MAY. 20) Dae National Power Corporation ot Date: CIRCULAR, NEG ABMINIGTRATNE OHBER-NO. : O- Od SUBJECT: Guidelines, Rules and Regulations Governing the Issuance of Appropriate Permit, Clearance, Authorities for Various Land Use and Resource Utilization Activities Inside NPC Reservations Pursuant to the provisions of Republic Act No. 6395 dated September 10, 1971 otherwise known as the Revised Charter of NPC; Executive Order Nos. 224 and 258, dated July 16, 1987 and July 10, 1995, respectively; PD No. 1515 as amended by PD No. 1749; and Ministry Order No. 83-01-13, dated November 22, 1982, the following guidelines, rules, regulations, terms and conditions governing the issuance of appropriate permit/clearance/authority for various land use and resource utilization activities inside NPC-managed reservations are hereby issued for compliance and guidance of all concerned: SECTION 1. DEFINITION OF TERMS a. Abandoned Forest Products — forest products left within forestlands, alienable and disposable lands and private lands inside NPC reservations, whose owners or claimants cannot be identified or that which have been unclaimed for more than fifteen (15) days; . Application — refers to the formal application (Annex B ~ Form 1) for any land use or resource utilization activity with the required supporting documents submitted and the corresponding fees and charges paid by the applicant or his duly authorized representative to NPC; +6, Available Area — an area within the NPC reservations which is approved and allowed by NPC for utilization and/or establishment of any land use project; ‘d. Bona fide Resident — is a person who has continuously resided in the place for at least one (1) year prior to the filing of the application as certified by the Punong Barangay of the barangay where the land use activity/project will be undertaken; -e. Certificates of Origin — refer to any of the following documents, namely: Certificate of Timber Origin (CTO), Certificate of Lumber Origin (CLO), Certificate of Non-Timber Forest Products Origin (CNFPO), issued by the concerned WAO to accompany the transport of timber, lumber or non-timber forest products, showing the volume, type of 1 Ry *% product, place of loading, conveyance used, date of transport, source and destination/consignee of the products to be transported; Corporation — the National Power Corporation; Drifted Logs - logs that are washed out by floods and/or water currents; 7 Environmentally Critical Area (ECA) - an area delineated as, environmentally sensitive such that significant environmental impacts are expected if certain types of proposed projects or programs are located, developed or implemented in the area; For this purpose, all NPC reservations are classified as environmentally critical areas; Environmental Compliance Certificate (ECC) ~2 document issued - by the President of the Philippines or his duly authorized representative certifying that the project under consideration will not bring about an unacceptable environmental impact and has a_ satisfactory Environmental Management Plan (EMP); Environmentally Critical Project (ECP) - development activities/project which has a high probability/potential for negative environmental impacts; Environmental Impact - effect/consequence of a development project - (industrial, commercial, housing, etc.) on the environment and the surrounding community in the reservations; Environmental Impact Assessment (EIA) — process that involves evaluating and predicting the likely impacts of a project (including cumulative impacts) on the environment during construction, commissioning, operation and abandonment. It also includes designing appropriate preventive, mitigating and enhancement measures addressing these consequences to protect the environment and the community's welfare; . Fire Damaged Trees ~ trees damaged by fire that are either dead or living but with nil chance of survival; Forest Charges (FC) — refer to a levy being imposed by the government on timber and other forest products cut in forestlands; (See Annex J-Sample Computation Sheet 4) Forest products - means timber, pulpwood, firewood, bark, tree top, « resin, gum, wood, oll, honey, beeswax, nipa, rattan, or other forest growth such as grass, shrub, and flowering plant, the associated water, fish, game, scenic, historical, recreational and geologic resources in forest lands; Forest Products Gathering Authority (FPGA) - Refers to an authority issued by the NPC President or his duly authorized representative , to cut/gather/collect and utilize forest products planted 2 £ ow po or grown within NPC reservations for personal use, livelihood purposes, government projects, public safety and scientific use (Annex F- Form 3-B); . Forest Products for Personal Use — Refers to forest products which are granted for household consumption or use which in case of timber must be those planted by the applicant in his private titled/property and in no case shall exceed