RSRP) and Rs.6500-10500 (RSRP), the General Managers may make 90%
re-imbursement in respect of two Institutions/Societies including one International
Institutions, of which they are allowed to take membership.
In case of any officer/supervisor wishing to take up membership beyond the limits laid down
above, prior approval of the Board would be necessary for which, in deserving cases, the
Railways/Units may send proposals to Railway Board in consultation with their FA&CAO
along with General Manager's recommendation.

clarification whether in the wake of the Office Memoranda referred to above, second family
pension is admissible to a family pensioner who is already in receipt of an amount of family

27.05.78 instance of S.P.E and Vigilance Organization, may be
heard by the Divisional Railway Manager in respect of
divisionally controlled staff and by the Chief Personnel
Officer (A) in respect of Headquarters controlled staff
before a final decision to effect the transfers is taken.

discretion to transfer non-gazetted staff from
Stations/Posts against whom there are complaints – the
man with longest stay being shifted first and those on the
verge of their retirement { with one (1) or two(2) years
service left} may be exempted if complaints against them

ordered. When the transfer of the railway servant is on
temporary basis, the same should be mentioned in his
transfer orders.

Side Stations involved only in train passing duties and
not doing any commercial duties may be exempted from
the purview of the periodical transfer.

(i) The widows and dependent children of the deceased CPF beneficiary who had retired
from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in
receipt of Ex gratia payment of 605/- p.m.
(ii) Central Government employees who had retired on CPF benefits before 18.11.1960 and
are in receipt of Ex-gratia payment of 654/-, 659/-, 703/- and 965/-.
3. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher
rupee. In their application to the pensioners/family pensioners belonging to Indian Audit and
Accounts Department, these orders issue in consultation with the C&AG.
4. This issues with the concurrence of Ministry of Finance, Department of Expenditure

3. However, doubts have been raised by one of the railways regarding methodology to
be followed in calculating presumptive railway freight. The matter has been examined in
Board’s office and it has been decided that rates per km. for transport by road as prescribed
in Board’s letter No F(E)I/2008/AL-28/15 dated 29.12.2010 would be applicable to
transportation of personal effects made by road between places connected by rail also.
Therefore, there would no longer be any distinction in rates of transportation of personal
effects by road between places connected by rail or not connected by rail.

2. This is informed that the claims submitted by a claimant member of family (other
than spouse) for family pension after the death of a pensioner /family pensioner, in Form
14 and supported by the death certificate and PPO of the pensioner /family pensioner,
may be processed in consultation with the Pay and Accounts Officer, who is the
custodian of the pension file which contains all relevant Forms and information of the
pensioner. In a very rare case where the name of the claimant member is not available
in the records of the Head of Office as well as the Pay & Accounts Officer concerned
and the claimant member also fails to submit a copy of PPO or Form 3 containing
‘Details of Family submitted earlier by the deceased employee /pensioner, the

to these certificates, PAN Card, Matriculation Certificate, Passport, CGHS Card, Driving
License, Voter’s ID Card and Aadhar Number may also be accepted. Acceptance of
voter’s ID card and Aadhar Number is subject to the condition that the pensioner /family
pensioner certifies that he /she is not a matriculate and he /she does not have any of the
documents mentioned in Form 14 or above. Apart from these documents, the Ministries
/ Departments may accept any other documents submitted by the claimant , which may
be relied upon and which establishes the relationship of the claimant with the pensioner
and / or contains his/ her date of birth.
3. The applicant has also to prove that no other surviving member in the family , who
may have a prior entitlement for family pension, is eligible. For this purpose, the
above and / or any other documents, such as marriage/death / income certificates of
the other members, which may be essential in a given situation, may be used.

2. Consequent upon the decision of the Board to enhance the period of advance
reservation from 90 days to 120 days vide Commercial Circular No. 12 of 2012 dated
06.02.2012, the issue regarding enhancing the validity period of passes and PTOs was
under examination in Board’s office with a view to facilitate securing confirmed reservations
on such Passes and PTOs. After careful consideration by Board, it has been decided that
the validity period of full/half sets of Privilege/ Post Retirement Complimentary/Widow
Passes and PTOs shall be one month more than the Advance Reservation Period in
general. Hence the validity of such Passes /PTOs shall be Five months instead of Four
months, at present. However, if advance reservation period is reduced in future, the validity
of Pass/PTO will not be less than four months period. Accordingly, item 3[iv], [v] and [xiv] of
Schedule II under heading ‘General Rules’, item No. [i] under Column 4 of Schedule IV and

2. The Department of Pension and Pensioners’ Welfare has been receiving requests to
issue a clarification whether family pension to eligible child / children of a family pensioner
who has been declared missing can he granted.
3. The matter has been considered in this Department in consultation with the
Department of Expenditure, Ministry of Finance. It has been decided to make similar
provisions to mitigate the hardships of the family caused by the deprivation of its rightful
family pension as a consequence of disappearance of the family pensioner. The
administrative Departments/ Ministries may grant family pension to the next eligible member
in the family subject to fulfilment of conditions as prescribed from time to time for dealing
with the cases of missing employees/pensioners.
4. The Indemnity Bond prescribed for missing pensioners has been suitably modified to
include the name and relationship of the next eligible family member as well as the
deceased employee/pensioner and the missing family pensioner(s).
5. These provisions would also be applicable in case a person who is eligible for family
pension, goes missing before the family pension is actually sanctioned to him/her. In such
cases, family pension will be sanctioned to the next eligible person.
2. It has been decided that a relaxation of six months in retention of Railway quarter in
case of compassionate appointment to the wards /spouse of the missing Railway employees
where employee is missing and compassionate appointment begins after 02 years from the
date of missing/lodge of F.I.R may be allowed thus making the normal permissible period as
two years and six months subject to the conditions laid down in the original letter dated
17.07.2002. The six months additional extension, so granted, is further extendable by
another six months, only with the approval of the General Manager of the concerned
Railway, in cases where finalization of compassionate appointment gets delayed thereby
making the maximum period of retention on normal rent as three [1+1+1/2 +1/2] years.

2. In pursuance of the discussions held in the PNM meeting between Railway Board
and All India Railwaymen’s Federation [AIRF] on 23rd and 24th February, 2012, it has been
decided that instructions issued vide Board’s letter dated 17.06.2011 [RBE No.91/2011]
stands withdrawn and wherever higher grade posts have been surrendered after the issue of
the letter dated 06.03.2007 [RBE No. 32/2007] and which have led to promotions being
adversely affected for staff working in the immediate lower grade [except in case of cadre
restructuring] in all situations the higher grade posts may be restored and the post in the
lowest recruitment grade form the cadre be surrendered without resorting to seeking
difference of money value from the vacancy bank.
3. This is being allowed as a onetime measure. It may also be ensured that in future,
while surrendering higher grade posts instructions contained in RBE No. 32/2007 are strictly
followed without any deviation.

regulating Dearness Allowance under these orders.
3. The additional installment of Dearness Allowance payable under these orders shall
be paid in cash to all railway employees. The arrears may be charged to the salary bill for
April, 2012 and no honorarium is payable for preparing separate bill for this purpose.

2. It has, time and again, been noticed by this Ministry that the extant instructions on
periodical transfer are being interpreted differently by different Railways. The position in this
regard, is clarified in the following paragraphs. The instructions for periodical transfer of
Railway employees cover two broad categories of staff:
[i] [a] The first category includes staff of Commercial Department [such as Commercial
Supervisors, Enquiry-cum-Reservation Clerks /Booking Clerks, Goods Clerks,
Parcel Clerks, Ticket Checking Staff etc., ] and the staff of the Operating
Department [SSs/SMs/ASMs etc.]
[b] In order to avoid large scale dislocation in the case of this category of staff,
periodical transfer may, as far as possible, be effected without involving a change of
residence of the staff concerned, so long as the fundamental objectives of such
transfers can be achieved by transferring such staff to a different location in the
same station or to a different station in the same urban agglomeration.

The staff Inspection Unit (SIU) of the Ministry of Finance (Department of Expenditure)
had conducted the work measurement study of the office of the Regional Labour
Commissioner (Central) Dhanbad and Jaabalpur under the Ministry of Labour and
Employment and made recommendations one of which is as under:-
Para 8.2 of the reports: “An effective mechanism is required to be evolved to make the
Contractual Labour Act and the BOCW Act effective in its enforcement. The observation of
the team is that implementation of these Acts which are lately emerging as wider in its
coverage on ground, is quite ineffective in curbing the violations. In this context, the SIU is of
the view that to make these two laws in operatonalization form and making it effective, a
directive from the highest level of the Ministry can go to all Ministries and their executive
authorities to hire the contractors who are in position to fulfil all the conditions stipulated in
the schedule- I to XII of the Contract Labour Act. This measure from the Ministry will to some
extent make the establishments perceptive to the directions of the Ministry and will have an
indirect effect in the enforcement of this Act”.
Board desire that Railway should ensure better and effective compliance of the
provisions of all the Labour enactments including the provisions of the Contract Labour
(Regulation and Abolition) Act, 1970 and the Building and Other Construction workers
(Regulation of Employment and Conditions of service) Act, 1996.

