I. GENERAL PROVISIONS

Art. 1. – (1) At “Dunarea de Jos” University of Galati, teaching and research vacancies shall
be filled exclusively by the selection procedure organized under the provisions of Law no.
1/2011, the Government Decision (HG) no. 457/04.05.2011, and in compliance with the
University Charter and the Senate Decision.
(2) The candidate selection is public and open.
Art. 2. – (1) The applicants for a teaching or research vacancy for an indefinite period of
time must hold a PhD title.
(2) Academic teaching and research vacancies may not be created for candidate selection by
turning an existing position into a higher rank one.

II. SETTING UP AND ANNOUNCEMENT OF SELECTION PROCEDURES AND


CALENDAR FOR TEACHING AND RESEARCH VACANCIES

Art. 3. – According to the legislation in force, the university may approve, for the purpose of
candidate selection and for a determined period of time, to publish teaching or research
vacancies such as Assistant Lecturer, Lecturer, Associate Professor, (Full) Professor,
Research Assistant, Researcher 3rd, 2nd, and 1st grades.
Art. 4. – (1) Teaching vacancies are established according to the academic curriculum and
standardization criteria established by the University Senate, in compliance with the legal
provisions and financial resources available.
(2) Research positions are established according to the needs of departments, laboratories,
research centers or institutes within the university, according to research themes / topics
and infrastructure, in compliance with the legal provisions and financial resources available.
Art. 5. – Teaching and research vacancies are announced and published during the first 30
calendar days of each semester, according to the university strategy and the Senate
decision.
Art. 6. – Teaching and research vacancies are announced by the Head of Department or
Head of the Doctoral School in which a vacancy is available, after previous consultation with
its members, based on a written request approved by the council of that department or
doctoral school. Proposals are further submitted to the faculty council for validation by open
vote.
Art. 7. – Based on the approval of the Faculty Council, the Dean approves the proposals and
submit them to the Council of Administration for approval . After approval , the Council of
Administration addresses the Senate the request for opening the candidate selection
procedure for the available vacancies announced. In this written request, the vacancies shall
be identified by indicating the position number in the department / doctoral school, the
subjects / research activities, the amount of factual and conventional hours assigned by the
position workload.
Art. 8. – In view of publication in the Official Gazette of Romania, Part III, the University
shall submit the following documents to the Ministry of Education, Research, Youth, and
Sports according to the deadline provided in Art. 5:
1) list of vacancies and their workload components as approved by the council of
administration , the Senate, signed and stamped by the Rector;

2) the department or doctoral school structure containing the vacancies, signed by the
Rector, the Dean and the Head of Department or of the Doctoral School;
3) in case of teaching vacancies, the Rector’s affidavit that all advertised vacancies
concern only curricula of legally established study programs, mentioning the type of
attendance and the place where courses are held;
4) the University Candidate Selection Procedures and Methodology for Teaching and
Research Vacancies.
Art 9. – (1) The University may organize the selection of the candidates for teaching or
research vacancies for an indefinite period of time only after publication of the available
vacancies by the Ministry of Education, Research, Youth, and Sports in the Official Gazette of
Romania, Part III.
(2) The selection of the candidates may be initiated only after teaching and/or research
vacancies have been published in the Official Gazette.
Art. 10. – Teaching or research vacancies for an indefinite period of time shall be advertised
at least two months before the date of the first event in the candidate selection procedure
takes place, at least in one of the following ways:
1) on the home page of “Dunarea de Jos” University of Galati website, in an easily
accessible location;
2) on a specialized website, managed by the Ministry of Education, Research, Youth,
and Sports;
3) in the Official Gazette of Romania, Part III;
4) in mass media, in a newspaper available nationwide.
Art. 11. – On the selection procedure website and within the deadline provided in Art. 10,
at least the following information shall be published:
a) description of the vacancy for which the selection procedures are held;
b) workload / duties characterizing the position for which the candidate selection is
organized, including types of activities;
c) the minimum start salary for the vacancy concerned;
d) calendar of candidate selection and selection procedure;
e) the indicative summary of the subjects and topics to be dealt with by the candidates
during selection procedures, including lectures, courses and other, or the topics from
which the competition commission may choose;
f) the description of the selection procedure;
g) the complete list of documents which the applicants must include in their application
files;
h) the postal address the application file shall be sent to.
Art. 12. – Announcement of the positions of associate professor, professor, scientific
researcher 1st and 2nd grades shall also be made in English.

