I believe there is probable cause to charge the defendant with these charges because:
I was patrolling in Cedar City Utah when I observed a vehicle traveling westbound on Coal Creek. I observed
that the license plate was in the rear back window. The license plate was not illuminated and the brake light
was covered so that it was not visible. I performed a traffic stop on the vehicle. While I was talking with the
driver I observed that he had red blood shot eyes. His speech was slightly slurred and he had an odor of an
alcoholic beverage coming from his person. I asked him to perform field sobriety tests. As he was getting out of
the vehicle he informed me that he had a firearm on his waist. I asked him if I could remove the firearm and he
allowed me to remove it. I checked it and found that it had a full magazine and a round in the chamber. During
the test I observed clues that lead me to the conclusion that the driver, Alexander Buzz D.O.B. 1/22/1992, was
impaired to the point that he should not be operating a vehicle. I placed the driver under arrest for suspicion of
DUI and being in possession of a firearm by an impaired person. I transported the driver to the Section 11 office
in Cedar City Utah. At the office I read the driver his driver license admonitions and asked him to consent to a
breath test. He consented and after waiting the allotted Baker time he blew into the Intoxilizer 8000. The test
result came back with a result of 0.160. I booked the driver into the Iron County Correctional Facility for DUI and
possession of a firearm by an impaired person.
