A. Lineamientos básicos
En la República Argentina, el Ministerio Público de la Defensa es la institu-
ción encargada de brindar, a nivel nacional, el servicio de asistencia jurídica y
defensa judicial de los derechos de las personas (servicio de defensa pública).
Cumple un rol preponderante en la promoción y protección de los dere-
chos humanos, y tiene la misión principal de promover el acceso a la justicia y
otorgar asesoramiento y patrocinio jurídico a quienes, por diversas razones y
dependiendo del tipo de proceso judicial que se trate, no tengan un abogado
que los represente.
Además debe intervenir en todo proceso judicial donde se encuentren
involucrados los intereses o bienes de las niñas, niños y adolescentes y de
personas con declaración de incapacidad, o bien, frente a procesos donde
aquella se encuentre cuestionada, velando por el respeto de sus derechos.
Se encuentra institucionalizado como un organismo estatal previsto en
la Constitución Nacional (art. 120 CN). Cuenta con autonomía funcional y
autarquía financiera, y es independiente de las estructuras de gobierno y de
la administración del Poder Judicial.
El servicio de defensa pública es brindado por defensores públicos, que
son magistrados de la Nación –con igual status que los jueces o fiscales ante
los cuales actúan– y acceden al cargo mediante concurso público y mantienen
estabilidad como tales, pudiendo ser removidos sólo por causas graves expre-
samente previstas, y por un jurado integrado por representantes de diversos
órganos del Estado, de asociaciones profesionales y académicas.
La defensa pública en Argentina tiene antecedentes que se remontan a los
años del Virreinato del Río de la Plata. Desde mediados del siglo XVI ya existía
la figura del “protector de indios”, con funciones de defensa en juicio. También
el Código Civil Argentino, que entró en vigencia en 1871, había establecido la
intervención obligada de un “Ministerio de Menores” como parte esencial en
todo asunto judicial o extrajudicial, de jurisdicción voluntaria o contenciosa, en
los cuales fueren parte personas menores de edad o incapaces.
En la actualidad, el ámbito de cobertura de la defensa pública se ha am-
pliado. Efectivamente, los defensores públicos intervienen en todos los fueros
(materia penal, penal tributario, de ejecución penal, civil, comercial, laboral,
contencioso administrativo, de ejecuciones fiscales tributarias, de la seguridad

Defensa penal
El ordenamiento procesal penal vigente prevé al derecho de defensa
como un derecho del imputado, quien tiene la facultad de elegir quién será el
abogado que lo defienda. Si no lo hiciera, el tribunal debe designarle de oficio
al defensor público que corresponda. Por lo tanto, en materia penal, el MPD
asume la defensa de toda persona imputada de un delito, siempre que no
designe abogado particular4.
El servicio es gratuito. Sin embargo, si el imputado resulta condenado y
tiene medios suficientes al momento de la sentencia, debe abonar al servicio
de defensa pública –a la institución y no al defensor individual- los honorarios
que se regulen judicialmente5.
Organismos internacionales
Como se ha indicado precedentemente, el legislador ha dado un paso ade-
lante en orden a la actuación del Ministerio Público de la Defensa con respecto
a la protección de los derechos humanos y ha otorgado al Defensor General la
facultad de patrocinar y asistir técnicamente, a las personas que lo soliciten,
ante los organismos internacionales que correspondan (art. 51 inc. v), LOMP).
Programas y Comisiones
Como fuera mencionado, la DGN realiza otras acciones dirigidas a proteger

C. Relación con las funciones del Defensor del Pueblo de la Nación (art. 86 CN)
En referencia a la misión del Defensor General de la Nación de “realizar
todas las acciones conducentes para la defensa y protección de los derechos
humanos” -como se referenció más arriba- la ley dispone que es “sin perjuicio
de lo establecido en el artículo 86 de la Constitución Nacional” (art. 51 inc. d)
LOMP), que es el que se refiere al Defensor del Pueblo de la Nación. Así, dice
el artículo 86 de la CN que tiene como misión “la defensa y protección de los
derechos humanos y demás derechos, garantías e intereses tutelados en esta
Constitución y las leyes, ante hechos, actos u omisiones de la Administración”.
Si bien los ámbitos de actuación no son idénticos, claramente las funciones
de ambos organismos referidas a la defensa y protección de derechos huma-
nos, se complementan en el sistema argentino, de manera de otorgar efectiva
vigencia a los derechos y garantías reconocidos.