III. ELIGIBILITY CRITERIA FOR TEACHING AND RESEARCH POSITIONS

A) Requirements for candidates’ participation in selection procedures for


teaching positions

Art. 13. – For the position of junior assistant for an indefinite period of time, the following
criteria shall be met:
(1) holding a PhD title;

(2) holding the title of resident physician or a higher medical title, except for positions which
include subjects not matched in the Ministry of Health network and those of pre-clinical
departments (for the position of registered nurse in medical higher education);
(3) other criteria, as established by the faculty.
Art. 14. – For the position of lecturer, the following criteria shall be met:
(1) holding a PhD title;
(2) holding the title of resident physician or a higher medical title, except for positions which
include subjects not matched in the Ministry of Health network and those of pre-clinical
departments (for the position of registered nurse in medical higher education);
(3) other criteria, as established by the faculty.
Art. 15. – For the position of associate professor, the following criteria shall be met:
(1) holding a PhD title;
(2) compliance with the national minimal standards for filling this teaching vacancy,
established by CNATDCU as per Ministry order;
(3) holding the title of specialist physician except for positions which include subjects not
matched in the Ministry of Health network and those of pre-clinical departments (for the
position of associate professor in medical higher education);
(4) other criteria, as established by the faculty
Art. 16. – For the position of professor, the following criteria shall be met:
(1) holding a PhD title;
(2) compliance with the national minimal standards for filling this teaching position,
established by CNATDCU as per Ministry order;
(3) holding the title of MD ( senior physician) except for positions which include subjects not
matched in the Ministry of Health network and those of pre-clinical departments (for the
position of full professor in the medical higher education);
(4) holding the qualification of PhD supervisor, certified as per Ministry order;
(5) other criteria, as established by the faculty.

B) Requirements for candidates’ participation in selection procedures for research


positions

Art. 17. – For the position of research assistant for an indefinite period of time, the
following criteria shall be met:
(1) holding a PhD title;
(2) other criteria, as established by the faculty.
Art. 18. – For the position of scientific researcher, the following conditions are required:
(1) holding a PhD title;
(2) other criteria, as established by the faculty.
Art. 19. – For the position of 3rd grade scientific researcher the following criteria shall be
met:
(1) holding a PhD title;
(2) other criteria, as established by the faculty.
Art. 20. – For the position of 2nd grade scientific researcher the following criteria shall be
met:
(1) holding a PhD title;
(2) compliance with the national minimal standards for filling this research position,
established by CNATDCU as per Ministry order;

(3) other criteria, as established by the faculty.


Art. 21. – For the position of 1st grade scientific researcher the following criteria shall be
met:
(1) holding a PhD title;
(2) compliance with the national minimal standards for filling this research position,
established by CNATDCU as per Ministry order;
(3) other criteria, as established by the faculty.

IV. APPLICATION FOR TEACHING AND RESEARCH VACANCIES

Art. 22. – Registration of applications for positions advertised as vacant opens on the day of
its publication in the Official Gazette of Romania, Part III, and closes 15 calendar days before
the first selection procedure event takes place.
Art. 23. – In order to apply for a teaching or a research position, the applicant must submit
a file containing the following documents:
- application form signed by the candidate;
- affidavit regarding the authenticity of the documents contained in the file;
- applicant's proposal for academic career development plan both in terms of teaching,
in case of teaching positions, and in terms of scientific research; the proposal shall be
elaborated by the candidate, it shall extend over a maximum of 10 pages; this is one
of the main selection criteria;
- applicant’s curriculum vitae, in hard copy and electronic copy;
- applicant’s list of published papers, in hard copy and electronic copy;
- checklist for fulfilment of specific standards of “Dunarea de Jos” University for
participating in the selection procedure. The checklist is filled in and duly signed by
the candidate;
- notarised copy of doctoral diploma and, in case the doctoral degree was obtained
abroad, the recognition or equivalence certificate thereof by the Romanian State
(delivered by or in accordance with the procedure of the Ministry of Education,
Research, Youth, and Sports);
- abstract, in Romanian and an international language, of the doctoral dissertation or,
of no more than one page for each version;
- affidavit by the applicant indicating the lack of incompatibility situations provided by
Law No. 1/2011 in case the applicant is declared successful;
- notarised copies of medical titles (for medical higher education);
- copies of other diplomas: Baccalaureate diploma or recognition certificate, Bachelor
of arts diploma or recognition certificate, academic records or Diploma Supplement,
as the case may be;
- notarised copies of other diplomas attesting the applicant’s level of education;
- copy of identity card, passport or equivalent;
- notarised copy of Birth Certificate;
- notarised copies attesting name change – marriage certificate or proof of name
change;
- fee payment receipt as established by the University Senate;

