COMPLAINT-AFFIDAVIT

I, UWILYN DELA ROSA BESAHAN, of legal age, Filipino,

widow, and a resident of P-1, Capitan Juan, Lantapan, Bukidnon, hereby
freely execute the following complaint-judicial affidavit after having
been duly sworn to in accordance with law, informed and instructed
that that I must answer the following questions according to what I
personally know on the matter and that being under oath, I may face
criminal liability for false testimony or perjury, I hereby depose and say,
in answer to the questions asked of me:

(Will you please state your name and other circumstances?)

A: Ako si Uwilyn dela Rosa Besahan, Filipino, byuda, nagpuyo

sa Purok 1, Capitan Juan, Lantapan, Bukidnon, ug asawa ni Libert Q.
Besahan nga gipatay.

(I am Uwilyn dela Rosa Besahan, Filipino, widow, a resident of

Purok 1, Capitan Juan, Lantapan, Bukidnon, and spouse of the late Libert
Q. Besahan who was killed.)

2. Q: Unsa may akong matabang sa imo?

(How can I help you?)

A: Mopasaka unta ko ug sumbong batok ni Jonel Pinohon nga

taga Purok 5, nailhan pod nga Katiguman, Barangay Capitan Juan,
Lantapan, Bukidon, sa pagdunggab-patay sa akong bana nga si Libert
Q. Besahan niadtong 22 January 2018 didto sa Katiguman.

(I would like to file a case against Jonel Pinohon of Purok 5, also

known as Katiguman, Barangay Capitan Juan, Lantapan, Bukidnon, for
stabbing my husband, Libert Q. Besahan, which caused his death.)

3. Q: Imo bang madetalye kung unsay nahitabo?

(Can you tell in detail what happened?)

A: Adtong 22 January 2018, nagtrabaho ko sa uma isip usap ka

laborer. Mga alas 2:30 sa hapon niabot si Elmer “Mimi” Besahan,
manghod sa akong bana nga si Libert, ug nibalita nga si Libert

nadunggaban didto sa Purok 5, Capitan Juan, ug sya karon gidala sa

rescue nga sakyanan sa barangay paingon sa Provincial Hospital.

(On 22 January 2018, I was working as a farm laborer. At around

2:30 in the afternoon, Elmer “Mimi” Besahan, younger brother of my
husband, Libert, arrived and informed me that Libert was stabbed at
Purok 5, Capitan Juan and that he is now transported by the barangay
rescue vehicle towards the Provincial Hospital.)

4. Q: Unya unsay imong gibuhat?

(And what did you do?)

A: Nisakay dayon ko sa motor gi-drayban ni Mimi ug nagpa-

drayb ko pauli sa balay para mag-ilis ug sinina ayha mo-apas sa hospital.
Pag-abot nako sa emergency room sa hospital, nakita nako akong bana
nga galisod na ang kahimtang pero maka-sulti pa. Gipangutana nako
sya kung kinsa ang nagdunggab sa iya. Nitubag sya nga anak ni Bokoy.

(I immediately went with Mimi on his motorcycle and went home

to change clothes before proceeding to the hospital. Upon reaching the
hospital emergency room, I saw the dire condition of my husband but
still he can talk. I asked him who stabbed him. He answered that it was
the son of Bokoy.)

5. Q: Kinsa man ni si Bokoy?

(Who is this Bokoy?)

A: Si Nelson Pinohon. Iyang dagnay kay Bokoy.

(It’s Nelson Pinohon. His nickname is Bokoy.)

6. Q: Kaila ka kang Bokoy or Nelson Pinohon?

(Do you personally know Bokoy or Nelson Pinohon?)

A: O, kaila ko sa iya kay sa Purok 5 man gyud ko gikan.

(Yes, I personally know him because I originally came from Purok

5.)

7. Q: Unsa pa man imong gipangutana sa imong bana, kung naa?

(What else did you inquire from your husband, if any?)

A: Nangutana ko kung nag-unsa siya didto sa Purok 5.

(I asked him why he was at Purok 5.)

(What was his answer?)

A: Nasuko sya ug iya kong gipapahawa kay init kuno kaayo ang
akong kamot. Adtong higayona, ako syang gigunitan.

(He got angry and told me to stay away from him because my
hand was too hot. At that time, I was holding him.)

9. Q: Ug unsa may imong gibuhat?

(And what did you do?)

A: Ni hawa ko ug nipalit ug gi-resita nga tambal.

(I went away and bought the required medicines.)

10. Q: Unsay nahitabo sunod?

(What happened next?)

A: Mga 6:00 sa gabii nakabalik ko sa hospital ug gisultian ko

nga gidala sa operating room akong bana. Mga alas 7:00, gisultian ko
nga patay na akong bana.

(At around 6:00 in the evening, I arrived in the hospital and was
informed that my husband is in the operating room. At around 7:00 pm,
I was informed that he passed away.)

11. Q: Unsa man imong gibuhat, Mrs, paghuman?

(What did you do after that?)

A: Nasakitan gyud ko ug maayo, Sir. Naa ra bi mga anak.

Nagpatabang gani ko sa among mga parente para lang maplastar lang
ang iyang lubong.

(I really felt the pain, Sir. We have kids. I even asked for help from
our relatives for him to have a decent burial.)

12. Q: Pila man diay kabuok inyong mga anak?

(How many children do you have?)

A: Naa mi 4 ka anak.

(We have 4 children.)

13. Q: Nganong nahibaw-an man nimo nga si Jonel Pinohon ang

nagdungab sa imong bana?

(How did you know that it was Jonel Pinohon who stabbed your
husband?)

A: Adtong gi-haya pa akong bana didto sa among balay, niadto

ang purok president sa Purok 5 ug ako siyang gipangutana ang ngalan
sa nagdungab sa akong bana. Iyang gisulti ang ngalan - Jonel Pinohon.

(During my husband’s wake, at home, the purok president of

Purok 5 came so I asked him the name of the person who stabbed my
husband. He told me the name - Jonel Pinohon.)

14. Q: Wala na koy laing pangutana, naa ka bay idungag pa?

(I have nothing more to ask, do you have anything more to say?)

A: Wala na, Sir.

(Nothing more, Sir.)