A. Independencia
El Ministerio Público, como ya se mencionó, posee una unidad jerárquica
y ejerce sus funciones con unidad de actuación e independencia, sin sujeción
a instrucciones o directivas emanadas de órganos ajenos a su estructura.
El Defensor General de la Nación tiene a su cargo el gobierno y la admi-
nistración general y financiera del Ministerio Pública de la Defensa. A tales
efectos, dicta reglamentos de superintendencia general y financiera, de orga-
nización funcional, de personal, disciplinarios, y todos los demás que resulten
necesarios para el cumplimiento de las funciones encomendadas al MPD por
la Constitución y las leyes1.
Los defensores públicos, por su calidad de magistrados, gozan de inmuni-
dad funcional y estabilidad en sus cargos. Estas características resultan funda-
mentales a fin de garantizar su independencia y evitar presiones o influencias
que afecten el normal desempeño de sus funciones.
Los magistrados del MPD no pueden ser arrestados excepto en caso de
ser sorprendidos en flagrante delito. La LOMP estipula expresamente que las
cuestiones que los miembros del Ministerio Público denuncien con motivo de
perturbaciones que afecten el ejercicio de sus funciones provenientes de los
poderes públicos, se sustanciarán ante el Defensor General de la Nación, quien
tendrá la facultad de resolverlas y, en su caso, poner el hecho en conocimiento
de la autoridad judicial competente, requiriendo las medidas que fuesen nece-
sarias para preservar el normal desempeño de aquellas funciones.
Control interno
El control interno es ejercido por la Dirección General de Auditoría Interna
Control externo
En cuanto al control externo, además de las previsiones contenidas en la
Ley de Administración Financiera del Estado, la Ley Orgánica del Ministerio
Público dispone que el control de la ejecución del presupuesto estará a cargo
de la Auditoría General de la Nación, en su carácter de órgano rector del control
externo gubernamental, y que la Comisión Bicameral del Congreso, creada
por la misma ley, deberá expedirse en la rendiciones de cuentas del ejercicio
(Conf. art. 24 LOMP).
Asimismo, el Defensor General de la Nación tiene entre sus deberes pre-
sentar un Informe Anual detallado al Congreso de la Nación, el cual debe con-
tener una rendición de cuentas; una evaluación del trabajo realizado durante
el ejercicio; un análisis sobre la eficiencia del servicio y propuestas concretas
sobre las modificaciones o mejoras que requiera4.
C. Autarquía financiera
El Ministerio Público de la Defensa posee autarquía financiera. De acuerdo
a ello, la institución cuenta con crédito presupuestario propio y tiene la facultad
de administrar y ejecutar el presupuesto que se le asigna, de acuerdo a las
leyes y reglamentaciones vigentes.
Presupuesto
Recursos propios
El art. 22 de la Ley Orgánica del Ministerio Público dispone que “… a los
efectos de asegurar su autarquía financiera, el Ministerio Público contará con
crédito presupuestario propio, el que será atendido con cargo a rentas gene-
rales y con recursos específicos. El Defensor General de la Nación elaborará
el proyecto de presupuesto y lo remitirá al Congreso para su consideración por
intermedio del Ministerio de Economía (...) El Poder Ejecutivo sólo podrá formu-
lar las observaciones que estime apropiadas, pero sin modificar su contenido,
debiéndolo incorporar en el proyecto de presupuesto general de la Nación”.
Es así que en el marco del procedimiento de la formulación anual del
Presupuesto General de la Nación el área de Administración General de la
Defensoría General de la Nación elabora el proyecto de presupuesto institu-
cional para el Ejercicio Fiscal próximo, así como el Plurianual, y los remite al
Ministerio de Economía y Finanzas (en adelante MECON), según el cronograma
que anualmente éste último establece para todas las instituciones públicas
nacionales, a los fines de cumplir con el precepto legal de presentación ante
el Congreso de la Nación.
El presupuesto del Ministerio Público se elabora en base a los requeri-
mientos de las distintas dependencias y a las necesidades detectadas por la
Administración, y es discutido y consensuado con el Ministerio de Economía y
Finanzas Públicas de la Nación a través de los órganos específicos especializa-
dos en la materia, en base a las políticas macroeconómicas y a la proyección
de recursos económicos para el próximo año.
El presupuesto de la totalidad del Ministerio Público se encuentra financiado
en un 99,87% con fondos del Tesoro Nacional, mientras que el presupuesto
restante es financiado por transferencias externas y por recursos propios.
A los fines de la ejecución del presupuesto, según los principios establecidos
en la Ley de Administración Financiera del Estado Nº 24156, una vez aprobada
la Ley de Presupuesto Anual por el Congreso de la Nación, le compete a la
Jefatura de Gabinete de Ministros de la Nación, su distribución mediante el
dictado de una Decisión Administrativa que se emite durante el transcurso de
mes de enero todos los años.
A su vez, la misma norma dispone que la ejecución del presupuesto se
hará trimestralmente, para lo cual se procede a solicitar periódicamente lo

que se denomina “cuota”, que no es más que el monto máximo en que el or-
ganismo puede “comprometer” gastos durante determinado período (mensual/
trimestral), según el grado de ejecución presupuestaria hasta el momento y
las propias estimaciones de gastos.
Por tratarse de un órgano autónomo, la máxima autoridad del MPD, con-
serva amplias atribuciones para la administración y ejecución financiera del
presupuesto asignado, en virtud de las cuales puede realizar modificaciones
presupuestarias que resulten necesarias a través del mecanismo de compen-
sación de partidas -sin que esto implique un aumento del crédito presupues-
tario-, y en función de las reprogramaciones presupuestarias que el Ministerio
de Economía y Finanzas de la Nación se vea obligado a efectuar por razones
ajenas al MPD y ligadas al desarrollo económico del país.
El presupuesto original para el año 2014 se determinó en $ 1.086.149.371
- incrementándose en un 22 % con relación al presupuesto del año anterior-
de los cuales se estima que $ 1.700.000 son financiados por transferencias
externas y por recursos propios.
Durante el año 2014 la composición del presupuesto por tipo de gasto es
de: un 92 % para el gasto en personal (primordialmente salarios y beneficios
sociales), un 1,00% para los gastos de servicios básicos (luz, agua, teléfono,
etc.) y un 4% para los demás gastos, con excepción de los bienes de capital o de
uso que poseen un 2 % del presupuesto. El resto del presupuesto corresponde
a los gastos que se financian con transferencia externas o recurso propios.

instancias del proceso judicial.
Las defensorías de la Ciudad Autónoma de Buenos, sin incluir a la Defen-
soría General de la Nación, son 83. Cada una de ellas se encuentra a cargo de
un defensor público y se compone de un plantel de funcionarios y empleados
asignados para que colaboren con el titular de la dependencia.
Tutorías y curadurías públicas: En la Ciudad Autónoma de Buenos Aires
funcionan 2 tutorías y 18 curadurías públicas, cada una a cargo de un tutor/
curador, según sea el caso, y con un plantel de personal propio. Las tutorías y
curadurías son coordinadas por la Dirección General de Curadurías y Tutorías
Públicas que depende de la Defensora General de la Nación.
Unidades de Letrados
Teniendo en cuenta las especiales necesidades de cobertura del servicio
de defensa pública, por resolución administrativa se crean Unidades de Letra-
dos, integradas por funcionarios del organismo que cumplen con los requisitos
para ser designados magistrados y que hayan aprobado el correspondiente
examen, a los efectos de brindar el servicio de defensa pública en distintos
ámbitos de intervención.