Art. 24. – A maximum of 10 publications, patents or other papers of the applicant, in


electronic copy, selected by the applicant as being the most relevant for his/her professional
achievements will be attached to the application file.
Art. 25. – The applicant's curriculum vitae, in Europass format, shall include, at least:
a) information on completed studies and degrees acquired;
b) information on professional experience and jobs;
c) information on research-development projects conducted by the applicant as a project
manager and grants obtained, if applicable, indicating the funding source, amount of funding
and the main resulting publications or patents;
d) information on awards / honours or other elements of recognition of the applicant's
scientific contributions;
e) information on the applicant’s membership and affiliations to scientific or professional
associations/societies;
f) other relevant data on the candidate’s activity.
Art. 26. – The complete list of the applicant's works shall be structured as follows:
a) list of maximum 10 papers or studies considered by the applicant as the most relevant for
his/her professional achievements, in electronic format.
b) doctoral dissertation(s);
c) patents and other intellectual property titles;
d) books and chapters in books;
e) in extenso articles/studies, published in mainstream international journals;
f) in extenso publications in proceedings of the main international conferences in the field;
g) other works and scientific contributions or, as the case may be, in the field of artistic
creation.
Art. 27. – (1) Applicants for positions of associate professor or scientific researcher 2 nd
degree shall mention at least 3 names and contact addresses of personalities in the field of
the position concerned, from the country or from abroad, not employed on a regular basis by
the higher education institution advertising the vacancy, who have agreed to write letters of
recommendation regarding the applicant's professional qualities.
(2) Candidates for positions of full professor or scientific researcher 1 st degree shall mention
at least 3 names and contact addresses of personalities in the field of the position
concerned, from the country or from abroad, who have agreed to prepare letters of
recommendation regarding the applicant's professional qualities.
Art. 28. – (1) The applicant’s file is submitted to the University address mentioned on the
selection procedure website, directly or through postal or courier services for the
confirmation of receipt;
(2) The applicant’s file is submitted to the legal office / advisor of the University who, after
checking the information provided, certifies the compliance with the selection procedure
legal provisions.
(3) The approval of the legal office is made known to the applicant within 48 hrs since its
issuance but no later than 5 working days before the first assessment activities in the
selection procedure take place, being invited to sit up for the examinations in accordance
with the publicized schedule.
(4) After having received the legal office approval, the application file is further submitted to
the selection committee beginning with the closing date of application submission, but no
later than 5 working days before the first assessment activities in the selection procedure
take place in accordance with the publicized schedule.

V. CONTEST EXAMINATION COMMISSIONS AND COMPETITION PROCEDURE


Art. 29. – The selection procedure may not involve persons who:
a) are spouse, affine and family relatives, up to 3 rd degree included, to one or more
candidates;
b) are employed in the same institution with a candidate who has a management position
and are hierarchically subordinated to the candidate;
c) are associated with the applicant in companies that have shares representing at least 10%
of the company capital;
d) are or have been paid by research projects in which an applicant has been project
manager during the last five years preceding the selection procedure;
e) receive or have received, in the last 5 years prior to the selection procedure, services or
benefits of any kind from the candidate.
Art. 30 – The selection procedure is considered to involve persons who:
(1) participate in the decision process of appointment of the selection committee;
(2) are members or substitute members of the selection committee;
(3) take up professional or administrative evaluation tasks in the selection procedure;
(4) are involved in dealing with complaints with respect to the selection procedure.
Art. 31 – (1) The structure of the selection committee shall be established after the
publication of the vacancy, for each opening.
(2) The structure of the selection committee is proposed by the head of department, or the
head of the doctoral school the position belongs to, is approved by the council of the
department or of the doctoral school, then the proposal is submitted to the faculty council
for approval/validation.
(3) The list of the members of the selection committee as approved by the faculty council is
further submitted to the Senate for approval.
(4) Following the approval by the University Senate, the selection committee is appointed by
the Rector's decision.
(5) The selection committee may also include substitute members.
(6) Within 2 working days since issuance of the Rector's decision, the decision is sent to the
MECTS and the list of the members of the selection committee is published on the related
website.
(7) For positions of associate professor, full professor, scientific researcher II and I, the list
of the members of the selection committee is published in the Official Gazette of Romania,
Part III.
Art. 32. – (1) The selection committee is made up of 5 members, the chairman included,
specialists in the field of the vacant position or related fields.
(2) Should a member of the selection committee be not available for joining the commission,
he is replaced by a substitute member, appointed in accordance with the same procedure as
the full members.
(3) A decision of the selection committee is valid if voted by at least 3 of its members. The
decisions of the selection committee are made by the secret vote of the members.
(4) The deliberations of the selection committee are led in plenary format by its chairman.
(5) For the positions of associate professor, full professor, scientific researcher II and I, at
least 3 members of the selection committee must be outsiders of the institution organizing
the competition, from the country or from abroad. If one of the members from outside the

university, becomes unavailable at the time of the competition, he can be replaced by a substitute
member who also comes from outside the institution.

