CONSTITUTION AND BY-LAWS
PREAMBLE

WE, THE SCI-MATH CLUB COUNCIL, IMPLORING THE AID OF ALMIGHTY GOD IN
ORDER TO DEVELOP AND TRAIN STUDENTS THROUGH SCIENCE AND MATHEMATICS
FOR TECHNOLOGICAL AND EDUCATIONAL ADVACEMENT BY EXPOSING THEM TO
ACTIVITIES RELATED TO SOCIAL, ACADEMIC AND SERVICE TO PROMOTE HIGH
STANDARDS OF PERSONALITY, STUDENTSHIP, GOVERNANCE AND PROVISION TO
NURTURE SOLIDARITY, DEED AS THE PARTICIPATING ASSOCIATES OF THE
INSTITUTIONAL SUPERVISION, ADVANCE THE CORPORATE WELL-BEING OF THE
LEARNERS AND TO SUCCEED JUST AND BENEVOLENT MILIEU, DO HEREBY
PROMULGATE THIS CONSTITUTION AND BY-LAWS.

ARTICLE I
NAME AND DOMICILE

Section 1. The organization established here in shall be known as the Science-Mathematics


Club. Here in referred to as the SCI-MATH CLUB COUNCIL.

Section 2. Science-Mathematics Club Council (SCI-MATH CLUB) Council shall be located


within the Republic Colleges of Guinobatan, Inc., G. Alban St. Iraya, Guinobatan,
Albay 4503.

ARTICLE II
DECLARATION OF OBJECTIVES AND FUNCTIONS

Section 1. The Science-Mathematics Club Council (SCI-MATH CLUB) Council shall be


autonomous in undertaking programs of action complementary to the development
of the institution as well as the departmental associations through the cooperation
of the students.

Section 2. The Science-Mathematics Club Council (SCI-MATH CLUB) Council shall have the
following objectives:
a. To uphold the ideals of the SCI-MATH Club geared towards ensuring well-
rounded and developed students;
b. To develop a sense of service and responsibility among the students for the
welfare of the society;
c. To serve as an active agent for students’ ideals and sentiments;
d. To strengthen the rights and welfare of the students;
e. To strengthen the ties among the students, faculty and administration by way
of discussing problems and plans through peaceful and intellectual means so
that the common good may reign;
f. To initiate and promote programs involving students in campus activities that
are designed to enhance the development of the students; and
g. To undertake fund raising projects and activities to support SCI-MATH CLUB
programs and objectives.
ARTICLE III
MEMBERSHIP

Section 1. Bona fide students of Republic Colleges of Guinobatan, Inc.-High School Student,
taking up Science and Mathematics subjects and an active student leaders.

ARTICLE IV
RIGHTS AND DUTIES OF THE MEMBERS

Section 1. Members in good standing shall have the following rights:


a. To participate in all deliberation;
b. To participate in any activity undertaken by the SCI-MATH CLUB council;
c. To be informed of the rules and regulations affecting him;
d. To have the grades speedily recorded, his Form 137 speedily processed and the
confidentiality of his academic records;
e. Shall have the freedom of the press and of speech, and of peaceful assembly not
contrary to the constitution of the SCI-MATH CLUB and the existing laws
governing such rights;
f. To petition the proper authorities for redress of grievances, present views and
opinions conducive to broad, sound ad healthy thinking of vital issues concerning
the welfare of the students;
g. Right against exploitation, involuntary servitude nor cruel or unusual punishment;
h. To reasonable protection. In case of arrest within the school premises,
coordination shall be accorded to school administration;
i. To question during the general assembly all decisions and policies promulgated
by the SCI-MATH CLUB council;
j. To recommend for impeachment any officer subject to the conditions stipulated
by this constitution;
k. To propose for the amendment of any provision in this constitution and by-laws;
and
l. To have free access on records, reports and documents left by the SCI-MATH
CLUB council.

Section 2. The duties of the members shall be:


a. To uphold the constitution and by-laws of the SCI-MATH CLUB Council;
b. To abide by the decisions of the majority in all undertakings of the council;
c. To attend meetings, activities, and other functions of the council; and
d. To meet all financial obligations and other duties and responsibilities due to the
council.

