SUBJECT: A Matter Respecting Personal Information about an Identifiable


Individual, under s. 239(2) of the Municipal Act, 2001 – Interim
Chief Administrative Officer

RECOMMENDATIONS

That Regional Council AUTHORIZE the appointment Mr. Maurice Lewis as Interim
Chief Administrative Officer (CAO) until a permanent CAO is hired; and

That the Regional Clerk BE AUTHORIZED to bring forward a bylaw for the appointment
of an Interim CAO, effective May 20, 2016 or the last date of employment of the current
CAO, Mr. Harry Schlange.

KEY FACTS

 Mr. Harry Schlange, Niagara Region CAO, resigned his post on April 8, 2016,
with an anticipated end date of May 20, 2016.
 The Municipal Act, 2001, s. 229, outlines the responsibilities of a municipal CAO.
 Prudent, for the sake of leadership and business continuity, to appoint an Interim
CAO for the duration of the CAO recruitment process.
 The Regional Chair undertook consultation with the Corporate Leadership Team
in regard to arrangements for an Interim CAO.
 Mr. Maurice Lewis, Commissioner of Corporate Services, is recommended as the
Interim CAO, effective May 20, 2106 or the last date of employment of the
current CAO, Mr. Harry Schlange.

Financial

All salary and payroll related costs are included in the existing, and Council approved,
2016 budget.

Corporate

The Interim CAO will assume all duties and responsibilities of the CAO, as per the CAO
job description, and the accountabilities outlined in the Municipal Act, 2001, s. 229.

Governmental Partners

The Municipal Act, s. 229, outlines the responsibilities of the CAO, as per the following:

229. A municipality may appoint a chief administrative officer who shall be


responsible for,
(a) exercising general control and management of the affairs of the municipality for
the purpose of ensuring the efficient and effective operation of the municipality;
and
(b) performing such other duties as are assigned by the municipality. 2001, c. 25,
s. 229.

The Interim CAO will function as a key point of contact for municipal, provincial and
federal leadership staff.

Public and/or Service Users

The Interim CAO will function as the senior appointed official of the regional municipality
and provide leadership in the areas of finance, human resources and business/service
delivery, to implement Council’s Strategic Priorities, and is accountable to Regional
Council.

ANALYSIS

The Regional Chair undertook consultation with the Corporate Leadership Team (CLT)
to discuss the role of the Interim CAO, and current organizational priorities. Further to
that consultation, and an assessment of organizational capacity, is it recommended that
Mr. Maurice Lewis, assume the role of Interim CAO for the duration of the recruitment
for a permanent CAO.

ALTERNATIVES REVIEWED

For the sake of leadership and business continuity, it is prudent to appoint an Interim
CAO for the duration of the recruitment for a permanent CAO. In order to provide
consistency of leadership, a review of suitable internal candidates for the role of Interim
CAO was undertaken. Further to that review, and consultation with CLT, an internal
candidate has been identified and is agreeable to this recommendation being brought
forward to Regional Council for consideration.

ORIGIN OF REPORT

The purpose of this report is to seek authorization from Regional Council to appoint an
Interim CAO, for the duration of the recruitment for a permanent CAO.
