Subject : Information on the results of MEPC 59

MEPC. 59 was held in London from 13 to 17 July 2009. In this regard, significant matters
on its session are summarized as follows.

1) Adoption of amendments to the MARPOL Annex Ⅰ


2) Unified Interpretation on the MARPOL Convention
3) Resolution on the MARPOL Convention
4) The matters to be discussed on the Ballast Water Management Convention
5) The matters to be discussed on the Ship Recycling Convention
6) The matters to be discussed on control of GHG emissions from ships
7) Other main issues

1. Adoption of amendments to the MARPOL Annex Ⅰ

1.1 Res.MEPC.186(59) → Enter into force on 1 January 2011


Addition of a new chapter 8(Reg. 40, 41, 42) to the MARPOL Annex Ⅰ
○ Reg. 40(Scope of application) :
This regulations contained in this chapter apply to oil tankers of 150 GT and above
engaged in the transfer of oil cargo between oil tankers at sea(STS operations) and
their STS operations conducted on or after 1 April 2012.
○ Reg. 41(General rules on safety and environmental protection)
• Any oil tanker involved in STS operations shall carry on board the STS operations
Plan approved by the Administration not later than the date of the first annual,
intermediate or renewal survey of the ship to be carried out on or after 1 January
2011.
• The STS operations Plan shall be developed taking into account the information
contained in the best practice guidelines for STS operations identified by the
Organization, i.e., IMO's "Manual on Oil Pollution, Section Ⅰ, Prevention" as
amended, and the ICS and OCIMF "Ship-to-ship Transfer Guide, Petroleum", fourth
edition, 2005⌟.

• The person in overall advisory control of STS operations shall be qualified to
perform all relevant duties, taking into account the qualifications contained in the
best practice guidelines for STS operations identified by the Organization as
mentioned above.
• Records of STS operations shall be retained on board for three years.
○ Reg. 42(Notification) :
• Each oil tanker subject to that plans STS operations within the territorial sea, or the
exclusive economic zone of a Party to the present Convention shall notify that Party
not less than 48 hours in advance of the scheduled STS operations.
○ New section 8A related to STS operations is added to From B of supplement to the
IOPP certificate.

1.2 Res.MEPC.187(59) → Enter into force on 1 January 2011


Amendments to regulations 1, 12, 13, 17 and 38 of MARPOL Annex Ⅰ,
Supplement to the IOPP Certificate and Oil Record Book part Ⅰand Ⅱ
○ Reg. 1(Definitions) : New definitions concerning oil residues(sludge), oil residue(sludge)
tank, oily bilge water, oily bilge water holding tank are added.
○ Reg. 12(tanks for oil sludge) : The requirements for the sludge tank is transferred
from an unified interpretation to the formal regulation and revised partially as follows.
• Reg. 12.3.2.1 : The oil residue(sludge) tank(s) shall be provided with a designated pump
for disposal that is capable of taking suction from the oil residue(sludge) tanks(s).

<Refer to MEPC.1/Circ.642 Flow Diagram of Integrated Bilge Water Treatment System (IBTS)>

• Reg. 12.3.2.2 : Sludge tanks shall be separated from bilge systems. But arrangements
may be made for draining of settled water from the sludge tanks to an oily bilge
water holding tank or bilge well if manually operated self-closing valves and

arrangements for subsequent visual monitoring of the settled water are provided.
○ Reg. 12, 13, 17, 38 : The word “sludge” is replaced by the words “oil
residue(sludge)”, and the existing words “and other oil residues” are deleted.
○ Amendments to the supplement to the IOPP certificate form A and form B :
• “Paragraph 3.2.3 - Tank for mixing oil residues with fuel oil, capacity

m ” on the
IOPPC form A/B is deleted.
• “(Double bottom requirements)” on the Paragraph 5.8.2 of IOPPC form B is deleted.

• The checking item of paragraph 5.8.5 and 5.8.7 on the IOPPC form B is subdivided.

• “Paragraph 6.1.5.4 - Oil like noxious liquid substances” on the IOPPC form B is
deleted.
○ Amendments to the Oil Record Book parts Ⅰ
• Paragraph 11.4(quantity of residue collected by manual operation) on the Code (C) is added.