Board’s letter dated 03.01.2012 quoted therein was circulated under SC No.01/2012.
Railways are further directed that the prescribed schedule as contained in Railway
Board’s letter of even number dated 29.03.2011 for retirement/recruitment under the
Scheme should be strictly adhered to. Any delay on the part of the Railways in
completing the various prescribed stages of retirement/recruitment cycle would dilute the
objective/purpose of the Scheme.
With the issue of Board’s letter dated 23.5.2012, action may be initiated to fill up the
promotional vacancies that may arise upto 31.12.2012, in accordance with the instructions
circulated under SC No. 143/2009, if not already assessed otherwise.
3. On a reference from both the Federations, the matter was reconsidered by this
Ministry and it has been decided to withdraw the para 2.1 of Board’s letter of even number
dated 21.11.2011, thereby restoring para 2.3 of Board’s letter dated 03.09.2009. It is further
advised that the Railways may fill up the promotional vacancies as may arise up to
31.12.2012 keeping in view para 2.3 of letter dated 03.09.2009, if not assessed otherwise.
Other stipulation made in the letter ibid shall hold good till further orders.

[a] For Pre-March 2009 retirees: The RELHS-97 will remain open-ended with a lock-in-
period of six months for referral outside the Railway Hospital with the rider that this
lock –in-period can be relaxed only in an emergency provided the patient is either
admitted or visits the Railway Hospital and the facilities for the treatment are not
available in Railway Hospital. Such referrals are to be processed only on
recommendation of a specially constituted Medical Board.
[b] For March 2009 and onwards retirees: The RELHS-97 will remain open for a period
of another one year from the date of issue of the letter for all those retired railway
personnel who have not joined the scheme for one reason or the other. The lock-in-
period of six months as applicable for pre-March, 2009 retirees shall be applicable for
these retirees also. Henceforth joining RELHS-97 has been made mandatory for all
retiring Railway personnel without any exit clause whatsoever.
All other terms and conditions of RELHS-97 mentioned in Board’s letter dated
16.03.2009 under reference will remain unaltered.
This has the approval of the President and issues with the concurrence of Finance
Directorate of Ministry of Railways. Wide publicity should be given to the above provisions.

In exercise of its powers to make reasonable relaxations in public interest for a class
/ group of employees, in all or any of the existing provisions regarding house allotment /
retention, the Board has decided that permission for retention of Railway accommodation at
the previous place of posting in favour of officers/staff posted to ECR and NWR be further
continued till 31.03.2013. It has also been decided by the Board that the retention of 08
months (02 months on normal rent & 06 months on special license fee) granted in cases of
normal transfer, is also applicable beyond the date up to which the special relaxation is
granted.

2. A resolution has already been issued vide letter no.5[7]2003-ECB &PR, on 10th
October, 2003 to operationalise the decision of the Government to introduce a new pension
scheme based on defined contributions. An interim Pension Fund Regulatory And
Development Authority [PFRDA]is also being constituted.
3. In line with this decision, it has been further decided that new entrants in all
Autonomous Bodies under various Central Ministries /Departments recruited on or after
1.1.2004 will also be governed by the new scheme and not by the existing pension scheme
in these organizations.
Over the past few months, this Department has been receiving letters directly from
autonomous institutions/PSUs seeking clarifications regarding the date of implementation of
the new pension scheme and its applicability to the new entrants joining autonomous
bodies/PSUs. The desired clarifications have been considered in consultation with
Department of Economic Affairs, Ministry of Finance and Department of Pension &
Pensioners’ Welfare.
2. The NPS architecture comprising the NPS Trust, the trustee bank, the Pension Fund
Managers [PFMs] and the Central Recordkeeping Agency [CRA] has since been
opertationalised. The accumulated corpus in respect of Central Government employees
[Civil, Railways, Posts & Defence Civilians] has already been transferred through Trustee
Bank to PFMs. Further, the data transfer to NSDL is nearing completion and online monthly
upload and simultaneous data transfer has already commenced.
3. It is, therefore, requested that in order to ensure that employees in the autonomous
bodies under the administrative control of your Ministries/Departments, recruited on or after
1.1.2004, are similarly brought over to the NPS architecture, the autonomous bodies may be
advised to contact PFRDA for shifting to the NPS architecture operationalised by
PFRDA/NSDL.
4. The exercise of shifting over to the NPS architecture should be completed by 31st
January, 2009 by all the autonomous bodies.

Sub: Applicability of New Pension Scheme to the employees of the
Autonomous Bodies under various Central
Ministries/Departments.

This is in continuation of this Department’s O.M. of even number dated 28th
November, 2008 wherein it was requested that in order to ensure that employees in the
autonomous bodies under the administrative control of your Ministries/Departments,
recruited on or after 01.01.2004, are brought over to the NPS architecture, the autonomous
bodies may be advised to contact PFRDA for shifting to the NPS architecture
operationalised by PFRDA/NSDL.
2. To take the above process further, the PFRDA has devised a formal Letter of
Consent which is required to be submitted by the Central Autonomous Bodies indicating
their formal commitment towards discharging their obligations under the NPS. The format of
the said ‘Letter of Consent’ is being enclosed with this OM. The ‘Letter of Consent’ may be
circulated to all the Central Autonomous Bodies under the administrative control of your
Ministries/Departments for forwarding the same to PFRDA through the Financial Advisers of
the respective Ministries/Departments.

2. DOP&PW’s earlier instructions dated 05.10.1999 were adopted /circulated vide this
office letter No.F[E]III/99/PN1/35 dated 21.1.2000 for compliance.
i) All pensioners' dues are to be settled by strictly following the procedure laid down in
Rule 56 to 76 of CCS(Pension)Rules, 1972.
iii) Any delay in processing of pension resulting in pension not being authorised on the
last working day of retirement of the government servant, should be reported by the
Head of Office to the next higher authority who would watch the settlement of delayed
cases.
v) Once it has been decided to pay gratuity, the amount should be paid immediately
pending a decision regarding payment of interest. This would reduce the interest
liability, if any, on payment of delayed gratuity.
vi) In the matter of delayed payment of leave encashment, the Department of Personnel &
Training in their Note dated 2.8.99 has clarified that there was no provision under
CCS(Leave)Rules for payment of interest or for fixing responsibility. Moreover,
encashment of leave is a benefit granted under Leave Rules and not a pensionary
benefit.
vii) In the matter of CGEGIS, the Department of Expenditure, Ministry of Finance, in their
U.O.No.709/EV/1999 dated 6.8.1999 had clarified that payment under CGEGIS cannot
be termed as terminal benefit. As payments under this scheme are made in
accordance with the Tables of benefit which takes into account interest upto the date
of cessation of service, no interest is payable on account of delayed payments under
the scheme. They had also clarified that CGEGIS payment cannot be withheld and no
Government dues can be recovered from the accumulation except the amount claimed
by the financial institution as due from the employee on account of loans taken for
house building purpose.
3. The above recommendations were circulated among all Ministries /Departments vide
this Department’s OM No. 38/64/98-P&PW(F) dated 05th October, 1999. However, it is
noticed that all Ministries /Departments are not strictly following the above instructions. The
above instructions provide that, wherever delays are anticipated, provisional pension should
be sanctioned immediately. Thus, in case where regular pension is not authorized at the
time of retirement, provisional pension should invariably be sanctioned. Inspite of these
instructions, there have been instances where payment of pension [regular or provisional] is
not authorized at the time of retirement. In some cases, the administrative departments
have been directed by the Central Administrative Tribunal/Court to pay interest for delay in
payment of pension and a number of proposals for payment of interest on delayed
pensionary benefits is being forwarded to Department of Pension and Pensioners Welfare.
Therefore, it is reiterated that all the Ministries /Departments should strictly follow the above
recommendations communicated vide this Department’s OM dated 05.10.1999.
4. The Ministries /Departments may circulate this O.M among the concerned
attached/subordinate /field organizations under the administrative control of the respective
Ministries /Departments for strict compliance.

2. The training modules of ALPs have been revised recently vide Board’s letter
No.E[MPP]2009/3/14 dated 05.06.2009. In this regard it is stated that the training modules
pertaining to SMs/ASMs have already been circulated and are being implemented by the
Railways. The question of revision is now under active consideration of the Human
Resource Reforms Committee. Till the revised training modules are issued, Zonal Railways,
keeping in view the changes in the working practices, technology etc. and the local
conditions may modify the training module of SMs/ASMs accordingly to suit the current
requirements.
3. Zonal Railways are aware that training of the above referred categories are
undertaken in the Main Training Centres and there are nominated training managers who
are required to monitor the quality and content of the training programme. The Railway
administration, therefore, must ensure that qualitative training is imparted to the trainees and
they should chalk out an action plan so that systems are put in place, both for monitoring
quality of training through active involvement of the training managers as also undertaking
regular evaluation of the level of knowledge, skills and preparation of vital safety category
staff, who have undergone training.
8. It is desired that the issue be deliberated at the highest level in the zonal railways, to
ensure qualitative improvement in the training environment.

