History of the Rolling Hills Subdivision

1991 Unit I on the TRACT MAP 85-1008 was annexed in Oct 1991.

1992 Unit 2 on TRACT MAP 85-1008 was annexed in January 1992.

• The original roads were built by Schuster Construction to access each of the 40
acre parcels in the sub-division.

• The original Declarations of CC&R’s was initiated by the Rolling Hills Partners.
That same year, the Declaration of Road Maintenance Association was formed.

• Each lot in the RH subdivision shall have an average of 40 acre “average”


parcels. Zoning code: R1 A B

• The county required Penneleme Rd to extend the pavement to connect with the
county easement and dirt road that transitions the BLM land between Rolling Hills
and Surrey Village.

• The extension of Penneleme from Norbus south was built at the same time and to
the same standard as the rest of the roads in the development except that some of
the extension road does not meet the 80’ wide easement requirement because of
terrain restrictions.

1995 • The zoning changed from 40 acre “average” parcels to 10 acre “average” parcels.

• Property owners were encouraged to split their lots, one benefit was not to have
to pay additional road association fees until the new lot was sold. At which time,
the new owner was responsible for the additional road association fee. Currently,
we have 42 paying lots in our association.

1997 The original roads, Penneleme, Kobuntie and Norbus, were paved in 1997.

•An easement was created to build Wood Duck Pass.

•The owners of the property on Wood Duck Pass shall be responsible for the
reasonable cost and maintenance, upkeep and repair of the road. The cost shall be
equally shared by all owners based on the number of lots/parcels owned within the
properties.
2000 Wood Duck Pass was paved up to Fred Lourence’s residence by Fred Lourence.
2002 • The extension to Norbus Road was paved and annexed into the road system by a
provision in the Amended and Restated Declaration of Road Maintenance
Association and Declaration of Annexation dated May 29, 1997 page 7,
Annexation Pursuant to Approval, paragraph one. It gave the “Partners” authority,
for a period of 5 years, to annex properties into the road association without a vote
of the membership.
2003 • Unit 3 on TRACT MAP 85-1008 was annexed into the RHE when the survey
lines were re-assessed.

• Several properties were sub-divided and developed. The extension of Kobbuntie


Road and Royal Oaks Road were annexed into the road system by a vote of the
association membership.

• Declaration to rescind the road maintenance association of for Royal Oaks Drive
and the road maintenance association for the southerly extension of Kobbuntie
Court. Book 2269, pages 117-120. Page 118 has verbiage stating the two regions
will conform to the RHRMA rules.

2005 The extension to Unit One was paved in 2005 by contributions from Fred and the
other property owners on Wood Duck Pass, as well as those in Unit One. It was
designated on TRACT MAP 85-1008 as a private drive and has a 60’ wide
easement.

2009 • The zoning code was changed by the Tehema County Planning Department to
allow for an average of 2 acre lots Due to lack of funds, it was not changed by the
Tehema County Zoning Department.

2011 • The Association voted to increase fees to $345.00 per year for a 3 year project
consisting of a double chip and seal on Penneleme Rd. The fees began in 2012 and
will continue through 2014

The membership voted to amend the following:
1. Increase the RHRMA governing Board to include five (5) members from three
members.
2. The Board members may increase or decrease the road maintenance dues twenty
(20) percent in any one (1) year without the approval of the majority of the
membership.

•Road Maintenance fees are $1300.00.


2013 •Phase Two of the road construction began in July. Additionally, a fog seal was laid
over the double chip seal starting at Jelly’s Ferry Rd to the end of Phase Two.

•The membership voted to combine the Architectural Control Committee into the
Road Association Board of Directors.

•Road Maintenance fees are $1300.00.


2014 •Phase Three of the road construction was completed in August 2014.

•The Rolling Hills Subdivision website was launched.

•A motion was made to continue the Road Maintenance fees as $1300.00. The
membership voted and it was passed.

•A motion was made to have the board present a ballot to the membership
amending the by-laws to increase the dues starting in 2015 to $500. The
membership voted and it was passed.

•A motion was made and agreed unanimously was to have the board issue a ballot
to change the bylaws increasing the minimum square footage of homes to be built
in the subdivision from 1,500 square feet to 2,000 square feet. . The membership
voted and it was passed.

• Guest speakers, Sean Moore (TC Planning Department) and Greg Mathis. Greg
began the meeting with a broad history of the development and the need to secure
an easement for the monument. Sean addressed the importance of resolving
ambiguities and inconsistencies in CC&R’s regarding second dwellings and lot
sizes. He pledged to work closely about any developments and changes that may
occur in Planning and Zoning. Off the record discussion reassured the Board that if
the 2 acre minimum went into effect, it would not really effect us due to the
topography of the land. He suggested we attend Public Hearing meetings to
request it changed to 10 acre lots.
2015 •Phase Four of the road construction was completed in July 2015. The project
consisted of chip sealing (1,004 sq. ft) of Norbus Rd and (427 sq. ft) of Penneleme
Rd. Asphalt Patching (apx. 900 sq. ft) on low areas of Penneleme Rd. Fog Seal
(144,708 sq. ft) the new chip seal and the last two sections of Penneleme.