five (5) cubic meter per head of the family per year, Forest Products for Livelihood — Refers to forest products which are granted for the purpose of earning a living. In case of timber harvesting, is limited to the 3° and 4" group species suitable for fuel wood or small scale cottage industries such as handicrafts, novelty items, etc; Forest Products for Government Projects — Refers to salvageable - forest products granted for the construction of government or semi- government infrastructure projects; Gratuitous Permits — Refers to such permits which the President or * the Manager of NPC may issue gratuitously to other government agencies, education and health institutions and duly registered private entities engaged in government approved projects to undertake certain land uselresource utilization activity including the collection or Utilization of a specified number/volume of forest products including wild flora and fauna within NPC reservations for scientific research purposes subject to provisions of applicable law; Initial Environmental Examination - Initial Environmental , Examination (IEE) - document required for projects located within ECA's; Land Use / Resource Utilization Activity - any activity that involves utilization of the land and/or any resources found within NPC reservations; . Land Use Permit (LUP) — a document granted to qualified land use applicants who complied with the requirements and conditions set by the NPC, authorizing the conduct of specified land use activities on public lands inside reservations subject of NPC control and jurisdiction (Annex E - Form 3-A); Long Term Activity — shall refer to projects which has a duration of One (1) year or more; - Premium Species — shall refer to trees, the wood of which has special - characteristics, such as strength, durability, beauty, scarcity and rarity or is used for special purpose. For this purpose, the list of species grouping provided in Annex A of the DENR Administrative Order No. 63 Series of 2000 (DAO 2000-63) is hereby adopted and made an integral part of this Order as Annex N. : Coes Z. PrivatefTitled Land ~ refers to land subject of a validly issued title belonging to any private person or entity; aa,Public Land — term generally used to describe the land of public domain that has not been subjected to private rights and is devoted for public use; bb.Reforestation Deposit - refers to an amount collected from the applicant for a land use activity as part of the performance bond purposely for replacement of trees and other forest products that will be damaged or affected by the operation or implementation of the project pursuant on the guidelines prescribed therefor; (See Sample ‘Computation in Annex J-Computation Sheet 3) cc. Replacement Ratio — refers to the number of seedlings required to be planted and maintained by the proponent for at least three (3) years for every trees/sapling/seedlings cut or damaged due to the operation or implementation of a land use activity/project; dd.NPC-Managed Reservation - refers to both geothermal and watershed reservations established and proclaimed by the President of the Philippines for specific purpose or purposes in accordance with law. This shall include all reservations enumerated in Section 3 of this Order; ee. Salvageable Forest Product — refers to dead or dying standing trees, . abandoned logs, drifted logs, sunken logs, uprooted and fire/typhoon damaged trees, tree stumps, tops and branches or fallen forest products; ff. Special Tree Cutting Permit (STCP) - refers to a permit issued by the Manager, WMD to cut trees and/or other minor forest products due to site preparation activity of an authorized long term land use/activity (Annex G - Form 3-C); gg. Sunken Logs — logs found at the bottom of a river/stream, lakes and other bodies of water, hh. Typhoon Damaged Trees — trees whose tops, branches and trunks were blown away or destroyed by strong wind that are either dead or living but with nil chance of survival; ji, Unavailable Area - portion inside NPC-managed reservations - designated as strict protection zone where any destructive /extractive land use or resource utilization activity is prohibited, jj. Uprooted Trees ~ trees that were blown down due to natural causes, the roots of which are exposed above the ground and have a nil chance of survival; kk. WAO — refers to the Watershed Area Office (previously Watershed ‘Area Team) of NPC tasked to do watershed management functions specific to the area mentioned in Section 3 hereof, ll. WMD - refers to the Watershed Management Department of the National Power Corporation; mm. Wood Recovery Permit (WRP) - refers to a permit issued by the Manager, WMD to gather/collect /retrieve and utilize or dispose of salvageable forest products (Annex H - Form 3-D); SECTION 2. SCOPE ~ The Land Use Permit (LUP) shall apply to public lands inside reservations subject of NPC's complete control and jurisdiction as well as in those areas and