G.S.R.66. – In exercise of the powers conferred by the proviso to Article 309 of the
Constitution, the President hereby makes the following rules further to amend the Railway
Services [Pension] Rules, 1993, namely:-
1. Short title and commencement- [1] These rules may be called the Railway
Services [Pension] [Amendment] Rules, 2012.
2. They shall come into force on the date of their publication in the
Official Gazette.
2. In the Railway Services [Pension] Rules, 1993, [hereinafter referred to as the
said rules], in rule 15, in sub-rule [3], in clause [a], after the words “licence fee”, the
following shall be inserted, namely:
“[6] The recovery of licence fee [where it is not possible for the Directorate of
Estates to determine the outstanding licence fee] as well as damages [for the
occupation of the Government accommodation beyond the permissible period after
the date of retirement of allottee] shall be the responsibility of the Directorate of
Estates and the withheld amount of gratuity under sub-rule [5] above, the retiring
Government employees, who are in occupation of Government accommodation, shall
be paid immediately on production of “No Demand Certificate” from the Directorate of
Estates after actual vacation of the Government accommodation.
[6 A] The Directorate of Estates shall ensure that “No Demand Certificate shall
be given to the Government employee within a period of fourteen days from the actual
date of vacation of the Government accommodation and the allottee shall be entitled
to payment of interest [at the rate applicable to General Provident Fund deposit
determined from time to time by the Government of India] on the excess withheld
amount of Gratuity which is required to be refunded, after adjusting the arrears of
licence fee and damages, if any, payable by the allottee and the interest shall be
payable by the Directorate of Estates through the concerned Accounts Officer of the
Government employee from the actual date of vacation of the Government
accommodation up to the date of refund of excess withheld amount of gratuity.
4. In rule 98 of the said rules, in sub-rule [1], in clause[i] in sub-clause [g], in item [5],
in sub-item[v], the words ‘ten per cent of the death-cum-retirement gratuity or one
thousand rupees, whichever is less”, the words ten per cent of death- cum-
retirement gratuity” shall be substituted.

been considered by Ministry of Railways and it has now been decided that the Civilian
recipients of Chakra awards shall also be provided 1st Class /2nd AC Complimentary Card
passes on the same lines as admissible to Defence awardees. The procedure and other
conditions for issue of such Card passes to Civilian Chakra awardees shall remain the
same.

Welfare) on the above subject is sent herewith for your information and necessary action.
2. In pursuance of the enhanced rates of ex-gratia to the surviving SRPF( C) retirees
issued vide Board’s letter No.F(E)III/98/PN1/Ex-Gr/3 dated 15.11.2006 para 1[ii] of
DOP&PW’s O.M. dated 30.04.2012 may be read as under:-
“The surviving Group ‘A’, ’B’ , ‘C’ and ‘D’ SRPF (Contributory) beneficiaries who had
retired from service during the period from 01.04.1957 to 31.12.1985 and have been
sanctioned enhanced slab-wise ex-gratia @ 3000/-, 1000/-, 750/- and 650/-
per month respectively w.e.f. 01.11.2006, in lieu of uniform rate of 600/- p.m. are
entitled to Dearness Relief @ 139% w.e.f. 01.01.2012”.
3. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher
rupee. In their application to the pensioners/family pensioners belonging to Indian Audit and
Accounts Department, these orders issue in consultation with the C&AG.

and subsequently retired/demitted service.

2. The matter has been examined and it is clarified that the increment in question will be
admissible to all those employees who were stagnating at the maximum of their pay scale
for more than one year as on 01.01.2006 including those who were in receipt of stagnation
increment[s]. It is also clarified that the one year period is to be reckoned w.e.f. the date of
drawal of pay at the maximum of scale and not from the date of drawal of stagnation
increment.

Copy of Board’s letter No.F[E]III/2008/PN1/12 dated 29.06.2012 is published for
information, guidance and necessary action. Board’s letters dated 08.09.2008, 08.10.2008
and 18.11.2008 quoted therein were circulated under SC Nos.117/08, 157/08 and 170/08,
respectively.
2. The fixation of family pension at ordinary rates is subject to the provision that the
revised family pension in no case shall be lower than 30% of the minimum of the pay in the
pay band plus the grade pay corresponding to the pre-revised pay scale from which the
pensioner had retired. In case of HAG and above scales it is 30% of the minimum of the
revised pay scale. In the cases of such employees who retired/died on or before 31.12.2005,
the family pension at enhanced rates was also required to be revised.
3. It is clarified that the revised enhanced family pension, under sub-rule 3(a) of Rule 54
of the CCS (Pension) Rules, 1972, during the applicable period, shall also be determined as
per para 4.1 of O.M. No.38/37/08-P&PW(A), dated 01.9.08. Further, it shall not be less than
50% of the sum of minimum of the pay in the pay band plus the grade pay or 50% of
minimum of pay scales in case of HAG and above, corresponding to the pre-revised pay
scale in which the pensioner/deceased employee had last worked.
4. In cases where the pension authorized on retirement was less than 50% of the last
pay drawn and amount of pension revised after 1.1.2006 is also less than 50% of the sum of
minimum of the pay in the pay band plus grade pay or 50% of minimum of revised pay
scales in case of HAG and above, the revised enhanced family pension may be less than
50% and shall be restricted to that amount.
5. In the case of a pensioner who died prior to 1.01.2006, the notional revised pension
as on 01.01.2006 shall be taken into account for the purpose of calculation as above. In all
cases, the amount of revised enhanced family pension shall not be less than 30% of the sum
of minimum of the pay in the pay band plus the grade pay or 30% of minimum of pay scales
in case of HAG and above.

number dt. 19.09.2011 where it was requested to conduct resurvey/Jt. Survey, as the case
may be, in all the railway establishments who are coming under the purview of the
Apprentices Act 1961, in keeping with the training facilities available with the units.
Necessary Budgetary provision may kindly be made in view of the increase in the
number of training slots.
The Ministry of Railways has decided that para 3.3 of the Master Circular on Act
Apprentices stands modified as per Correction Slip No.30/2012 enclosed.

2. It has now been decided by Ministry of Railways that Complimentary Card passes
issued to sports-persons who are Arjuna Awardees shall henceforth be valid for travel in 2nd
AC/3rd AC in Rajdhani trains and Chair Car [CC] in Shatabdi trains besides being valid for
travel in 1st Class/2nd AC in other Mail/Express trains [except Duronto trains]. It has been
further decided that the companion allowed at the age of 65 years shall also be entitled to
travel in the same Class along with Arjuna Awardees in Rajdhani/Shatabdi trains. It may be
further mentioned that aforesaid travel facility by Rajdhani/ Shatabdi trains shall be
admissible only to Arjuna Awardees and not to other sports-persons who are provided with
Complimentary Card passes.

2. The question of reducing the lower age limit has been considered by the Board in the
light of the demand made by Federations viz., AIRF & NFIR in the PNM meetings. It has
been decided that the lower age limit for induction of Trackmen for transfer to Workshops,
Traffic and Commercial department against 10% quota with 50% seniority and against 40%
quota on bottom seniority, may be reduced from 45 years to 40 years. Other terms and
conditions of transfer of Trackmen against both the quotas remain unaltered. The matter will
be reviewed after 6 months. Railways are requested to furnish the details of number of
Trackmen inducted into other departments for the period from 01.08.2012 to 31.01.2013.

(i) Special Casual Leave (CL) upto a maximum of 5 days would be allowed once in
a year to any willing employee for only one such programme;
(ii) Special Pass (as per the entitlement) would be given once in a year to any willing
employee;
(iii) No TA/DA would be payable.
(iv) No programme fee would be payable by the Railways; and
(v) The personnel willing to participate in such programme would be spared subject
to the convenience of the Administration.

of distance between the residence and the hostel for reimbursement of Hostel Subsidy
subject to fulfilling other conditions as laid down in their OMs dated 02-09-2008 and
subsequent instructions thereon. It also provides for reimbursement of Children Education
Allowance/Hostel Subsidy for the initial two year Diploma/Certificate Course from
Polytechnic / ITl / Engineering College after Class X.

[i] Instructions issued vide Board’s letter of even number dt. 18.04.2012 [RBE No.
52/2012] will come into effect for all recruitments against sports quota both through Talent
Scouting and Open Advertisement from the year 2013-14 onwards.
[ii] All recruitments against sports quota both through Talent Scouting and Open
Advertisement for the year 2012-13, will be done as per instructions issued vide Board’s
letter No. 2010/E[Sports]/4[1]/1[Policy] dated 31.12.2010 [RBE No.189B/2010], read with
modifications issued from time to time.
[iii] Any recruitment against sports quota for the year 2012-13 which has already been
completed and conducted by the Railways as per Board’s instructions dated 18.04.2012
[RBE No. 75/2012] remains valid.
2. Recruitment against sports quota both through Talent Scouting and Open
Advertisement for the year 2012-13 must be initiated before 30.11.2012 and finalized by
28.02.2013.

2. Recently, a question has been raised whether in view of the change in the rate of
leave salary during study leave in India, any revision in the terms given to Central
Government employees selected for the Jawaharlal Nehru Fellowship is called for. The
matter has been considered in this Ministry and the President is pleased to decide, in
consultation with the C&AG that in supersession of the earlier O.M. the following terms will
be given to Central Government employees who are awarded Jawaharlal Nehru Fellowship
in future in relaxation of Rule 51, 57 and 59 of Central Civil Services [Leave] Rules, 1972:
[i] They will be granted study leave for the entire period of the Fellowship;
[ii] They will be entitled to the benefits admissible to them in accordance with the
Fellowship and in addition, entitled to draw leave salary only [without allowances] equal
to the pay that they drew while on duty with the Government immediately before
proceeding on such leave.
[iii] Where considered necessary, the official may be allowed during the period of the
Fellowship, the continued use of the facility of the residential telephone officially allotted
to him, subject to payment by him of the bills for the rental and call charges of the
telephone.
2. In partial modification of the aforesaid O.M. the President is pleased to decided that
Central Government employees who are awarded Jawaharlal Nehru Fellowship will be
entitled to Dearness Allowance at the Central Government rates on the leave salary
admissible to them.
2. So for as persons serving in the Indian Audit & Accounts Departments are concerned,
these orders are being issued after consultation with the C&AG of India.
2. The rates of the Special Allowance, in future, would increase by 25% every time the
Dearness Allowance payable on revised pay scales goes up by 50%.
4. This has the sanction of the President and issues with the concurrence of the
Finance Directorate of the Ministry of Railways.