ARTICLE V
ORGANIZATIONAL SET-UP

The Science-Mathematics Club Council (SCI-MATH CLUB) Council shall be composed of the
following:
a. General Assembly
b. Executive Council
c. SCI-MATH CLUB Committees

ARTICLE VI
GENERAL ASSEMBLY

Section 1. The general assembly shall be composed of all bona fide students of RCGI-High
School Department.
Section 2. It shall be the highest policy-making body of the council. As such, it shall have the
following powers:
a. To act on any proposal presented by any member of the executive council on
any of the member of the assembly.
b. To impeach or suspend any member of the assembly in accordance with the
provision of Article XIV of this constitution and by-laws.
Section 3. In cases wherein the General Assembly failed to constitute a quorum, ¼ of the
members shall have special powers to act on decisions in behalf of the General
Assembly.

ARTICLE VII
POWERS AND FUNCTIONS OF THE EXECUTIVE COUNCIL

Section 1. The executive council shall be composed of the elected The Science-Mathematics
Club Council (SCI-MATH CLUB) Council, President, Vice-President, Secretary,
Treasurer, Auditor, Business Managers, Press Information Officer, and other
officers.

Section 2. The executive council shall have the following powers and functions:
a. Legislate all matters affecting the council;
b. Determine the program of activities of the council subject to the approval of
the General Assembly;
c. To enforce the decisions made by the General Assembly;
d. To act on the grievances, requests, and recommendations as presented by
the student.

ARTICLE VIII
POWERS AND DUTIES OF THE EXECUTIVE COUNCIL MEMBERS

Section 1. The President shall be the Chief Executive Officer of the Council. He shall:
a. Preside over the general, regular, special and emergency meetings of the
assembly and the council;
b. Carry out and implement resolutions, policies, and council laws passed and
approved by the General Assembly;
c. Create special committees and appoint its members;
d. Represent the council in its official capacity as the President in occasions and
events where the council needs his representation;
e. Authorize and countersign all disbursements to be paid by the treasurer;
f. To take active supervision over the properties, interests, business and affairs
of the council; and
g. Perform such other acts as may be required of him by the council and the
assembly.

Section 2. The Vice-President shall:


a. Assists the President in all matters;
b. Take-over the duties of the President in case of absence, disability, death,
resignation or removal for the cause of the President;
c. Monitor the activities of the High School Based Organization; and
d. Perform such other acts as may be required of him by the council and the
assembly.
e. Represent the Science-Mathematics Club Council (SCI-MATH CLUB)
Council to the local Government, community, stakeholders; and
f. Monitor the activities of the Community; and
g. Perform such other acts as may be required of him by the council and the
assembly.

Section 3. The Secretary shall:


a. Record and keep the minutes of the Council and the Assembly;
b. Prepare and send communication pertaining to the activities of the council
and the assembly;
c. Head of the Secretariat Committee; and
d. Prepare accomplishment report at the end of the semester; and
e. Perform such other duties as may be entrusted of him by the council and the
assembly.

Section 4. The Treasurer shall:


a. Act as the custodian of the funds and property of the Council;
b. Disburse the funds of the Council in accordance with such rules and
regulations or such administrative orders promulgated by the administration;
c. Prepare the financial statement, which shall be supported by the vouchers
and official receipts at the end of the School Year;
d. Head of Finance, Budget and Appropriation Committee; and
e. Perform such other duties as may be entrusted of him by the council and the
assembly.

Section 5. The Auditor shall:


a. Audit the funds and account of the council;
b. Certify the legality of the expenses by the Council;
c. Assists the Treasurer in collecting funds for the Council; and
d. Perform such other duties as may be entrusted of him by the council and the
assembly.

Section 6. The Business Manager shall:


a. Supervise all business and fund raising activities of the Council;
b. Head the Ways and Means Committee; and
c. Perform such other functions as may be designated of him by the council and
the assembly.

Section 7. The Press Information Officer shall:


a. Disseminate information for the Mass Media duly approved by the President;
b. Post the minutes, financial statements and other important documents
prepared by the secretary and treasurer;
c. Head the Networking and Information Committee; and
d. Perform such other functions as may be designated of him by the council and
the assembly.

Section 8. The other officers shall:


a. Represent the Science and Mathematics students or the respective
committees in the SCI-MATH Club Body; and
b. Perform such other functions as may be designated of him by the council and
the assembly.

