11 AN ORDINANCE PROHIBITING THE THROWING, LITTERING AND DISPOSAL OF
12 GARBAGE OR WASTE MATTER IN PUBLIC PLACES AND OTHER AREAS NOT DULY
13 DESIGNATED AS DISPOSAL SITE, AND PROVIDING PENALTIES THEREOF.

15 WHEREAS, the general welfare clause under Section 16 of R.A. 7160, otherwise
16 known as the Local Government Code of 1991, provides in part that local government
17 units shall ensure and support, among other things, the perseveration of the comfort
18 and convenience of their inhabitants within their respective territorial jurisdictions;
19
20 WHEREAS, R.A. 7160 likewise provides that local government units shall
21 endeavor to be self-reliant and shall continue exercising the powers and discharging
22 the duties and functions currently vested upon them. They shall also discharge the
23 functions and responsibilities of national agencies and offices devolved to them
24 pursuant to this Code. Local government units shall likewise exercise such other
25 powers and discharge such other functions and responsibilities as are necessary,
26 appropriate, or incidental to efficient and effective provisions of the basic services and
27 facilities such as the formulation of pollution control law and other laws on the
28 protection of the environment;

30 WHEREAS, Section 3(i) of R.A. 7160 provides that local government units shall
31 share with the national government unit the responsibility in the management and
32 maintenance of ecological balance within the territorial jurisdiction;
33
34 WHEREAS, Section 468 (a)(4)(i) of R.A. 7160 also empowers the Sangguniang
35 Panlalawigan to approve ordinance adopting measures and safeguards against
36 pollution and for the preservation of the natural ecosystem in the province, in
37 consonance with approved standards on human settlements and environmental
38 sanitation;

40 WHEREAS, the Provincial Government of Ilocos Norte firmly believes that a clean
41 and tidy community fosters concern for the environment. To this end, there is a need
42 to intensify the campaign on proper waste disposal to prevent ecological and
43 environmental degradation and instill a sense of discipline, social responsibility and
44 awareness for the environment to promote ecological justice and sustainable
45 development;

47 NOW, THEREFORE, be it enacted, as it is hereby enacted by the Sangguniang
48 Panlalawigan of Ilocos Norte, by virtue of the powers vested in it by law, in session duly
49 assembled that:

51 Section 1. TITLE OF THE ORDINANCE. This Ordinance shall be known as the
52 “Ilocos Norte Anti-Littering Ordinance).”

1 Section 2. COVERAGE. This Ordinance shall apply to all individual residents,
2 transients, residential houses, commercial establishments such as but not limited to
3 groceries, department stores, private or public markets, talipapa, sari-sari stores,
4 restaurants, hotels, institutions like schools, hospitals, churches, offices; industrial
5 establishments of any kind; in all public places such as parks, drainage canals,
6 culverts, roadsides, rivers, riverbanks, creeks, beaches, streets, alleys, and other areas
7 not duly designated herein as garbage disposal site, within the territorial jurisdiction of
8 PGIN.

10 Section 3. DEFINITION OF TERMS. As used in the Ordinance, the following
11 terms are defined as follows:

13 a) Garbage or Waste Matter – used interchangeably in this Ordinance, refers to
14 solid waste matters, trash, litters, junks, debris, rubbish, excrements, manure,
15 bits and pieces of surplus or leftovers, both biodegradable and non-
16 biodegradable; also includes industrial wastes and liquid matters such as urine,
17 used oil and other liquid wastes.

19 b) Throwing/littering – shall refer to the act of scattering, cluttering, dumping,
20 untidy depositing and/or the smattering of garbage or waste matter in areas
21 prohibited in this Ordinance;
22
23 c) Duly Designated Areas – shall refer to specific areas identified as landfill site,
24 compost pit, or materials recovery facilities; also refers to garbage disposal
25 device or equipment such as trash bins/receptacles and garbage collection
26 vehicles put in place by the General Services Office in certain public areas,
27 including the garbage receptacles inside commercial establishments or
28 institutional building provided by the owners thereof;

30 d) Disposal – the act of disposing or placement of garbage or waste matter;
31
32 e) Garbage Disposal Site – shall refer to Engineered Landfill Site, and Materials
33 Recovery Facilities;
34
35 f) Material Recovery Facility – is a place where waste are either made into compost
36 and/or recycled. It shall include solid waste transfer station or sorting station,
37 drop-off center, a composting facility, and a recycling facility;
38
39 g) Compost pit – it is a sunken area, hole or cavity in the ground for organic or
40 biodegradable wastes;
41
42 h) Biodegradable Garbage or Compostable Waste – refers to kitchen wastes, garden
43 wastes, animal wastes, and human wastes. It shall include any vegetable matter,
44 trash, soiled tissue, papers, spoiled food, fruits, kitchen left-overs and other
45 organic wastes easily destroyed or digested by bacteria or oxidized and reduced
46 to compost and can be used as soil conditioners or fertilizers;
47
48 i) Non-Biodegradable Garbage or Recycled Waste – shall refer to solid wastes that
49 do not easily decompose or decay by bacterial action or oxidation. Rather, it
50 takes a long time of exposure to moisture before it gets degraded, neutralized
51 and reduced to compost; e.g. tin cans, plastics, bottles, plastic containers,
52 glasses, Styrofoam, aluminum, steel, GI sheets, pipes, metals, rubbers,
53 asbestos, used tires, vehicle parts and construction debits;