reservations being managed by NPC by virtue of Memorandum of Agreement (MOA) with other government agencies. The Special Tree Cutling Permit (STGP) and Wood Recovery Permit (WRP) and Forest Products Gathering Authority (FPGA) shall apply to both public and private lands under NPC control and jurisdiction. The issuance of a Gratuitous Permit shall be governed by this Order for areas within NPC Reservations and by the provisions of the MOA with other government agencies for areas and reservations being managed by NPC by virtue of Memorandum of Agreement (MOA). SECTION 3. COVERAGE The provisions of these guidelines shall apply to the following: A. Reservations over which NPC exercises complete jurisdiction, control and regulation pursuant to E. O. Nos. 224 and 258; Proclamation Nos. 2320, 663 and 441 as enumerated hereunder thus: ‘a. Upper Agno Watershed Reservation as covered by - Proclamation No. 548; b. Angat Watershed Reservation as covered by Proclamation Nos. 505 and 599; c. Caliraya-Lumot Watershed Reservation as covered by . Proclamation No. 573; d. Makiling-Banahaw Geothermal Reservations as covered by Proclamation No. 1111; e. Buhi-Barit Watershed as covered by Proclamation No. 573; a a <= Tiwi Geothermal Reservation as covered by Presidential Proclamation No. 739; Lower Agno (Immediate) Watershed Reservation as per proclamation No. 2320; Amlan Watershed Reservation as covered by Prociam: No. 663. and Talomo Reservation as per Prociamation No. 441. B. Reservations under Memoranda of Agreement (MOA) entered into by / the NPC with the DENR and other government agencies for co- management arrangements, covering portions of the following five (5) watersheds; a b, ‘Agus River Watershed covered by MOA dated 18 April 2005; Lake Lanao Watershed Reservation covered by the MOA dated 4 July 2003; Pulangi River/Nabalintongan (Kulaman) River Watershed covered by the MOA dated 2 July 2004; Pantabangan-Carranglan Watershed Reserve covered by the MOA dated 4 April 1997; and Magat River Forest Reserve also covered by the MOA dated April 1997. SECTION 4. ISSUING AUTHORITY The person(s) and/or official(s) authorized to approve or deny application for permit/authority shall be in accordance to: the prescribed Issuing Authority as follows: A. OTHER LAND USE AND RESOURCE UTILIZATION ACTIVITIES Permit/authority for other land use and resource utilization activities not covered under subsections A and B above, may be approved or denied by the President of NPC upon recommendation of the Manager, WMD. D. DELEGATION OF AUTHORITY In the event of an emergency or such situation when going through the usual or prescribed process of application is deemed impracticable or may result to possible damage or injury to life or property, the Chief of concerned WAO/Field unit is hereby authorized to issue temporary permit/authority for / land use/resource utlization activities under subsections A and B above, provided that such delegated authority shall be limited in scope or to such extent necessary to avoid or minimize damage and temporary in nature until the existence of said emergency or situation shall have already ceased. Provided, further, that the applicant granted with temporary permit/authority shall comply with the requirements as may be imposed by NPC subsequently upon cessation of the said emergency or situation. For this purpose, the Manager of WMD shall issue supplementary guidelines providing for specific procedure and requirement in order to effectively implement this provision SECTION 5. DUTIES AND RESPONSIBILITIES A. The Watershed Area Office The respective Watershed Area Office shall be responsible for the following: 4. Receives application for land use and resource utilization and ~ makes initial determination if: a) the applicant is qualified to apply; ) the activity/project being applied for is allowed c) the proposed project site is within NPC jurisdiction; (n) 3. Check the completeness of the required initial documents as, enumerated in Section 7 hereof; 2. Conduct ocular inspection of the proposed projectisite using appropriate form (Annex C ~ Inspection Form) and initial inventory of affected forest resources (i. @. timber, and other minor forest products) based on the “Standardized Guidelines and Procedure” {Annex M-1~3) to determine extent of possible damage and tecommen appropriate mitigating measures; Ie HE Be pf ¥ Coordinate with the concemed Independent Power Producers ~ (IPPs) and contractors/operators of privatized power plants and seek their comments on the impact of the activities applied for on their operation and their plan for expansion; ‘Assess the appropriate application and inspection fee to be paid by “ the applicant directly to the NPC Cashier; Alternatively, applicant may deposit such assessed amount in a specified account denominated as Forest Protection, Management, Reforestation and Development Fund (FPMRDF) at any branch of Land Bank of the Philippines, after which, a copy