A. Proceso de nombramiento
La LOMP establece un régimen de selección para el Defensor General de
la Nación y otro para los demás defensores1.
B. Estabilidad
El Defensor General de la Nación, al igual que los demás defensores
públicos oficiales, ejerce sus funciones por tiempo indeterminado. Según la
LOMP “gozan de estabilidad mientras dure su buena conducta y hasta los
setenta y cinco (75) años de edad”. Pudiendo ser nombrados nuevamente
por el término de 5 años.
Todos los magistrados del MPD, además de estabilidad en el cargo, gozan de
intangibilidad en sus remuneraciones, lo cual implica que sus retribuciones son
fijadas por ley y no pueden ser disminuidas mientras permanezcan en funciones8.
El Defensor General de la Nación sólo puede ser removido en caso de
constituirse una de las causales previstas en la Constitución9, y a través del
procedimiento de juicio político10.
Los restantes magistrados sólo pueden ser removidos de sus cargos por el
D. Dependencias
El MPD posee una infraestructura de aproximadamente 200 dependencias
distribuidas en todo el territorio de la República Argentina. Ya sean oficinas
propias (en edificios o en locales a la calle), oficinas arrendadas, y oficinas
concedidas en préstamo (ubicadas, por lo general, en los mismos edificios
donde funciona el Poder Judicial).
En la actualidad todas las dependencias poseen teléfono y servicio de
internet, por lo que su comunicación está dada, principalmente, por correo
electrónico y por telefonía básica.
Comisión de Cárceles
Se conformó con dos objetivos centrales, asistir jurídicamente a las per-
sonas privadas de libertad y monitorear las condiciones de detención (entre
ellas, las condiciones de alojamiento, alimentación y atención médica de los
internos asistidos por la defensa pública) y el respeto de los estándares de
derechos humanos en materia de privación de la libertad.
Esta función de monitoreo se efectúa en todas las unidades carcelarias
dependientes del Servicio Penitenciario Federal y en todo centro de detención
que aloje detenidos federales16; y consiste en visitas regulares que se realizan
sin previo aviso y en las que se procede a recorrer la totalidad de las instalacio-
nes y se mantienen entrevistas con la población alojada y con las autoridades.
Con posterioridad a la visita se confecciona un informe en el que se consig-
nan las condiciones verificadas, se destacan las buenas prácticas observadas
y se formulan las recomendaciones necesarias para subsanar los problemas
advertidos. Los informes son remitidos a las áreas gubernamentales respectivas
y se realiza su seguimiento.
La Comisión de Cárceles cuenta con líneas telefónicas con cobro revertido
(gratuitas para la persona que la realiza) a fin de que los detenidos/as realicen
de los principios allí acordados. La Oficina para el Cono Sur de América Latina
del ACNUR ha considerado públicamente que el protocolo de actuación es
una muy buena práctica en la protección de los niños refugiados, primera en
su especie en América Latina, por lo que ha mostrado su interés en que dicha
experiencia sea replicada en América Latina.
Además de las intervenciones relacionadas con los niños, niñas y adoles-
centes no acompañados o separados de sus familias, la Comisión asume la
representación legal ante la Comisión Nacional para Refugiados (CONARE)
de los solicitantes de reconocimiento de la condición de refugiado mayores
de edad que son asistidos por los defensores públicos en los procedimientos
de extradición, o por la Comisión del Migrante de la Defensoría General de la
Nación en los procedimientos de expulsión.
Efectivamente, mediante la Res. DGN Nº 1055/11 se dispuso la creación
del Programa de Asesoramiento y Representación Legal para las personas
refugiadas y solicitantes del reconocimiento de dicha condición.
El Programa, primero en su especie en América Latina y uno de los pocos
en el mundo, prevé que la Comisión brinde representación legal a toda persona
solicitante del reconocimiento de la condición de refugiado en Argentina que
así lo requiere, desde el inicio mismo del expediente y hasta su conclusión.
Ello implicará brindar representación legal con los alcances indicados
anteriormente a un promedio de 600 personas al año, procedentes de más
de 60 países.
Asimismo, el Ministerio Público de la Defensa celebró un acuerdo de coo-
peración con la CONARE y el ACNUR para asegurar el derecho de las personas
solicitantes del reconocimiento de la condición de refugiado a la representación
legal, mediante mecanismos de información y derivación y actividades de
capacitación conjunta.
Fruto de ello, tanto la CONARE como el ACNUR colaboraron en el desarrollo
de los contenidos del curso de capacitación para los aspirantes a integrar el
programa, como así también los representantes de las organizaciones de la
sociedad civil que vienen trabajando en la defensa de los derechos de las
personas migrantes y refugiadas.
A. Funciones Consultivas
Legislación nacional
El MPD actúa no sólo frente a requerimientos particulares y puntuales,
sino que también se propone participar en la discusión de políticas públicas y
colaborar en la producción de cambios estructurales.
Entre los deberes y atribuciones que la LOMP le asigna al Defensor General
de la Nación, se encuentran: elevar al Poder Legislativo la opinión del MPD
acerca de la conveniencia de determinadas reformas legislativas y al Poder
Ejecutivo si se trata de reformas reglamentarias; y responder a las consultas
formuladas por el Presidente de la Nación, los Ministros del Poder Ejecutivo,
los Presidentes de ambas Cámaras del Congreso Nacional, la Corte Suprema
de Justicia de la Nación y el Presidente del Consejo de la Magistratura.1
La DGN cuenta con un área cuya misión primordial es dar seguimiento a los
proyectos legislativos que se encuentran en tratamiento en el Congreso de la
Nación y que poseen relevancia institucional, mediante la elaboración de proyec-
tos de ley, o mediante la propuesta de reformas a los proyectos ya presentados.
En materia penal, la DGN fue invitada en el año 2007 por el PEN a parti-
cipar de una Comisión cuyo objetivo fue elaborar un anteproyecto de ley de
Código Procesal Penal de la Nación. Dicha Comisión trabajó en el ámbito del
Ministerio de Justicia y Derechos Humanos de la Nación y culminó su tarea
con la presentación de un anteproyecto de ley de Código Procesal Penal. La
participación de la DGN en ese proceso fue de fundamental relevancia para
asegurar que las garantías constitucionales y derechos consagrados por los
tratados internacionales de derechos humanos fueran respetados. Así, se
veló por el derecho a ser juzgado en un plazo razonable, por la necesidad de
consagrar a la prisión preventiva como una medida cautelar excepcional y
asegurar el juzgamiento por un juez imparcial, entre las cuestiones tratadas.
Entre otras propuestas de proyectos normativos que ha realizado la DGN
merece mencionarse la reglamentación de la Ley Nº 26.485 de “Protección
integral para prevenir, sancionar y erradicar la Violencia contra las Mujeres en
los ámbitos en que desarrollen sus relaciones interpersonales”. La Comisión
B. Presentación de Informes
Como se expuso anteriormente, el Defensor General de la Nación tiene
la obligación legal de remitir anualmente al Congreso de la Nación el Informe
de la actividad llevada a cabo por el Ministerio Público de la Defensa durante
cada ejercicio, que comprenda, además, una evaluación del trabajo realizado
y propuestas sobre mejoras a realizar (art. 32, Ley Nº 24.946). El informe,
además, es publicado a través del sitio oficial de la institución3, para consulta
de todos los ciudadanos.
C. Funciones de Promoción
Actividades de capacitación
La DGN, a través de la Secretaría General de Capacitación y Jurisprudencia
y los Programas y Comisiones, realiza diversas actividades de capacitación
dirigida a todos los integrantes del MPD.
En este sentido, se efectúa una capacitación amplia y permanente con
el fin de formar técnicamente a los integrantes del organismo e incentivar el
compromiso necesario para un moderno y eficiente manejo institucional en la
protección de los derechos fundamentales.
En virtud de la amplia actuación territorial del MPD y la necesidad de
capacitar a todos sus integrantes, se ha utilizado la novedosa herramienta de
la teleconferencia para poder acercar conferencias y charlas dictadas en la
Capital Federal a todas las dependencias del país.
Además, en el año 2013 se creó junto con el Ministerio Público Fiscal de la
Nación, la Escuela del Servicio de Justicia, con el fin de desarrollar actividades
de capacitación de manera conjunta.
En ese marco, se creó la Carrera de Especialización en Magistratura, cuyas
características salientes consisten, por un lado, en la concepción de la justicia
como un servicio a la sociedad y, por el otro, su carácter gratuito –totalmente
inédito en materia de posgrados- y abierto tanto a los operadores judiciales,
como a abogados del sector público y de la matrícula.

de la DGN y/o desde otras instituciones nacionales y provinciales, se organi-
zan y que, por la temática que desarrollan, puede resultar de interés para los
integrantes del MPD.