1 j) Residual Garbage or Non-Recyclable Wastes – shall refer to useless matters that
2 included disposable diapers, ceramics, candy wrappers/sachets, used rugs, PVC
3 containers, containers made from multiple layers of plastic such as squeezable
4 bottles, and the like;

6 k) Hazardous Waste – shall refer to batteries, paints, hospital wastes such as
7 syringes, used/broken radios/television sets, refrigerators, and other appliances
8 or equipment;
9
10 l) Waste Disposal Device or Equipment – refers to garbage collection trucks and
11 garbage receptacles;
12
13 m) Public Places – shall include the beaches, path roads, pathways, vegetation
14 areas, streets, sidewalks, highways, parks, playgrounds, schools, government
15 offices and any other edifices publicly used;
16
17 n) Waterways – shall include canals, drainage, sewers, creeks, streams, rivers,
18 swamps and the like;
19
20 o) Immediate Surroundings – shall refer to the frontage or vicinity including up to
21 the mid-span of the road, street, alley or avenue from the edge of the street
22 gutter, sidewalks of residential houses, hotels, resorts, business/commercial
23 establishments or offices whether private or public;
24
25 p) Industrial Waste – are organic and inorganic residues, hazardous materials,
26 hazardous and toxic chemicals, metals and wood;
27
28 Section 4. PROHIBITED ACTS. The following acts shall be prohibited:
29
30 a) To dump, throw, or litter garbage, refuse, or any form of solid waste in public
31 places and immediate surroundings, including vacant lots, rivers, canals,
32 drainage and other water ways;
33
34 b) To bring out garbage on the property line of residential and commercial
35 establishments or any part of the road which must be stored in properly sealed
36 plastic containers and to be brought outside only upon arrival of the authorized
37 garbage hauling trucks in their respective localities;
38
39 c) To place, store or dump construction wastes or debris, junked or under repair
40 vehicles, dilapidated appliances and other immovable objects in any part of the
41 road, street or avenue or in any sidewalk which may obstruct or impede the
42 vehicular and pedestrian traffic;
43
44 d) It is unlawful for the operators of public conveyance, trucks, lorries, tankers,
45 delivery vans, and other commercial and transportation facilities to spill, scatter
46 or litter any form of waste in a public area; and
47
48 e) To spit or urinate in public places or areas not proper for spitting or urinating,
49 or not designated for spitting or urinating.

1 Section 5. PENALTY. Any person or entity found to be violating the provisions
2 of this Ordinance shall have the option to pay the following penalty in lieu of his
3 prosecution in the proper court:
4 a) For Individuals/Home Establishment Owners:
5
6 First Offense – Php 500.00 Fine
7 Second Offense – Php 1,000.00 Fine
8 Third Offense – Php 1,500.00 Fine
9
10 b) For Commercial/Industrial/Institutional Entities:

12 First Offense – Php 1,000.00 Fine
13 Second Offense – Php 2,000.00 Fine
14 Third Offense – Php 3,000.00 Fine
15
16 The above-enumerated fine shall be paid to the Office of the Provincial Treasurer
17 within three (3) working days from date of apprehension; otherwise, the violator shall
18 be prosecuted in court and imposed a maximum penalty of Three Thousand Pesos
19 (Php3,000.00) or made to render a maximum of FORTY (40) hours of Community
20 Service or both fine and Community Service at the discretion of the Court.

22 The imposition of Community Service shall be under the supervision of the
23 Provincial General Services Office or his/her authorized representative.

25 Minors apprehended shall be instructed to pick-up their litters or waste
26 scattered for proper disposal and the Provincial Social Welfare and Development Officer
27 or authorized representative shall call the attention of the parents/guardian or
28 concerned school teacher/authority for counseling.

30 Section 6. CITATION TICKET. For violating the provisions of this Ordinance,
31 the Apprehending Officer shall issue a Citation Ticket;
32
33 Section 7. CITIZEN’S ARREST. Notwithstanding the Apprehending Officer’s
34 authority in the preceding section, any citizen who is willing, able and is a witness to
35 any violation of this Ordinance can apprehend the offender and call the Apprehending
36 Officer deputized and authorized in the preceding section for appropriate action;

38 Section 8. ENFORCEMENT. The Local Chief Executive is hereby empowered to
39 authorize and deputize Apprehending Officers other than police officers and ordinance
40 officers such as Provincial Auxiliary Police, Sanitary Inspectors, General Services Office
41 personnel, market personnel, collectors, and members of environmental groups or
42 Civil Society Organizations.

44 Section 9. PROCEEDS OF FINES. Administrative fines collected through the
45 Citation Ticket issued shall accrue to PGIN under a Special Fund exclusively to be
46 expended for the project, programs and activities which include but not limited to:
47
48 a) Sanitation;
49 b) Waste management;
50 c) Clean and Green program;
51 d) Linis Probinsya; and
52 e) Other environment and health project developments.

1 Section 10. SEPERABILITY CLAUSE. If any provision of this Ordinance is
2 declared unconstitutional, the same shall not affect the validity and effectivity of the
3 other provisions hereof.

5 Section 11. REPEALING CLAUSE. Any ordinance and executive order
6 inconsistent herewith shall be deemed repealed.
7
8 Section 12. EFFECTIVITY. This ordinance shall take effect immediately upon its
9 approval and publication.