(i) If the relevant RRs provide for filling up of vacancies in a grade by Direct Recruitment,
induction of an employee to that grade through LDCE/GDCE may be treated as Direct
Recruitment for the purpose of grant of financial upgradation under MACPS. In such cases
past service rendered in a lower pay scale/Grade Pay shall NOT be counted for the purpose
of MACP Scheme.
(ii) if the relevant RRs prescribe a promotion Quota to be filled on the basis of LDCE/GDCE,
such appointment would be treated as promotion for the purpose of benefit under the
MACPS and in such cases, past regular service shall also be counted for further benefits, if
any, under the MACP Scheme.

clarified that as per RS(RP) Rules, 2008, a Railway servant has the option to have his pay
fixed from the date of his second promotion, if he has been granted two
promotions/upgradations between 01.01.2006 and 29.8.2008. In such cases, however, the
Railway Servant concerned will not be entitled to draw any arrears on account of 6th CPC
w.e.f.01.01.2006 till the date of effect of option exercised on second promotion.

(i) A person appointed as ‘Trainee’ enjoys the status of a Government servant from
initial day and will be allowed all the allowances and benefits allowed to a
government servant.
(ii) A person appointed as a ‘Trainee’ on compassionate grounds has to acquire
minimum educational qualifications in 5 years.
(iii) The probation period of a person appointed as ‘Trainee’ on compassionate
ground will begin only from the date he/she acquires minimum educational
qualification and such person will be on probation for a period specified in the
Recruitment Rules of the post / grade against which he/she is being appointed.
(iv) A ‘Trainee appointed on compassionate ground is entitled to all kinds of leave
applicable to a regular Railway servant.
(v) A person appointed as ‘Trainee’ shall be allowed Children Education Allowances
per the admissible rates.
(vi) A person appointed as ‘Trainee’ on compassionate ground would not be entitled
for Overtime Allowance during the period he/she continue as ‘Trainee’.
(vii) A ‘Trainee’ has the status of Government/Railway Servant from initial day, as
such, dependent of a person appointed on compassionate ground as ‘Trainee’
would be eligible for compassionate appointment in the event of his/her death in
harness/medical unfitness.
(viii) A ‘Trainee’ appointed on compassionate ground, till he/she acquires minimum
educational qualification would be allowed increment at normal rates in the pay
scale of -IS.
(ix) A person appointed as Trainee on compassionate ground, is eligible to Medical
benefits as available to holder of the post in pre-revised Scale of Rs. 4440-
7440 without any Grade Pay.

Based on the recommendations of 6 Central Pay Commission, the revised pay
structure of Rajbhasha staff of Zonal Railways was notified vide Board’s letter No. PC-
VI/2008/I/RSRP/1 dated 11.09.2008 and 19.11.2008. There have been demands regarding
improvement in the pay structure of above staff and an item has been raised by both the
Federations before Departmental Anomaly Committee also.
2. The issue of Rajbhasha Staff of Zonal Railways has been examined in consultation
with Ministry of Finance [Department of Expenditure]. The President is pleased to decide as
under:
[a] The Grade Pay [GP] of Rajbhasha Sahayak Grade II would be upgraded from
Rs.2800/- in PB-1 to that of GP of Rs.4200/- in PB-2 and it would be merged with Rajbhasha
Sahayak Grade I. The merged Grade would be designated as Jr. Translator.
[b] The future recruitment will be in the grade of GP Rs.4200/- i.e. the grade of Jr.
Translator through 100% direct recruitment and the education qualification of the entry
Grade [Jr. Translator] would be kept as Masters Degree. Detailed instructions in this regard
will be issued by Establishment Directorate separately.
[c] The existing Grade of Rajbhasha Supdt. In PB-2 GP Rs.4600 will henceforth be
designated as Sr. Translator in the existing pay structure.
[d] The grade of Rajbhasha Sahayak Grade II would be phased out by placing the
existing incumbents in the higher grade subject to fulfillment of educational qualification as
below:

[e] Those who do not possess the requisite qualifications as above may be
placed in the higher grade only on completion of six years of regular service in the
lower grade in pay scale Rs.4500-7000 [pre-revised]/PB-1 GP Rs.2800.
[f] The benefit would be extended on prospective basis i.e. from the date of
issue of these orders.

(iv) The availability of staff nominated on the basis of panel of promotion given by
DPC or Select List given by Selection Board will be decided as on 04.09.2008. In
case a staff from the panel given by DPC or Select List given by the Selection
Board has joined on or prior to 04.09.2008, then status of all the staff included in
panel given by DPC or Select List will be protected and all staff will be considered
available and their seniority determined by following the basic principle of
seniority, i.e., order of panel given by DPC or merit list given by Selection Board.
In case all the staff included in the panel given by DPC or Select List given by
Selection Board joins after 04.09.2008, then the seniority of such staff within a
grade, will be determined by placing them below all available staff as on
04.09.2008 but maintaining their inter-se seniority in order of panel of DPC or
merit list given by Selection Board.
3. All the cases of determination of seniority except merged MTS posts will be decided
accordingly. The issue of determination of seniority of merged MTS (erstwhile Group ‘D’)
posts would be taken up separately.

d) Retro-reflective clothing should be supplied timely to each individual; and
e) Two pairs of shoes will now form a part of the uniform of the Trackmen and hence, they
may be reimbursed Rs.900 p.a. However, the reimbursement is subject to the actual
procurement of shoes and submission of receipt thereof. As such, the reimbursement
should be given upto twice a year @ Rs.450 per reimbursement.

exceeded in case of any retired railway employees during the period of re-
engagement.
6. While engaging such staff and assigning duties to them, it must be ensured that safety
and other operational requirements are adequately addressed.
7. Remuneration to such staff be made as stipulated vide this Ministry’s letter No.
E[NG]II/2007/RC-4/CORE/1 dated 11.12.2009 [in each and every case of engagement
of retired employee, the daily allowances plus full pension should not exceed the last
pay drawn].
8. The scheme will be valid up to 14.09.2013.
9. Operation of the scheme will be subject to discharge of engaged staff immediately on
joining of selected candidates from RRBs.

2 ‘Wages’ for the purpose of calculating Productivity Linked Bonus shall include ‘Basic
pay’ as defined in the Railway Services ( Revised Pay) Rules, 2008 and dearness allowance
drawn during the financial year 2011-12. Other conditions of eligibility, method of calculation
of wages, etc., as prescribed in this Ministry’s instructions and clarifications issued from time
to time, shall remain unchanged.
3. It has also been decided that in the case of eligible employees mentioned in Para-1
above who were not placed under suspension, or had not quit service/retired/expired during
the financial year 2011-12 or were on leave where leave salary admissible is not less than
that admissible on leave on average pay, may be paid an amount of 8975/- towards
Productivity Linked Bonus for the financial year 2011-12. In the case of employees other
than those mentioned above, the amount of Productivity Linked Bonus may be calculated in
accordance with the extant instructions on the subject.
4. Further, in relaxation to the provisions in Rules 905(2), 908 and 909 of State Railway
Provident Fund Rules, as contained in Chapter 9 of R.I/1985 edition [2003 Reprint Edition],
such of the subscribers to the SRPF as are entitled to Productivity Linked Bonus may, if they
so desire, deposit the whole or part of the amount admissible under the Scheme in their
respective State Railway Provident Fund Accounts.
5. Disbursement of Productivity Linked Bonus for the financial year 2011-2012 to all
eligible non-gazetted Railway employees mentioned in para 1 above should be made on
priority and may be paid in Cash/ECS as per the salary mode before the ensuing Puja
/Dussehra holidays.

1. The applicant has also to prove that no other surviving member in the family , who
may have a prior entitlement for family pension, is eligible. For this purpose, the
above and / or any other documents, such as marriage/death / income certificates of
the other members, which may be essential in a given situation, may be used.
1. In terms of the OM dated 5th March, 1998, parents who were wholly dependent on the
deceased Government Servant when he/she was alive will also be entitled to Family
Pension with effect from 1st January, 1998 subject to the fulfillment of the other
conditions prescribed in this regard. Doubts have been raised whether parents of
Government Servants, who died prior to 1st January, 1998 will also be entitled to Family
Pension. It is clarified that Family Pension will be admissible in these cases subject to
the following:
a. The parents were wholly dependent on the Government Servant when he/she was alive;
b. The Government servant has not left behind a widow/widower, eligible son or daughter
or a widowed/divorced daughter, who will have a prior claim to Family Pension in the
order indicated;
c. All other prescribed conditions are fulfilled.
The Family Pension will, however, be payable only with effect from 1st January, 1998. It
will be the responsibility of the pension sanctioning authorities concerned to satisfy
themselves, based on a scrutiny of the service records and other relevant documents,
that the parents were, in fact, wholly dependent on the deceased Government Servant
when he/she was alive and that he/she has not left behind any of the other specified
beneficiaries who have a prior claim to the family pension.
d. The family pension wherever admissible to parents, the mother will receive the pension
first and after her death the father will receive the family pension.
Ministry of Agriculture, etc. are requested to bring the contents of this Office
Memorandum to the notice of their Controllers of Accounts, Pay & Accounts Officers and

Since KRCL have recently started issuing PRCP/Widow passes to their employees, it
has been decided that these passes should also be made valid to travel over Indian
Railways.
In this connection, it is clarified that such employees are entitled for one II class ‘A’
pass in a year even if they are eligible for only one set of privilege pass owing to the length
of their service.