Durante los últimos años la DGN ha editado una gran cantidad de libros re-
lacionados con la labor que se desarrolla, fruto de actividades de investigación,
académicas y/o propias del actuar funcional de los integrantes del organismo,
entre los que se destacan: Derecho Internacional de los Derechos Humanos.

A. Guiding principles
In the Argentine Republic, the Federal Public Defender’s Office (Ministerio
Público de la Defensa) is the institution in charge of providing legal aid and
judicial defense of people’s rights (public defense services) nationwide.
It has a dominant role in the promotion and protection of human rights,
and its main aim is the promotion of access to legal aid and defense for any
person unable to get legal counseling due to diverse reasons related to the
type of judicial process under application.
Moreover, it must intervene in every judicial process involving interests
and property of minors and legally incapacitated persons, safeguarding the
respect for their rights.
It has been institutionalized as a state organization in accordance with
the National Constitution (Art. 120) with functional autonomy and financial
autarchy, thus independent from all other governmental structures and from
the Administration of The Judiciary.
The public defense service is provided by Public Defenders, who are magis-
trates hired through public examinations and their positions are as stable as
those of judges or prosecutors. They can only be removed due to serious causes
that are specifically detailed beforehand, by a jury composed of representatives
from different State bodies and professional and academic associations.
The origins of the Public Defense in Argentina can be traced back to the
times of the Río de La Plata Viceroyalty. The role of “Protector of the Indians”,
entitled to practicing defense in trial, already existed since the middle of the
16th century. Likewise, the Argentine Civil Code, enacted in 1871, had set the
mandatory intervention of a “Minors’ Bureau” as an essential part of any judi-
cial or civil matter where there were minors or incapacitated persons involved.
However, beyond its historical origins, the Public Defense in our country
has multiple competences. It takes part in cases related either to criminal (de-
fendants or convicted), civil, trade, work, administrative law, or social security

Criminal Defense
According to the ruling criminal process ordering, the right to defense is
considered to be a right of the accused, who is free to choose the lawyer who
will defend him. If the accused does not choose a defender, the court appoints
the corresponding Public Defender. Thus, in criminal courts, the FPDO accepts
the defense of any person accused of a crime as long as no private lawyer has
been appointed.
The service is offered free of charge. Nevertheless, if the accused were
found guilty and had enough economic means at the moment of the sentence,
he/she must pay the counsel’s fees set by the court to the Public Defense –to
the institution, not to the defender himself- (Cf. Law N° 24946 –OLFPO–,
Arts. 63 and 64).

In all the above mentioned cases, the Federal Public defender’s Office
intervenes from the beginning of the process and in all instances, including
the sentence execution stage.
International Organizations
As indicated above, the legislature has taken a step forward regarding the
Federal Public Defender´s Office action in terms of protecting human rights
and granted the Federal Public Defender General the authority to sponsor and
provide technical assistance to all people who request it, before the international
organizations concerned (art. 51 v) OLFPO).
A. Autonomy
The Federal Public Office displays a hierarchical organization and performs
its roles autonomously without being restricted in any manner by instructions
or orders originated in any other ruling authority (Art. 1, OLFPO).
The Federal Public Defender General is in charge of governing and ruling
the Federal Public Defender´s Office in administrative and financial matters.
For that purpose, general and financial administrative regulations are issued,
as well as functional-organizational, personnel and disciplinary ones, together
with any necessary measure for the fulfillment of the functions commanded by
the Argentine Constitution and legislation to the FPDO (Art. 21, sec b, OLFPO).
Public Defenders, as magistrates, perform their duties enjoying immunity
and stability in their positions. Such characteristics are of prime importance
to guarantee their independence and to avoid influences or pressure that may
affect the normal performance of their duties.
FPDO magistrates cannot be arrested in any way unless caught in open
breach of the law. According to the OLFPO, matters denounced by members of
the Public Defense in terms of disturbance of their duties originated in public
sectors will be presented to the Federal Public Defender General who, in turn,
will have the power to resolve such matters and, if necessary, make the situa-
tion known to the corresponding judicial authority and demand the required
measures to preserve the normal functioning of the duties of the Defense (Law
N° 24946 –OLFPO– Art. 14).
Internal Control
The General Board for Internal Audits is in charge of the internal control and
it reports directly to the main authority of the institution (Cf. Law 24156, Art.
100). One of the focal points of internal control is set by Law 24156, section
101, where it is established that “…the highest authorities of each activity or

jurisdiction are responsible for, within their limitations of ruling, the creation
and continuation of an internal control system that will include prior and post
control instruments into the organizational plan, as well as in the regulations
and procedure manuals of each institution/ body.”
The quoted law above also determines that the mode adopted by control
should be integral and integrated, that is, a comprehensive control of the orga-
nization in all its areas and operations, “…to cover budgetary, economic, finan-
cial, patrimony, normative, management issues together with the assessment
of programs, projects and operations, all based on the criteria of economy,
efficiency and efficacy…” (Cf. Law 24156, Art. 103).
In order to fulfill its mandates, the General Board of Internal Audits of the
Office of the Federal Public Defender General applies the internal auditing
norms set by the national ruling institution in this matter, the General Union’s
Office (SIGEN, in Argentina), and the procedures established within the norms
together with those widely accepted in its competence area, such as national
and international professional associations.
External Control
In the matter of external control, besides the contingencies expressed in our
State Financial Administrative Law, the Organic Law of the Federal Public Office
rules that execution of the Budget will be in charge of the General Auditor’s
Office, as this is the ruling body of external governmental control. The Organic
Law also sets that the Bicameral Commission of Congress created by the same
law should issue a statement on the balance presented (Art. 24).
Furthermore, the Federal Public Defender General is expected to submit
an annual detailed report to the National Congress as part of their duties. The
report should include the balance and overall evaluation of the work produ-
ced during the period together with an analysis of the efficiency of the service
provided and concrete suggestions for changes or improvements necessary
(Art. 21 sec. d, OLFPO).
C. Financial autarky
The Federal Public Defender’s Office has financial autarky. Accordingly, the
institution holds its own budget appropriation and has the authority to admi-
nister and enforce the allocated budget according to the laws and regulations
that are in force.
Budget
Funding
The Organic Law of the Federal Public Office, in its 22nd article, rules that
“the Federal Public Office shall have budgetary credit of its own in order to

