DEED OF GRANT OF
USUFRUCTUARY RIGHTS
KNOW ALL MEN BY THESE PRESENTS:

THIS DEED OF GRANT OF USUFRUCTUARY RIGHTS, made, executed,


and entered into by and between:

HEIRS OF ROSALINA G. GARDOSE, all of legal age, resident of Barangay


Taslan, Tapaz, Capiz, herein after referred to as “GRANTOR”,

-and-

MUNICIPALITY OF TAPAZ, CAPIZ, a Local Government Unit with office


address at Municipal Hall, Brgy. Poblacion, Municipality of Tapaz, Capiz
represented herein by Municipal Mayor HON. ROBERTO O. PALOMAR,
herein after referred to as “GRANTEE.”

WITNESSETH:

WHEREAS, the undersigned Grantor are the surviving heirs of Rosalinda Gardose
legitimate owner of a parcel of land identified as Cadastral Lot No. 109 under Certificate
of Title P-4019 situated at Barangay Taslan, Tapaz, Capiz more particularly described as
follows:

“A parcel of land known as Cadastral Lot No.109 , containing an area of Twenty Five
Thousand Six Hundred Twenty Five (25,625) square meters, more or less; bounded on
the North by Lot No. 97; on the East by Lot No. 112; and on the South by Lot No.
114; and on the West by Lot No. 110/109:

WHEREAS, the GRANTOR desires to give the GRANTEE the right of usufruct
over the portions of the said real property with the latter having to use it for the
INSTALLATION OF TWELVE STEEL (12) POST for the Solar Power Street Light to
the use and enjoyment of the Barangay in return for assuming the obligation to preserve
the property during the term of this usufruct.

NOW THEREFORE, for and in consideration of the mutual agreements, covenant


and stipulations hereinafter set forth, the GRANTOR hereby transfer and conveys unto the
GRANTEE by way of usufruct the afore-described parcel of land, subject to the following
terms and conditions,

1. This grant of Usufruct shall be valid and binding even after the lifetime of
GRANTOR, and must be respected by its the heirs and assigns;

2. The grant of Usufruct shall cover only portions of the property with an area of
ONE (1) SQUARE METER FOR EVERY POST WITH A TOTAL OF
TWELVE (12) SQUARE METERS of which the Municipality of Tapaz and
the National Government, or its representatives shall construct TWELVE (12)
STEEL POST for the Solar Power Street Lighting Project, under the Increased
Community Safety and Security at Night Through Installation of Solar Power
Street Light KALAHI Project in Barangay Taslan, Municipality of Tapaz,
Capiz;

IN WITNESS WHEREOF, GRANTOR and the GRANTEE in order to


immediately give effect to this deed have herewith affixed their signatures this ____day of