ARTICLE IX
STANDING COMMITTEES

Section 1. The organization shall have the following standing committees:


a. Secretariat Committee
b. Finance, Budget and Appropriation Committee
c. Ways and Means Committee
d. Sports and Recreations Committee
e. Networking and Information Committee
f. Grievance and Arbitration Committee
g. Revisions and Constitutional Amendment Committee
h. Special Committee

Section 2. The Secretariat Committee


a. The Secretariat Committee shall be headed by the Secretary of the Council.
b. Members of which shall be appointed by the Executive Council.
c. It shall be in charge of all matters pertaining to the documentation of the
activities of the Council.

Section 3. The Finance, Budget and Appropriation Committee


a. The Finance, Budget and Appropriation Committee shall be headed by the
Treasurer of the Council.
b. Members of which shall be appointed by the Executive Council.
c. It shall facilitate to the collection of membership fees and other contributions
set by the Council.
d. It shall present proposals and means of raising funds of the Council in case of
special projects.
e. It shall attend to the financial requirement of the Council to enable the latter to
implement its objective, programs, projects and activities.
f. It shall ensure the implementation of the financial programs of the Council.

Section 4. The Ways and Means Committee


a. The Ways and Means Committee shall be headed by the Business Manager
of the Council.
b. Members of which shall be appointed by the Executive Council.
c. It shall be in charge of planning, organizing, and adopting measures and
programs to raise funds for the Council.

Section 5. The Sports and Recreation Committee


a. Chairman and members of Sports and Recreation Committee shall be duly
appointed by the Executive Council.
b. It shall take charge of the planning, organizing, devising and adopting
programs and activities for the genuine sports development for the members
of the Council.

Section 6. The Networking and Information Committee


a. The Networking and Information Committee shall be headed by the P.I.O. of
the Council.
b. Members of which shall be appointed by the Executive Council.
c. It shall be in charge of conducting seminars, trainings and the like.

Section 7. The Grievance and Arbitration Committee


a. The Chairman and members of the Grievance and Arbitration Committee
shall be duly appointed by the Executive Council.
b. It shall take appropriate actions to maintain good relations among the
members and shall settle and resolve disputes and disagreements.
Section 8. The Revision and Constitutional Amendment Committee
a. The Chairman and members of the Revision and Constitutional Amendment
Committee shall be duly appointed by the Executive Council.
b. It shall hear, consolidate and sponsor on the floor all proposed amendments
to or revisions of the SCI-MATH CLUB Constitution and By-Laws.
c. It shall conduct a study or survey to determine the veracity of the proposed
amendments or revisions.

ARTICLE X
ELECTION

Section 1. The election of the Science-Mathematics Club Council (SCI-MATH CLUB) Councill
shall be determined by the Office of the Students Services subject to the existing
Rules and Regulations.

ARTICLE XI
TERM OF OFFICE

Section 1. The term of office of the officers of the SCI-MATH CLUB Council shall be until such
time that their legal successors have been duly elected and qualified, unless,
removed from office sooner for the causes provided for by the SCI-MATH CLUB
Council Constitution and By-laws and their respective Internal Revenue Rules and
Procedures, permanently incapacitated, dies or resigns from office.

ARTICLE XII
SUCCESSION AND FILLING-UP OF VACANCIES

Section 1. In case the President of the Council voluntarily resigns, dies, is permanently
incapacitated, is removed from the office or has been absent without leave for more
than three (3) consecutive meetings, the Vice-President shall automatically assume
the office for the unexpired portion of the term and shall discharge the powers and
duties and enjoy the rights and privileges appurtenant thereto.
Section 2. Any vacancies in other positions resulting from impeachment, resignation, disability
or death, a special election through a plebiscite called for the purpose shall be held.

Section 3. In case the President of the Council is suspended as a result of an administrative


case or has taken any form of authorized leave of absence for more than ten (10)
days, the Vice-President shall automatically assume office of the SCI-MATH CLUB
President in an acting capacity until such time that the President resumes his office.

Section 4. Suspensions from any other positions shall be filled-up by the Executive Council
within two (2) days.

