Ricketson GBI, Region 13 - Perry Field Office 108 Woodlawn Drive Perry, GA 31069 RE: GARY DEWAYNE LEE Investigation GBI case number: 13-0034-23-19 Incident date: August 13, 2018 Special Agent-in-Charge Ricketson: Thave reviewed the GBI case file regarding statements made by Gary Lee at a City of Wamer Robins Department Directors meeting on August 13, 2018. Numerous department heads and city employees were present at this meeting (Mayor Randy Toms, Jim Elliott, Mandy Stella, Kathy Opitz, Bill Mulkey, Ross Moulton, Jarred Reneau, George Brannen, Sheri Windham, Kim Demoonie, and Gary Lee). During the meeting, Gary Lee said essentially “I'm going to cut her head off” referring to Sheryl Frazier, CEO of Warmer Robins Housing Authority. Ms. Frazier was not present at this August 13* meeting. On August 15, 2018, Gary Lee called Ms. Frazier and said something along the lines of “I just want to say that I am sory, that was a slip of the lip, that my grandmother and mother did not raise me that way.” Terroristic Threats & Acts, O.C.G.A. 16-11-37, is a crime in Georgia and requires (per these facts) the threat to commit any crime of violence (that arguably exists here) and that such threat be made with intent to terrorize another. O.C.G.A. 16-11-37(b)(2)(A). After a complete review of the file, I see no evidence that the statement by Gary Lee was made with intent to terrorize Ms. Frazier who, again, was not present and did not hear the comment. Therefore, I am not presenting any charges to the Grand Jury or taking any other prosecutorial action.