• Paragraph 15.3(transfer of bilge water to slop tank or holding tank or other tanks)
of Code (d) is added.
○ Amendments to the Oil Record Book parts Ⅱ : The title of Code (J) is partially
amended.

2. Unified Interpretation on the MARPOL Annex Ⅰ

2.1 MSC-MEPC.5/Circ.5 Measurements of distance


○ The measurement of distances between the inner and outer skins for protecting the
spaces inside, relevant to the SOLAS, MARPOL, Load Lines Conventions, and other
instruments, whereby, unless explicitly stipulated otherwise, distances are to be
measured by using moulded dimensions.

MARPOL Annex Ⅰ / Reg. 23.7.3.2
○ The unified interpretation to regulation 23.7.3.2 of MARPOL Annex Ⅰ on the
overpressure to be set for calculation of cargo oil level after damage of an oil tanker
had been agreed at MEPC 58.

The pressure “p” is to be taken as the maximum static inert gas pressure that is
obtained at the discharge side of the non-return device fitted forward of the deck
water seal or 5 kPa, whichever is greater. However, p need not be taken more
than the maximum tank pressure corresponding to the P/V valve set-point.

○ But, a comment was raised that the above MARPOL Unified Interpretation has
unjustly applied an exceedingly conservative pressure. MEPC 59, therefore approved
new revised wordings as follows for a “simplified approach”.

If an inert gas system is fitted, the normal overpressure, in kPa, is to be taken as 5 kPa.

2.3 MEPC.1/Circ.675
Tentative discharge criteria of cargo hold washing water in the Gulfs area and
Mediterranean sea area
○ Until on going review of MARPOL Annex Ⅴ is adopted and entered into force, the
tentative discharge criteria of cargo hold washing water for temporary use were
agreed as follows.
• Cargo hold washing water, containing the remnants of any dry cargo material,
generated in connection with the ship cleaning its cargo holds should not be treated
as garbage under MARPOL Annex V within the Gulfs Area and Mediterranean Sea
Area.
• In the above case, such cargo hold washing water may be discharged at a greater
distance than 12 nautical miles from shore within these areas. Cargo residues in the
washing water must not originate from a cargo material that is classified as a
marine pollutant in the IMDG Code.

3. Resolution on the MARPOL Convention

3.1 Res.MEPC.180(59) → MEPC invites Governments to follow this recommend


from 1 July 2010
Amendments to the survey guidelines under the HSSC(Harmonized System
of Survey and Certification) for the revised MARPOL ANNEX VI
○ Initial, Annual, Intermediate and Renewal Survey items under the MARPOL Annex Ⅵ
adopted by Res.MEPC.180(59) which is expected to enter into force on 1 July 2010
are provided as follows.
• Initial survey : Surveys related to facilities containing Ozone Depleting Substance,
Diesel Engines on NOx, Equipment on SOx and Particulate Matter, Facilities on
Volatile Organic Compounds and each Shipboard Incinerator shall be carried out.
- Ozone Depleting Substance : confirming that no installation or equipment
containing ozone depleting substances has been installed after 19 May 2005,
other than hydro-chlorofluorocarbons(HCFCs).
- NOx : Confirming which marine diesel engines are required to be certified with
EIAPP certificate.
- SOx and PM : confirming that satisfactory arrangements are in place for using
compliant fuel as required.
- Volatile Organic Compounds : confirming the satisfactory installation of the
vapour collection piping.
- Shipboard Incinerator : confirming the satisfactory installation and operation of
each incinerator.
• Annual Survey, Intermediate Survey and Renewal Survey : confirming the validity of
each document and actual conditions

3.2 Res.MEPC.181(59) → MEPC invites Governments to follow this recommend


from 1 July 2010
Guidelines for Port State Control under the revised MARPOL ANNEX VI
○ Guidelines for Port State Control under the MARPOL Annex Ⅵ adopted by Res.MEPC.181(59)
which is expected to enter into force on 1 July 2010 are provided as follows.
• Initial inspection : confirming whether documents required by the Annex with regard to
ozone depleting substance, NOx, SOx & PM, and VOCs are clearly valid and maintained.
• Detailed inspection : confirming whether facilities for ozone depleting substance, NOx,
SOx & PM, and VOCs are properly maintained.
• Detainable deficiencies :

