8. Have creditors petition and affidavit verying the petition been served
on the Judgment Debtor at least eight days before hearing of the
petition?
1. Always have a checklist when handling a bankruptcy matter to avoid omission to file
documents within the stipulated time frame.
3. A status report folder should be updated for each and every file to indicate what has been
completed and what needs to be completed. This would avoid miscommunication and
failure to comply with procedures when the file is transferred to another lawyer or
handled by more than one lawyer.
4. All correspondence relating to the file must be kept in orderly fashion for easy reference.

5. The client’s original documents must be safeguarded in a secure compartment. Missing
or destroyed documents may lead to failure to comply with the limitation period
applicable as replacement of such documents requires time.
6. Lawyers should specify their work limit in their retainer to avoid a claim in negligence or
omission on their part.