guarantee its financial autarchy. The budget will be catered for by governmen-
tal funds and other specific resources. The Federal Public Defender General
will produce the budgetary project and send it to the Congress for its approval
through the Department of Economy (…) The Executive Branch may only make
the observations it deems applicable but without modifying its content and with
the obligation to include it in the general national budgetary project.”
In consequence, the Administration Area of the Office of the Federal Public
Defender General produces the institutional budgetary project for the coming
fiscal period as well as the multiannual one following the procedures set for
yearly estimation of the General National Budget. Both budgetary projects are
sent to the Department of Economy and Finance (MECON) in accordance with
the calendar set for all national public institutions, so as to ensure compliance
with the legal requirement of budget presentation to Congress prior to Sept-
ember 15th of each year.
The budget of the Federal Public Defender’s Office is produced as a result
of the requirements from the different areas and the needs identified by the Ad-
ministration. Then it is discussed with the Department of Economy and Finance
through the corresponding specialized bodies on the basis of macroeconomic
policies and the projection of economic resources for the following year.
The global Budget for the Federal Public Defender’s Office is financed in
its 99,87% by funds from the National Treasure, while the remaining part is
attended to by means of external transfers and internally created resources.
In order to execute the budget, in accordance with the State Financial
Administration Law Nº 24156, after the Annual National Budget Law has
been passed by Congress, the Chief of Cabinet Ministers is responsible for its
distribution through an Administrative Decision issued during the month of
January each year.
The Regulation also determines that the budget be executed every three
months. Therefore, partial amounts are periodically demanded that cover the
maximum estimated spending that the FPDO can engage in during a set period.
The amount demanded will be affected by the percentage of the budget that
has been spent to the moment, as well as the expected spending for the period.
Given that the FPDO is an autonomous institution; its highest authority
displays wide attributions for the administration and financial execution of the
assigned budget. It is in this context then, that the Federal Public Defender
General may modify the budget if necessary by means of compensatory bud-
get entries, which do not imply an increase in budgetary credit assigned. The
mechanism is also necessary for budget reprogramming that the MECON may
need to enforce for reasons that are external to the FPDO but related to the
economic situation of the country.
The original budget for 2014 was determined at $ 1.086.149.371 (Argen-

tine Pesos) - increasing by 22% over the previous year’s budget-, of which an
estimated $ 1.700.000 is financed by external transfers and own funds.
During the mentioned year, the FPDO Budget was divided according to
the type of expenditure into: 92,00% for personnel (mainly salaries and social
welfare), 1,00% for services (electricity, water, telephone, etc.) and a 4,00%
for expenditures other than assets and equipment that are already assigned a
2,00% of the budget. The remaining percentage of the budget represents ex-
penditures afforded with external transfers and internally developed resources.
The City of Buenos Aires counts with 2 public Guardianships and 18 Cu-
ratorship offices led by a guardian and/or curator respectively, and with their
corresponding staff. The General Board of Public Guardianships and Curatorship
offices that depends from the Office of the Federal Public Defender General is
in charge of coordinating the Guardianships and Curatorship offices mentioned
above.
A. Appointment Process
The Federal Public Defender General and Public Defenders are appointed
according to two different procedures set forth in the OLFPO (Law N° 24946
–OLFPO–, Arts. 5 and 6).
Lawyers complying with the minimum age and seniority requirements (Law
N° 24946 –OLFPO–, Art. 7) can apply to participate in the public examination.
The FPDO is in charge of administering the test through a jury composed of
Public Defenders acting at Court or higher levels who will in turn select a list of
three candidates to be sent to the Executive Branch (Law N° 24946 –OLFPO–,
Art. 5 and 6).
The Executive Branch added a public instance to the appointment of Public
Defenders to ensure any observation or objection to the candidates be made
in due time and manner. For such purpose, The Executive has established
through its Decree 588/2003 that the information on the public examination be
published in the website of the Justice Department and Human Rights, namely
the position to be covered, the names of the shortlist of three, the scores they
obtained in the examinations as well as their curriculum vitas. At the same
time, the information is also published, with a direct link to the website of the
Department, in two newspapers of national distribution. In the case of positions
in any of the Provinces, the above mentioned information is also published in
a local newspaper. (Cf. Executive Branch Decree No. 588/03, Art. 4, 5 and 6).
B. Tenure
The Federal Public Defender General and all other Public Defenders are
appointed for a non-specified term of office. In the words of the OLFPO: “The
stability of Public Defenders should be maintained as long as their conduct is
proper and until seventy-five (75) years of age.” In the last case, they can be
reappointed for a five -year term.
All FPDO magistrates are granted security in their payment, together with
appointment stability. The importance of such granted security lies on the fact
that the salary Public Defenders receive is set by law and cannot be reduced
as long as they stay in office (Cf. Argentine Constitution, Art. 120).
The Federal Public Defender General can only be removed in case one of
the reasons foreseen in the Constitution were proved, and only by means of a
political trial (Cf. CN, Arts. 53 and 59, and Law N° 24946 –OLFPO–, Art. 18).
All other magistrates can only be removed by the Trial Jury of the Federal
Public Office in cases of poor performance, serious negligence or for having
committed any sort of intentional crime. The Jury is formed by seven members:
Three who must comply with the requirements set by the Constitution to become
members of the Supreme Court of Justice and will each be appointed by the
Executive Branch, the Senate and Supreme Court of Justice respectively; other
two members of the jury will be representatives of the Federal Public Office –
each selected by drawing lots, one from among higher level Public Defenders,
and the other among higher level prosecutors. The last two members of the
jury will be lawyers with a federal license who comply with the requirements to
be members of the Supreme Court of Justice, and they will be appointed: One