of the deposit/payment slip shall be presented to NPC Cashier for the issuance of the Official Receipt (OR); Conduct joint inspection and validation activities with the representatives from WMD and the applicant, including preparatory coordination activity and other logistical requirements subject to pertinent provisions in Annex L-1; Moritor all land use/resource utilization projects/activity inside their respective areas of responsibility; Conduet on-the-spot and/or regular monitoring and inspection to - check compliance of the applicant with the terms and conditions set by NPC; Maintains and updates a database of all land use/resource “ utilization activity within its area of jurisdiction containing relevant information and prepares periodic or annual report to be submitted to the Manager of WMD; Report all incidents of violations of the terms and conditions set by the NPC and other pertinent environmental laws; 10. Participate actively in the prosecution of violation of this Order and other pertinent laws; and 11.Perform such other duties and functions necessary and incidental to the above duties and responsibilities and such other powers which are necessary to the effective implementation of this Order. The Watershed Management Department The Watershed Management Department shall be respon for the following: 1. Receives application for land use and/or resource utilization submitted directly to WMD and forward or transmit the same to the concerned WAO for its appropriate action; 2. Reviews and evaluates all applications endorsed by the WAO and » checks the completeness and veracity of the documents submitted, paying close attention to the authenticity of the Land Title, Tax Declaration and other proof of ownership , and all other pertinent legal documents and clearances issued by other agencies; 3. Promptly retums to the concerned WAO, any application found to be incomplete or lacking with any of the initial requirements except item nos. 1, 3, and 6 thereof, in which cases, WMD instructs the WAO to advise the applicant to submit such lacking document within ten (10) days from receipt of notice. Failure by the applicant to comply will resuit in the denial of his application; 4. If necessary, conducts field inspection and validation of the documents and initial inventory report jointly with the representative(s) of WAO and the applicant and prepares an inspection and validation report thereafter using appropriate form (Annex D — Validation Form); 5. Makes final assessment of fees and charges based on the result of the inspection and validation and informs the applicant directly or through the WAO with further instructions for payment relative thereto and the submission of the final requirements which include but not limited to those enumerated in Section 7(B) hereof, 6. If so warranted, prepares andior issues the appropriate permit Jauthority or recommends the approval thereof by the NPC President or otherwise informs the applicant through the concerned WAO of any action taken or decision rendered by NPC and the basis thereof; 7. If necessary, conducts on the spot and/or regular monitoring and inspection to check compliance of the applicant with the terms and conditions set by NPC; 8. Maintains and updates a database of all applications for permitfauthority acted upon containing relevant information and riodic or annual report to be submitted to the President 9. Determines in coordination with WAO any appropriate action or measures to undertake regarding any violation of the terms and conditions committed by the applicant, his representative or any other party; 10.Perform such other duties and functions necessary and incidental to the above duties and responsibilities and such other powers which are necessary to the effective implementation of this Order. SECTION 6. QUALIFIED APPLICANTS 10 ~! The following persons may, subject to specific qualifications, apply for land use or resource utilization activity inside NPC reservations as enumerated in Section 3 of this Order: a. An individual, of-legal age and bona fide resident of the barangay where land use activity/project will be undertaken; b. ‘Owner of the titled land or his/her duly authorized representative; c. Government/semi-govemmentiprivate group/institution through their authorized representative; d. Corporation, association, business organizations and/or duly authorized representative. SECTION 7. REQUIREMENTS Prior to the implementation of any land use or resourée utilization activity inside NPC reservations, the following initial requirements, as may be applicable and warranted by the nature of the land uselresource utilization activity being applied for, shall be submitted to NPC, to wit: A Initial Requirements Three (3) copies of duly accomplished application forms (Annex B), - secured from respective WAO or WMD; . Payment of a non-refundable-Application and Inspection Fee based on the schedule of fees as prescribed in the herein