ORDER:
The Government of India has proposed to form Four Laning and widening of
the Madurai Natham Road (NH 785) under “Bharatmala Pariyojana. The Government of
India have published a notification in the reference first cited u/s 3(a) of National
Highways Act 1956 in the Gazette of India No. 145 dated 12.1.2018duly appointing the
District Revenue Officer, Madurai as Competent Authority for the purpose of Acquisition

of lands for widening and Four Laning of Madurai Natham Road (NH 785) and the
Deputy General Manager(T) and Project Director of National Highways Authority of
India, Madurai has sent Land Plan Schedule (LPS) for acquisition of landsfor the above
project. On the requisition of National Highways Authority of India, Land Acquisition
proceedings were initiated under National Highways Act 1956 (Act 48/1956) and the
Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and
Resettlement Act 2013 to acquire an extent of 7038Sq.M. of land as detailed below in
Kadavur village, Madurai North Taluk, Madurai District for Four Laning of Madurai
Natham National Highway from Chettikulam to Kadavur (7/300 to 18/400). After due
survey and demarcation in the field, the following lands were identified as necessary for
the four-way track and construction of elevated corridor in National Highway Road.
It was observed that a few of these survey numbers have been converted to Housing
Plots and hence are considered as House Sites (Manai) for the purpose of this award, as
indicated in the table above
2) The Notification u/s 3(A)(1) of National Highways Act 1956(Act 48/1956)
was published in the Gazette 1278dated 28.3.2018 in S.O 1414(E)dated 28.3.2018, in
the reference 2nd cited, duly informing the public the intention of the Government of
India to acquire the above-mentioned land for a public purpose for widening/four laning
of Madurai Natham National Highway (NH 785). The substance of this notification was
also published in the local dailies as mentioned below in the reference 3 rd cited u/s
3(A)(3) of National Highways Act 1956, calling for objections if any from interested
persons within 21 days from the date of publication.
3) The objection petitions u/s 3(C)(3) of National Highways Act 1956 were
received and disposed of, after due consideration
4) The notification under section 3(D) of National Highways Act 1956 was
published in the reference 4th cited in the Gazette 1890 dated 24.5.2018 in S.O
2085(E)dated 22.5.2018 duly announcing the decision of the Government of India for
the acquisition of the above-mentioned land for the purpose stated above. The
substance of this notification was also published in local dailies as mentioned below in
the reference 5th cited u/s 3(G)(3) of National Highways Act 1956 inviting all parties
interested in the acquired lands to appear in person or represented by agent or by a
legal practitioner before the Competent Authority and the District Revenue Officer,
Madurai District at Collector’s Office on 08.06.2018 and submit their claims over the
lands under acquisition.
5) Thirteen out of the Thirty Seven land owners appeared for enquiry u/s
3(G)(3) on the date fixed and statements were recorded from them. The owners of the
acquisition lands were finalized on the basis of the Revenue Records and local enquiries
from the Village Administrative Officer, Kadavur. The details of the owners of the land
acquisition land so finalized in Annexure-1.
6) Valuation of Structures:
Compensation for the structures in the acquisition fields have already been
included in the 3G Award 16/2018(ROC No. 29236/2018/B3) passed by the District
Revenue Officer and Competent Authority for Land Acquisition on 24.08.2018.
7) Damages to be compensated
There are no damages to be valued and compensated apart from the land
building for which compensation is awarded in this order.

8) Severance compensation:
The payment of severance compensation does not arise since no request or
demand has been made by the land owner in this village
9) Encumbrances
As per section 3(D)(2) of the National Highways Act 1956 all the acquisition
lands mentioned above are vested with the Government of India free from all
encumbrances from the date of publication of the Notification u/s 3(D)(1) of the Act.
Similarly, out of 12 sales under dry lands, the highest 6 sales have been
taken for consideration. The average sale amount of 6 sales works out to Rs. 131.79 per
Sq.M. which is higher than the guideline value of Rs. 24.90 per Sq.M. However, the
valuation of dry lands in Kadavur was fixed as Rs. 122.39 per Sq.M. for all dry lands to
be acquired in Kadavuras notified u/s 3(A)(1) of National Highways Act 1956(Act
48/1956), published in the Gazette No.586 dated 15.2.2018 in S.O 666(E) dated
15.2.2018 as per order no. B3/29236/2018dated 14.07.2018. Hence, the value of all dry
lands in Kadavur is fixed at Rs. 122.39 per Sq.M.
As Kadavur village is within 30 km from the Urban Limit, a multiplication
factor of 1.25 has been fixed as per schedule of 30(2) of the Right to Fair Compensation
and Transparency in Land Acquisition Rehabilitation and Resettlement Act 2013.
12) Solatium:
As per section 30(2) of the above said Act Solatium amount calculated at
100% of the Compensation Amount is payable to the Land Owner whose right of usage
and easement right is affected due to acquisition of land.

The amount of Compensation will be paid under RTGS Scheme on the report
of the Special Tahsildar (LA-NH) after deciding the ownership and after getting
Encumbrance certificate from the owner till the date of disbursement of Compensation
amount. The Special Tahsildar invariably verifies the ownership and identify the land
owners including the pattadars who did not appear for enquiry under section 3(G)(3) at
the time of payment of compensation amount on the basis of records produced by the
recipients. Before making payment, the Special Tahsildar is requested to ensure that
the lands covered under this award are free from encumbrances by way of verifying the
documents available in the respective Sub Registrar’s Office. The land owners will
surrender the original documents to prove their title and ownership over the acquisition
lands and also the records to prove their identity along with two copies of passport size
photo at the time of payment of compensation.