by the Argentine Federation of Lawyer Registry, and the other by the Registry
of Lawyers of the City of Buenos Aires.
C. Staff Composition
The FPDO has the following personnel structure to assist the duties of
appointed Public Defenders (FPDO Regulation Nº 1628/10, arts. 6, 7 and 8).
• Legal Technical Area: Personnel in their area must be graduate lawyers.
They are in charge of leading, performing, controlling, advising and certi-
fying Public Defense and any other legal administrative matter inherent
to the duties of the Office of the Federal Public Defender General.
• Technical Administrative Area: Personnel in this area are in charge of
leading, performing, controlling, advising on matters related to human
resources, accounting and finance, as well as in computing, technology
and issues of expertise. Personnel in this area will perform skilled or
administrative tasks at different levels of seniority.
• Support Services: Personnel in this area perform duties related to dri-
ving official vehicles, cleaning, general maintenance, general errands,
and mail delivery at public or private organizations that do not demand
any particular skill or knowledge, and/ or janitorial tasks.
The three areas are, in turn, subdivided according to categories which
represent the levels of seniority which personnel may achieve throughout their
career within the FPDO (FPDO Regulation Nº 1628/10, Art. 5). Legal Technical
and Legal Administrative members of staff are denominated “officers” while
the other members of staff are referred to as “employees” (FPDO Regulation
Nº 1628/10, Art. 2).
According to data gathered in December 2013, 2125 people constitute the
working force of the FPDO, detailed as follows:
set by the Law No. 26861 on “Democratic and equal admission of personnel
in the Nation’s Judiciary and the Federal Public Office”, which established the
public competition as the approved mechanism of personnel admission in the
referred jurisdictions. Implementing these rules and regulations has also stood
for emphasizing the competence and suitability of the Federal Public Office’s
personnel, according to Art. 16 of the National Constitution.
Personnel Tenure
Personnel working for the Federal Public Defender´s Office can be divided
into two groups: Appointed or permanent personnel with granted stability; and
temporary personnel that work for specific periods and for specific tasks.
The FPDO has the faculty to hire temporary personnel, in this sense, it can
contract services for a set period of time, it can contract work for a defined task
for the time the task demands, and it can contract temporary staff to cover
necessary demands from different areas of the Federal Public Defender´s
Office. Each of the categories above mentioned are related to their equivalents
in The Judiciary in terms of salary, pension and taxes (FPDO Regulation Nº
1628/10, Arts. 7 and 8).
The majority of the personnel (78%) at the Federal Public Defender´s Office
are permanent staff according to data gathered in December 2014.
D. Offices nationwide
Around 200 offices of the FPDO are distributed in the Argentine territory.
Some belong to the Federal Public Defender´s Office, as in the case of offices in
buildings or of independent premises, rented offices, and offices that have been
loaned to the Federal Public Office generally in the buildings of The Judiciary.
At present, all offices count with telephone service and Internet connection,
hence communication is carried out through e-mails and land telephoning.

Prison Commission
The Prison Commission was set up with the aim of achieving two main
objectives: To provide legal aid to those who are in prison or detainment, and
to monitor the conditions in which people are imprisoned –namely housing,
feeding, and medical care of those aided by the Public Defense– and the res-
pect for Human Rights standards in the field of imprisonment. The monitoring

assistance to families, particularly for its creation and while it is responsible for
the care and education of dependent children; special protection to mothers
during a reasonable period before and after childbirth; special measures of
protection and assistance on behalf of all children and young persons without
any discrimination for reasons of parentage or other conditions; protection to
the family by society and state; everyone’s right to an adequate standard of
living for themselves and their family, including adequate food, clothing and
housing, and to the continuous improvement of living conditions; the right of
everyone to the enjoyment of the highest attainable standard of physical and
mental health and for the healthy development of the child; the best interests
of the child being of a primary consideration; the right to education; the right to
just and favorable conditions of work and ensuring for himself and their family
an existence worthy of human dignity.
Likewise, the Program produces socio-environmental reports to accompany
prisoner’s release requests and domicile arrests for the Public Defenders. The
reports account for family and economic situation, and specifically focus on
the impact that deprivation of liberty effects on individuals and their families.
been working for the Commission in the City of Buenos Aires as from
July 1, 2008. Since the creation of this team, each and every child
unaccompanied or separated from their family that arrives in the
country and requests to be considered as a refugee is received and
assisted by a member of the team.
• Right to Health: The Commission works towards ensuring the right to
health by actions such as obtaining appointment for an initial medical
check-up for all the children and adolescents under its guardianship;
providing therapeutic assistance, and psychological care, all free of
charge.
• Right to freedom of worship: The Commission provides orientation to
its youngsters under legal guard on the religious services and places
of worship for their corresponding religions, and takes part in religious
festivities these youngsters may invite the Commission to attend.
• Right to family life: The Commission, according to a work agreement
with the International Commission of the Red Cross (ICRC), helps search
for relatives of the youngsters under its guardianship in their countries
of origin and works together with the International Organization of Mi-
grations (IOM) to achieve refugee family reunifications of those under
the guardianship of the Commission.
Similarly, the Head of the Commission travels to the countries of origin of
the children and adolescents under its guardianship to learn about the Human
Rights situation there. Hence, trips were made to Liberia, Sierra Leona, Guinea
Conakry and the Ivory Coast in January 2010.
Besides actions related to children and adolescents unaccompanied or
separated from their families, the Commission takes legal representation before
the National Refugee Commission (CONARE) of those people of age seeking
recognition as refugees who are aided by Public Defenders in their extradition
processes, or who are aided by the Migrant Commission of the Office of the
Federal Public Defender General in expulsion processes.
Protocol for the protection, assistance and durable solutions for unac-
companied and separated children seeking asylum: In 2011 was passed
the Protocol, for which this Commission collaborated with the National Com-
mission for Refugees (CONARE), the Federal Immigration Department (DNM),
the UNHCR, the latter local partner agencies (FCCAM and MyRAr), UNICEF,
IOM, the International Committee of the Red Cross (ICRC), the Secretariat for
Children, Adolescents and Family (SENAF), the Council for the Rights of Children
and Adolescents of the City of Buenos Aires and the Government of the City
of Buenos Aires. Since the Protocol was passed, the signatories have been
holding regular meetings to articulate the enforcement of the principles therein
agreed. The UNHCR Office for the Southern Cone of Latin America has publicly
considered the protocol performance as a very good practice in the protection

of refugee children, first of its kind in Latin America, and has shown interest in
such experience to be replicated in Latin America.
Besides the interventions related to unaccompanied and separated chil-
dren and adolescents, the Commission provides legal representation, before
the National Commission for Refugees (CONARE), to the adult refugee-status
petitioners assisted by public defenders in the extradition procedures, or by
the Migrant Commission of the Office of the Federal Public Defender General
in the expulsion process.
In fact, the Res. DGN Nº 1055/11 stipulated the creation of the Legal Coun-
seling and Representation Program for refugees and refugee-status petitioners.
The program, first of its kind in Latin America and one of the few in the
world, requires that the Commission legally represent any one who is requesting
the recognition of the refugee status in Argentina and willing to be given such
representation, from the very opening of the file and until its closure.
This actually implies providing legal representation, with the scope outlined
above, to an average 600 people a year, coming from over 60 countries.
Also, the Federal Public Defender’s Office entered into a cooperation agree-
ment with the CONARE and the UNHCR to ensure the right of people seeking
recognition of the refugee status to legal representation, through information
and referral mechanisms and joint training.
As a result of that, both the CONARE as the UNHCR collaborated in deve-
loping the content of the training course for the candidates aspiring to join the
program, as well as for the representatives of civil society organizations that
have been working in the defense of migrants’ and refugees’ rights.

opened. Moreover, decentralized offices have been opened in underprivileged
neighborhoods in the City (Barracas, Lugano 1 & 2, La Boca and Ciudad Oculta).
The latter service is provided in a joint effort together with the Centers for Access
to Justice operating under the State Department of Justice and Human Rights.