- absence of valid IAPP certificate, EIAPP certificate or Technical File.
- each marine diesel engine does not comply with the relevant NOx emission limit.
- the sulphur content of any fuel oil being used does not compliant with the
relevant requirement.
- an incinerator installed on board the ship on or after 1 January 2000 does not
comply with requirements contained Ⅳ to the Annex, or the standard
specifications for shipboard incinerators developed by the Organization.
- the master or crew are not familiar with essential procedures regarding the
operation of air pollution prevention equipment.

3.3 Res.MEPC.182(59) → MEPC invites Governments to follow this recommend


from 1 July 2010
Guidelines for the sampling of fuel oil for determination of compliance wite
the revised MARPOL Annex Ⅵ
○ The primary sample should be obtained by one of the following methods :
• manual valve-setting continuous-drip sampler;

• time-proportional automatic sampler; or

• flow-proportional automatic sampler


○ Sampling location : A sample of the fuel delivered to the ship should be obtained at
the receiving ship’s inlet bunker manifold and should be drawn continuously
throughout the bunker delivery period.

3.4 Res.MEPC.184(59) → MEPC invites Governments to follow this recommend


from 1 July 2010
Guidelines for Exhaust Gas Cleaning Systems
○ The Administration of a party should take into account any relevant guidelines
developed by the Organization pertaining to alternatives provided for in regulation 4
of the MARPOL Annex Ⅵ.
○ Values corresponding to the emission limits of SOx Exhaust Gas Cleaning Systems in
accordance with regulation 14.1 or 14.4 of the MARPOL Annex Ⅵ are as follows.

3.5 Res.MEPC.185(59) → Crude oil tankers should apply this guideline from 1
July 2010
Guidelines for the development of a VOC Management Plan
○ The revised MARPOL Annex Ⅵ requires a tanker carrying crude oil to have onboard
and implement a VOC management plan approved by the Administration from 1 July
2010.
○ MEPC approved MEPC.1/Circ.680 on Technical information on systems and operation
to assist development of VOC management plans.

4. The matters to be discussed on the BWM Convention

4.1 The status of Ballast Water Management Systems that make use of active
substances is as follows.
○ Approval status of active substance up to MEPC 58 is provided in the BWM.2/Circ.16
(2008.10.17).
○ Basic approval status in MEPC 59 concerning the active substance of ballast water
management system makes use active substances is as follows.
• The Hyundai Heavy Industries Co., Ltd. (HHI) Ballast Water Management System
(EcoBallast) proposed by the Republic of Korea in document MEPC 59/2/4.
• The AquaTriComb
TM
Ballast Water Treatment System proposed by Germany in
document MEPC 59/2/8.
• The Blue Ocean Shield Ballast Water Management System proposed by China in
document MEPC 59/2/2.
○ Fanal approval status in MEPC 59 concerning the active substance of ballast water
management system makes use active substances is as follows.
• The NK-O3 BlueBallast System (Ozone) proposed by the Republic of Korea in
document MEPC 59/2/3.
• The RWO Ballast Water Management System (CleanBallast) proposed by Germany
in document MEPC 59/2.
• The Hitachi Ballast Water Purification System (ClearBallast) proposed by Japan in
document MEPC 59/2/5.
• The Greenship Sedinox Ballast Water Management System proposed by the
Netherlands in document MEPC 59/2/6.

4.2 Use of potable water as ballast water


○ The MEPC noted that the chemical in the potable water could be potentially

discharged and agreed that if the usage is for ballast water then this should be
subject to the Ballast Water Management Convention. But, this issue will be
re-visited when the “Procedure for assessing other methods of ballast water
management” currently under development by the BLG Sub-Committee is finalized.

