Cyber Crimes

Cyber crimes are any crimes that involve a computer and a network. In some cases, the computer may
have been used in order to commit the crime, and in other cases, the computer may have been the
target of the crime.In the past, cybercrime was committed mainly by individuals or small groups. today,
we are seeing criminal organizations working with criminally minded technology professionals to commit
cybercrime, often to fund other illegal activities.

1. The Computer as a Target :-using a computer to attack other computers.

e.g. Hacking,Virus/Worm attacks,DOS attack etc.

2. The computer as a weapon :-using a computer to commit real world crimes.

e.g. Cyber Terrorism, IPR violations,Credit card frauds,EFT frauds, Pornography etc.

WHITE COLLAR CRIME

White collar crimes are a vast area. Mr yasanthaKodagoda, PC has written an Article on
the same/on a part of it sometime back. Is it possible to identify a sub area in this
segment which needs immediate attention in srilanka?

Or maybe we can have an article on Bribery in the light of white collar crimes? what do
you think?

White collar crime refers to those offenses that are designed to produce financial gain using some form
of deception. This type of crime is usually committed by people in the business world who, as a result of
their job position, are able to gain access to large amounts of other people’s money. White collar crime
does not involve violent, drug-related, or overtly illegal activities.

Wildlife crim refers to the taking, trading (supplying, selling or trafficking), importing, exporting,
processing, possessing, obtaining and consumption of wild fauna.

Going by the article there is no problem with the laws but with regard to implementation
thereof isn’t it ?

Child Abuse and Neglect

Child abuse means doing something that hurts a child. Neglect means not giving or doing something that
a child needs.

PHYSICAL ABUSE INCLUDEShitting, kicking, shaking, pinching, and burning. It may leave bruises, cuts, or
other marks and cause pain, broken bones, or internal injuries.

EMOTIONAL ABUSEis saying or doing things that make a child feel unloved, unwanted, unsafe, or
worthless. It can range from yelling and threatening to ignoring the child and not giving love and
support. It may not leave scars you can see, but the damage to a child is just as real.

ORGANISED SEXUAL ABUSEis any sexual contact between an adult and a child or between a
n older child and a younger child. Showing pornography to a child is a type of sexual abuse.

NEGLECT happens when a child does not get the shelter, schooling, clothing, medical care, or
protection he or she needs. Child neglect is just as serious as abuse and is more common

THE CHILD ABUSE PREVENTION AND TREATMENT ACT

This Act is not passed in Sri lanka right? where is it being implemented?India?
If possible find where it is being implemented and if the above new areas are covered
therein?

NEWLY EMERGING CRIMES – How relevant and crucial are these areas to Sri Lanka?
PIRACY

Piracy off the Horn of Africa has become an increasingly serious problem over the last years. The lack of
rule of law in Somalia, which has been without an effective central government since 1991,Recent years
have seen an increased number of attacks, with pirates becoming more organized and more aggressive
as they arm themselves with a higher grade of weapons.

IDENTITY-RELATED CRIMEInteresting area!

This area comes under the white collar crimes. This topic have two elements

 identity theft (unauthorized possession, trafficking or use of personal information,)


 identity fraud (the fraudulent use of another person’s personal identification to gain advantage,
obtain property)

Mr sunil D.B. Abeyrathna(AAL) has written a book about the it law (INTRODUCTION TO INFORMATION
AND COMMUNICATION TECHNOLOGY LAW) and as I know he is the only person practicing it law in the SL
(subject to correction) and he has LLM for IT law, if we selected this area we can ask him to write an

assistance.Where identify information is obtained by criminals, it can be abused to launder money, to
commit fraud and to enable illicit activity and irregular movement for organized crime purposes include
human trafficking, migrant smuggling and even terrorism.

TRAFFICKING IN CULTURAL PROPERTY

Cultural property is part of the common heritage of humankind. It so unique and important a testimony
of the evolution and identity of peoples, that the importance of protecting it has been stressed in several
international instruments.Organized crime groups are increasingly involved in trafficking in cultural
property, both through legitimate markets such as auctions and through the Internet, but also in
underground illicit markets. Trafficking in cultural property is also becoming an important source for the
laundering of the proceeds of crime.
ENVIRONMENTAL CRIME

Organized criminal syndicates are moving poached or illegally harvested wildlife with the help of the
same sophisticated techniques and networks used for illicit trafficking in persons, weapons, and drugs
and other contraband.

ORGAN TRAFFICKING

The transplantation of healthy organs into persons whose own organs have failed, improves and saves
thousands of lives every year. But demand for organs has outstripped supply, creating an underground
market for illicitly obtained organs.

HATE CRIME

the violence of intolerance and bigotry, intended to hurt and intimidate someone because of their race,
ethnicity, national origin, religion, sexual orientation, or disability.”