attached ‘Schedule of Fees and Charges (Annex L); Clearance from other concerned agencies, local government units and IPPs or plant ownerloperator stating among others that the projectlactivity being applied for will not affect their present ‘operation or any future plan for development or expansion; Duly notarized ~-memorandum of agreement with lot ‘owners/claimants in case of projects affecting private lands; . Location map of the area applied for within the reservation, drawn to scale at least 1:10,000 or preferably larger and topographic map (drawn to scale at least 1:1,000 or larger); . Recent photographs of the area being applied taken from four different angles/direction i.e. North, South, East and West; feasibility study or development, management and/or operational plan (as applicable) of the proposed land use/resource utilization activity to be undertaken; 8. Authenticated copy of Land title/certificate including annotations at the back thereof, 9. Copy of the preceding year's real property and tax declaration and receipt of realty pai 10.Certificate of Registration from SEC, DTI, CDA, as well as corporate/company constitution and by-laws, as applicable; 11.nitial snventory Report prepared and signed jointly by a licensed Forester and the Proponent, reviewed by the concerned WAO, in case tree cutting and forest products harvesting/utilization is involved following the procedures and format prescribed in Annex M-1 hereof, 42. Initial Environmental Examination: (IEE) prepared and duly signed by an accredited preparer; 13.When already issued by the DENR, a copy of the. Environmental Compliance Certificate (ECC); and 44LOther documents as may be required based on the nature of activity B. Final Requirements Upon completion of the initial documentary and field validation, the following'final documents must be submitted to WMD, to wit: 1. Final Inventory Report of timber and non-t validated by the concemed WMD personn imber forest products as 2. .Payment of the remaining fees and charges assessed based on the actual inspection and validation by the concemed WMD personnel ; 3. Draft Reforestation Plan prepared and signed jointly by a licensed Forester and the Proponent for projects/activities requiring the cutting of trees and other vegetations; Note: Final Reforestation Plan shall be submitted by the proponent and approved by NPC upon determination of the final replacement ratio considering the adjustment after scaling of logs which were actually cut/damaged; 4. Comprehensive’ compilation of all relevant documents including but not limited to the initial requirements enumerated in Sec. 7(A) and items 1-3 above; Three (3) identical hardeopies preferably bookbound and a Softcopy thereof shall be submitted directly to WMD or through the concerned WAO which shall forward the same to WMD. To guide the applicants and the evaluator hereof, the Manager of WMD may also issue a supplemental guideline which will provide for specific requirements for each of the activities/iand uses that may be allowed under this Order. SECTION 8. TERMS AND CONDITIONS Without prejudice to other conditions that may be imposed by NPC on a case to case basis, the following guidelines, terms and conditions shall apply to all proposed and/or existing land use activity/projects within NPC reservations: a, Any land use activity undertaken/implemented inside the reservations, with /ptior authority from the President of NPC, shall continue to be governed by the terms and conditions stipulated thereof provided they are not inconsistent with the provisions of this Order; b. Areas covered by present or planned energy development project(s)/activity(ies) of the Corporation shail not be available for any land use activity, However, when needed for public use, the NPC President, through WMD may make available certain unavailable areas within the reservations for specific land use(s) or activity(ies) subject to provisions of existing laws; c. Any permit or authority granted by the President of NPC, to develop/utiize area(s) within the reservations for specific land use(s) or activity(ies) is non-transferable and/or shallnot be used for any other purpose(s) unless otherwise authorized by President, NPC; d. That the grantee understands that-exploration of indigenous energy is still a priority in the area and in the event of its need for energy exploration, the applicant shall, without objection or unnecessary delay, allow the government's expropriation of land and its development for the purpose of national development; e. That the permittee shall ensure that -no cutting of trees and other vegetation shall be undertaken nor shall any human activities be conducted on other areas of the reservation including those areas designated as “Buffer Zone” without the necessary authority/permit duly issued by NPC; {That in cases where the land use would likely to affect trees and other vegetation, the grantee shall cause or endeavor to exert all