4.3 Consideration on the availability of Ballast Water Management System for


ships constructed in 2010 with a Ballast Water Capacity of less than 5,000
cubic metres subject to regulation B-3.3
○ The Committee, noting that postponing the dates stipulated in regulation B-3.3 would
not be beneficial to the implementation process and would not stimulate the
installation of new ballast water technologies on board ships, concluded that no
changes to Assembly resolution A.1005(25) were needed with respect to ships
constructed in 2010.

5. The matters to be discussed on the Ship Recycling Convention

5.1 Adoption of a Ship Recycling Convention and requirements for entering into
force of this convention
◯ A new "International Convention for the Safe and Environmentally Sound Recycling of
Ships(hereinafter referred to as the Ship Recycling Convention or the Convention)"
was adopted through a diplomatic conference to be held in Hong Kong, from 11 to 15 May
2009.
◯ This Convention shall enter into force 24 months after the date on which not less
than 15 States have either signed it, the combined merchant fleets of the States
constitutes not less than 40 per cent of the gross tonnage of the world's merchant
shipping and the combined maximum annual ship recycling volume of the signed
States during the proceeding 10 years constitutes not less than 3 per cent of the
gross tonnage of the combined merchant shipping of the same States.

(15 States + 40 % + ship recycling capacity of 3% of that fleet)

<Interpretation> The combined maximum annual ship recycling volume of the signed
States during the proceeding 10 years constitutes not less than 3 per
cent of the gross tonnage of the combined merchant shipping of the
same States.

5.2 Res.MEPC.178(59)
Calculation of recycling capacity for meeting the entry-into-force conditions
of this convention
◯ It was concluded that year's Lloyd's Register-Fairplay annual publication World Casualty
Statistics should be used when the maximum annual ship recycling volume is calculated.

5.3 Res.MEPC.179(59) → This guidelines should be applied as soon as possible,


or when the Convention becomes applicable to them
Guidelines for the development of the Inventory of Hazardous Materials
◯ These Guidelines provide recommendations for developing the Inventory of Hazardous
Materials (hereinafter referred to as “the Inventory”) to assist compliance with
regulation 5(Inventory of Hazardous Materials) of the Ship Recycling Convention.
◯ Materials not required to be listed in the Inventory (section 3.3) :
It was concluded that solid metals or metal alloys used in a ship’s general
construction that contains hazardous materials listed in Table B need not be listed in
the Inventory.

◯ Treatment of the cases where the necessary Material Declaration(MD) cannot be
obtained for the development of Part I of the Inventory for new ships (section 4.1.1) :
MEPC concluded that it was counterproductive for the guidelines to legitimize non
compliance to the requirements of the Convention and therefore agreed to delete the
text related to the extension up to the next renewal survey in the draft guidelines.
◯ For reference, it is kindly informed that a Technical Information(2009018/IMO) titled
as “Guidance for the development of Part Ⅰ of the Inventory of Hazardous
Materials(IHM) for new ships” was circulated by this society.

5.4 Proposed sequence for the development of the guidelines


◯ guidelines for safe and environmentally sound ship recycling
◯ guidelines for the development of the Ship Recycling Plan
◯ guidelines for the authorization of Ship Recycling Facilities
◯ guidelines for survey and certification
◯ guidelines for inspection of ships

6. The matters to be discussed on control of GHG emissions from ships

6.1 Issues on Green House Gas


○ The MEPC 59 agreed that all documents and the debates on the type of legal
instrument and application issues, in their entirely, should be left for future sessions,
and agreed that this session should concentrate on the technical, the operational and
the market based measures.

6.2 Matters related to Energy Efficiency Design Index(EEDI) for new ships
○ MEPC.1/Circ.681 : “Interim Guidelines on the Method of Calculation of the Energy
Efficiency Design Index for New Ships” is approved.
The latest draft formula is as follows.

○ MEPC.1/Circ.682 : “Interim Guidelines for Voluntary Verification of the Energy


Efficiency Design Index (2 stage : Preliminary verification at the
design stage - Verification of the Attained EEDI at sea trial)” is
approved.
○ The MEPC agreed that the scope of the EEDI should be wide to allow all ship types
to be tested on a voluntary basis, with the aim of allowing a maximum of

experiences to be gained in the trials.
○ For reference, technologies for reducing carbon need to be introduced in order to
obtain an attained index complying with the required index to be reinforced step by
step in the future. In this regards, the factor concerning technologies for reducing
carbon located to the numerator of the EEDI formula are as follows.

