14 then there is an expectation that the Victorian Police simply will not pursue the matter after the
15 2018 Victorian State election is held, and the ALP were to be back in power. Let be blunt about it I
16 view that there can be no excuse for the Victorian Police to use DOUBLE STANDARDS.

18 I will give you an example.
19 On 9 January 2008 police officers attended to my residence and made it clear that if I didn’t
20 come with them to the police station for questioning they would arrest me. I decided to go
21 with the police. As soon as I sat in the backseat of the unmarked police car which then started
22 to drive off a police officer sitting next to me then warned me that I was under arrest and
23 anything I said could be used against me. I responded that anything he stated will be used by
24 me in a forthcoming book.
25 One has to ask what was the use of an arrest where it could do no more than I was already
26 doing and that was to cooperate with the police to interview me.
27 Nevertheless it was clear the police somehow held an arrest was justified and a later
28 complaint about it was held it to be so.
29 So, the Victorian Police had the power to arrest me regardless that I was already on my way in
30 a police car to assist with their investigation.
31 It can be stated that at no time did I refuse to answer questions and later I was advised I could
32 go home. I subsequently wrote a book about it and within 2 weeks of providing the then Chief
33 commissioner with a copy I was advised I was no longer a suspect in the investigation.
34 What had eventuated was that (after I warned one of my daughters to be careful with the dogs
35 she had for any baby when born – as she was pregnant suddenly sexual abuse allegations had
36 been made against me.
37 Reality is that when being questioned I made clear that they could check with my former wife
38 that I had never stayed overnight at her place since she moved to Ascot Vale residence. As
39 such the allegation as to what happened the day in the evening that her mother had moved
40 there was I never even then knew of the change of residence until afterwards as I resided in
41 the Mallee with another daughter.) the police questioned me about matters which I view even
42 a rookie police officer could have checked out that the allegations were not based upon
43 the facts as they existed at the time.
44 The mere fact I made known they could ask my ex-wife – with whom I had no contact until
45 years later and saw her only twice in 2 decades) underlines I was not worried about what my

1 former wife might state, as after all I could prove to have been 350 kilometers away from her
2 residence that night.
3 Moreover, I also made clear I owned my property in the Mallee and as such the police could
4 have gone down to check out if the property was as alleged. Well before they attended to my
5 residence. And indeed they would have found that what had been claimed was different then
6 the physical facts of the residence.

8 I was never charged but still my complaint that the police overreacted to arrest me was not
9 supported by internal investigations.

11 Yet, now we have the Victorian Police arresting some lower level workers and have the Victorian
12 Ombudsman report as well as the refund of the claimed fraudulent monies and the Victorian Police
13 now can’t bother to arrest those involved to question them. It seems to me that the Victorian Police
14 is playing politics that because those who were in my defrauding taxpayers now being in
15 government are getting SPECIAL TREATMENT.

17 In my any person at the ODPP has a conflict of interest he/she should have recuse himself/herself.
18 We got a very serious matter that goes to the very pillar of democracy and that is defrauding
19 taxpayers to gain election benefits and inappropriately financially and otherwise benefit for this.
20 In my view Victorians are entitled to expect that the Victorian Police arrest the persons involved as
21 much as they did with me, even so they had no factual evidence against me whereas now there is a
22 Victorian Ombudsman and repayment of monies, etc.
23 In my view the Victorian Policed is damaging its credibility by this delay to act appropriately as
24 again if it is good enough to arrest someone who nevertheless is cooperating with the police then I
25 view the Victorian Police now failing to act while those who were involved are failing to cooperate
26 with the police it means to me the Victorian Police is using DOUBLE STANDARDS.

33 It appears to me that the Victorian Policed is dragging this case along and Victorians are entitled to
34 ask what is behind doing so! It is not out of the order that former police officers are landing good
35 jobs from the Government and I wonder if this is what is really behind it.

37 As it is clear that those involved in the Red Shirt saga were at the time not in any government
38 position but were unemployed candidates in a political election, that is unless then had private
39 employment otherwise, then the fact that they subsequently came into Government cannot be any
40 excuse not to arrest them where they refuse to cooperate with the police with its investigation.

13 If the issue is that the ODDP must be consulted before making an arrest then why has the Victorian
14 Police not done so previously with me and with the 17 persons previously arrested. Is it because of
15 what now appears to me to go around at the alternative media that there is a mateship that is too
16 close for the Victorian Police to be and operate without bias?
17 Do you really think that lawyers representing their clients in future will so to say not have a ball
18 game to use this kind of DOUBLE STANDARDS if the Victorian Police arrested their client
19 without consulting first the ODPP?
20 In my view the Victorian Police is neglecting to consider that its lack of appropriate action and
21 using DOUBLE STANDARDS can be also harmful for democracy itself. Victorian now may
22 conclude that if you rort the system but get into government than you will less likely be held
23 accountable by the Victorian Police than others who merely are accused without any hard evidence.
24 In my view the task of the Victorian Policed is to serve the community and not those who
25 defrauding taxpayers and regretfully it appears to me the Victorian Police by its failure to act
26 promptly and decisive and applying DOUBLE STANDARDS by this may be part of undermining
27 our democracy!
28 I consider the stealing of an election to undermine democracy and Victorian electors have a right to
29 know before the next election is held what, if any, charges there will be made. I understand Gerard
30 Nash QC had presented his advice. The ODPP might be politicized because of the connection with
31 the ALP Government and so I view the Victorian Police could have already arrested those who
32 failed/refused to assist the police with its investigation as for this no ODPP assistance is needed, as
33 the Victorian Police proved in the past! Again, those candidates involved in the Red Shirt scam
34 were acting in private capacity and unless privately employed were not employed as they were not
35 even Members of Parliament when writs are issued until they are sworn in when the writs are
36 returned. When writs are issued all then Members of Parliament no longer are then Members of
37 State Parliament and only can regain this position is declared to be the successful candidate by the
38 Electoral Commission and subsequently after the return of the writs make an oath to accept the seat
39 elected for. For the record it means any FORMER Member of Parliament, including with this State
40 election, which uses taxpayer’s monies for political election purposes are in fact defrauding
41 taxpayers? There can be no excuse for any Member or former Member of Parliament not to know
42 the law because they are the one legislating and expect ordinary citizen to be aware of the law as
43 such, clamp down on the theft as the Victorian Police would do against ordinary citizens and not
44 engage in DOUBLE STANDARDS!