practical means to save those treesisaplings and seedlings from being cut or damaged, by modifying the plan or design in such a way as to incorporate the trees therein or reduce the area proposed to be used, among other measures; g. That in case, the removal of trees is necessary and unavoidable, a Tree Cutting Permit may be issued by NPC, provided however, that relocation/transplanting of trees through earthballing method should first be resorted to whenever practicable and the expenses therefor shall be for the account of the permittee; .. That the terms and conditions of the Tree Cutting/Earthballing Permit shall form an integral part of the Land Use Permit and any violation thereof shall, in addition to the appropriate penalties to be imposed therefor, be a ground for its cancellation; That the cut trees and other minor forest products shall be"tumed-over to the concemed NPC Watershed Area Office (WAO) for proper management and cisposition in consonance with existing regulations; That in cases where the actual volume of logs recovered exceeds the volume determined in the Final Inventory Report, an adjustment shall be made on the fees and charges and the replacement ratio which shall be collected from the Proponeni/permittee; That the permittee shal conduct or cause to implement reforestation activity to replace the cutlballed/damaged trees/seedlings and saplings based on the following replacement ratio: * One Hundred (100) seedings for every premium species of trees/sapling/seediings cut/balled/damaged; + Seventy Five (75) seedlings for every softwood or furiture/construction species of trees/sepling/seediings cul/balled/damaged; and * Fifty (50) seedlings for other species of trees/saplings cut/balled/damaged; That in case of failure to tum over the volume of wood materials covered by this permit or that other trees/seediings/sepling shall be cut or damaged which are not covered by an approved authorityipermit, without prejudice to other penalties which may be imposed by NPC such as but not limited to Gayment of four (4) times the prevailing market price of the wood materials, the permittee shall in addition be ‘required to pay the amount necessary to implement additional reforestation activity folowing the replacement scheme hereunder specified: * One Thousand Five Hundred (1,500) seedlings per cubic meter of trees not tumed over to NPC; « One Thousand (1,000) seedings per premium species of seediings/sapiing cut; and «Five Hundred (500) seediings per species other than premium species of seedings/sapiings illegally cut ; That in connection with the immediately preceding items () and (K) above, the permittee shall, within Ten (10) days from receipt of the adjusted fees and charges and replacement ratio, prepare and submit a Final Reforestation Plan in coordination with the concemed Watershed Area Office (WAO) which shall contain an implementation schedule covering all necessary and relevant activities including at least a three (3) years of maintenance; Provided, that the permittee “u £ uM in # shall commence the implementation of the aforementioned reforestation plan not later than Sixty (60) days from approval thereof by NPC; n. All travel expenses of the inspection team relative to the conduct of all inspection and/or validation activities shall be for the account of the applicantiproponent, including the actual cost of transportation, lodging, meals and necessary incidental expenses; ©. That the NPC shall not be held liable for any untoward incident that may occur or any cases/suits that may evolve resulting from the operation of the approved land use and/or resource utilization activity(ies); p. That the grantee shall conduct the proposed activity only in the applied area and in accordance with the submitted management or operational plan; q. That any falsification of, or misrepresentation in the documents submitted shall be sufficient ground for revocation of the authority/permit granted without prejudice to possible penalties and legal actions that may be filed against those individualiparties responsible thereto; r. That the NPC thru the WMD and its Area/Field Offices shall have the ‘right to conduct on-site investigation and inspection anytime it warrants to determine compliance with terms and conditions of pertinent laws, policies, rules and regulations governing watershed management, SECTION 9, PROHIBITIONS ‘The following activities, among others, as provided under existing forestry and other environmental laws, rules and regulations are prohibited within NPC reservations: a) Cutting, gathering and/or collecting timber or other products without license from NPC; b) Unlawful occupation or destruction of watershed areas; c) Pasturing of livestock inside watershed areas without permit; d)* Obstruction to navigation or flow or ebb of tide in any stream, river, lake or bay inside NPC reservations; e) ‘Hunting, destroying, disturbing, or mere possession of any plant or animal or