It is also his submission that the concept of judicial review has so much developed that even the validity
of the statutes mentioned in Schedule IX to the Constitution of India can be tested by the Courts with
the power of judicial review to decide as to whether such statutes satisfy the rule of law, as held in I.R
Coelho v. State of Tamil Nadu, (2007) 2 SCC 1. Therefore, according to him, the impugned Section 14 of
the SARFAESI Act does not satisfy the principle of the rule of law and hence, it is liable to be struck
down.
