BRIEF NOTE

Venkatrao Memorial Trust trust is registered in the year 1350 fasli by Late
Gunde Rao Pampad S/o Late Shri.Kishan Rao R/o Shalibanda, Hyderabad.
The said Trust was created by Sri.Gunde Rao Pampad in memory of his son
Venkat Rao who died at a very young age. The Trust was originally
constituted with Sri Hanumanth Rao Shaeb Vakil, Sri Janardhan Rao Shaeb
Vakil, Sri Gunde Rao Shaeb Harwalkar and Dr.Rama Rao Saheb Joshi.

The Original Trustee namely Sri Gunde Rao Pampad created the Trust by
donating one building bearing No. 494 at Laldarwaza Hyderabad, agricultural
lands at Nandigam village i.e., Sy.No. 1270 admeasuring 12 Acrs 36 Gunta,
Sy.No.1271 admeasuring 14 Acrs 27 Gunta, Sy.No.1272 admeasuring 6 Acrs
26 Gunta, Sy.No.1274 admeasuring 10 Acrs 34 Gunta, Sy.No.1275
admeasuring 18Acrs 08 Gunta, Sy.No.1276 admeasuring 17 Acrs 33 Gunta,
Sy.No.1281 admeasuring 8 Acrs 27 Gunta, and Sy.No.1282 admeasuring 12
Acrs 31 Gunta, total Trust land admeasuring 102 Acrs 22 Guntas &
land near to Alwal, Secunderabad. The intention of the original trustee was
to establish a primary school in Kanada language at Shah Ali Banda,
Hyderabad.

Due to Acquisition award No.G1/5437/05 dated 30.12.2006 for widening of

NH-7 an extent of Ac. 4.07 Gts., was effected and compensation amount
not claimed by the trust.

As per the intention of the Creator of the Trust (clause No. 8 of trust deed )
is that if the Trustee dies or voluntarily resigns, the remaining Trustee shall
be bound to nominate any person for the vacant seat however one male
member from the family of Gunde Rao Harwalkar’s family shall compulsorily
be a trustee.

All the founder Trustee have passed away without nominating any of the
family members of Late Sri Gunde Rao Harwalkar’s family since the family
members was out of Country who had no axis to the Trust and was not
aware of Trust being in existence.
Sri Nishit Harwalkar is the grandson of late Gunde Rao sahib who had come
to India in the year 2004 and now he is settled in Bangalore .

Sri Nishit Harwalkar’s first cousin namely Anil Harwalkar is resident of

Hyderabad who informed Mr.Nishit that a Trust has been created by their
Grandfather Late Sri Gunde Rao Pampad and that all the trustee originally
nominated have expired and no one has taken care and responsibility of the
trust being lawful entitlement as a trustee.

Sri Nishit Harwalkar came to Hyderabad and made enquires and nominated
apart from himself, five other members as trustees vide supplementary
Deed No. 294/07 dated 12-09-2007.

The trust lands admeasuring 102 aces situated at Nandigam village &
Mandal, Shadnagar Revenue Division, R.R.Dist., are under illegal occupation
of third parties under various fictitious documents.

The Collector, Mahaboobnagar has initiated proceedings U/Sec 145 of the

Cr.P.C. for removing illegal occupants. The land admeasuring 30 acres has
fallen to the hands of some people who purchased the same under fictitious
documents created by persons who are having vested interest(Premdas
Goud). The Trust has initiated civil proceedings for cancellation of the said
sale deeds before II Addl.Dist., Judge, Mahboobnagar.

Some group of people with vested interest created fictitious document and
obtained pattadhar Pass Book (on the strength of documents executed by
R.Sudershan Goud). Trust has appealed to the Concerned RDO for
cancellation of the said pass books and for issuing the pass book in favour of
the Trust and orders dated 18-11-2017 passed in ROR Appeal No.
B/ROR/802/2007 on the file of RDO, Shadnagar RR Dist., has cancelled the
mutation proceedings and ordered to mutate the name of Venkatrao
Memorial Trust. The Tahsildhar, Nandigam Mandal has mutated the lands in
favour of Venkatrao Memorial Trust by honouring RDO order.
Gunderao Pampad blessed with one daughter namely Seetha Bai Pampad
and one son namely Venkat Rao Pampad (died at early age). The said
Seetha Bai Pampad marriage was performed with Gunderao Harwalkar and
they blessed with four children namely Prabhakar Harwalkar, Vijaya(died),
Asha, Anil Harwalkar, Except Prabhakar Harwalkar others are not blessed
with male child, hence Nishit harwalkar is only male member of said family.

Sri Nishit Harwalkar S/o Prabhakar Harwalkar and grandson of Trustee Late
Gunde Rao Harwalkar R/o H.No.No. 3-6-770/1, Street No. 13,
Himayatnagar, Hyderabad is the legal heir. The state succession court has
granted succession certificate/Legal Heir certificate infavour of Sri Nishit
Harwalkar vide orders dated 14-09-2017 passed in C.A.No. 25 of 2017.

Dr. TV Narayana and others fraudulently created a trust deed dated

26-11-2005 and got it registered the same as document No.512/2005 for
renewal of trust by becoming the trustee as per new trust deed. On the
strength of said deed they alienated the trust land under four sale deeds in
favour of Keshava Reddy, Manoj khandelwal and their wives.

Nishit Harwalkar being lineal descendant of Harwalkar Family as well as

clause No.8 of original Registered Trust Deed No. 2616 on 21 st Amadard
1350 Fasli, is entitled to file petition and manage Trust.