Task Force Committee under Human Resource Reforms Committee for reviewing
Training Module for Personnel Department has submitted its report in respect of categories
of Chief Staff & Welfare Inspector and Office Superintendent [Personnel & other
Departments selected through LDCE Quota].
2. Existing Training Module of Office Superintendent and Chief Staff & Welfare
Inspector through 20% LDCE Quota provide for a training programme of 64 and 61 days
respectively. The Task Force in consultation with the stake holders have revised the training
period for both the categories to 21 working days. The training module along with course
contents for the above categories is enclosed at Annexure I and II and this has the approval
of Board.
3. It has been decided that there is a need for changing the existing methodology. At
the beginning of the training programme itself the trainees shall be provided with
comprehensive study material on each of the topics. The trainees are expected to read the
material and come prepared for discussion. At the beginning of the class a diagnostic test
should be conducted by way of Objective questions on the day’s topic which can be of 20
questions. Later on the instructor will provide all the answers to questions and discuss the
various related issues. However, no weightage will be given for the marks obtained in these
tests and would not be added in the marks scored for the final evaluation.
4. At the end of the training, the trainees are expected to come out with a suitable
module, check list, formats, work flow, flow charts and other tools and techniques to enable
processing of practical case, incorporating the best practices available on the Railways
/Divisions/Units.
5. Trainees should go on line for study tour to see the practical aspects of the Railway
system in relation to various departments covered in the training. Evaluation should
continue on the basis of Written Test to be conducted at the end of the training.

Kindly refer to instructions issued vide this office letter No.E(MPP)2000/3/8 dated
07.11.2002 (RBE No.202/2002) regarding imparting training in First Aid of five days’ duration
for the front line staff of Railways. In addition to the above, instructions for imparting training
on First Aid, Medical Care & Trauma Management to railway staff, involved in train operation
(Crew/Guard/SM/Controller/Gangmen/TTE/AC Staff) were issued vide Board’s letter
No.E(MPP)2010/3/65 dated 20.01.2012 (RBE No.11/2012) as part of the one day course on
“Threat Perception and Emergency Response”.
Railways are requested to ensure that the above instructions are fully implemented
and all concerned staff are adequately trained in rendering First Aid at the time of their
deployment at stations & trains.
The matter has been considered by the Board and in exercise of powers vested with
the full Board for making reasonable relaxations in public interest in all or any of the existing
provisions regarding allotment/retention of Railway quarters and charging the rent therefor
for a class/group of employees, in continuation of Board’s letter under reference the Board
have now decided that the officers and staff posted at Jammu-Udhampur-Srinagar-
Baramulla Project may be permitted to retain Railway accommodation at their previous place
of posting on normal rent upto March, 2018 or completion of the project, whichever is earlier.

AIRF and NFIR during the PREM meeting have expressed apprehensions on
creation of posts with reference to Board’s letter dated 04.09.2012 (RBE 96/2012).
It is clarified that the Railways can create posts with matching saving only, on
account of new organization and new assets like new trains, new locos, extra coaches, etc.
as per Board’s letter No. E(G)76 EC 2-7 dated 17.11.79 read with Board’s letter’s No
.E(G)82 EC 2-2 dated 12.07.1984 and E(NG)II/91/PO/Genl./2 dated 24.06.1991
respectively. Board’s letter No. E(G)2003 EC 2-3 dated 31.10.2003 deals with creation of
posts for maintenance of rakes for new trains on matching savings basis failing which by
debits from the vacancy bank, to be set off first by future credits. Board have further
permitted DRM’s to create posts in safety and operational categories on 1:1 basis for new
assets as envisaged in Board’s letter No. E(MPP)2003/1/88 dated 05.04.2006 with the
approval of the General Manager.

In all the above cases, posts should be created only in accordance with the
prescribed norms or yardsticks with the prior concurrence of FA&CAO after clearly
establishing that the need cannot be met by readjustment.
2. Except to the extent shown above, there is a complete ban on creation of posts in all
other categories, including staff required for expansion of any present activity. Whereas
under earlier orders, Railways could create posts in relaxation of the ban orders if the
cost could be met from matching surrender without any increase in man power, the
position is no longer so and it requires Cabinet’s approval for creation of posts with
corresponding saving.
3. The Ministry of Railways would also wish to reiterate that before creating additional
posts in terms of the clarifications given above, the GMs should ensure in consultation
with their FA&CAOs that the requirements cannot be met in whole or in part from
existing sanctions or by measures such as tightening up of the links of Drivers/Guards
etc. reducing to the utmost the number of running staff engaged in stationary duties or
even by drafting other categories of staff, who may have spells of slack periods. As
creation of additional posts and filling them up on the basis of fresh recruitment will have
adverse repercussion on the profitability of the Rlys. GMs should exercise utmost care
in achieving maximum economy in working expenses and should resort to creation of
addl. posts only when they are inescapable and even then only to the minimum extent
necessary. In this connection the results of annual review made by the Efficiency Bureau
on the staff strength of the different departments of various Rlys., pointing out areas
where the strength is in excess of the requirement, are also to be borne in mind by the
GMs in sanctioning additional staff.
4. This issues with the concurrence of the Finance Directorate of the Ministry of
Railways.
2. While processing the cases of extension of deputation terms beyond three years, it has
been observed that the deputationists are assigned higher grade pays even in some cases
two grades above that of the grade pay of his/her parent Railway in violation of the above
provisions. When the cases of extension of deputation beyond five years reached to
DOP&T, that Department have taken this scenario seriously and asked for certain
clarification which are required to be sent.
3. The matter has been considered. It is advised that the instructions of DOP&T and
DPE issued to the Railways from time to time, may be followed scrupulously and Railway
employees may not be allowed to join other organizations on deputation basis in higher
grade pay and also not allowed to overstay while on deputation so that such piquant
situation can be avoided in future.

IMPORTANT LETTERS/INSTRUCTIONS ISSUED AS NON-SERIAL CIRCULARS

Tuition Fee, admission fee, laboratory fee, special fee charged for
agriculture, electronics, music or any other subject, Fee charged for
practical work under the programme of work experience, fee paid for the
use of any aid or appliance by the child, library fee, games/sports fee and
fee for extra-curricular activities. This also includes reimbursement for
purchase of one set of text books and notebooks, two sets of uniforms and
one set of school shoes which can be claimed for a child, in a year.
2. Instances have come to notice that claims of reimbursement of CEA in favour
of wards of Railway employees studying in Railway schools/colleges are being
disallowed on certain Divisions/ Units on the grounds that it is applicable only to
children studying in recognised private schools.
3. Board’s instructions on the subject of allowing reimbursement of education
expenses to the eligible wards of Railway employees are unambiguous. Board have
not defined the type of school i.e., government or private and also because the CEA
includes components like reimbursement of expenditure incurred on purchase of one
set of text books and note books, two sets of uniforms and one set of school shoes in
a year, claims for reimbursement of CEA submitted by a Railway servant whose
ward is studying in a Railway School should be allowed, provided the other
conditions are fulfilled.
4. This issues with the approval of the competent authority.

Further, the illustration under Para 28 also demonstrates that 1st financial
upgradation would be admissible on completion of 10 years of regular service from
the date of actual joining of the post in the entry grade, 2 nd financial upgradation on
completion of 20 years service from the date of initial appointment or 10 years from
the date of 1st financial upgradation/promotion, whichever is earlier, and 3 rd financial
upgradation would be admissible on completion of 30 years service from the date of
initial appointment or 10 years from the date of 2nd financial upgradation/ promotion,
whichever is earlier.
It is, therefore, advised that financial upgradation under MACP Scheme may
be regulated strictly as per the stipulations contained in Board’s letter of even
number dated 10.06.2009[RBE No.101/2009].

[i] While identifying sections for the purpose of grant of minimum guaranteed
kilometrage in terms of para 3.12 of Board’s letter No. E[P&A]II-80/RS-10
dated 17.7.1981, short sections worked by diesel or electric locos may also be
identified for this purpose if, generally, it is not feasible to give extended run or
allow one or more round trips within the duty hours. The above point may
also be taken into account while reviewing the identification of
sections/circumstances as order by Board’s letters No. E[P&A]II-84/JCM/1
dated 2.2.85 and 18.2.85.
[ii] It is understood that, on some of the Railways the running staff who are
unable to complete the run on an identified section due to some reason or the
other and are relieved enroute, are granted only the actual kilometrage
instead of 120 km. It is clarified that such situations should also be covered
by the scope of the review required to be carried out in terms of the Board’s
letter No. E[P&A]II-84/JCM/1 dated 18.2.85.
[iii] Another point raised by the Federation was that, on some of the Railways,
payment of the minimum guaranteed kilometrage of 120 Km. to the running
staff working on identified sections includes payment for travelling as
passengers on duty before or after working trains. It is clarified that the
running staff working on identified sections should be granted 120 Kms. For
working the section and in addition, they should be paid half the kilometrage
covered while travelling as passengers on duty before or after working the
identified section.