•A motion was made to continue the Road Maintenance fees as $500. The
membership voted and it was passed.

• Gate contractor, Kim Brahn representing Gate Pro, presented options for
installing a gate entrance on Penneleme Dr. The installation would run between
$15,000 - $25,000. The membership voted against the installation of a gate.

2016 •Phase Five of the road construction was completed in July 2016. The project
consisted of chip sealing the remainder of Penneleme Rd. Apply a Fog Seal from
the low draw to the end of Penneleme Rd (newly chipped seal) and the portion of
Norbus Rd completed in 2015.

•A motion was made to increase the Road Maintenance fees as $550. The
membership voted and it was passed.

•The fire road/shared driveway owned by Adams-Wiley and Flatt families is


accessible for Association Members. There is a double lock combination on the
gate and a sign that indicates it is private property to be used for emergency use
only. Both the lock and the sign is to deter non members from accessing the road.

•Spraying (for weed control) the roads will be completed in February thru April
and members will be notified ahead of time via email. The membership voted and
it was passed.

•The membership voted and approved a voluntary Directory of Members for


community safety. The Directory was distributed to participating members in June
2016.

• The membership voted and approved the use of Survey Monkey to gather
information and voting on certain issues.

• Implementation of Phase 2 of the Tehama County General Plan which included


re-zoning Rolling Hills subdivision to R1A-B:86 One-Family Residence; Special
Animal Combining; Special Building Site Combining 2 acre Zoning District.
2017 • Phase Six of the road construction was completed in July 2017. The project
consisted of completing the lower portion of Kobbuntie Rd. Remove 2 areas at the
approach 3” deep for a total 132’. Apply tack to the edges of the existing asphalt.
Remove 2,730 sq ft of asphalt 3” deep (wheel ruts). Apply fog seal coat to new
asphalt patches. Place a double layer chip seal to 19,500 sq ft. Apply a fog seal to
the new chip area.

• Monument solar lights were replaced and installed them in May 2017.

•Spraying (for weed control) the roads was be completed in February thru April
and members were notified ahead of time via email.

• Goat Grazing and Fire suppression was presented by Tim Arrowsmith. A survey
was sent to members about interest level and fees. The results of the survey were
inconclusive and the Board advised Tim Arrowsmith to contact individual land
owners.

• Updated website- the CC&R’s and By-laws were retyped and crossed referenced
to reflect amendments and changes.

• Fire road off Kobbuntie- the lock is missing and fence was down.

• The Road Maintenance fees as $650.

• A letter of support was submitted by the Board to the Planning Commission.


“We support re-zoning our community from R1A-B:86 One-Family Residence;
Special Animal Combining; Special Building Site Combining 2 acre Zoning
District back to a a R1-A-B:435; One-Family Residence; Special Animal
Combining; Special Building Site Combining 10 acre Zoning District.” The letter
will be presented and voted on by the Board of Supervisors in September 2017.

• A letter from the Board was submitted to the Planning Commission regarding the
implementation of Phase 3 of the General Plan.
“We are in full support of re-zoning #16-06 from an Upland Agricultural Zoning
District to a R1-A-B:435; One-Family Residence; Special Animal Combining;
Special Building Site Combining 10 acre Zoning District.” The letter will be
presented and voted on by the Board of Supervisors in August 2017.

August 3rd 2017 The Planning commission voted 3-1 to recommend to the Board
of Supervisors to re-zone Rolling Hills Estates back to R1-A-B:435; One-Family
Residence; Special Animal Combining; Special Building Site Combining 10 acre
Zoning District.

November 7, 2017 the Board of Supervisors voted to re-zone Rolling Hills Estates
back to R1-A-B:435; One-Family Residence; Special Animal Combining; Special
Building Site Combining 10 acre Zoning District.
2018 • The Road Maintenance fees remain at $650.

• Monument solar lights were stolen in April 2018.

• Spraying (for weed control) and weed whipping the roads was completed in
February thru April. Members were notified about the spraying ahead of time via
email.

• Phase Seven of the road construction was completed in two parts. The first part
was completed on May 7, 2018, which consisted of crack sealing on Penneleme
Rd from Jelly’s Ferry to just before the Brumbaugh driveway. The second
project consisted of a double and single chip seal of the last half of Kobbuntie Rd
along with a fog seal over the new chip area.

• Survey sent out to members to gather information regarding an option to approve


CLUSTERING to split lots less than a standard 10 acre minimum. The Board
was responsive to the results of the survey and voted to recognize clustering as
an option for lots that can not be split into a 10 acre parcel due to the
topography of the land. The clustering restriction may be approved if the
parcel is more than 8 acres. Landowners are encouraged to request a letter of
approval from the Board to accompany their application to the County.

• Mosquito Spraying was completed on April 24, 2018.

2019 • The Road Maintenance fees remain at $650.
