DEED OF ASSIGNMENT AND TRANSFER OF RIGHTS

KNOW ALL MEN BY THIS PRESENTS:

This deed, made and entered into this 7th day of September, 2018 at the City of Cebu, by
and between:

JAMIENA M. OMPOY, Filipino Citizen, of legal age, with residence at Nivel


Hills, Busay Cebu City, and hereinafter referred to as the "ASSIGNOR".

-and-

ALJADE C. TAMBIS, Filipino Citizen, of legal age, with residence at Orchid


Sybu Dormitory, First St. La Guardia, Lahug Cebu City, Cebu Philippines,
hereinafter referred to as the "ASSIGNEE".

WITNESSETH that -

WHEREAS the ASSIGNOR is a Real Estate Salesperson of Avida Towers Riala a


condominium Corporation located at IT Park, Lahug, Cebu City, Cebu Philippines;

WHEREAS the ASSIGNEE is also a Real Estate Salesperson at the same


Condominium Corporation;

WHEREAS the ASSIGNEE was the one who made sales of condominium units to the
following persons-

1. LIM GEOK YEN, PAMELA Condominium Unit No: ATR4-1915


located at Jose Maria Del Mar St.,
Avida Towers Riala, IT Park, Lahug
Cebu City.
2. LOW LIAN CHOO, IRENE and Condominium Unit No: ATR4- 1811
SUSILA KANAGASABAPATHY located at Jose Maria Del Mar St.,
Avida Towers Riala, IT Park, Lahug
Cebu City.

WHEREAS, the ASSIGNEE has referred and transferred his sales contract with the
abovementioned persons to the hereinafter ASSIGNOR;

WHEREAS, the ASSIGNOR has offered to assign her rights over the receivables such
as the commission and incentives which shall pertain to the ASSIGNOR due to the sale
contract transferred by the ASSIGNEE to the ASSIGNOR above-stated;

WHEREAS, the commission to be received by the ASSIGNEE is that commission that


an AVIDA TOWER Real Estate Salesperson may receive upon a successful sales contract
which is computed at 2.25% of the Total Contract price of a Condominium unit, while the
incentives refers to the sellers promo, which is not fixed, and may vary from month to month
depending on the promo;

WHEREAS the PARTIES agreed that any and all future successful referrals made by
the ASSIGNEE to the ASSIGNOR, shall have the same effect as herein provided;

NOW, THEREFORE, for and in consideration of the foregoing premises, the


ASSIGNOR hereby assigns, transfers and conveys unto the ASSIGNEE, all her rights, and
interest to the aforementioned receivables pursuant to this Agreement and the ASSIGNEE by
these presents hereby accepts the assignment and agrees to be bound by the terms and
conditions of the Contract to Sell and the rules and regulations, and restrictions pertaining to
the said unit.
IN WITNESS WHEREOF, the parties have hereunto set their hands on the date and place
first above written.
