Instances under DO 27 where plea bargaining is allowed

1. Sec 5, par 1 - Sale, Trading, etc., of Dangerous Drugs

- Penalty = life imprisonment to death, with fine from P500k to P10M
- Plea bargaining allowed to Sec 11, par 3 (Possession of Dangerous Drugs) where drugs
involved are either shabu or marijuana, and the amount is less than 5 grams for shabu,
and less than 300 grams for marijuana
- Sec 11, par 3 - reclusion temporal and fine from P300k to P400k
2. Sec 7 - Accused is charged as visitor of drug den
- Penalty = reclusion temporal and fine from P100k to P500k
- Plea bargaining allowed to either Sec 12 (Possession of Equipment for Dangerous
Drugs) or Sec 15 (Use of Dangerous Drugs)
- Sec 12 - 6 months and 1 day to 4 years, and fine from P10k to P50k
- Sec 15 - 6 months rehab (1 st offense); prision mayor and a fine from P50k to P200k (2 nd
offense)
3. Sec 11, par 3 - Possession of Dangerous Drugs (refer to notes under No.1)
- Penalty = reclusion temporal and fine from P300k to P400k
- Plea bargaining allowed to Sec 12 (Possession of Equipment for Dangerous Drugs)
- Sec 12 - 6 months and 1 day to 4 years, and fine from P10k to P50k
4. Sec 12 - Possession of Equipment for Dangerous Drugs
- Penalty = 6 months and 1 day to 4 years, and fine from P10k to P50k
- Plea bargaining allowed to Sec. 15 (Use of Dangerous Drugs), with alternative for
accused to plea guilty and avail of mitigating circumstance of voluntary plea of guilt
- Sec 15 - 6 months rehab (1 st offense); prision mayor and a fine from P50k to P200k (2 nd
offense)
5. Sec 13 - Possession of Dangerous Drugs during Parties or Social Events
- Penalty = Max penalties under Sec 11 regardless of purity or quantity, i.e. life
imprisonment to death, with fine from P500k to P10M
- Plea bargaining allowed to Sec 11, par 3, IF quantity of shabu is less than 5 grams, and
less than 300 grams for marijuana.
- Sec 11, par 3 - reclusion temporal and fine from P300k to P400k
6. Sec 14 - Possession of Equipment for Dangerous Drugs during Parties or Social Events
- Penalty = Max penalty under Sec 12, i.e. 6 months and 1 day to 4 years, and fine from
P10k to P50k
- Plea bargaining allowed to Sec 15 (Use of Dangerous Drugs)
- Sec 15 - 6 months rehab (1 st offense); prision mayor and a fine from P50k to P200k (2 nd
offense)
7. Sec 91 par 1 - Responsibility of Law Enforcement Officials and Employees in Testifying
as Prosecution Witnesses in Drug Cases
- Penalty = reclusion temporal and fine of not less P500k
- Plea bargaining allowed to Sec 91 par 2 (Liability of Immediate Superior if he fails to
exert reasonable effort to present witness to court)
- Sec 91 par 2 - 2 months and 1 day but not more than 6 years, and a fine of not less
than P10k but not more than P50k
