AFFIDAVIT OF DESISTANCE

I, ________________, 11-year-old minor, assisted by my mother

_______________, Filipino citizen, and a resident of _________________,
after having been duly sworn to an oath in accordance with law, hereby
depose and state that:

1. That on February 15, 2018, I have caused the filing of a Criminal

Case against ______________________ for Violation of R.A. No.
7610 and now pending before Branch 44, Regional Trial Court,
Initao, Misamis Oriental. Said case was denominated as
Criminal Case No. _____________________;

2. That subsequently after filing the said case and with the help
and intervention of people in authority, I, assisted by my
mother, and the respondent have already mended our
differences and that we have already settled our dispute
amicably;

3. After giving it some thought and having already settled our

dispute amicably, I have decided not to pursue the case
anymore and for humanitarian reasons, I am desisting from my
complaint;

4. That for such reason, I am no longer interested to pursue the

same and that I will no longer testify in the proceedings in said
case;

5. That I am aware that if I discontinue and will not testify in said

case, the same shall be dismissed and cannot be re-filed again;

6. That despite of the same, I will still signify, confirm and affirm
that I am no longer interested to pursue the case against
_____________________ and will no longer testify in the
proceedings;

7. That for this purpose, I have absolved said __________________

from the charges I made against her and shall absolve her
forever from any civil or criminal liabilities whatsoever. Neither
will I testify in any proceedings of the case against her;

I am executing this affidavit in good faith to affirm the foregoing facts

and for the purpose of requesting the Honorable Court of the Regional
Trial Court, Branch 44 to dismiss the criminal case I have filed against said
________________.