products derived therefrom without a permit from NPC; ) “Dumping or otherwise disposing of any waste products detrimental to the watershed area or to the plants and animals or inhabitants therein; g) Use of any motorized equipment without a permit from NPC; H peter h) ‘Mutilating, defacing or destroying objects of natural beauty, or burial grounds, religious sites, artifacts or other objects belonging to cultural communities; i) ‘Damaging and leaving roads and trails in damaged conditions; 3) - Squatting, mineral locating, or otherwise illegally occupying any land; k) Constructing or maintaining any kind of structure, fence or enclosures and conducting any business enterprise without a permit; 1). Leaving in exposed or unsanitary condition, refuse or debris, or depositing wastes in ground or in bodies of water; m)-Altering, removing, destroying or defacing boundary marks or signs; n) ,All other restrictions as the law and all duly constituted authorities may hereinafter promulgate; SECTION 10. PROCEDURES AND PROCESS FLOW The following standard procedures and process flow (see Annex A) shall be followed and observed in the processing of any application for land use/resource uilization activity inside NPC-managed reservations: a. Applicant submits the initial requirements directly to WMD or to the concemed WAO which shall acknowledge the same by issuing receiving form (Annex 1). In case of applications submitted directly to WMD, the application shall immediately be transmitted to the concerned WAO for appropriate evaluation; b. The concerned WAO shall, upon receipt of the application, check and -verify the completeness of the preliminary/initial requirements submitted using a checklist prepared for this purpose; ©. If found to be complete, the WAO shall instruct the applicant to’ pay the appropriate application and Inspection Fees upon issuance of an assessment form therefor. d. Within five (5) days after submission of complete preliminaryfinitial requirement, the WAO shall conduct“ocular inspection and initial estimate of vegetations that will be affected by the proposed activity or project; If necessary, considering the volume of trees/forest products that will be affected, the WAO shall fequire the proponent to submit a comprehensive inventory of timber and non-timber forest products that will be affected which shall be prepared and signed by a licensed Forester; e. The concerned WAO shall’endorse the application with all the relevant documents and information to the WMD; 1. The concemed WMD Head Office Staff, shall within three (3) days from receipt of the endorsed application, review and evaluate the application taking due consideration on merit and authenticity of the supporting documents and the recommendation or comments of the WAO concerned; g. The WMD H.O. staff makes a preliminary determination and recommendation whether or not the proposed activity should be given due course based on the initial evaluation; Informs the applicant directly or through the WAO of the adverse decision or ruling, if such is the case; Otherwise, instructs the WAO to coordinate with and notify the applicant of the schedule of the field inspection and validation activity which shall be undertaken not later than Ten (10) days from such notice; h. The concemed WMD and WAO staff together with the applicant or his duly authorized representative(s) shall Conduct ocular inspection of the project area and validation of the inventory report and other documents; i. Upon completion of the inspection/validation activity, the concerned WMD H.O. staff, shall ‘prepare the validation report (Annex D) to be concurred with by the concerned WAO personnel; J. The applicant is advised to’submit the final requirements in accordance with Section 7 (B) hereof, which include payment of the remaining fees and charges as detailed in the Computation Sheet (Annex J- Sheets 1~4) and summarized in the Land Use Charges Assessment Form (Annex K- Form 4-B) issued, as prescribed in the herein attached Schedule of Fees and Charges (Annex L); k. The NPC President or his duly authorized representative shall, if so warranted, and upon consideration of the recommendation made by the Inspection Team, issue or otherwise deny.the issuance of the appropriate permiticlearance/authority; |. In situations where the application is denied, WMD shall inform the applicant directly or through the concerned WAO of such denial in writing SECTION 11. INSPECTION AND MONITORING The “inspection activities shall be conducted for both proposed and existing development projects. An initial inspection shall be done prior to the commencement of any development activity. Each proposed project shall be assessed based on the degree of its environmental impact and the.weight of its merits commensurate to the interest of the NPC to protect and conserve the watersheds under its jurisdiction. In the case of establishmentsiprojects operating and/or existing prior to the effectivity