network and the follow-up of cases and support to Public Defenders on the
matter of indigenous peoples’ rights.
As mentioned above, training activities were carried out by the Program to
raise awareness and to make the rights of indigenous peoples better known.
For example, a leaflet was printed with basic concepts about the FPDO and the
Brasilia Regulations regarding Access to Justice for Vulnerable People. The
material was especially designed and produced by members of indigenous
communities who took part in a visit to the FPDO.
The Program also seeks to provide institutional and technical support to
Public Defenders in those cases in which members of any indigenous people
need assistance to defend their rights, acting as coordination and articulation
link with other institutions so as to satisfactorily meet their needs.
Performance before the Inter-American Human Rights System: Within the
framework of the intense activity in defense of indigenous peoples’ human
rights, the Federal Public Defender’s Office is giving the Potae Napocna Na-
vogoh Qom Community technical assistance in the judicial cases it initiated
aiming at getting the official recognition and securitization of the community
ages-long territory. Thus, representing Mr. Félix Diaz and the above mentioned
Qom Community, the OFPDG together with the Center for Legal and Social
Studies (Centro de Estudios Legales y Sociales - CELS), successfully requested
the rightful precautionary measures before the Inter-American Commission on
Human Rights (hereinafter IACHR). The precautionary measures are currently
still in force and in March 2012 the IACHR convened a work meeting with all
the parties involved, which was duly attended by the Office of the Federal Public
Defender General.
Migrant Commission
This Commission provides legal aid in order to support the defense and
promotion of the Human Rights of all migrants who inhabit the national territory
and are in conflict with our penal law.
The Migration Law, Law N° 25871, came into effect on July 7, 2010, by
means of the Decree 616/2010. This regulation enables the speeding of proce-
dures to be followed by foreigners who wish to inhabit the Argentine territory by
establishing a system of norms that complements and adapts the mechanisms
of protection of their rights. Art. 86 in the ruling decree establishes that the
Federal Public Defender´s Office will intervene to guard the interests of those
who wish to present administrative actions before the National Direction of
Migrations and do not have economic resources to do so.
The following actions are taken to promote the defense of the rights of
immigrants:
• Official visits: the Commission makes official visits to penitentiaries
which house immigrants assisted by the FPDO.

need it, within the scope of intervention of public defense, fostering advocacy
and awareness on the matter.
In addition, among its main objectives, the Program aims at promoting acti-
vities oriented to the defense and protection of human rights and the reduction
of barriers to access to justice for persons with disabilities and older adults,
in order to reach factual equality in the exercise of their fundamental rights,
strengthen the Federal Public Defender’s members’ skills in issues related to
the right to healthcare and in defending the rights of persons with disabilities
and older adults. Moreover, it also fosters policies oriented to raise awareness
towards the protection of the aforementioned groups’ human rights.
It carries out its activities in coordination with the rest of Programs and
Commissions of the Office of the Federal Public Defender General and inte-
grating the various national and international institutions that may collaborate
with the provision of these services.
One of the main activities carried out by this Program has been the elabora-
tion of the Protocol on Access to Justice for Persons with Disabilities. Proposals
for Adequate Treatment. (Protocolo para el Acceso a la Justicia de las Personas
con Discapacidad. Propuestas para un Trato Adecuado. – original title in Spa-
nish). The document was prepared under the II Regional Eurosocial Program
for Social Cohesion in Latin America, together with the City Public Prosecutor’s
Office and the State Department of Justice and Human Rights and coordinated
by our institution. It also had the key contribution of the President of the UN
Committee on the Rights of Persons with Dissabilities, María Soledad Cisternas
Reyes, and the support of Judge María Silvia Villaverde. The Protocol includes
concrete proposals and recommendations on the appropriate treatment to
be given to persons with disabilities and is oriented to justice administrators,
following the guidelines set out in the Convention on the Rights of Persons with
Disabilities and the Rules of Brasilia.
Along with a Trainers’ Training Plan, the Protocol was placed at the disposal
of over 70 Argentine justice administrators from different –national and inter-
national- spheres of intervention, reaching to the Judiciaries and the Federal
Public Defender and Prosecutor’s Offices of the 24 provinces in our country,
thanks to the agreement celebrated with Federal Court Board and the Supreme
Courts of the Argentine Provinces. This action has been taken hoping that it
would be a great plan to raise awareness and the subsequent commitment
to implement the enforcement of the right to an adequate treatment of the
persons with disabilities, in the daily work of each and every magistrate, official
and employee in the justice system.
have been working with the Centers for Access to Justice. These centers are
decentralized offices of the Federal Public Office, which are located throughout
the City of Buenos Aires, particularly in poor neighborhoods. The main objective
is aimed at removing structural barriers and facilitating access to justice for
vulnerable groups of the population, according to their specific legal needs. In
this sense, the team intends to provide an integrated service of information,
consultation, referral and assistance to suit these needs.
The role of this team is mainly addressing cases of institutional violence
and migrants’ expulsion, which are referred to the relevant areas of the Fede-
ral Public Defender’s Office. Secondly, it addresses all inquiries on criminal or
civil matters in which the different work units of the FPDO may intervene; or
ultimately provides directions, always in accordance with the objectives and
scope of the terms set in the “Brasilia Regulations regarding Access to Justice
for Vulnerable People”.
A. Counseling Functions
National Legislation
The FPDO takes part in specific requests and it also proposes participation
in the discussion of public policies and collaboration in structural changes.
Among the duties and attributions assigned to the Office of the Federal
Public Defender General, the OLFPO includes those of submitting to The Legis-
lature the opinion of the FPDO on the convenience of certain legislative reforms,
and to the Executive Branch if the matter is related to regulatory reforms. The
FPDO is also entitled to respond any consultation from the President of the
Republic, Ministers of the Executive Branch, the Presidents of both Chambers
of Congress, the Supreme Court of Justice and the President of the Magistrate’s
Council (Art. 51 sec. k and l).
An area within the FPDO is dedicated to the follow-up of legislative projects
being treated at Congress that are institutionally relevant. This section produces
drafts or proposes amendments to already presented drafts.
In terms of criminal law, in 2007, the FPDO was invited by the National Exe-
cutive Branch to take part in the Commission that was to draft the bill for the
National Code of Criminal Procedure. The Commission worked at the National
Justice Department and Human Rights and presented the corresponding bill
draft. The relevance of the FPDO participation in the process resided in gran-
ting the observance of constitutional rights and guarantees as established by
international Human Rights treaties. It is thus that rights such as the right to
trial within a reasonable period of time, the right to be judged by an impartial
judge, and the need to consider preventive incarceration as an exceptional
precautionary measure were guarded.
Within the body of bill drafts presented by the FPDO it is worth to mention
the regulation of Law Nº 26485 on “Integral protection to prevent, punish
and eradicate all violence against women in their interpersonal relations en-
vironments/ habitats”. The FPDO Commission on Gender Issues took part in
the Judges Panel that drafted the regulation of the law, which was submitted
to the National Executive Branch (Executive Branch Decree Nº 1011/2010,
Law 26.485 ruling).