(6) Members of the selection committee shall have an academic or scientific rank superior or
at least equal to that of the position for which the selection procedure is organized.
(7) For the sole purpose of participating in the selection committee, the equivalence of
academic or scientific titles of the foreign members with the national academic or scientific
titles is made with the approval of the university senate.
(8) The president of the selection committee can be:
a) the head of the department, the head of the doctoral school;
b) the dean or vice-dean of the faculty in which the academic position is available;
c) a member of the department or faculty council, delegated by voting for this purpose.
Art. 33. – The selection committee assesses the applicant in relation to the following
aspects:
a) the relevance and impact of the applicant’s scientific results;
b) the applicant's capacity to advise students or young researchers;
c) the applicant's teaching competencies in case of teaching positions;
d) the applicant's capacity to transfer knowledge and results to the economic or social
environment or to disseminate his/her scientific outcome;
e) the applicant's capacity for teamwork and the efficiency of his/her scientific collaborations;
f) the applicant’s capacity to conduct research and development projects;
g) the applicant's professional experience in institutions other than the institution organizing
the academic selection
Art. 34. – (1) The applicant's professional competences are assessed by the selection
committee based on the application file and additionally on one or several planned academic
activities, including lectures, delivery of courses, other practical activities, according to the
methodology of the faculty / department / research group.
(2) The chairman shall prepare a report based on the appraisal reports of all the members of the
contest committee. The report is approved by decision of the contest committee and is signed by
each member of the contest committee and by the chairman.
(3) The University shall publicize the date, the time and the venue of the event
Art. 35. – (1) The academic selection procedure for a position of assistant lecturer for an
indefinite time consists of three events:
- written examination;
- speech presenting the most significant results of previous professional achievements and
academic career development plan;
- practical examination.
(2) The topic for the practical examination is decided by the selection committee and
announced to all applicants 48 hours before the exam.
(3) The results of the exams are assessed on a scale from 10 to 1.
(4) Each member, including the chairman, gives integer marks/grades, and the final exam
grade is the arithmetic average of these marks, unrounded, with two decimals.
(5) The practical examination consists in conducting a seminar, a workshop or a practical
case study in front of a student audience in the presence of the selection committee or in
front of only committee members if there are no teaching activities at the time of the
academic selection procedure and events.

Art. 36. – (1) The academic selection procedure for a position of assistant professor (Rom.
lector / şef lucrări) for an indefinite time consists of three events:
- application form;
- a speech presenting the most significant results of previous professional achievements and
the candidate’s academic career development plan;
- public lecture / conference in front of a student audience in the presence of the selection
committee or in front of only committee members if there are no teaching activities at the
time of the academic selection procedure and events.
(2) The topic for the public lecture / conference is decided by the selection committee and
announced to all applicants 48 hours before the exam.
(3) The results of the exams are assessed on a scale from 10 to 1.
(4) Each member, including the chairman, gives integer marks/grades, and the final exam
grade is the arithmetic average of these marks, unrounded, with two decimals.
Art. 37. – (1) The competition for filling in the vacant positions of associate professor and
professor consists in examining the applicants’ activity based on their files and directly
known information. An applicant coming from outside the higher education system shall
demonstrate his/her teaching skills by means of a public lecture / conference in front of a
student audience in the presence of the selection committee or in front of only committee
members if there are no teaching activities at the time of the academic selection procedure
and events. The committee may also request this from applicants who teach in other higher
education institutions or at “Dunarea de Jos” University of Galati, if this is deemed necessary.

