This Agreement executed this 27th day of September, 2018 at DARPO Leyte-Biliran Provincial Office,
Tacloban City by and between:

TARCELO D. MATOBATO, Filipino, of legal age with address at Brgy. San Antonio Farm, Alang-
alang, Leyte


JENNY ANN MATOBATO represented by Antonio Matobato, NENITA MATOBATO, ALLAN

CREADO, LETICIA IDLOY, JASON NUEVA and ANTONIO MATOBATO, all Filipinos, all of legal ages,
all with address at Brgy. San Antonio Farm, Alang-alang, Leyte;


WHEREAS, TARCELO D. MATOBATO is a farmer beneficiary for Lot 3324-C located at Brgy. San
Antonio Farm, Alang-alang, Leyte;

WHEREAS, the abovestated landholding is due for survey in order that an individual CLOA would be
generated in favor of TARCELO D. MATOBATO;

WHEREAS, the SECOND PARTY are actual occupants of the said landholding;

WHEREAS, the parties desire to buy peace and wish to avoid a possible litigation in this case.

NOW THEREFORE, in consideration of the foregoing and the further covenants hereinafter set forth,
the parties agree as follows:
1. The FIRST PARTY agrees that the houses of the actual occupants would no longer be delineated
during the survey;
2. The FIRST PARTY agrees that he will be paying the full amount of the value of the land to the
Landbank of the Philippines notwithstanding the presence of the houses of the SECOND PARTY;

3. This Compromise Agreement shall not affect nor prejudice any case or cases between the parties
not specifically referred to herein.

4. Upon delivery of the initial payment made by defendant KABISOTE and delivered to the escrow-
trustee of the parties, the parties shall seek Court approval of this Compromise Agreement and the
cancellation or lifting of the notice of lis pendens issued by the Court over theproperty subject of the

to execute this Agreement.

6. The parties or their assigns hereby waive, renounce and forever quitclaim all their respective
claims and counterclaims subject of the instant action as well as those that may arise therefrom, in
connection therewith or in relation thereto.

7. The foregoing covenants are not contrary to law, morals, or public policy and the parties bind
themselves to comply strictly with their undertakings.
