AFFIDAVIT OF WITNESS
I, LANI I. PANGATUNGAN, Filipino citizen, of legal age, single, and a
resident of Datag, Maribago, Lapu-Lapu City, Cebu, after having been duly
sworn to in accordance with law hereby depose and say:

1. That I was formerly the Barangay Secretary for Barangay Maribago,

Lapu-Lapu City, Cebu, during the term of Barangay Captain Joseph
Pangatungan for the years __________ until _____________;
2. That I was present during a meeting held at the Brgy. Hall of Brgy.
Maribago called for the purpose of deliberating as to whether or not
the proposal of Maribago Seaview Pension to develop a public park at
its own expense for the benefit of the public be approved;
3. That in the said meeting, nobody raised the issue of who is the
owner/ proprietor of Maribago Seaview Pension and nobody in the
council was aware of the registered owners of the said Pension ;
4. That in the course of the Barangay Council meeting, what was
discussed was only the private entity’s intention and desire to
introduce the structures on the public beach if such improvements
and structures would be beneficial for the barangay and its
constituents;
5. That after the deliberation, the Brgy. Council including Rodrigo D.
Taghoy approved the proposal of the private entity after taking into
account that said project will be for benefit of the barangay and its
constituents and that no public funds will be utilized for the project
since the construction will be shouldered by the private entity and
that ownership of the structures will be the barangay;
6. That there was never any bad faith or malice on the part of the Brgy.
Council including Rodrigo D. Taghoy in entering into an agreement
with Maribago Seaview Pension for their decision was made in good
faith and believing that their action would redound to the benefit of
the barangay;
7. That I execute this affidavit in order to attest to the veracity of the
foregoing facts and for whatever legal purpose it may serve best.