VI. CLOSURE OF THE SELECTION AND RECRUITMENT PROCEDURE FOR


ACADEMIC TEACHING AND RESEARCH VACANCIES
Art. 38. – (1) The selection procedure may take place no later than 45 days after the
deadline for application registration.
(2) The selection procedure consists in evaluating scientific and educational qualities of the
applicants for teaching positions.
(3) For each position, the selection committee decides the hierarchy of the candidates and
appoints the candidate with the best results.
(4) The chairman of the selection committee shall report on the selection procedure based
on the assessment reports prepared by each member of the selection committee, complying
with the candidates’ hierarchy as determined by the committee.
(5) The report on the selection procedure is validated by decision of the selection committee,
signed by each member of the committee, the chairman included, who further presents the
report in the faculty council reunion; the candidates’ files shall be submitted to the faculty
council and conditions shall be provided for the council members to review them.
(6) The faculty council checks the procedures for compliance and approves the academic
selection procedure report.
(7)The hierarchy of the candidates established by the selection committee may not be
modified by the faculty council. The selection procedure report validated by the faculty
council shall be presented by the Dean in the Senate reunion. The candidates’ files are
submitted to the University Senate and conditions shall be provided for the Senate members
to review them.
(8) The University Senate checks the procedures for compliance and approves or
disapproves the selection procedure report.

(9) The University Senate approves the competition results , also taking into account the Report
made by the Commission for scientific research in the University Senate by simple majority, by
open nominal voting. A minute of the senate meeting and the list of the members present
will be enclosed to the academic selection procedure file.
(10) The hierarchy of the applicants established by the selection committee may not be
modified by the University Senate.
Art. 39. – (1) Further to the validation of the selection procedure results by the Senate,
appointment to the position and award of the related academic title by the University are
enforced by the Rector’s decision, starting with the semester following the selection
procedure.
(2) For teaching positions, the decision of appointment and award of the related title, and
the selection procedure report, are further submitted to the Ministry of Education, Research,
Youth, and Sports and the National Council for Titles, Diplomas, and Certificates, within two
working days after its issuance.
Art. 40. – (1) For research positions, provisions of Law 319/2003 shall be complied with,
notwithstanding the provisions of art. 39, paragraph (1), and art. 40, paragraph (1).
(2) Selection procedures for research vacancies in the University shall comply with the
provisions of Law 319/2003, as follows:
a) those organized for the scientific council of the organization, by the faculty council;
b) those provided for the administrative council, by the University Senate;
c) those provided for the scientific secretary or the scientific director of the entity, by the
head of department, head of the doctoral school, dean or vice dean.
Art. 41. – Should a vacancy remain unfilled, the selection procedure may be resumed
according to the entire regulations described above.
Art. 42. – The final results are published on the selection procedure website within two
working days since its completion.
Art. 43. – No later than September 1 st, “Dunarea de Jos” University of Galati reports on the
annual organization, development and closure of the academic selection procedures for
filling in academic teaching and research vacancies. The report is also sent to the Ministry of
Education, Research, Youth, and Sports and the National Council for Titles, Diplomas, and
Certificates.
Art. 44. – (1) If following appointment of the successful candidate one or more persons of
the higher education organization are in a situation of incompatibility under Art. 295,
paragraph (4) of Law no. 1/2011, appointment and granting of the academic title by the
higher education institution or the professional research-development degree may take place
only after the settlement of the situation(s) of incompatibility. The settlement of the
situation(s) of incompatibility shall be communicated to the Ministry of Education, Research,
Youth, and Sports within the following two working days.
(2) Spouses, affines, and family relatives up to 3 rd degree included may not be appointed if
they find themselves one towards the other in a position of leadership, control, authority or
direct institutional assessment at any level in the same university.
Art. 45. – Heads of departments, Deans and the Rector are responsible to the University
Senate for the smooth running of the academic selection procedure, in compliance with the
quality standards, academic ethics, and legislation in force.
Art. 46. – Should any irregularities be found, the University Senate may apply sanctions
under the law, up to dismissal of the person / persons found responsible for the violation of
the applicable laws in force.

VII. APPEALS
Art. 47. – (1) If a candidate can prove failure to comply with the legal competition
procedures on the part of one of the persons or entities involved in the selection procedure,
he/she may submit an appeal within the 5 working days following result notification.
(2) The appeal shall be in writing, registered at the University register office and settled by
the academic selection committee within 24 hours since its registration.

(3) The outcome of the appeal resolution is communicated immediately to the Rector and Vice
Rector in charge of teaching issues, and they will decide whether to cancel or continue the contest.

(4) In case of cancellation of the contest for a vacant place, this can be made available for a
subsequent competition.

Art. 48. – Failure to comply with the present Methodology by the persons in charge of the
organization and development of the vacancies selection procedure is a disciplinary violation
and is sanctioned as per Law 1/2011 or other legal provisions as applicable.

VIII. FINAL PROVISIONS


Art. 49. – The present Methodology enters into force on the date of its validation by the
University Senate.
