PETITION
PETITIONER, Dan Patrick S. Garcia, to this Honorable Court,
most respectfully files this Petition for renewal/reappointment of his
Commission as a Notary Public for El Salvador to Binuangan, Misamis
Oriental including the City of Cagayan de Oro. In support of this
petition, he states, that:

1. He has been commissioned as a Notary Public for El Salvador to

Binuangan, Misamis Oriental including the City of Cagayan de
Oro, by this Honorable Court under Appointment for Notary
Public No. NC-2017-151 issued for such purpose on August 31,
2017 with a term ending on December 31, 2018. Copy of the
Appointment for Notary Public is hereto attached as Annex
“A”;

2. He was born on August 16, 1986 and is of legal age, married,

Filipino Citizen, a resident of Zone 1, Poblacion, Laguindingan,
Misamis Oriental, Philippines for years and with office address
at Merlin P. Caiña and Associates, 2nd Floor, Consortium
Building, Corrales Extension Street, Barangay 26, Cagayan de
Oro City and he may be reached through his Cellphone No.
0917-7165-699;

3. He was admitted to the Philippine Bar on May 23, 2017 and was
enrolled in the Roll of Attorneys with No. 66957 as indicated in
 a Certification to that effect issued by the Bar Confidant dated
June 14, 2018. Copy of the Certification is hereto attached as
Annex “B”;

4. He has paid his IBP membership due for the year 2019 on
December 19, 2018 as evidenced by the Payment Receipt No.
027 issued by the IBP-Misamis Oriental Chapter on December
19, 2018. Copy of the Payment Receipt is hereto attached as
Annex “C”;

5. He is a bona fide member in good standing of the Integrated

Bar of the Philippines, Misamis Oriental Chapter. Copy of his
Certificate of Good Standing dated June 26, 2018 is hereto
attached and marked as Annex “D”;

6. He has recently paid his annual professional tax for 2019 as

evidenced by an Official Receipt issued by the Office of the
Provincial Treasurer of Misamis Oriental under O.R. No.
9519800A dated December 19, 2018. Copy of Professional Tax
Receipt is hereto attached and marked as Annex “E”;

7. He has not been convicted of any crime involving moral

turpitude or any other crime as evidenced by a Clearance
issued by the National Bureau of Investigation dated July 5,
2018. Copy of NBI Clearance is hereto attached and marked as
Annex “F”;

8. He has no pending administrative case before the Office of the

Bar Confidant as indicated by its Certification to that effect
dated June 14, 2018, copy of which is hereto attached as
Annex “G”;

9. His photographs, specimens of his signature and impressions of

the official dry seal that he will be using as a notary public are
hereto attached as Annexes “H” to “H-2”, “I” to I-2, and “J”
to “J-2”, respectively;

10. He has attended the Mandatory Continuing Legal Education

(MCLE) Seminar held on November 26-29, 2018 at Grand
Caprice Hotel, Limketkai Drive, Cagayan de Oro City. However,
the certificate for such attendance is yet to be issued.
Nonetheless, pending the issuance of the said certificate, he
has until April 14, 2019 to comply with the MCLE Compliance
No. VI in consonance with Bar Matter 850. Copy of Certification
issued by the IBP-Misamis Oriental Chapter is hereto attached
and marked as Annex “K”;
 11. He has been faithfully submitting his monthly notarial reports
with the Office of the Clerk of Court (RTC-OCC), Notarial
Section as evidence by a Clearance/Certificate issued by the
latter for such purpose and which is hereto attached and
marked as Annex “L”;

12. He possesses all the qualifications and none of the

disqualifications for the office of the notary public and that he
has read and understood the duties and obligations of a notary
public under the Notarial Law and has heretofore complied with
its requirements on notarial reports and books;

13. He has not applied for commission before any other courts and
shall undertake to inform the Executive Judge within ten (10)
days in case of any change in the given address and to submit
his monthly report religiously;

14. He now desires to be granted Notarial Commission as Notary

Public for and in the City of Cagayan de Oro and the Province
of Misamis Oriental.

PRAYER

WHEREFORE, in view of the foregoing, it is

respectfully prayed unto the Honorable Court that he will be
reappointed and/or re-commissioned as Notary Public for and in the
City of El Salvador to Binuangan, Misamis Oriental including the City
of Cagayan de Oro.

depose and state that:

1. I am the Petitioner in the above captioned Petition for

Renewal/Re-appointment of Notarial Commission to be filed
with the Office of the Executive Judge of the Regional Trial
Court of Misamis Oriental 10th Judicial Region, Cagayan de Oro
City;

2. I have caused the preparation of the same;

3. I have read the allegations contained therein; and I certify that

they are all true and correct to the best of my own knowledge;

4. I further certify under oath that I have not commenced any

similar petition or proceeding before the Supreme Court, the
Court of Appeals or its different divisions or in any other
government agency or tribunal and should I learn of any similar
petition or proceeding filed before any of the aforesaid bodies,
I undertake to notify this Honorable Court within five (5) days
from notice.
