“The Township of Toms River has reviewed the proposed plans submitted on August 12, 2016 for the above
application for Preliminary & Final Major site Plan with Variances for Cox Cro Crossing located on Block 166,
Lot 6,7,8,15 & 15.03 on 2124/2180 Lakewood Road and 15 Cox Cro Road. Applicant submitted Outbound and
Topographic Survey, Architectural Renderings, and Preliminary and Finel Major Site Plan. Outbound and
Topographic Survey was prepared by Charles Surmonte, NJ Professional Engineer and Land Surveyor, dated
January 21, 2016. Cox Cro Crossing Mixed Use Renderings were prepared by Thomas J. Brennan, NJ
Registered Architect, of Thomas J. Brennan Architects dated April 22, 2016. Cox Cro Crossing office Building
Renderings were prepared by Thomas J. Brennan, NJ Registered Architect, of Thomas J. Brennan Architects

Administrative
I. The application planning review was complete on September 14, 2016. The applicetion was deemed
incomplete. The applicant has submitted a survey which does not show all of the lots that are part of the
application. In addition, the Site Plan includes lot 15, which no longer exists. Lot 15 and a portion of 3.01
‘were subdivided to create lots 15.02 and 15.03. Applicant should correct all documents to reflect the actual
proposal.
The applicant submitted revised Preliminary and Final Major Site Plan documents on October 21, 2016, but
did not submit a revised survey. The application was deemed incomplete on November 28, 2016 for ¢
missing survey.
On January 3, 2017, the applicant submitted a revised survey of the property. The planning review was
completed on February 7, 2016 and has determined that the applicant is not under the jurisdiction of the
Planning Board. The applicant sequires a height variance for the multi-family component. The multi-
family component is permitted in the Rural Highway Business zone in accordance with the provisions of the
‘Multi-Family 4 (MF-4) land use zones established by 348-10.17.4. The Multi-Family 4 (MF-4) land usc
‘code permits a maximum height of 35° and three useable floors from grade level, whereas the applicant is
proposing a maximum height of 40° 4” and four usable floors. ‘The applicant is exceeding the permitted
height by more than 10%, thereby triggering a “D(6)” variance, which can only be granted by the Zoning
Board of Adjustment. The applicant may modify their epplication and submit to the Planning Board or
withdraw their application irom the Planning Board and submit to the Zoning Board of Adjustment.
