House of Representatives

Dear Representatives Goodlatte and Gowdy:
L write on behalf of my client, former FBI Director James B. Comey, and in response to
your letter to me dated September 21, 2018, in which you, on behalf of the House Committee on
the Judiciary and the Committee on Oversight and Government Reform, request a transcribed,
closed door interview of Mr. Comey. We understand from your correspondence that your
committees are jointly investigating “decisions made and not made during the 2016 election by
the Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI).”
Mr. Comey respectfully declines your request for a private interview. He would,
however, welcome the opportunity to testify at a public hearing. Given that Mr. Comey no longer
has a security clearance, we do not anticipate the public setting to present concerns about the
disclosure of classified information, Moreover, we also expect that, because any information
about which you may inquire was acquired by Mr. Comey while he was in the employ of the FBI,
you will obtain in advance the necessary approvals from the FBI for Mr. Comey to disclose FBI
information that may be responsive to your examination.
Because Mr. Comey has a variety of commitments in the coming months, please contact
me as soon as possible to schedule a hearing date.
Sincerely,
N. Kelley