sents one of the biggest breakthroughs before the Inter-American system is the
one known as “Life imprisonment for Minors”. In this case, the Argentine State
was denounced for the violation to the norms of the American Convention on
Human Rights and the Convention on the Rights of the Child in that these ins-
truments set mandatorily there should be differentiated sentencing for minors,
as well as in the sense that their physical integrity is at stake. In the years that
minors have been under detention, they have been subject to innumerable and
unjustifiable transfers and abuse. On November 2, 2010, the IACHR issued the
Report Nº 172/10 in terms of Art. 50 of the American Convention on Human
Rights on the case mentioned.
Therein the IACHR stated that the Argentine Republic violated the rights
comprised in Articles 1.1, 2, 5.1, 5.2, 5.6, 8.2.h, and 19 of the Convention,
regarding Mr. Cesar Mendoza, Claudio Nunez, Lucas Mendoza, Saul Roldan
Cajal and Ricardo Videla Fernandez; the rights provided in Articles 8.2.e 8.2.d
of the ACHR in the case of Cesar Roldan and Saul Mendoza Cajal; the rights
established in Articles 4.1 and 5.1, 8.1 and 25.1 of the ACHR to the detriment
of Ricardo Videla Fernandez and his family; and the rights comprised in Articles
5.1, 5.2, 8.1 and 25.1 of the ACHR and 1, 6 and 8 of the Convention to Prevent
and Punish Torture in the case of Lucas Mendoza and Claudio Nuñez. The report
recommended that the Argentine State take certain measures to redress the
rights of Cesar Mendoza, Claudio Nunez, Lucas Mendoza, Saul Roldan Cajal
and Ricardo Videla Fernandez, along which a reform of the Penal System of
the procedural law on the right to appeal. Finally, the Commission recommen-
ded the implementation of training programs for prison staff on human rights
standards, improvement of the detention conditions in the Provincial Prison of
Mendoza, and financial compensation for each of the victims and their families.
Finally, the case stood before the Inter-American Court of Human Rights
(ICHR). In an historic decision, the ICHR found the Government of Argentina guilty
of human rights violations for imposing sentences of “perpetual deprivation of
freedom” against five people for crimes they committed during childhood. The
ICHR also found the State internationally responsible because the criminal
procedure codes applied did not allow a comprehensive review of criminal
judgments by a higher court, for the lack of adequate medical care to one of
the children referred to above, for having inflicted torture against two of the
victims without investigating the facts properly, as well as for failing to properly
investigate the death of one of those while in state custody. This precedent was
the first case resolved by the ICHR that has a public defender in its all procedure.
As for the rights of indigenous people, and as mentioned above in the
description of the Program on Cultural Diversity, the IACHR passed for the first
time a precautionary measure petition regarding an indigenous community: the
one requested by the FPDO to guarantee the safety and security of Mr. Felix
Diaz and the community he represents.

B. Presentation of Reports
It is legally mandatory for the Federal Public Defender General to annually
submit a report on the activity of the Federal Public Defender´s Office to the
National Congress every fiscal year. The report should also include an evaluation
of the work produced during the period as well as suggestions for improvement
(Law Nº 24946, Art. 32). Citizens may check the information provided in the ins-
titutional website (http://www.mpd.gov.ar), where the report is later uploaded.
C. Promotional Activities
Training Activities
Various training activities are offered to members of the FPDO through the
General Secretariat of Training and Jurisprudence, and through the Programs
and Commissions of the FPDO.
To achieve this purpose, an ample and varied training is implemented so
as to technically instruct the FPDO personnel and foster the ideological com-
mitment necessary for a modern and efficient management of the institution
in pursue of the protection of the fundamental rights.
Teleconferencing has been implemented to make it possible for all offices
in the country to have access to Conferences and talks delivered in the City of
Buenos Aires. This technological development is a response to the wide territorial
coverage of the FPDO and gives an answer to the training needs of its personnel.
In addition, in 2013, our institution created the Justice Service School in a
combined effort with the Federal Public Prosecutor’s Office, in order to develop
joint training activities.
Within this framework, we created the Magistracy Specialization Graduate
Degree, the outstanding characteristics of which are, on the one hand, the
conception of justice as a service to society and, on the other, the fact that it is
free of charge –completely unprecedented in graduate degrees- and open both
to justice administrators and to public and private licensed lawyers.

Inter-American standards of human rights, it selects cases in higher national
courts where rules and principles of human rights were used. The network is
sponsored by the Inter-American Commission of Human Rights and it is sup-
ported by the Inter-American Institute of Human Rights, among others.
Finally, seminars, teleconferences, courses, workshops and training activi-
ties organized within the FPDO are distributed together with activities organized
by other national or provincial institutions that may be deemed relevant to
FPDO members.

the Federal Penitentiary Service called: “Guía de Recursos para la Asistencia
de Mujeres Víctimas de Violencia Familiar, Sexual o de Trata de Personas en la
Ciudad de Buenos Aires”; and the booklet on “Restricciones a la persecución
penal del delito de aborto y principios de accesibilidad al aborto no punible”
(a compilation of decision by international institutions and of case law from
national and local courts).
The FPDO is mainly concerned with ensuring effective assistance and legal
defense of the rights of people.
this sense, contact is kept with the Judicial, Legislative and Executive Branches
in the above mentioned levels.
The FPDO and the CSJN work coordinately together, honoring the agreement
signed between both parties, in denounces of violence against women in their
family or interpersonal relations.
In December 2009, the Federal Public Defender General decided to join
the investigation undertaken by the Office of Women Issues for the National
Supreme Court of Justice for the creation of the first “Gender Map of the Ar-
gentine Justice”. The purpose of the map was to establish the occupational
distribution per gender in the Judicial Power in order to identify the obstacles
and needs of women who are part of the administration of justice.
The FPDO maintains fluent contact with both chambers of the National
Congress and it takes part in meetings of their commissions. It helps in the legal
process by means of the presentation of rulings and opinions on bill drafts where
the scope of human rights protected by international human rights instruments
seeks to be regulated. The FPDO is regularly consulted before bills are passed.
Programs and Commissions of the FPDO are in charge of connecting with
state institutions which look after and design public policies in human rights
matters.
Finally, the Federal Public Defender General participates in the Federal
Council of the Public Defense of the Argentine Republic that acts as coordina-
tion among defenders and general counselors of the Provinces and the City of
Buenos Aires and the Federal Public Defender General before Higher Provincial
Courts. The objective of the council is to create a setting for an organic and
ordered meeting place for representatives of the highest hierarchy of the public
defense in the Argentine territory so as to design actions for the strengthening
of the public defense institutions and help towards its total emancipation from
other powers of State.
