Any person who willfully and deliberately:
(a) obstructs the development or propagation
of organic agriculture, or the manufacture,
production, sale or use of organic agricultural
inputs;
(b) refuses without just cause to extend the
support and assistance required under this
Act; and

Any person who willfully and deliberately:


(c) mislabels or claims that the product is
organic when it is not in accordance with the
existing standards for Philippine organic
agriculture or this Act shall, upon conviction,

be punished by imprisonment of not less than
one (1) month nor more than six (6) months,
or a fine of not more than Fifty thousand
pesos (P50,000.00), or both, at the discretion
of the court. If the offender is a corporation or
a juridical entity, the official who ordered or
allowed the commission of the offense shall
be punished with the same penalty. If the
offender is in the government service, he
shall, in addition, be dismissed from office

QUALIFICATIONS FOR ORGANIZATION-APPLICANT
• Owned by Filipino
• Not engaged in organic production at the time of application and
during accreditation
• Been engaged in organic production or related extension service
for at least 3 yrs
• Undergone organic certification training
• Able to deploy 1 inspector/region
• Have financial resources
• Clean track record in previous financial dealings
• Luzon, Visayas and Mindanao satellite office
• Not providing consultancy
• With Manual of Certification Procedures

GUIDELINE FEATURES:

SCOPE OF APPLICATION

• MSMEs individual or group of farmers/producers/


processors applying for local 3rd party certification
whose products are for the local market
• if products are for export, only covers MSMEs,
indigenous people and ARBs tapped a local CB with
international recognition
• cost of subsidy for individual should be less than 10% of
the market price of the produce; for group should be
less than 5%

SCOPE OF INCENTIVE

• covers total certification costs (application & processing


fees, travel expenses and per diem of inspectors, and
lab fees)
• subsidy may be availed 3 times
• subsequent socialized subsidy guidelines after two
years of implementation
• only farms complied with the organic standards

D. Granting of Certification Subsidy
GUIDELINE FEATURES:

PROCESS OF APPLICATION

• Select CB from BAFPS list of accredited CB to do the


certification and negotiate the fees
• Assess readiness for certification through the use of
checklist at organic website
• Submit docs to AMAS (letter of intent, farm profile,
computation of certification fees, contract with CB, CB
pre-assessment report) for application approval
• AMAS notice to proceed to CB for the inspection

• Sign MOA stating the total incentive amount


• Submit docs to AMAS (inspection report,
certification committee decision, organic
certificate, CB declaration of no conflict of
interest, CB billing statement) for the incentive

GUIDELINE FEATURES:
CONDITIONS
• subsidized farms found violating the standards can no longer
avail subsequent subsidy
• for approved certification with conditions, re-inspection fees
shall be borne by the applicant
• for denied certification applications, certification costs shall be
borne by the applicant
• if conflict of interest identified after the grant of subsidy,
CB accreditation and applicant organic certificate shall be
revoked. Subsidy forfeited.
