RE: Donald Smith VI.ay 23,2002

Dear Mr. Bell:

I am writing to express my grave concerns about Mr. Donald Smith who was attending my
psychosexual treatrnent progr:rm. As you kmow, I conducted a comprehensive psychosexual evaluation of
Mr. Smith on April 18 and 25,2002. He subsequently started group psychosexual therapy and attended
three group sessions. In his second and third group session, Mr. Smith did not cooperate with doing his
homework assignments, and in his third session, when his lack of cooperation was addressed, Mr. Smith
informed the group and his therapist that he would no longer be attending therapy at the Arlington
Psychological Center. He further stated that he was "interyiewing" with other psychosexual treatment
programs in Duval County and in south Florida and that he would "decide" what program he wanted to
attend in the future.

IVIr. Smith discussed in detail three reasons that he was seeking another treatment program:

1. Dr. Vallely would not recommend that he not take Medical Recs in

2. Dr. Vallely would not immediately sanction visitations between Mr. Smith and his natural
child;ren.

3. Dr. Vallely's program was too long and Mr. Smith wants out of his Plan of Compliance as
soon as possible so that if he commits another crime in the future. he wilI not be threatened
with civil commitment.

Mr. Smith directly and clearly stated that he is in the process of "shopping" for a therapist and therapy
program that will meet his demands as he outlined them. He was unreceptive to my statements that
his ceasing Medical Recs in Ge (which he has not even started) would not be recommended until he
demonstrated sufficient therapeutic progress in developing self-control. He was also unwilling to
accept the need to only allow contact between he and his children when this was clinically appropriate

HE
to meet his children's needs. Finally, the client claimed
that he could successfully complete other
treatrnent progftIms much faster, citing one progr:tm
that will graduate him ..in 1g months whether
have the skills or not," and that this would allow I
him to avoid threat of civil commihnent if he
commits another crime' He clearly and directly
stated that he wanted to circumvent possible legai
consequences to his continued criminal behavior
in the fufure by graduating as fast as possible from a
psychosexual treaftnent program. k

This situation is terribly troublesome and dangerous

for a number of reasons. In the first place,
Mr' Smith has left my program without
-rf,ng
psychosexual program which means that he
arrangements to immediately start another
will not be under clinical control for some unknown
amount of time' Secondly, his avowed reasons for "shopping"
for another psychosexual treatrnent
program are in direct disregard for safety and
welfare orctrilaren; represents an attempt to manipulate
his way out of the requirements of his Plan of compliance;
and ,.pr"*, a direct desire to
circumvent viable psychosexual heatment. All Mr.
smith is attempting to do is to continue his
psychopathological patterns at the potential expense
of children and other rrtti..,. in the community.

I have no investment in Mr- smith continuing therapy

i, my treatment program but I am highly
invested in protecting the community, its children, ,ra
Mr. Smith. should this client be allowed
"v"nlets
to pick and choose a psychosexual treatrnent program that
him circumvent the safety provided by
his Plan of compliange, he would be getting incompetent
treatrnent and he would pose a clear present
and future danger to children and the community.
siould the client be placed in another psychosexual
program, that program must adhere to compliance with
the safety features of Mr. Smith,s plan of
compliance' Anything less would facilitate Mr. smith's psychopathology
and jeopardize potential
victims.

If you have need of further information rg Name, p do not hesitate to contact me.