of this Order, they shall be notified and given sixty (60) days from receipt of such notice, to apply for the appropriate permitiauthority. Failure to comply shall result to their operation/establishment to be considered unlawful and subject to appropriate and immediate legal action After a permiticlearance/authority is issued, WMD and WAO shall conduct * regular on-site monitoring and inspection to check and verify the compliance of the applicant on the terms and conditions set forth in the permit/authority. Provided, That when the nature of the aetivity/projects so warrants, 2 Multi-partite Monitoring Team (MMT) shall be created consisting of representatives from a) the WMD, b) the WAO concerned, c) other relevant departments of NPC, d) other concemed government agency, e) LGUs, f) local NGO, and g) the Proponent. For this purpose, the Proponent shall, prior to the commencement of any field works pertaining to the approved project/activity deposit an amount to be determined by the Manager, WMD in a special account created for this purpose to be used by the MMT for its monitoring operations. SECTION 12. IMPOSITION OF FEES AND CHARGES The fees and charges to be imposed in all applications for land use and/or resource utilization activity shall be those found in Annex L. (Schedule Of Forestry Administrative Fees And Charges) hereof. Provided however, that amendment thereto maybe made in accordance with the law particularly Republic Act No. 7161 (An Act Incorporating Certain Sections Of The National Internal Revenue Code Of 1977, As Amended, To Presidential Decree No. 705, As Amended, Otherwise Known As "The Revised Forestry Code Of The Philippines," And Providing ‘Amendments Thereto By Increasing The Forest Charges On Timber And Other Forest Products) and other pertinent issuances of relevant government agencies which may be adopted by NPC. In addition to the fees and charges imposed in Annex L hereof, the Manager of WMD is hereby authorized subject to approval by the President of NPC, to impose other fees for forest protection, management, reforestation, and development, the proceeds of which shall accrue into a special deposit of the Corporation as its revolving fund for the aforementioned purposes. SECTION 13. CREATION OF SPECIAL ACCOUNTIDEPOSIT Pursuant to Section 65 and 66 of Presidential Decree No. 705, there is hereby . created a special accountideposit denominated as Forest Protection, Management, Reforestation and Development Fund (FPMRDF) where all fees, charges, and other collections shall be credited by virtue of this Order. All amounts which accrue in the aforesaid special account can only be used specifically for the aforementioned purpose. SECTION 14, ASSESSMENT, COLLECTION AND DISBURSEMENT ‘The assessment of the charges and fees above-mentioned shall be the responsibility of the Manager (WMD) or his authorized representative. Collection and disbursement shall be made in accordance with the existing NPC guidelines and procedures. Provided, that the proceeds of the collection of the fees imposed in the immediately preceding Section and the special deposit heretofore required of permittees shall be constituted into a revolving fund for such purposes and be deposited in the Land Bank of the Philippines, as 2 special deposit of the 18 pi Corporation. Withdrawals therefrom shall be effected by the NPC President or his authorized representative on the basis of a consolidated annual budget prepared by the WMD Manager of a work program for the specific purposes mentioned above SECTION 15. PENAL PROVISIONS Should there be violation of any provisions of this Order, penalties shall be meted on the party liable therefor depending on the nature of the violations based on existing laws, rules and regulations which include but is not limited to PD No. 705, as amended, Ministry Order No. 83-01-13 (series of 1982), “The Revised Penal Code of the Philippines’, the National Integrated Protected Areas System (NIPAS) Act, the Clean Air Act, the Clean Water Act and the Water Code of the Philippines. Without prejudice to the filing of appropriate civil and criminal liability with the regular courts, the Manager of WMD shall impose administrative fine and penalty including forfeiture of bond/deposits in favor of NPC. The administrative fine and penalty to be imposed for violations of this Order or of any condition of the permits/authorities issued pursuant to this Order shall be as follows: Prohibited Act _ Remarks. SECTION 16, SEPARABILITY CLAUSE If any of the provisions of these Order is held or declared to be unconstitutional or invalid by a competent court, the other provisions hereof shall Poy 9 ey » continue to be in force as if the provisions so annulled or voided had never been incorporated in this Order. SECTION 17. REPEALING/AMENDING CLAUSE Other existing issuances, memoranda and circulars which are not consistent herewith are hereby repealed, amended or modified accordinaly. SECTION 18.