6.3 Matters related to Ship Energy Efficiency Management Plan(SEEMP)


○ MEPC.1/Circ.683 : “Guidance for the Development of a Ship Energy Efficiency
Management Plan” is approved.
○ Interesting parties are invited to use SEEMP in accordance with this Guidance
(MEPC.1/Circ.683) on a voluntary basis.
○ The SEEMP seeks to improve a ship's energy efficiency through four steps.
• Planning :
Guidelines on Best Practices for fuel-efficient operation of ships set out in
paragraph 4 below can be used to facilitate this part of the planning phase.
• Implementation :
The planned measures should be carried out in accordance with the predetermined
implementation system. Record-keeping for the implementation of each measure is
beneficial for self-evaluation at a later stage.
• Monitoring :
The EEOI(MEPC.1/Circ.684) developed by the Organization is one of the
internationally established tools to obtain a quantitative indicator of energy
efficiency of a ship and/or fleet in operation, and can be used for this purpose.
• Self-evaluation and improvement :
The self-evaluation is to evaluate the effectiveness of the planned measures and of
their implementation and to develop the improved SEEMP for the next cycle.

6.4 Matters related to Energy Efficiency Operational Indicator(EEOI)


○ MEPC.1/Circ.684 : “Guidelines for Voluntary Use of the Energy Efficiency Operational
Indicator” is approved.
○ The purpose of this guidelines on EEOI is to establish a mechanism for ship owners
to improve the energy efficiency of a ship’s operation.
○ Formula of the EEOI is defined as the ratio of mass of CO2 emitted per unit of

transport work.

6.5 Consideration of proposals on market-based measures


○ Proposed market-based mechanisms, such as a global emission trading scheme for
ships and a global contribution scheme (levy), has been considered in the MEPC.
○ Work plan(MEPC 59/24 Annex 16) for further consideration of Market-Based
Measures is approved.
○ Key items of the work plan concerning market-based measures are as follows.
• MEPC 60 would further consider the methodology and criteria for feasibility studies
and impact assessments in relation to international shipping.
• MEPC 61 would evaluate further and identify the elements that could be included in
such a measure.
• MEPC 62 would be in a position to report progress on the issue to the twenty-
seventh regular session of the Assembly, to identify possible further steps.

7. Other main issues

7.1 Annex 11 of MEPC 59/24


Draft amendment to Regulation 13 and 14 of the revised MARPOL Annex Ⅵ
○ Proposed Emission Control Area for NOx, SOx & PM covering all coastal waters to
200 nautical miles from the territorial baseline of the United States and Canada was
approved at this session with a view to adoption at MEPC 60.

7.2 Annex 27 of MEPC 59/24


Amendments to Res.MEPC.121(52) concerning the Western European
Waters PSSA
○ The following amendments are made to annex 2 of Res.MEPC.121(52).
• In paragraph 2, under Traffic Separation Schemes, delete “Off Berlenga”.

• In paragraph 4, under Areas to be avoided, insert : “In the region of the Berlengas Islands”

• In paragraph 6, under Mandatory Ship Reporting Systems, insert : “Off the coast of
Portugal”
• In paragraph 7, under Coastal Vessel Traffic Services (VTS), insert : “Coast of
Portugal VTS”

Draft amendment for addition of new chapter 9 to MARPOL Annex Ⅰ
○ Special requirements for the use or carriage of oils in the Antarctic area are as follows.
• With the exception of vessels engaged in securing the safety of ships or in a
search and rescue operation, the carriage in bulk as cargo or carriage and use as
fuel of the following:
- crude oils having a density at 15℃ higher than 900 kg/m3;

- oils, other than crude oils, having a density at 15°C higher than 900 kg/m or a
2
kinematic viscosity at 50°C higher than 180 mm /s; or
- bitumen, tar and their emulsions. - The end-
