Terms and Conditions of Use

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY

Following installation you will be required to enter a Registration Code which will
allow
continuing access to the CD. To be issued with such a code you must complete and
sign the
Registration Form and fax it to the number or mail it to the address stated on the
form.
By doing so you are agreeing to be bound by the terms and conditions set out below.

In these Terms and Conditions of Use, 'Autodata Open CD' means the software
programs and
data stored on this Autodata compact disc, all related data stored on this Autodata
compact disc, any upgrades or updates to the software programs and data, and any
related
printed materials.

1. LICENCE:
(a) Autodata Limited (Autodata) grants you a non-exclusive, non-
transferable limited
licence to use Autodata Open CD subject to these Terms and
Conditions of Use.

(b) Payment of the appropriate licence fee to Autodata or its


authorised agent entitles
you to receive the relevant Registration Code from Autodata giving
you access to
Autodata Open CD for a period of 50 years or for such shorter
period as shall have
been notified in writing by Autodata or its authorised agent.

(c) The licence is issued to a single site or address and covers the
installation and
use of Autodata Open CD on a single personal computer in use at
that location or
the downloading and use of the software programs and data to the
hard disk of that
single personal computer.

(d) Registration Codes permitting the downloading and use of the


software programs and
data to the hard disk of one or more additional personal computers
at the location
applicable in paragraph 1(c) are issued only at the discretion of
Autodata or its
authorised agent and [may be] are subject to the payment of
additional licence fees.

(e) You may not use, rent, lend, lease, sell, distribute or otherwise
transfer Autodata
Open CD or any copy, modification, translation or adaption of
Autodata Open CD in whole
or in part except as permitted by law or expressly set out in these
Terms and Conditions
of Use. You may not reverse compile, disassemble or otherwise
reverse engineer all or
any portion of Autodata Open CD.

2. RIGHTS IN AUTODATA OPEN CD


(a) All rights in Autodata Open CD including without limitation all
copyright and database
rights (including but not limited to all data, text, images,
diagrams, layouts
incorporated into Autodata Open CD) and all copies of Autodata Open
CD are owned
by Autodata Limited and are subject to international copyright laws
and treaties.
All rights of Autodata are hereby expressly reserved. Users remain
liable for
improper or unauthorised use.

(b) The copyright notice included in Autodata Open CD must at all times
remain an
integral part of Autodata Open CD and any permitted copy.

(c) AUTODATA and the Autodata logo are registered as the Trademark of
Autodata Limited.

3. WARRANTY AND LIABILITY


(a) The information contained in Autodata Open CD has been compiled by
Autodata Limited
from information supplied by car and component manufacturers. All
reasonable care h
as been taken to ensure the accuracy of such information.
Nevertheless, Autodata
shall not be held responsible for the consequences of using
information which may
prove to be incorrect or to have been misrepresented, or errors
that may have
inadvertently arisen during its preparation.

(b) The information contained in Autodata Open CD is provided 'AS IS'


and all conditions
or warranties express or implied, statutory or otherwise
(including without
limitation those pertaining to accuracy, completeness, currency,
non-infringement,
merchantability or fitness for a particular purpose (whether or
not notified) of
any product) are hereby excluded.

(c) Autodata Limited warrants that the compact discs on which Autodata
Open CD is provided
are free from all defects in materials and workmanship under
normal use and shall
remain so for a period of 90 days from the date of delivery to
you. This warranty
is limited to the original purchaser of Autodata Open CD only and
is not transferable.

(d) During the warranty period referred to in paragraph 3(c) above,


Autodata will replace
any Autodata Open CD compact disc not meeting the standards
referred to in paragraph
3(c) above which is returned to Autodata with proof of purchase.

(e) The warranty in paragraph 3(c) does not apply to any version of
Autodata Open CD which
has been damaged as a result of any misuse or alteration or the
media on which it is
stored by anyone other than Autodata.

(f) Except as set out in these Terms and Conditions or as required by


law, no other warranties
(whether express or implied) are made in respect of Autodata Open
CD.

(g) Your sole remedy and the entire liability of Autodata are as set
out in these Terms and
Conditions and in no event shall Autodata be liable to you or any
other person for any
damages including any incidental or consequential loss, loss of
profits or business or
other damages arising out of any representations relating to
Autodata Open CD or the
use or inability to use Autodata Open CD.

4. GENERAL
(a) You shall not assign or sub-license all or any part of Autodata Open
CD, the data and
software included on it or these Terms and Conditions without the
prior written consent
of Autodata.

(b) In the event that you fail to comply with these Terms and
Conditions, Autodata shall be
entitled to terminate the licence granted to you with immediate
effect and without notice.

(c) If any provision of these Terms and Conditions and the licence
granted to you is declared
void or unenforceable the remaining provisions of these Terms and
Conditions and the
licence shall remain in full force and effect.

(d) These Terms and Conditions and the licence granted to you shall be
governed by and
construed in accordance with the laws of England.