In terms of Board’s instructions contained in their letter dated [SC No. 85/09], eligible
employees were granted financial upgradation under the scheme of MACP. Item 16 of
Annexure-1 therein stipulates that on grant of financial upgradation under the MACPS, there
shall be no change in the designation, classification or higher status, however, financial and
certain other benefits which are linked to the pay drawn by an employee, such as HBA,
allotment of Government accommodation.
The matter has been examined and it is clarified that as per the Audit instructions
below Rule 1601 of IREC Vol. II, a Government servant's claim to travelling allowance should
be regulated by the rules in force at the time of journey, in respect of which it is made, was
undertaken.
Rule 1602 [2] of IREC Vol. II envisages that where a railway servant is promoted or
reverted or is granted an increased rate of pay with retrospective effect, no revision of claims
for travelling allowance is permissible, in respect of the period intervening between the date
of promotion or reversion or grant of increased rate of pay, and that on which it is notified,
unless it is clear that there has been an actual change of duties.
Board in their letter dated 09.12.2011 [SC No. 156/2011] issued instructions
that in exceptional circumstances, if the candidates being considered for
appointment on compassionate grounds, land loser, accident victims, LARSGESS
and Substitutes, do not possess the prescribed minimum educational qualification,
they may be appointed in -1S Pay Band without any grade pay. The period spent in
-1S pay band by the future recruits will not be counted as service for any purpose.
Regular pay bands are to be given only on acquiring the minimum educational
qualification prescribed under the recruitment rules.
It is further stipulated in Rule 2009 of IREC Vol.II that a copy of the orders
sanctioning a railway servant’s transfer to foreign service must always be
communicated to the Accounts Officer by the authority by whom the transfer is
sanctioned. The railway servant himself should, without delay, communicate a copy to
the Accounts Officer and take his instructions as to the officer to whom he is to account
for the contribution; report to the latter officer the time and date of all transfers of charge
to which he is a party when proceeding on, while in, and on return from, foreign service
and furnish from time to time particulars regarding his pay in foreign service, leave
taken by him, his postal address and any other information which that Accounts officer
may require.
Rule 2012 of IREC Vol.II provide that contribution for leave salary or pension due
in respect of a railway servant on foreign service should be paid annually within 15 days
from the end of each financial year or at the end of the foreign service if the deputation
on foreign service expires before the end of a financial year, and if the payment is not
made within the said period, interest must be paid to Government on the unpaid
contribution, unless it is specifically remitted by the President at the rate of two paise a
day per Rs.100 from the date of expiry of the period of 15 days upto the date on which
the contribution is finally paid. The interest shall be paid by the railway servant or the
foreign employer according as the contribution is paid by the former or the latter.
While reiterating the above codal provisions for strict adherence, it is advised that
the instructions regarding payment of FSC charges should invariably be incorporated in
the office orders whenever the officers/staff are sent on deputation to foreign service so
that the foreign service contributions are remitted regularly to the Accounts Department.

Henceforth, the Substitute Bungalow Peons who fulfill all the norms of
recruitment should be engaged, duly completing all the formalities viz., medical
examination, verification of original documents of age, community, qualification etc.,
within a period of Sixty days from the date of communication of sanction of the
General Manager, failing which, the sanction of the General Manager is deemed to
have been withdrawn. In such a case, the Division/Officer has to send a fresh
proposal for General Manager’s sanction giving reasons for not acting upon the
earlier sanction.
The joining report of the candidate, countersigned by the officer under whom
the Substitute Bungalow Peon is working should be sent to the Cadre Controlling
Officer for information and record.
A large number of Assistant Loco Pilots recruited recently were directed for
undergoing the prescribed training in anticipation of receipt of the report of verification of
character and antecedents from Police authorities. However, it has been brought to the
notice that even though the training period of these candidates is completed / likely to be
completed shortly the reports in many cases are yet to be received by the Divisions.
[i] The divisions have already sent the forms to the District Police authorities and a
delay occurred more than a month.
[ii] The candidates should be asked to produce character certificate in the prescribed
form [copy of the proforma enclosed] from First Cass Executive Magistrate
[including District Magistrate or Sub-Divisional Magistrate].
[iii] Undertaking by the candidate that he is aware that his appointment is provisional
and that he can be terminated at any time in case of adverse reports.
[iv] It is also informed that if the character and antecedents information is not received
even after completion of 3 months from the date of issue of the letters to the
concerned authorities, Personnel Inspectors /Welfare Inspector should be deputed
for obtaining the same.

It has come to notice that on certain Divisions, running staff who are medically
decategorised and kept on supernumerary posts after implementation of VI CPC
scales of pay w.e.f. 01.01.06, are being allowed ALK, which is against Board’s
instructions on the subject.

decategorised running staff kept on supernumerary posts in terms of Board’s
instructions supra. Allowance in lieu of Kilometerage ( ALK) paid to such staff

To avoid grievances from the retiring employees at a later date, it has been decided
that a pre-retirement counseling session be organized at the Divisional/ Workshop level on
the 10th of every month by calling the officers and employees retiring on superannuation
during that month. Staff retiring under the scheme of LARSGESS may also be called for
the above session.
During the counseling session, the retiring employees should be given a copy of the
draft calculation sheet with details of pension, commutation value, retirement gratuity,
leave encashment, group insurance etc. duly explaining the post retirement benefits
including medical facilities availability of holiday homes etc. Also, few tips on how to spend
post-retirement life can be given by Sr.DPOs/WPOs to the retiring officers/staff.
In respect of open line staff coming from various stations to Divisional Headquarters
the period of absence may be treated as ‘On Duty’. They may also be issued duty pass of
the entitled class for self only and TA/DA allowed.

APO/Bills retiring employees and their wards and
invariably indicated on the Pension Booklets to
facilitate quick intimation of various settlement
dues /documents to be submitted etc.
Railway Board from whom a clarification was sought as to whether erstwhile Group
‘D’ employees who were placed in GP 1800 in PB-1 after implementation of VI CPC scales
of pay and subsequently retired, are to be treated as Group ‘C’ for the purpose of issuing
Post Retirement Complimentary Passes or otherwise, have vide letter No. E[W]2010/PS5-
8/4 dated 02.03.2012, clarified that since all the posts carrying GP 1800 in PB-1 have been
classified as Group ‘C’ the employees retiring from these Group ‘C’ posts in PB-1 GP 1800
would automatically be entitled for Post Retirement Complimentary Passes/widow passes
as per Group ‘C’ entitlement [copy enclosed].

