I was notified of a computer breach that occurred. The incident involved a Hillsborough County School Board
member whose Facebook account was accessed without her authorization. Information was taken from the
account and given to La Gaceta (local newspaper) who published the information.
I contacted the victim via telephone and learned she would be attending a graduation at the Florida State
Fairgrounds where I was working in an off-duty capacity. We agreed to meet prior to the graduation for
interview.
I met with the victim and ascertained she did not know where the breach occurred, and she would be researching
the locations from where her account was accessed. She could not provide me with any suspects as she did not
have the proper information at that time. I did advise the victim to change her password to the account.
The victim was able to review the Internet Protocol (IP) addresses that accessed her account. She was able to
identify an incident on May 15, 2018 where her account was logged in to two (2) separate computers within the
School Board meeting room. This incident took place during a School Board meeting that was video recorded.
The account was accessed from IP address 168.254.225.142 at 1601 hours and 168.254.225.134 at 1551 hours.
Master Detective John Palomino and I responded to the Hillsborough County School Board located at 901 East
Kennedy Boulevard. We met with the victim and Rick Leneau, the Chief Information Office for the School
Board. Mr. Leneau advised the IP addresses in question were assigned to computers located within the School
Board meeting room on the first floor. We responded to the meeting room and viewed the two (2) work stations
which accessed the victim's account. One computer was the work station where the victim sits for meetings. The
other work station was the computer the victim occupied during 2017. That station is currently used by another
School Board member, identified as April Griffin through video footage of the meeting. The Internet Explorer
was opened and the history showed the victim's Facebook was accessed from that workstation on May 15, 2018
and was still logged in.
The victim did acknowledge she did not log her account off as she did not realize the potential invasion of her
account.
I contacted Assistant State Attorney (A.S.A.) Robert Petschow. I advised him of the initial facts of this case.
He reviewed the facts and advised the current Florida State Statutes did not support a criminal charge due to
the account being left logged in. He did advise me to confer with A.S.A. Ada Carmona so she could review any
relevant case law.
I contacted A.S.A. Ada Carmona and advised her the facts of the case. She advised she would need time to
review the case law to make a determination if these case was criminal in nature.

I met with the victim to keep her updated on any progress on this case.
I spoke to A.S.A. Carmona. She advised the current case law did not clearly define accessing another person
accessing an account which was left logged in. She did advise Federal laws addressed the issue of someone
exceeding their authority while using another persons account.
I contacted the victim and advised her of the ruling by the State Attorney's Office and referred her to contact the
Federal Bureau of Investigation with her complaint.
