Preamble
We, the sovereign Filipino people, imploring the aid of Almighty God, in order to build a just and humane society and establish a
Government that shall embody our ideals and aspirations, promote the common good, conserve and develop our patrimony, and
secure to ourselves and our posterity the blessings of independence and democracy under the rule of law and a regime of truth,
justice, freedom, love, equality, and peace, do ordain and promulgate this Constitution.
- The preamble introduces the Constitution by explaining the goals and purpose of the document. The preamble to the Philippine
Constitution explains that they are forming a government based on the values of truth, justice, freedom, love, equality, and
peace.
- It's like the introduction to a book or the "Purpose" section of a company document. The preamble tells you the who, why and
what or identifies the author and the purposes of the fundamental law and aids the authorities in the interpretation of the
Constitution since it lays down the visions of the government.
- "We, the sovereign Filipino people"... This part tells who is involved.
- in order to build a just and humane society and establish a Government that shall embody our ideals and aspirations, promote
the common good (basis of the Police Power), conserve and develop our patrimony, and secure to ourselves and our
posterity…… This part tells what the Constitution is intended to do.

ARTICLE II: DECLARATION OF POLICIES AND STATE PRINCIPLES


Section 9: The State shall promote a just and dynamic social order that will ensure the prosperity and independence of the nation
and free the people from poverty through policies that provide adequate social services, promote full employment, a rising standard
of living, and an improved quality of life for all.
- In this provision, the state solves at the same time a chain of social problems that comes with it: social unrest, breakdown of
family systems, diseases, ignorance, criminality, and low productivity.
- Just and Dynamic Social Order: This is accomplish through policies that: a.) Provide sufficient social services (in the field of
health, education, housing, etc). b.) Promote full employment c.) A rising standard of living d.) Improve quality of life for all.

- Republic Act No. 10532, This Act shall be known as the “Philippine National Health Research System Act of 2013”. It is
hereby declared the policy of the State to protect and promote the right to health of the people, instill health consciousness
among them and improve the quality of life of every Filipino through health research and development initiatives.
Section 10: The State shall promote social justice in all phases of national development.
- The policy mandates that the government will promote equality and fairness for all in its functions that enhance society.
- The state must give preferential attention to the welfare of the less fortunate members of the community: the poor,
uneducated, underprivileged, and disabled.
- Republic Act No. 1161, as amended, otherwise known as the "Social Security Law", It is the policy of the Republic of the
Philippines to establish, develop, promote and perfect a sound and viable tax-exempt social security service suitable to the
needs of the people throughout the Philippines which shall promote social justice and provide meaningful protection to
members and their beneficiaries against the hazards of disability, sickness, maternity, old age, death, and other contingencies
resulting in loss of income or financial burden. Towards this end, the State shall endeavor to extend social security protection
to workers and their beneficiaries.
Section 11: The State values the dignity of every human person and guarantees full respect for human rights.
- The recognition that the human person is the end and purpose of every social organization was implied in this provision.
- Human Rights Basis: Belief in inherent dignity (HUMAN DIGNITY) of every human person.
- A human person is a being not a thing: In a democratic state, the individual enjoys certain rights which cannot be modified or
taken away by the lawmaking body.
- Republic Act No. 10368, otherwise known as the “Human Rights Victims Reparation and Recognition Act of 2013”. Section 11
of Article II of the 1987 Constitution of the Republic of the Philippines declares that the State values the dignity of every human,
person and guarantees full respect for human rights. Pursuant to this declared policy, Section 12 of Article III of the Constitution
prohibits the use of torture, force, violence, threat, intimidation, or any other means which vitiate the free will and mandates
the compensation and rehabilitation of victims of torture or similar practices and their families.
Section 18: The State affirms labor as a primary social economic force. It shall protect the rights of workers and promote their
welfare.
- Human labor is not only treated as land, tools, or machinery. It mandates the State to provide living wage and full
participation to workers in decision-making processes which affects their rights and benefits.

- LABOR: 1. Right to self-organization 2. Right to collective bargaining 3. Right to collective negotiation. 4. Right to peaceful and
concerted activities including the right to strike. 5. Right to security of tenure. 6. Right to just and human condition of work 7.
Right to a living wage. 8. Right to participate in policy and decision- making processes.
- Republic Act No. 10771, This Act shall be known as the “Philippine Green Jobs Act of 2016”. It is the declared policy of the
State to:
 Affirm labor as a primary social economic force in promoting sustainable development;
 Afford full protection to labor, local and overseas, organized and unorganized, and promote full and productive
employment and equality of employment opportunities for all; and
 Promote the rights of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature.
 The State shall identify needed skills, develop training programs, and train and certify workers for jobs in a range of
industries that produce goods and render services for the benefit of the environment, conserve natural resources for
the future generation, and ensure the sustainable development of the country and its transition into a green economy.
In recognition of the participation of individuals and business enterprises in jobs creation, the State shall provide
incentives therefor.
Section 21: The State shall promote comprehensive rural development and agrarian reform.
- Covers all phases of rural development: Economic, Social, Political, Cultural and Industrial.
- Republic Act No. 10618, This Act shall be known as the “Rural Farm Schools Act”. It is hereby declared to be the policy of the
State to protect and promote the right of all citizens to quality education at all levels and take appropriate steps to make such
education accessible to all. Further to this, the State shall establish, maintain and support a complete, adequate and integrated
system of education relevant to the needs of the people and society and encourage non-formal, informal and indigenous
learning systems, as well as self-learning, independent and out-of-school study programs particularly those that respond to
community needs.
Section 22: The State recognizes and promotes the rights of indigenous cultural communities within the framework of national unity
and development.
- Recognizes the existence and the rights of the indigenous cultural communities.
- Directs the state to promote the rights of the indigenous cultural communities by considering their customs, traditions, beliefs,
and interests.

- Implementing state policies with full respect to their culture, dignity, uniqueness, and human rights.
- The State shall protect the rights of ICCs/IPs to their ancestral domains to ensure their economic, social and cultural well-
being and shall recognize the applicability of customary laws governing property rights or relations in determining the
ownership and extent of ancestral domain.
Section 26: The State shall guarantee equal access to opportunities for public service, and prohibit political dynasties as may be
defined by law.
- This does not allow the existence of political dynasties or the practice of keeping political power within the control of select
families.
- Emphasizes the duty of government to uphold democratic elections and appointments.
- Republic Act No. 10742, This Act shall be known as the “Sangguniang Kabataan Reform Act of 2015” Declaration of State
Policies and Objectives. – The State recognizes the vital role of the youth in nation-building .and thus, promotes and protects
their physical, moral, spiritual, intellectual and social well-being, inculcates in them patriotism, nationalism and other desirable
values, and encourages their involvement in public and civic affairs.
 In the SK Reform Act, Congress for the first time has adopted an enabling legislation for the policy of prohibiting political
dynasties under the 1987 Constitution.
 Under Republic Act 10742 or the SK Reform Act, SK bets “must not be related within the second civil degree of
consanguinity or affinity to any incumbent elected national official or to any incumbent elected regional, provincial, city,
municipal or barangay official in the locality where he or she seeks to be elected.”
 This covers the spouse of the incumbent barangay captain and members of the sangguniang barangay if they are still
within the 18-24 age bracket, their “first degree relatives” (like their children), and “second degree relatives” (like their
grandchildren or their siblings).