Henceforth, all proposals emanating from the Divisions requiring the personal
approval of General Manager / CPO and remarks on DOP/DPG references, CA-iii
cases, references from MP/MLA etc. should be personally signed by Sr.DPO except
in emergencies, in the absence of Sr.DPOs, in order to avoid delay in a particular
case, DPOs can sign.
Rule 1630[2] envisages that when a railway servant performs journey by road
between stations connected by rail, he may be granted travelling allowance if the head of
department in the case of gazetted railway servant and DRM in the case of non-gazetted
railway servant is satisfied that the journey by road was necessary in the interest of railway
service, such as saving of public time, or inspection of work en-route etc.
1. The PHOD/CHOD setting the question paper will bring the required number of copies of
the question paper in bilingual form in sealed cover/covers (room-wise) to the examination
centre or send the sealed cover/covers through an SG/JAG officer of his department
nominated for the purpose. The question papers in the sealed cover/covers are to be
handed over to the candidates in the examination hall/halls after obtaining
attestation/signatures of two candidates appearing for the examination on each of the sealed
cover/covers before opening the sealed cover/covers.
2. The Officer setting the question paper will arrange required number of Invigilators,
including stand-by, drawn from his department for the conduct of the examination.
3. The nominated Invigilators will collect the required number of answer books at the
examination centre from the APO/SPO (Gaz) and sign on each page of the answer book
before handing over the same to the candidates in the examination hall.
4. The aquittance roll of the candidates appearing in the examination will be taken by the
Personnel Branch Staff nominated for the purpose.
5. On completion of the written examination, the Invigilators will collect the answer books
from all the candidates and after ensuring that unwritten portions are crossed etc., will hand
them over to APO/SPO (Gaz) on duty who should in turn hand them over to Dy.CPO/Gaz or
the nominated officer for coding.
i) In case of 70% departmental selections coding would be done immediately after the
completion of the examination by allotting dummy/code numbers to the answer books in the
examination centre itself by Dy.CPO/Gaz. or the Personnel Officer nominated for the
purpose and the coded answer books kept in a sealed cover or covers depending on the
number of books duly obtaining the attestation/signatures of 2(two) candidates on the sealed
cover/covers in token of having sealed in their presence.
(ii) Coded fly leaves separated from the answer books will be kept in a separate cover and
sealed clearly indicating on the cover the date and time of sealing.
(iii) In case of 30% LDCE quota selections, since the number of candidates appearing is
large and the coding of the answer books will take more time, the examination will be
conducted in two spells at the following timings:-
Coding of Answer Books for Paper-I can be completed in the same manner as above in
the Two and half hours time interval and Paper-II on completion of the examination.
(iv) In case of selections to Group ‘B’ posts of APO ( both 70% & 30%) and PS Gr. I,
coding/decoding would be done by the SG/JAG officer of the Accounts department
nominated by FA&CAO. After the examination, the answer books would be sealed in the
examination hall duly taking the signature/attestation of two candidates and forwarded to the
nominated Accounts Officer for coding/decoding as is being done hitherto.
7. Dy.CPO/Gaz. will send the sealed cover/covers containing the coded answer books to the
evaluating officer/officers on the same day or on the following working day. The coded fly
leaves will also be kept under the safe custody of the personnel officer who coded the
answer books. The evaluating officer, after evaluation, should be advised to return the
cover/covers containing the signatures of the candidates also in which the coded answer
books were sent for evaluation to the Cadre controlling officer i.e. Dy.CPO/Gaz, for record.
8. On receipt of the evaluated answer books from the evaluating officer, the personnel
officer who has coded the answer books will decode with the help of fly leaves kept in his
custody and publish the written test results.
Duties of Officer nominated to set the Question Paper and Duties of Officer nominated to
evaluate the answer books is furnished in Annexure ‘A’ and ‘B’ for information and
guidance. The Personnel Officer in-charge of the selection should ensure that a copy of the
duties be sent to the paper setting officer and paper evaluating officer, as the case may be.
The Cadre Controlling officer should send a copy of the notification containing the details of
the date of written examination/supplementary examination [where permissible] and
subsequent changes, if any, in the dates of written examination/ venue etc, to Sr. VO[G] in
advance.
i) Questions should be based on the subjects included in syllabus. Syllabus which will
be part of initial notification will be sent by Personnel Branch along with letter of
nomination/intimation to question paper setting officer.
iii) Allot at least 10% of the total marks for the written test on “Official Language Policy &
Rules”. The question on Official Language Policy & Rules is mandatory. This is an
optional question. However, answering of this question shall be optional for the
candidate and should not be made compulsory.
vi) If question paper consists of both objective and descriptive type of questions,
objective and descriptive type questions should be given in two separate
parts. In main as well as supplementary examination, candidate should be
given uniform choice in answering number of questions in objective and
descriptive type of questions.
2. The paper setting officer shall ensure that the sealed cover/covers containing the
required number of question papers (as advised by Personnel Branch) in bilingual (Hindi &
English) is brought to the examination hall on the day of the examination by self or through
a SG/JAG officer nominated by him for conducting the examination.
3. It will be the duty of paper setting officer to make available the question papers in
English and in Hindi. Setting of question paper in Hindi is mandatory.
4. The paper setting officer will be responsible for ensuring confidentiality of the
question paper.
5. The paper setting officer would send two copies of the question paper (bilingual) to
Dy.CPO/Gaz after the examination is over. One copy of question paper would be retained
for official record in the Personnel department and another copy would be sent to the
paper evaluating officer/officers.
6. The paper setting officer should send the key to the objective type questions in a
sealed cover to Dy.CPO/Gaz for onward transmission to the paper evaluating officer in the
same sealed condition. In the case of 70% selection since only one paper is involved, one
sealed cover containing the key may be sent. In the case of 30% LDCE selection since two
papers (Paper-I & Paper-II) are involved, the key to Paper-I and Paper-II may be sent
separately i.e. in two separate sealed covers for onward transmission to the evaluating
officer[s] in the same sealed condition.

Annexure ‘B’
Duties of the Evaluating Officer
While evaluating the answer books the following precautions have to be taken:
1. On receipt of the sealed packets, he/she shall open the same and count them to
ensure that the answer books are intact.
2. Before starting evaluation, it shall be checked up to ensure that the candidate has
answered the specified number of questions only and marks should not be awarded
for additional questions answered.
3. If any candidate has attempted more than the required number of questions, answers
to the prescribed number of questions alone should be evaluated in the order they
appear on the answer sheets and the remaining answers should be ignored, with a
remark ‘not evaluated, being extra.’ For example, if the maximum number of
questions to be attempted is 4 out of 7 and the candidate has attempted say, 6
questions, only the first 4 answers in the order they appear in the answer book
should be evaluated and the remaining answers should be ignored. If a sketch etc.,
required to be done on a separate page has been attempted, it may be duly referred
to in the main body of the answer sheet to indicate after which question it was
attempted. When a question consists of sub-questions with a choice, the same
principle as indicated above should be followed.
4. The evaluator should use pen only for evaluation. There shall be no erasures, over-
writings, additions or alterations in the marks allotted for the answers and in case any
such alteration is to be made, the original mark should be cut off so as to retain its
legibility and fresh marks allotted and attested by the evaluating officer.
5. The evaluator shall not evaluate answer books which do not bear code number and
also the answer books which even remotely indicate the identity of the candidates. In
such cases, the evaluator shall send a separate communication to this effect while
returning the answer sheets to Dy.CPO/Gaz.
6. Evaluate the answers properly and uniformly, fairly, reasonably, objectively and
judiciously. For award of marks uniformly, the total points to be written for maximum
marks may be jotted down and for each point the marks to be awarded determined
before commencing the evaluation. Also keep ready correct answers for both
objective and narrative type questions and only then commence the process of
evaluation to the narrative type questions. Award marks strictly based on the
correctness and contents of the answers given by the candidates. The evaluating
officer should go through the key to the objective type questions provided by the
paper setting officer, before evaluating and arrive at the correctness, keeping in view
the latest Board’s instructions/ local instructions, if any. In case of alternative
possible correct answers to the objective type questions written by the candidates,
other than the one provided in the key, he should consult the paper setting officer
and evaluate the answers duly apprising the chairman of the selection board.
6.1 On each page at the bottom of the answer script, total marks scored on that page
should be indicated so that totaling mistakes can be avoided.
6.2. In the answers to objective type questions, wherever such questions are included in
the written examination, no corrections of any type should be permitted. In case any
correction is made, that answer shall not be evaluated at all. The correction may be
any one of the following types [the list is illustrative and not exhaustive]:
[a] Cutting;
[b] Over writing;
[c] Erasing;
[d] Scoring off a ticked answer in multiple-choice and ticking another answer; &
[e] Modifying the answer in any way.
It is mentioned here that the term objective type questions will include questions of the
following types:
7. The evaluating officer after evaluating the answer book should indicate on the top
sheet of answer book –
9. The officer evaluating the answer books shall not give any grace marks under any
circumstances. This is strictly prohibited.
10. The marks obtained by the candidates should not be rounded off while totaling. The
aggregate also should be left as such without any rounding off.
11. The evaluation of the answer books should be completed with least delay preferably
within 45 days (maximum limit).

Sub: Payment of stitching charges- procedure.

In terms of extant instructions Public Image categories of Railway
employees who come in contact with public is to be given good quality cloth in
lieu of stitched uniforms and paid stitching charges as per the rates laid down
by Board from time to time. As per Board’s instructions dated 17.4.2001 [SCR
SC No. 104/2001] it should be ensured that the reimbursement of stitching
charges at the prescribed rates are to be allowed only after the stitched
uniforms are produced within a reasonable period, say one month, which are
duly stamped with an indelible ink at an appropriate place on the wrong side
of the stitched dress for identification.
However, Rule 402 of IREC Vol.I, 1985 Edn. Third Reprint Edn. 2008 envisages that
no person who has been dismissed from Government service or convicted for a criminal
offence shall be re-employed, without the sanction of the President, or if the employment or
re-employment is to a Group C or Group D post, without the sanction of the General
Manager. Note below Rule 402 states that if a Railway servant who is dismissed, removed
or compulsorily retired from service is to be re-employed by an authority vested with such
powers either under rule 402 IREC-I or delegations made thereunder, such authority can
exercise powers only after obtaining approval of certain specific authority.
Item [7] of Part ‘F’ of SOP [Establishment Matters- Non Gazetted], General Manager
has delegated the powers of re-employment of non-gazetted staff after resignation/
retrenchment or termination of service [except removal and dismissal resulting from
disciplinary action]. Serial No. [6] under Remarks Column of the same item clearly stipulates
that no employee who had been dismissed from service or convicted for a criminal offence
should be re-employed without the prior sanction of the General Manager. Thus it is clear
that the powers of re-employment vested with the GM under Rule 402 in the case of persons
who were removed/dismissed resulting from disciplinary action have not been re-delegated
to PHODs or any other lower authority.
Therefore under Rule 402 of IREC Volume I General Manager only is empowered
to re-appoint an employee who has been dismissed/removed/ compulsorily retired as a result
of disciplinary action.