ARTICLE XIII
IMPEACHMENT AND REMOVAL FROM THE OFFICE

Section 1. Any officer may be disciplined, suspended or impeached from office on any of the
following grounds:
a. Culpable violation of the Constitution and By-laws of the SCI-MATH CLUB
Council.
b. Dishonesty, oppression, misconduct in office or gross negligence.
c. Abuse of authority.
d. Unauthorized absence for three consecutive regular or special meetings.

Section 2. In addition to the abovementioned grounds, the President or officers may be


disciplined, suspended or impeached from office on the ground of:
a. Failure to call/hold regular meetings for at least two (2) consecutive months.

Section 3. A verified complaint against any erring officer shall be initiated by a concerned
member of the council and it shall be filed before the grievance and arbitrary
committee.

Section 4. a.) For the purpose of impeachment, an affirmative vote of at least 2/3 of the
Executive Council shall be required for it to be endorsed to the General
Assembly.
b.) A majority vote of all the members of the General Assembly shall remove any
officer.

Section 5. For purpose of suspension, an affirmative vote of at least 2/3 of the Executive
Council shall be required at the disciplinary proceedings at which penalty is being
determined; provided that the period of suspension shall not exceed fifteen (15)
days.

Section 6. Resignation of any SCI-MATH CLUB Officer shall be deemed effective only upon
acceptance and approval by the following authorities:
a. The High School Organization Adviser
b. Assign faculty OIC of the Month
c. SCI-MATH Club Council Adviser
d. The Executive Council

ARTICLE XIV
MEETINGS AND QUORUM

Section 1. The General Assembly shall meet at least twice a year for the purpose of activities
for the year end reports. A majority of the total membership of the Assembly shall
constitute a quorum.

Section 2. The Executive council shall meet at least twice a month. Five members shall
constitute a quorum and their acts shall bind the Council.

Section 3. Special meetings may be called by the President when he deems it necessary.

Section 4. Conduct of Meeting


a. Simple parliamentary procedures shall be followed in all meetings, and
b. Other procedures for the conduct of meetings may be added upon by
different committees.

Section 5. The Secretary shall issue notice of the meetings at least three (3) days before such
meeting is to be held.

ARTICLE XV
FUNDS

Section 1. The general funds shall come from the membership fee and other contributions of
the members.

Section 2. Every member shall pay a membership fee of P30.00 good for the whole school
year.

Section 3. SCI-MATH CLUB Council may raise funds and other resources through
contributions, donations, or other means of local or foreign sources provided
authorized under existing laws of the Republic of the Philippines.

Section 4. The collection and disbursement of funds of the SCI-CLUB CLUB shall be governed
by the existing laws, rules and regulations of such administrative orders that may be
promulgated by the university.

Section 5. Sanctions and Penalty fees


Every SCI-MATH Club member should pay twenty pesos (Php 20.00) for
every failure to attend meeting and penalty fee of five pesos (Php. 5.00) for those
who will be coming late.

ARTICLE XVI
CARES COUNCIL ADVISER

Section 1. The SCI-MATH Club Adviser(s) must be a full-time faculty member of the RCGI-
High School Department handling Science or Mathematics subjects and chosen by
the majority of the Council Officers. Adviser shall act on all matters regarding
technicalities and shall also serve as the consultant of the Executive Council.

Section 2. The term of office of the adviser shall be co-terminus with the SCI-MATH CLUB
Officers.

ARTICLE XVII
AMENDMENTS, REVISIONS AND RATIFICATIONS

Section 1. Any amendment to, or revisions of this constitution may be proposed by the
Executive Council, upon a vote of ¼ of all its members.

Section 2. Any amendment to, or revisions of this constitution under section 1 hereof shall be
valid and take its effect upon ratification by a majority vote of students cast in a
plebiscite.

ARTICLE XVIII
TRANSITORY PROVISIONS

Section 1. All incumbent officers of the SCI-MATH Club Council shall continue to hold office
until removed, impeached, and suspended or until such time that the newly elected
officers shall assume office in accordance with this constitution.
ARTICLE XIX
SEPARABILITY CLAUSE

Section 1. If for any reason, any section or provision of tis constitution and by-laws is declared
null and void by any competent authority, no other section, provision or part thereof
shall be affected and the same shall remain in full and in effect.

ARTICLE XX
EFFECTIVITY

Section 1. This constitution shall take effect upon ratification by a majority vote of the students
in the plebiscite called for the purpose.
