Lrsp ‘Attachment to Agenda Item Approval Page October 3, 2018 Special Agenda The recently released 2018 School Ratings for LRSD reflect insufficient progress in improving academic performance in several schools. Under Act 930 of 2017, the state board of education has the authority to waive laws regarding teacher dismissal for school districts in the Level 5 ~ Intensive Support category. ‘Asa district in that category, LRSD needs this greater flexibility to make staffing changes in struggling schools than what the PNA currently allows. ‘Therefore, | direct Mr. Pore to present the following language for inclusion in the PNA. 1 Recognition - Delete this language: “The LRSD shall continue its recognition of the LREA throughout the term of this agreement and during negotiations for a successor agreement.” Restore this language from the current PNA: “In accordance with Board Policy, this recognition of LREA will continue so long as it is “deemed by the Board of Education to be in the best Interest of the employees and the District.” Board Authority — Include the following new language immediately after the existing sentence “Nothing in this agreement shall limit LRSD's statutory right to petition the State Board of Education for waivers pursuant to ACA § 6-15-103 while adhering to the Arkansas Teachers Fair Dismissal Act and the Public School Employee Fair Hearing Act.” However, the LREA and LRSD acknowledge the district is under Level 5— intensive Support wursuant to ACA §6-15-2916, and agree to support a waiver of the Arkansas Teacher Fair Dismissal Act and the Public School Employee Fair Hearing Act only for schools receiving 0 grade of D or F under the Arkansas Public Schoo!