Attention is invited to FA&CAO/SC’s letter No. A/ICC/MACP dated 26.3.2012
wherein instructions were issued that all the cases involving MACPS are to be invariably
got vetted by the respective associate accounts before the issue of memorandum and
drawal of pay and allowances. It was also indicated in the above letter that proceedings
[consisting of working sheets & notings] of the screening committee is to be submitted for
ready reference.
Based on the above, CPO addressed a letter to FA&CAO stating that once a
screening committee is constituted and their recommendations are accepted by the
competent authority, it becomes sacrosanct and no other authority except a higher
authority or Vigilance can question the proceedings or the correctness by the accepting
authority. Therefore, the letter of FA&CAO instructing that the cases involving MACPS
are to be invariably got vetted before the issue of memorandum and that proceedings
consisting of working sheets, notings of screening committee should also be submitted for
ready reference is not correct and interferes with the functioning of selection/ screening
committee and such a stand is not acceptable.
All the Sr.DPOs/WPOs are advised not to adhere to the provision of submitting
the copy of the proceedings & notings of the screening committee to associate finance.
However, a copy of memorandum granting the benefit of financial upgradations to eligible
staff together with copy of service record only needs to be sent to associate finance for
pre-vetting of pay fixations.
DOP&T’s instructions circulated under SC No. 146/06 laid down the procedure
for recruitment of physically handicapped persons, according to which, the competent
authority to issue a disability certificate shall be a medical board constituted by the
Central or the State Government. With the issue of these instructions, certification of
physical fitness of persons being considered for recruitment against PH quota by the
Railway Medical authorities is not necessary.
As per the extant instructions of Railway Board, the 3% quota meant for the
Physically Handicapped is to be calculated on total recruitments done in a year while
recruitments can be confined to the indentified categories of posts.
The matter has been considered and it is decided that henceforth, a copy of
Pension Calculation Sheet may also be provided to the pensioners with the
PPO/revised PPOs, if not already being provided.

Sub: Revisionary powers in disciplinary cases.

Attention is invited to Board’s RBE No.28/04 on the above subject, circulated under
SC No. 30/2004 [copy enclosed]. In terms of Board’s instructions contained therein,
Appellate authority can also exercise revisionary power when in a case no appeal has been
preferred in terms of Rule 25(1)(iv). However, for an appellate authority to exercise
revisionary power, this authority has to be of the rank of DRM and above. In other words, an
authority upto the rank of ADRM cannot exercise revisionary powers if it happens to be the
appellate authority in the case if no appeal has been preferred in terms of Rule 25[1][iv].
Revisionary powers will be exercised by the appellate authority only for conducting suo-motu
revision. The time limits laid down in Rule 25(5) also apply in cases of revision done by the
appellate authorities.
There are certain aberrations on the Divisions in the exercise of Revisionary powers
by ADRMs. It is clarified that if ADRM is the revising authority in a case, he can exercise
revisionary powers, suo-motu or otherwise, in terms of Rule 25(1][v] of RS [D&A] Rules,
1968. The revision petitions, if any, submitted by the employees may be disposed of
keeping in view the provisions contained in RS[D&A] Rules, 1968.
This issues with the approval of Competent authority.

Sub: Revisionary powers in disciplinary cases.
The provisions regarding revisionary powers in disciplinary cases are contained
in Rule 25 of Railway Servants (Discipline & Appeal) Rules, 1968. Doubts in this respect
have been raised by various railways from time to time particularly regarding the
exercise of revisionary powers by an appellate authority. The position in regard to Rule
25 is clarified in the succeeding paragraphs.
2. In terms of Rule 25(1)(v), an officer of the rank of Deputy HOD can also exercise
revisionary powers, provided he is otherwise competent to conduct revision in the case.
Revisionary powers can be exercised both suo-moto or on consideration of a revision
petition. However, suo-moto revision can be done subject to the time limits prescribed in
Rule 25(5).
2.1 Appellate authority can also exercise revisionary power when in a case no appeal
has been preferred in terms of Rule 25(1)(iv). However, for an appellate authority to
exercise revisionary power, this authority has to be of the rank of DRM and above. In
other words, an authority upto the rank of ADRM cannot exercise revisionary powers if it
happens to be the appellate authority in the case. Revisionary powers will be exercised
by the appellate authority only for conducting suo moto revision. The time limits laid
down in Rule 25(5) also apply in cases of revision done by the appellate authorities.
3. The provision of para 20(d) in the Master Circular No.67 may accordingly be read
as under:-
“(d) The revising authority has to be higher in rank than the Appellate Authority
where:-
(i) an appeal has been preferred; or
(ii) where the time limit prescribed for ‘revision to be made by the Appellate
Authority’, as laid down in Rule 25(5) of RS(D&A) Rules has expired.
The above stipulation does not apply to the revisions made by President.

Railway servants may also make a request in writing to the appointing authority to
accept the Voluntary Retirement by giving a notice of less than three months duly giving
reasons therefor. On receipt of the request the appointing authority may consider such
request for curtailment of the period of notice of three months if it is satisfied that the
curtailment will not cause any administrative inconvenience and subject to the condition
that the railway servant shall not apply for commutation of a part of his pension before
the expiry of the period of notice of three months.
The appointing authority in relation to this rule means the authority which is
competent to make appointments to the service or post from which the railway servant
seeks voluntary retirement.
In certain categories, orders for filling up the higher grade posts by Direct
Recruitment or by promotions/postings are issued with the approval of Head of the
Department, being Headquarters controlled posts. Although JA Grade officers are the
appointing authorities in respect of posts in non-gazetted cadre, they are not competent
to accept the request for Voluntary retirement of employees working against headquarters
controlled posts since the promotions/postings to these posts are ordered with the
approval of the HOD. Therefore, in future the requests for Voluntary Retirement received
from employees working against headquarters controlled posts, including the waiver of
notice period for Voluntary retirement, should be forwarded to the concerned Cadre
Officers in this office for obtaining the approval or otherwise from the respective HOD,
which should be communicated immediately in terms of item 9 of Part-F of Schedule of
Powers,2009. The Divisions should also indicate the position of DAR cases, if any,
pending or contemplated duly indicating whether the penalty of removal or dismissal
would be warranted in such case[s], SPE/Vigilance, HBA clearance, ECCS clearance in
the case of members of the Society, etc. together with the request of the employee.
This issues with the approval of CPO.

Doubts have been raised as to whether the Junior Stenographers who were
granted advance increments for acquiring proficiency in higher speeds in stenography
can be allowed to continue to draw these advance increments even after they have been
granted the financial upgradation under MACPS, or otherwise.
While promotions are ordered in a hierarchy of posts as per the avenue chart, the
financial upgradation under MACPS need not be to the next promotional post as per the
avenue chart. The financial upgradation is given to the next higher grade pay, even
though such a post may not be falling under the hierarchy of promotion.
This issues with the concurrence of FA&CAO and approval of the competent
authority.
Doubts have been raised by the Divisions whether in a situation where the caste
certificate [sub-caste] submitted by the candidate differs from that of the ex-employee
[father /mother] though they belong to the same family, appointment on compassionate
grounds can be considered treating the candidate as ‘unreserved’ or otherwise.
This is in supersession of the instructions on the subject and issues with the approval
of competent authority.

Para 104 of Chapter I, Section B of IREM Volume I, Revised Edition 1989, stipulates
that all appointments will be made on probation for two years. For trainees or apprentices
appointed to a working post after the conclusion of their training, the probationary period
commences on the date of such appointment.

2. The cut off date for reckoning the eligibility of a railway employee and his ward is 30 th
June. The last date for submission of requests is 31st July and the last date for withdrawal of
such requests is 30th September of the respective year. The requests under the SRRS are
thereafter to be processed by the railways accordingly. Request for retirement may be
accepted only if the ward is found suitable for recruitment in all respects including medical
fitness. As such, retirement of the employee and recruitment of the ward takes place
simultaneously.
3. In view of the upper age limit for the employees seeking retirement, the process of
recruitment of wards is required to be completed by the end of the respective year so that
the concerned employees should not cross upper age limit maximum by more than six
months. Instructions in this regard were also issued vide Board’s letter of even number
dated 25.07.2006.
4. It has come to the notice that the instructions conveyed vide Board’s letter dt.
25.7.2006 are not being followed by the Railways and they are taking much time in
completing the process of recruitment of the wards with the result the concerned employees
cross upper age limit by more than 1-2 years. As such the purpose of introduction of the
scheme is being defeated.
5. Board has taken a serious view in the matter. It is , therefore, reiterated that process
of recruitment of eligible wards of the eligible employees should be completed well in time so
as the retirement of the employee and recruitment of the ward take place by 31 st December
of the respective year positively as per the time schedule enclosed.
6. Further while submitting the panel of successful wards for recruitment to the
competent authority for approval, the concerned CPO should also certify that he was
personally satisfied that the whole process of recruitment of wards has been completed
within the time schedule fixed by Railway Board.
Note: In case 2nd chance to qualify written test is given to any ward in terms of Railway
Board’s letter dated 25.7.2006, the same may be given after a gap of 15 to 30 days. Such
cases should be finalized within a month’s time after the date of written test for 2nd chance.

FA&CAO/SC’s letter dated 17.07.2012 quoted therein is forwarded for information, guidance

There are instances where the leave to staff is being sanctioned by the competent
authority as leave without pay [LWP] with/without medical certificate. In terms of para 539 0f
IREM, EOL [Extra Ordinary Leave] can be granted to an employee where no leave is
admissible or other leave is admissible but the employee applies for grant of EOL. Since the
EOL as well as LWP is without pay, the sanctioned LWP is taken as EOL.
Now a doubt has arisen whether the period of such LWP [with/without medical
certificate] which is covered by sanction can be reckoned for computing regular service for
the purpose of granting benefit under MACPS.

For pensioners retired before 21.04.1999, option for Fixed Medical Allowance [FMA]
would be considered by pension disbursing authority[bank] in terms of provisions/guidelines
contained in Board’s letter referred to above.
