'------K1<H'IRIHN.ANCE MANDATING ALL CIIlLDREN'S PLAY AREA AND AMUSEMNET


ARCADES TO OBSERVE PROPER SANITATION IN THEIR ESTABLISHMENTS

WHEREAS, under Section IS, Article II of the 1987 Philippine Constitution states that "The
State shall protect and promote the right to health of the people and instill health consciousness a111ong
them";

WHEREAS, it is likewise provided under Section 16 of Republic Act 7160, otherwise known as
the Local Government Code of 1991, under the General Welfare Clause, the local goverrunent units shall
ensure and promote health safety of the people;

WHEREAS, Iloilo City Council to supplement the implementation of the provisions of the PD
No. 856 or the Sanitation Code of the Philippines, should provide guidelines and standards in the
cleanliness and sanitation of the different business establislunents especially children's institutions within
its jurisdiction'

WHEREAS, according to the National Institute of Environmental Health Services, children are
highly vulnerable to the negative health consequences associated with many envirorunental exposures.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of Iloilo, in


session du1y assembled, that:

Section 1. Title. - This ordinance shall be known as "Play areas and amusements arcades
sanitation ordinance";

Section 2. Objectives. -The following shall be the objective of this ordinance:

a. To instill awareness on these establishments to regularly sanitize all objects or gadgets used
for playing by children in order to avoid the swarming of vermin such as lies, mosquitoes,
coclcroaches, etc. that brings microbes and other bacteria that can cause diseases or illnesses
to the children;
b. To safeguard and ensure the health & wellness of the children that frequent these
establishments; and
c. To assist in the prevention or to prevent the spread of germs that may lead to airborne or
infectious diseases.

Section 3. Definition of Terms. - Under this ordinance the following shall mean:

a. Children"'s play area- a place where children can enjoy by playing or learning while having
some fun;
b. Amusement arcade - a place in which you can pay to play games on machines.

Section 4, Coverage and requirements. - All children's play areas and amusement arcades
within the_jurisdiction of the City oflloilo shall be required to observe the following:

a) To provide water and sink facility that must be within the reach of children equipped with hand
soap and towel and/or sanitation area for every 100 sq. meters;

b) Play areas must be sanitized before and after business day;

c) Hand sanitizer must always be ready and available for use of the children;

d) Play area and amusement arcades must be kept clean, safe and adequate to size for the needs of
the children;

e) All equipment and furnishing used shall be readily washable or otherwise easily.cleaned.

Section 5. Implementing Authority. - The Sanitary Inspection Division of the City Health
Office shall be tasked to monitor and inspect the sanitary orderliness of the covered establishments under
this ordinance.

Failure of the Sanitary Inspector to do his duty shall be subjected to administrative sanction to be
imposed by the City Mayor after an investigation.

Section 6. Penalties. - Establishments found violative of this ordinance, after due hearing, shall
be meted with the following pena1ties:

a) l"t offense -warning


b) 2°" offense - fine of3,000.00 and suspension ofpennit for 30 days
c) 3"' offense - fine of 5,000.00 and revocation of pennit to operate

The City Legal shall initiate the filing of the case for violation of this ordinance upon the
complaints of the Sanitary Inspector

The Sanitary Inspector shall issue citation ticket for violators. Within three (3) days from
issuance, violators shall pay to the City Treasurer's Office and present the receipt to the Sanitary
Inspector Division of the City Health Office. Failure to do so, the City Legal shal1 initiate the filing of the
case.

Section 7. Separability Clause. - Should any provision hereof be declared unconstitutional or


ultra vires, the others not so declared shall remain in full force and effect;

Section 8. Repealing Clause. - All other provisions of existing ordinances, resolutions and
executive issuances inconsistent with this ordinance are hereby repeale4d, amended or modified
accordingly.

Section 9. Effectivity. This ordinance shall take effect fifteen (15) days after the same has been
published in a newspaper of local circulation in the City oflloilo.
